Thank you everyone for your wonderful thoughts and comments. Yes it was a tearful day yesterday, as Sharon said She didn't know whether to laugh or cry so she did both, as for me well I'm still to numb and it will only sink in when I have everything in my hands, this could still be a trick of theirs they did pull one last July when they asked for the DS-221.

As many of you know this for us was a long voyage and the last two years were the worse, the waiver took 12 months and it was approved and there was a 5 month break because of many family difficulties on both sides and in that time we both became ill and both were operated on, Sharon was out of work for almost 5 month I had a stroke and then fractured my hip and was out for 2 months. We were in AP for 755 day then luck was on our side we moved from AP to AR and were there for less time than we thought we would, only 34 days of a usual 4 to 8 week period.

As for the immediate future, Sharon will still be visiting but not for the labour day weekend but the week after for a longer stay so she can meet some of my family which I never gave her the opportunity before as I always went to Kansas and she never came here. I am going to continue working here for the next few months and leave on December 3. There is no date for the wedding yet but it will be in 2010 in Manitou Springs Colorado.

The game isn't over yet just the first round, but the rest will be much easier to take since we will be together.

Right now the best I can do is say thank you all for the congratulations, thoughts, wishes and everything coming our way. There hasn't been one day that as we prayed for ourselves that you weren't included. When we first started I had one wish and it may have come through, that wish was that everyone who filed before we did got thier visa before we did and it may just of happened and if so I am glad and if not we are still praying for you for a quick exit and a move forward to AOS for all.

Well it has happened, after 1078 days they called to confirm my address so they can send the approved visa package out today.

Good Morning Lona, it is strange, and I doubt it is a cake they want to send, more like another dose of frustration only they can portion out. We have gone from strong to a bit less than that but we are still very determined and never thought of giving up. We can take the BS as long as we focus on the end results. I have called and left where I can be reached, hopefully they will call here and not at home.



Hi Carla, I was wondering if anyone in the process had ever gotten a call from the Montreal consulate because I don’t remember anyone saying they had received a call from the consulate in the past. They did leave a number but as you know they don’t answer their phones so I left a message for them to call me at work and if I don’t hear for they in the next few hours I’ll tell them to send an e-mail.

AS for Sharon spending the holiday weekend here that is still up for grabs since has to apply for a new passport, when she moved she packed the other one to well and can’t find it, she should be able to get one within three days according to the people she spoke with, and if not she will take a weeks holidays and still be here but a little later.



Hi Krikit, they didn’t have much to say as you read above, just that they were from the Montreal consulate and their number. I am waiting for a call from them and hope they call me at work since I’m here before they get to work there and leave hours after finish. I don’t know why they called and it can’t be good.

It was short and it was sweet. "This is the american consulate calling for Ron" end of call.
Have any Canaliens ever have that happen? All other communication between myself and the consulate has been by mail and e-mail. Anyone care to venture a guess as to what they want?
I have two guesses.
1. They will deny I returned my passport.
2. Due to my age they will want a hugh deposit "insurance" for possible future medical expenses.
I am sure they don't call to say congratulation you made it, and they don't I'm sure call to say numbnuts you fail but there is good news and bad news the good is you can stay in Canada and the bad is you can't come to the United States.

August 9th was the 3rd anniversary of our interview, maybe they just wanted to say happy belated anniversary.

What is advisable? fill the NR-73 or advise CRA when I file the tax forms for 2009 that I'm gone, byebye?
I've read that filing the NR-73 was not necessary and it gives CRA the chance to refuse non-resident status for tax purposes depending on the answers to the NR-73 Questions, and that it was better to file the a tax return for the current year and never file another return ever again.

I wrote to the ombudsman and the Director of DHS and got the typical no response reply, the first said nothing we can do and the second replies with a history of our trip which we already knew about since we lived it and they stated that our "A" number was our visa number which of course it isn't.
The ombudsman replied within a week and the director forwarded our package to customer services and they replied 12 months later. Neither one addressed the issue of there being a ####### masquerading as an officer in Montréal.

I reported that one to the CIS Ombudsman and the Director immigration at the time Emilio Gonzales.

It's everything that you handed in to Montreal.... It's basically your entire file (medical results, forms, etc).


I'm sure it is close to everything sent from the beginning, not everything Plus the IBIS name check that was done in california ours was CSC 2006, I got 2 pages for Sharon and 26 pages for me. actually mine wasn't in the envelope and should have been.

i actually have no idea why it was 2 envelopes!! no child no one else came with me, was surprized when i opend the express post an there was 2 envelopes! they didnt even open the second one at POE either so i didnt get to peek at it. the second brown envelope is still a mystery! star_smile.gif

Thank you for your reply. The file will be reviewed. To note, all our visa packet envelopes contain the “do no open” stamp, and an instruction sheet taped on the 1st envelope advising that the packet(s) should be presented ‘unopened’ to the immigration inspector, along with the passport, at the port of entry. Any original documents would have been returned separately from the packets, not sealed in an envelope and placed in the Xpress post envelop. We will review the file and advise you. Thank you for your understanding, it is important to prepare, assemble and issue visas according to Department of State guidelines and formalities.

When I opened my express post envelope, out came a brown envelope labeled DO NOT OPEN. Taped to that envelope was a piece of paper explaining a few things about activating the visa, AOS, etc. Finally, the passport was just loosely inside the expresspost envelope, on it's own

In the short time I had my visa in my hands I was able to advise my employer and landlord that I was giving notice and would be moving soon, that was before I found out everything had to be returned to Montreal for re-packaging.[size="3"]
I was hoping it would be done in a week but a week has passed. My employer has already found a replacement and my landlord may have a new tenant for my apartment by tomorrow. I was to purchase my ticket shortly but needless to say that is now on hold.

The documents are in our mail to be processed in order of receipt. Once we review the entire file we will advise you further.

Not an answer that I would have expected, but it won’t keep me awake at night. I thought the Consulate would assume responsibility of an error by a Consular Officer and attempt to correct that error as quickly as possible. Well, if dreams were wishes and wishes came true pigs would fly and I would have my visa before , oh well it’s only a dream. ZZzzzz.

Please advise what Consular Officer error is in question.

The error that is in question is the assembly of the package containing my passport and visa. There was and is an unopened brown envelope with the standard “do not open” markings and an information letter attached, in my envelope there were documents that I had requested be returned and they were but among those requested documents were at least one the 2006 IBIS report from CSC there may have been other documents I should not have seen, but I don’t know. I reported this to the Consulate and was advised to return the complete package as received, I returned more than I received as I was in the process of inserting the received document in their place within the originals I had at home when I saw the error, and because of that I assume I am again in Administrative Review.

P.S. I assume my assumption that it was a Consular Officer that put the package together was wrong, it was by office staff.

I hope you are right - you defintely have the record, I'm no where close on # of days. From what I read, you should get your visa very soon as well.

Sorry I have no way of knowing if it's a he or she - I just used the oldest politically incorrect way to describe a person.

It doesn't really matter if he's a he or she's a she, what matters is they they keep thosse finger working and supply us with the answers we are looking for.
Having a record is just something someone else wants normally, but this one, our personal record I hope no-one ever get to claim the title it is not one to celebrate.

That's weird INK, I haven't seen this with evidence of domicile being submitted - however it's kind of a new thing around here, we haven't had that many DCF Canada people until now.

I would write them back and ask them to clarify - that extra admin work might just be reviewing your file - ie: looking at the additional domicile info.


Agreed - we were thrying to find that out but you know they don't really share much on their internal processes. It is weird as I have seen a few people submitting evidence for domicile, but never extra admin work. You may be right that it is nothing more than just looking at the file...guess we'll just have to wait this out.

I hope you finally get an answer that will make sense to you.
A little side note; OP5 seems to be growing a heart, I have never seen the word apologize in any communication from any consulate employee. This may be a new beginning.

It's a case of the right hand not knowing what the left is doing.
They both may have recieved the same message but OP6 is new and doesn't know the length of time it takes to put the package together and assumed it was done and going out, and OP5 may be more experienced and knows when that message is recieved her is a time lapse for everything is ready to go.
To my thinking the issuance of the visa means that they have the document, they must marry it with the passport, then pull your file then the documents to be inserted in the brown do not open envelope and do so then mail everything to you.

So while we have been trying to find out how Canada Post messed up and did not deliver, we get this. We are at their mercy and they know it too well.

It is sickening when you get OP6's and wait over a week wondering where the envelope is and what could have happened to it, it's not enough the your nerves are basically raw from the process to start off then OP5 issues their little not yet it's still here and being put together. I got a phone call to confirm my address before they sent it and three days later it ws in my hands. Hopefully you will have it very soon and you will be done with them. Regarding Canada Post, if you are in an apartment ask a friend or neighbour to check for your package, the post man simply dropped my package in the lobby and walked away,anyone could have taken it and I wouldn't have known any different, I was lucky a friend and neighbour saw it and kept it for me.

None of us have the right to choose the speed with which we travel so we go with what we have been given. God knows what we can and can't handle and perhaps God thought a fast trip would be to much for us or God knew we needed more time to learn and blend and solidify what was given to us for a better and brighter future together.

Next month marks our 7th year together and If we had to go another 33+ years to reach the 40 years we could and would do it as there is an end date, the difficult part right now is I have had the visa in my hands and had to return it and not letting Sharon know because these past 2 weeks have been hard on her. I am not keep it a secret form her I just need the right time for her and the right time may be once I have everything in my hands again.

They will definately make an other offer so we'll see what's next, ball's in thier court.
It's all going back today all 3.8 pounds of it, had to copy and scan everything, don't want them to not send everything back. Should here back from them in a week or two.

Update on Sharon’s job offer, so far it’s a no go. Better to stay where she is at her present salary and bring home $1.00, than go to the new job get a raise and end up bringing home $0.80

Definately need to return it to have it put together properly, I don't want to find out the problem would be if I brought everything to the airport as it is now. The person I spoke with sounded very serious when he said "we will have a problem" what he said wasn't said casualy, it was more like if it isn't right you're up the creek without a paddle. That tone definatly does not need any second thought.
Now I have to photocopy everything to be sure it's all there when I get it back.

Everything went well regarding the interview yesterday, Sharon was happy with it. That is two down and one to go. She is taking a weeks holiday starting today adn they will call to set up the next and last interview, She was told yesterdays was the toughest of them all.

Just got back from the airport to see if they would do things right regarding my paperwork from Montréal.
I explained what had happened without say Montréal wanted everything back and was told to send it all back to Montréal bcause Montréal is DOS and they at the airport are not. What I was told very slowly and definately clearly so there would be no misunderstanding was "if we look at your package and everything is not in order or was opened there is going to be trouble". I guess it is time to comply with Montréal's request or get one hell of a sermon or denied entry later on.
I'm about ready to change my Tums for Demerol don't feel no pain with them.

She was offered her own store to manage with Chritopher and Bank but before accepting or refusing thier offer she needs to pass three interviews, one was done last week and another is today and the third could be anytime after todays interview

I'd seriously consider what trailmix said. Obviously we haven't yet been through enough, as long as I have my tums and Sharon has her meds we will survive. If only I knew they wanted everything back so they didn't look stupid when I showed up at the POE with the package the way they sent I would keep it, but by keeping it there may be problems at the POE or further on down the line.
I was going to activate the visa at the end of November and I'm not changing that date just yet. I will send them what I think is thiers and if anything is missing they can ask for it.
