According to the person I talked with the letter was mailed last week, I have yet to receive it though.

P.S. I have been waiting since April so I'm not expecting a letter before September/October and a date in either October/November. Right now the later the date the better for us.

I'm tired of having to get mine cut every two weeks so maybe I'll shave what is left or start one of those bleach shampoo treatments and get rid of what is left for good so there will be no need to shave the head every few days. Sharon, that is good news, no more work for a while other than getting the relationship back on track which will be more pleasure than work. Packing can be good too since it will be near the last time you will be using that room. I'll put my foot in my mouth and say that I am sure you are the only ones on the list with Aug 1, it is too bad because it would be nice to meet others from here, there, but with Alan beside you, you don't need anyone else. Enjoy the trip and the company, and don'T shave your head shave Alan's. :P

I think that their saying raise your right hand is a danmed good indication because if you didn't get it they stand at the window and hand you your passport back and grab for waiver papers in front of them. I'm only saying this because in the consulate reviews most everyone who got the visa states they were asked to raise their right hand, and no-one who was refused ever said they had to, me included. So folks when they say raise your right hand give them the biggest grin you can muster because your on your way unless you totally melt down and screw-up with the Qs and As.
Right now I am the only one appealing and I would like to keep it that way, it makes me feel so special that they want to keep me around but send you on your way. tongue.gif

My dear when we are too busy things go by without our noticing them.
I don’t know for sure that I am doing the right thing; I just know that this undertaking feels right and hopefully it is right and because of it changes will be done that will benefit others that follow us. I am hoping that pointing out a flaw will bring a remedy. Every time I read you are doing the right thing from you or anyone else, I hear a crowd saying you’re crazy, you should just roll over and give them what they want and in a year or two it will be all over, well if I rolled over it would be left to someone else and if everyone rolls over everything will remain the same and someone else will get a bum deal as we did. Thank you for the respect and admiration Lenina, but both are earned and I have yet to do that, it is still too early in the game to see if anything will come of it. As for the RFE I don’t think I will place anyone here in such a position as to sign their name to anything going to the DHS/USCIS office because very few here have actually finished the process and are out of repercussions’ way, Thank you and Bren for the offer it is a show of support and much appreciated.




For the PM thing I’m not sure why that would have happened, I may have changed it when playing with the timeline up date and other thing.

I'm also hoping that they see a judgement based on a wrong first impression and correct it. I also hope that they put in place a system where if someone makes such a call in the future there is a backup system for verifying that the call is accurate before acting on it. With the way things are done today and were in the past I am sure that many others were put in a position of total disbelief at what they heard and had to go through. They the DHS/USCIS people have to realise that they too are human and fallible and in need of a system that protects them and us from human errors. What was done to us was fair but done the wrong way and for the wrong reason, which is why I wrote to the Director so someone higher up will see what is going on not only with me but with others also and fix it.

Nini and Bee, you are both invited to share in our lunch in Washington also. Thank you also for the wishes they lighten our load, the journey was good until Montreal our time in the process went very well and with no REFs and even though the year dragged on as we lived day by day at the end we found that is really passed very quickly. This is the make or break time of the whole process, it is hard on Sharon right now and so little I can do to make things easier for her and calm her doubts. We will survive this and be together just not knowing when is terrible.

Even though what I am doing is for Sharon and I it is also done in the hope that it will be beneficial to others in the long run if changes are implimented to cure the short comings present in the system. It would be better if more than one CO made a decission regarding a couple or family's future having our future being in only one person's hands just isn't right when it comes to not getting the visa. We will wait and see what happens, we could be pleasantly surprised.

Thanks Lynette, I read your last post and am really sorry that it didn't turn out as it should have, Canadian family get-to-gethers usually last until the host boots everyone out. I'm hoping that something good comes from my action that will help others in the same or similar situation in the future; being that making a notation in one’s file that jeopardizes the complete process without having any proof of the assumption and that the noted assumption is false and proved within the medical report and presently in hand documentation and on top of that having a second CO state that the previous CO’s assumption in their view was not correct as they could not detect what the first CO noted that they did.



I am hoping that my action will cause a change that will make it necessary for a second CO to confirm the first’s belief as that is not the present case and nor was it in our case. I am not disputing the fact that I had a criminal record and on that alone I would have done the I-601, I never denied have a past drinking problem and on that I would have done an RFE willingly. I have proof documented proof of the fact that I had a criminal record, that documentation was presented in its entirety, I don’t deny that I had a drinking problem, I admitted to that and also stated how long ago I gave it up. My medical stated and confirmed that I was alcohol free yet I doubt that was taken into consideration or the medical results even consulted as it should have because of the CO's assumption, all the information presented should have been taken into consideration regardless of what the CO thought.

Thanks Lynette, I read your last post and am really sorry that it didn't turn out as it should have, Canadian family get-to-gethers usually last until the host boots everyone out. I wish more family attended your wedding also or at least replied to what you took the time to send them. The world is turning into a very sad state of affaires.

I really should have just rolled over and done the waiver thing as they want but this is one Canadian that just has to see what would happen if. In this case if I sent to whole danmed thing to the biggest person available (the director). Only four things can happen:
1. They review and make a decission in our favour.
2. They review and make a decission in their favour.
3. I get barred for life for fear that I will get drunk steal their car.
4. I get invited to lunch with the Director in Washington.

Any bets on which one I get?

With everything that is going on in our lives over the past few months frustration set in and action was taken that could send us in a tailspin.

Today I received confirmation from UPS that the package I sent to the Director of DHS/USCIS has been signed for, the package is a total copy of everything ever asked for including the NSN 7540-149-0995 indicating why the Visa was withheld.

The ball is back in their court, now we just have to wait and see if they play it ( grant the visa or schedule another appointment) or drop it (by stating that it has to go through Vermont as originally stated.) Included in the package were very good comments by Sharon and quite polite ####### comments from me regarding my thoughts regarding the reason for the waiver application.

When I had mine done by the RCMP it listed the wait time as 2 to 4 months,as this last date was beyond the expiration of my NOA2 I called the consulate and advised them of the possible problem and was told by the consulte not to worry as the expiration date would be extended as they were told it could take up to 7 months by the RCMP to get the certificate, the consulate said I should have it by August, I recieved it in March 70 days after applying for it and 3 days after talking with the consulate. I was quite surprised to get it but also very happy that it didn't take as long as I was told. Be prepared for a surprise because I for one think the timelines given are for their benefit more often than not but there is the odd one that does take the entire amount of time they state and for those I have no clue as to why.
