I received a waiver application at Montreal for an I-601 and also got a 212a, but haven't filed, instead I sent a copy of everything I had to the director of DHS/USCIS in Washington for an honest opinion of the facts as the reasoning for the waiver in Montreal was tainted by a COs noting in my file her impressions which were wrong. Hoping to hear from DC soon.

I have really never left since I have been here every weekday. I just decided that I was to wrapped up in what happened to continue posting in a positive way, you folks have enough to deal with without me bit-ching and complaining day in and day out. It was tiring and boring and I even got tired of me and what I was turning into. The tide has turned as they say and we are over the rougher parts now and ready again for what the consulate tosses our way. Sharon and I have always considered ourselves married and that is how we live our lives even at this distance from each other.

Now that the shock of the initial setback has worn off and most of the other issues have been dealt with we are to be back on track. The I-601 is being sent today; we needed the cooling down period and hopefully by now the waiting period will not be as I was told months ago. For those wondering if the issues came up between Sharon and I the answer is no the issues were beyond our control but now well within our control.
The 2.8 lb package that was sent directly to Dr. Emilio Gonzales' office seeking their assistance and clarification had been received and signed for many months ago but never replied to. Obviously not a very client oriented group at the top which now gives the reasoning of the way those in the dungeon are working, they have no direction from above.
A letter sent to the USCIS Ombudsman was replied to within a very short period but wasn't of much help as expected since they saw my issue as a legal problem and not within their realm.
Sharon and I are doing well and we are as always together loving each other as best we can with our daily phone calls.


P.S. I still don't drink, they haven't driven me to that point nor will they.

Stephanie, I hope others are right and you are no more than 5 weeks away from having your family all together in one place. Being away from your husband and your daughter has to be the most painful experience to go through, what Sharon and I are going through is nothing compared to being separated from spouse and child. I am sure that your husband is very anxious to see you and his son. I am glad that very soon all of you will be together even if it is a visit before the waiver process is completed. I'm sure that your daughter will be quite surprised to see her new brother and her mother again.

Everything happen for a reason and not before it is supposed to happen so right now we are waiting for our results but for us this is the last hoop we are jumping through if there is another one before they can make a decision we will go with plan B and Sharon will move here since her mother has given up on living since Sharon's father passed, Sharon was told that her mother if she continues as she is now may be gone in just a few months.
I hope you and your family have a good visit and the time remaining before you are together is very short.

Thank you so much Ron and Sharon. I wrote the consulat in Frankfurst an email ...they are usually very fast to reply. How is your process going? Why did you have to file a 601 waiver. Any tips? Our laywer just finished our waiver package and my husband is bringing it next week. He is coming to visit with our daughter.

Have you been given a time line as to how long it will take for your waiver to be processed? I do hope you all have a wonderful time together, I know how awful being apart can be.
The amount I gave you shouldn't change so much that it would be bothersome to you. As for a tip all I will say is don't concentrate on the waiver, keep your thoughts on your relationship and family and keep strong. The waiver process is a very strong energy sucker and needs to be kept in check.

We took a 5 month break after the interview, it was disheartening and I needed the time to get the anger out of my system and collect my thoughts so the waiver process was done correctly and we also had Sharon's fathers hospitalization and subsequent passing to deal with.
I have a criminal conviction dating back to 1976, nothing serious but still a conviction, which may have passed had the interviewer not noted in my file that she could smell alcohol on my breath and thought I was drinking before the meeting, which I beleive was the kicker. Not to bad all in all, 1 conviction in 63 years and sober for the past 23 years. According to the consulate 5 months ago I have 12 to 18 month wait after the papers are submitted for the ajudication to be done in Vermont, I hope it is much less by now.

There may be different waiting times depending on what the waiver is for, I'm not at all sure how it all works. I received a waiver application at my interview and was told then that it would take about 12 months, that was in August 07 and about a week later I called the consulat for information and was then told 12 to 18 month. My waiver is for ciminal and alcohol related issues your is not.
I hope you can get a waiver within 6 month.

Not sure if I am reading this right so if wrong please disregard.
When I received my I-601, I was told and it was also noted in the information package that the I-601 needed to be done within 12 months of receipt.
Mine was not for an oversay so there may or may not be different time limits.
If your husband received his I-601 at Montreal he most likely received the forms and an information packet with the infiormation you are seeking.

One can only wonder what goes on. How is it possible to have a touch and then have none exist as if it had never happened? At this very moment Sharon is packing and will be leaving before the end of the month. Better and happier times are ahead. This for us has never been about where, but where we were needed most by family. That where is no longer the concern it was so now we can concentrate on ourselves as we have been doing since the beginning.

We will be married long before Vermont says yea or nay to our waiver which is fine by us.

9 Months and 9 days watching every day for a touch on our waiver application and nothing happened, we remained at (04-09-2008), on the 9th month and 10th day at 4:00 p.m. an update appears (touch) (11-18-2008). Then to my surprise less than two hours later the (11-18-2009) disappears (and guess what (04-09-2008). If we were totally dependent on USCIS we would be heartbroken but that ain't happinen, Our alternative is working just fine for us.
Sure hope others here have better news regarding their Waivers and dealing with the government when it gets back to work on Wednesday.

The specific offense and or conduct upon which inadmissibility is based: The applicant was deemed inadmissible pursuant to 212(A)(2)(A). He was convicted of the unlawful taking of a motor vehicle without consent of the owner on September 24, 1976
The applicant's inadmissibility will result in extreme/serious hardship to the named relative because: Extreme hardship not needed as this crime is not a CIMT. Even if the conviction were a CIMT the crime occurred over 15 years ago and thus is approvable as long as the immigrant does not pose a risk to national security and can show rehabilitation.
Reformation and rehabilitation of the applicant is evidenced by:
The applicant has not been convicted of any other crimes. British Columbia granted him a pardon on November 6, 1992. All criminal reports from locations of residence show no other criminal activities. The applicant does not appear to be a threat to National Security.

P.S. A hardship letter was not sent with the waiver application, a 4 paragraph letter was; explaining the reason for the conviction, 1) I pled guilty to save time by not returning to court for a trial and save my friend the trouble with his insurance company after the accident the vehicle was involved in. He had loaned me the vehicle, also to write about 2) our past Sharon's and mine 3) our present with death in the family and our own illnesses and 4) our dreams of a future together with the time we have left due to our ages.

P.S.S. One thing is, it seems that convictions have an expiry date of 15 years, my conviction was over 30 years ago. There is no mention of my 221(g) maybe they're installing a breathalyzer for my next interview.
I hope someone can find something else here that is helpful to them.
I hope everyone that read this and those that don't; get a letter like this one, everyone deserves one, some more than others.

A slight change is necessary: I in fact applied sent the waiver at Montreal at the beginning of February 2008, they sent it to Vermont in the 2nd week of April so the complete process took a few weeks past the 12 month mark, which is well within their 10 to18 month statement.

You will get a Notice Of Action (NOA) and the EAC number can be use for tracking but it is totally useless since updates are not available for (I-601 and/or I-????, the only time you will get an update is when they are done and you are sent a notice of their findings. Our waiver was sent in February 2008 and the approval e-mail was received from CRIS on February 17, 2009, on February 23, 2009 the approval letter was received from Vermont then on February 23, 2009 the packet received from Montreal
Even though the visa was denied on 2007-08-09 it took until February 2008 to mail due to many issues that needed attention.
And now 5 months later everything is done and sent to Montreal, it is again sit and wait time

Thank you Mary, in my csae the CIMT wasn't a CIMT after all and the 601 was in effect a useless exercise which just won't go away. I hope you and your husband are through or close to being through with everything USCIS. For us we are just getting through the first part of this multi part process, I hope the OAS doen't take three years as this has.

Laurel: I see this happen a lot - the consular officer tells the applicant to fill out the DS-221, Two-Way Visa Action form. It appears to me that this form is intended to be an internal document to be completed by the consular officer. For one thing, one of the questions is whether an approval is recommended. For another, its not available online except in poor quality copy in the Foreign Affairs Manual. Whenever I see a consular officer asking the applicant to fill that out (DS-221), its a Red Flag to me that the consular officer doesn't know how to accept and process an I-601.

11. 212(d)(3)(a) Waiver Cases:

b. State whether consular officer is satisfied that the alien has a residence aboard which he has no intention of abandoning. If required, and that he is properly classifiable as a non-immigrant.



c. Give reasons for consular officer's recommending or not recommending a waiver (if not covered completely on face of form).



d. Give details as to purpose of visit (Item 22 on Form). including names and addresses of persons in the United States to be visited.



e. If consular officer recommends more than one entry, give reasons therefore. (See 22 CFR 41.95, Note 7.)



f. In security cases give the information outlined in section I(a) above.



g. In cases involving convictions give the designation of the crime, the date and place of its commission and of the conviction, and the sentence or other judgement of the court.

"communicable" or "noncommunicable", if alien has tuberculosis, If "communicable," state whether alien will comply with "Sanitary Measures for Travel of Aliens with Tuberculosis."



2. If alien is seeking admission for treatment indicate:
i. What arrangements have been made for treatment including where and from whom treatment will be

received.

II. What financial arrangements have been made for payment or hospital and other expenses.
iii. Whether a bond will be available if required by the Attorney General.



i. In other cases describe the circumstances on which the finding of ineligibility was based.

Once tha affidavit of support is accepted when approved for a greencard you do not have to prove you still meet the 125% again. Even when removing conditions you do not need to show earnings at 125% or over.

We have been through the beginning process, through an I-601, sent all document requested and waited for the yea or nay when I recieved a DS-221 which to me means they are having a problem and all my mind could think of was aging out.
Once we get out of Montreal we will relax but not before then.

What are the chances of being denied, I-601 was approved, the doctor said I was good to go and I am presently in AR in Vermont and I don’t know why, but my question is regarding the Affidavit of Support and our being over 65 years old. Would they take our age into consideration since Sharon would be over 75 before the Affidavit of Support timed out. Would they deny the visa on the grounds that Sharon will most likely not earn the 125% required,
