Well it seems I made a faux pas and became a burr in someone's saddle. Len I am sorry that I'm not as supportive as you would like me to be but that is just how I am, when the time comes that I am feeling that suport is needed I will be there with all the sincerity I can muster, I am not one to say something just because it is expected and others do it. At this time everyone here is hoping for a quick fix, we are all waiting and wanting and in the same line for a date with Montreal. My post was as Lynette's about a conversation we each had with Montreal today.

Lynette as always and from the very beginning of our time here I am following your progress, in the past it was because we were always so close in our progress, the good thing now is you have continued to move forward to where you are soon to be home with Ed and that makes me very happy for you. I will be happy again when you get the much awaited visa for a selfish reason, it will mean that I am closer to getting ours.

Len I am glad that you pointed out my shortcomming, it is something that will work at to make better.

According to what the lady said just a few moments ago "6 month" not 4 to 6 month but most likely 6 months before we are given a date, for me that would be sometime after October 16 since packet 3 was only returned on April 16. Since we have 49 days in we only have give or take 138 to go. So much for the garden wedding, it will be off to the chapel for us, it seems that the only constant right now is going backwards.

Hi Cutienpurg

I seem to be having some trouble viewing the list. When I view it here on VJ the list starts at fg & ss and ends at David & Monique yet if I copy and paste to Microsoft Excel it starts at fg & ss then ends at Katie & Allen which is an additional 9 people. Can you tell me if there should be more than 54 people on the list since it did seem to be longer in the past.

Thanks much for everything you are doing.
Ron

Hey Ron,

I beliiiiiiiiiiieve  there are 49 couples listed beginning with fg & ss and ending with Katie & Allen

Melytha ........I emailed the list to you, did you get it?

You are right regarding the number of people I was using the excel count which had a few blank lines. but still to get everyone on the list I must copy to excel as the version you post gives me a shorter list and a blank page for some reason.

Again thanks for all the work.

Just called Montreal (only took a minute or less to get through) and since we have been in the cue for only one month we still have a three to five months of waiting time. I was told they are at a four to six month waiting time. So it is looking like mid July to mid September for us.

After being told I would most likely get my certificate from the RCMP in August by the Consulate, I received it on Friday the 13th. I will be calling the Consulate and telling them I now have everything they require so I can be added to the interview waiting list.
Congratulations to those that have their date and God speed for those still anxiously waiting.
Ron
P.S. after having made a change a short time ago, please add us as having sent packet 3 back on April 16, 2007

Did the consulate mark you down as having sent in your packet 3 at an earlier date?

As you can see from the following I was entered in the system on March 19, but a subsequent call a few weeks later to the Consulate and a conversation with evil one a.k.a the ###### of Montreal who accused me of trying to get on the list without having everything got me knocked off and told to call when I had it all together. So to answer you yes I was on the list for a short while and will be back on it as of tomorrow.

Ron

So they knocked you to the back of the list because you asked a question about the police certificate after you sent in your checklist? I just want to make sure I understood that correctly, so I don't make the same mistake lol

All I sent in was the DS-156 and the DS-230 part 1, I didn't send the checklist and had no intention of doing so until I received the RCMP certificate since I didn't want a date before having everything in hand except the medical. They assumed that by sending the forms in I had everything, and I am sure that if I had spoken with someone other than the ####### of Montreal they would have left everything as it was. At this point in the journey it really doesn't matter where I am on the lit as long as I am on it.

Subject: RCMP check and other

I have requested an update on my request for a criminal background check with the RCMP, and I received a reply stating that my request was entered I their system on February 18, 2007, and it will take 120 plus days to process my request. The 120 plus days could run from May 20th to July 20th depending on whether they count 5 or 7 days as work days. Our visa process is valid until April 7th, with the 4 month extension permitted by the consulate I would have until the 7th of August to have everything finalized and I was wondering: 1. Does the interview have to be done on or before the 7th of August deadline? 2. Could the checklist be sent to the consulate before the RCMP documentation is in my hands and check it as having been received?

3. I have a letter from the court where I was arraigned is it necessary to also have a statement from the arresting police force also which was a RCMP detachment?

Thank you very much in advance for your assistance.

So how long did it take to get the fingerprinting completed Ron/Sharon??

It took 55 days from the time they entered me into their system which was about 3 weeks after they actually recieved it I express mailed in mid January and was entered in the system on February 18 for a total of proximately 76 days. The RCMP site said 120+ days and when our NOA2 expired on April 7th I called the Consulate and told them I wasn't yet ready and why, they said 6 months according to information they recieved from the RCMP and I should expect the certificate in August. The biggest surprise was what the certificate said " This certifies that a search of the national criminal reords repository maintained by the Royal Canadian Mounted Police (RCMP) concerning the person whose fingerprints, name and date of birth appear above could not be associated to any existing criminal record of conviction which may be diclosed in accordance with Federal laws." To some that would mean I don't have a criminal record when in fact it means I have one but since I was pardoned they under the law cannot disclose it, which means as per the Consulate I need a copy of my pardon and a copy of the court documents which I will have in my hands in two weeks.

Hi, the date that I returned my Packet 3 is wrong since I haven't yet returned 1/12/07 is th date I recieved packet 3 from the consulate.
This part is a rant
I am doing the big thing with the RCMP and I just called the consulate since petition expired on the 7th of this month and told them I was waiting for the RCMP docs and that I wasn't added to thier system until a month after I sent it to them and a month after they got it, the consulate said I should recieve everything from the RCMP by August. They were told that getting background checks will take up to 6 months

It was very surprising to call on the 7th and hear the appointment is on the 9th, but I wasn't going to complain I had everthing ready for over a month in advance, all I needed to do was get to Montreal and left here at 2:30a.m. on the buss and got there between 6 and 6:30a.m.

CanadaHow long have you and your loved one been separated?
Hi lenina and Bren, sorry I haven't had a positive attitude or kind words for anyone for such a long time but is seems that my mind has been corrupted by this process. It is my own fault we are in this predictament or half my fault, Debbie is the person that shares the other half.

Mumsie, Sharon still is not well enough to travel long distances,it may take a while yet for that to happen. As for montreal I contacted the USCIS ombudsman and they said there was nothing they could do but I definately should contact a lawyer regarding Debbie's observations and notations in my file. We are on the verge of abandoning our persuit of the visa, presently I am looking for a house here and we have started the process to get Sharon her PR here whichh she could get before Vermont and Montreal make their decission regarding our future.

I just like complaining, it is nothing big there are others here that are worse off. Sharon now has a passport and can come here. We are also exercising our options by applying for her immigration to canada and take the one that comes in first or if possible take both.
I don't know who is worse off, those who have been apart a long time or the ones that have just left there sweethearts

I was told 6 to 12 months and 12 to 18 months, Montreal sat on our paper work and sent it in April so it is actually 16 months left to the 18th month. By looking at 14 or 16 months down the road getting it earlier would be a bonus.

I don't mean to pry, but did something happen? If you arent comfortable answering, I understand, but wow.. that is kinda scary. My hubby and I will be having our interview in Montreal also.

I have a I-601 for one crime auto theft in 1976 and a I-212 for alcoholism, last drink was in 1984.

I hope it all works out for you two! I hope it is much quicker than 14 months!

You have nothing to worry about except getting yourself to your interview. My problem started to my thinking was not because of the crime committed but because the person collecting the information noted in my file she could smell alcohol on my breath and thought I was drinking before the meeting, which I hadn't.

Dear Ron and Sharon,

I am feeling like my heart swelled and wish I could take all your pain away.
I could say I am sorry to hear what you are about to do, but hey, you are taking your power back!
Congrats about that.

If you could just let it ride itself out to the end - perhaps an approval - then think about doing that.
I hope someone here can guide you about this.

And being that I have A.D.D. (self diagnosed), I cannot remember if Sharon ever contacted her congress person and/or thought of going to the media/press\ with this predicament.

In the end, I am so pleased for Sharon that she will enter a country that will take of you both in the long run; and so pleased for the both of you that you will be together and recover from these past government inflicted pains.

May your road there be safe and paved with rose petals.

We thought for a second or two about sticking with it, but we waited 4 year before filing and have been in the process since September 06 and didn't want to be in it til 09 anytime. It was a very easy decission for us to make, the only person we contacted was the ombudsman and their reply was we can't help you but you should hire a lawyer. The good thing is that in Canada my past will not will not interfere with our future as it has with the States.

I'm torn between telling you to scuttle the ship or fighting on. If you withdraw your application I don't think it will change your admissibilty if you didn't have any problems before. You've put so much effort into this venture I think that you should continue on with US immigration and simultaneously pursue Canadian immigration as vigourously as possible. The decision is yours but once you get the approval in the US, you could always choose which country to call home. Whatever decision you make will be the right one I'm sure. good.gif heart.gif

except that if you have concurrent applications going and USCIS finds out about the Canadian one, they'll just cancel the US one out of spite tongue.gif There was a couple on (I think it was) the Can/Am Yahoo list a couple of years ago that happened to.

There are a few questions I would like to ask, and I ask a few of the people in the know who are willing to share their knowledge to do so.
  • Who should be advised when withdrawing our visa petition?
  • Do you have an address where the cancellation should be sent? In case it is different from Montreal or Vermont.
  • After the cancellation would there be a time when admittance to the USA would be denied.
  • If possible, how long after cancellation of the petition will travel to the USA be permitted?
  • How long approximately would it take for the cancellation request to be processed?
We are not abandoning each other; that is not the purpose of the withdrawal of our petition, we are abandoning the process. We have little to no confidence in the American government making a decision on our behalf within the time it will take to have the Canadian government to process our petition from beginning to end.

Thank you

Ron

The decision is yours but once you get the approval in the US, you could always choose which country to call home. Whatever decision you make will be the right one I'm sure. good.gif heart.gif

The fight is over, we had no clue as to when it would be over one month or thirteen months from now when we could be together. This way we can apply for her to be here and she can live here and return there when it is necessary and if everything goes well she could have her permanent residency as soon as six months from now if this take longer the bonus is they we will be married and living together not apart. To have stayed with the process to go to the States I would have had to redo the medical, the criminal ground check, hotel, interview and the trip to Montreal & back. The need to cancel the process was to be able to enter the States ASAP so we have smooth sailing when the time to moves comes.
