CanadaCan't find my NO2!!!
:help: oK, little freak out going on right now... going through all my docs in preparation for my MTL interview and noticed that I can't find my N02 letter.... :crying: I must have forgot it in Virginia when I was down there last time. I am assuming that USCIS forwards a copy of this to the MTL Consulat . Can someone tell me if they needed it for the interview???? Do I need to contact USCIS for another copy just in case?


Arrrgh, just what I need, usually I am so organized I cant believe this, and asking my fiance to look for it at home is pretty much hopeless cause he is on deployment right now!!!Also, I remember that it expires in Jan or Feb so the Consulat will need to extend it. Help anyone???

I've been trying to phone MTL consulate for the last 3 days... I dial ext 3833, but keep getting the stupid voice recording that says enter the extension I wish to call...but nobody ever answers. I've been calling betweeen 14h00-16h30.

Anybody else have any luck getting through??? :wacko:

I was really hoping for some good news!!!! :o

I just phoned MTL cause I wanted to know if Packet 4 w/interview date was sent out yet (I had a feeling it was coming any day now) and she said I probably wont get Packet 4 until JANUARY and probaby won't get an interview until FEBRUARY.

Good thing I called to give them my new address (at my parents) cause I sold my house and moving Jan 31!!! So I can stop frantically checking my mailbox every night when I get home.

Hmmmmm, Feb is no better than Jan with Montreal weather, I think I'll take the train and not risk the dangerous hwy drive.....

Hi Karlita,

I also plan on travelling to the US prior to my actual "Move" next July. I simply won't travel with my passport with the visa in it. You can cross the border with birth certificate and driver's licence. If need be and you have to travel with passport, you just tell them that you don't want to activate it yet. I've heard of other VJ'rs do this. Hope this helps!

By the way, you prob won't get your interview until January anyway at this point in time!

Mercy... Did you say FEBRUARY interview???? Holy moly!!!!! That's like 4 mths away for those like me who sent back the checklist in Oct. I think many of us in the waiting room thread are in that boat right now. That's incredible.... I guess with Thanksgiving and Xmas holidays, there will be some delays, but Feb sounds sooooo long from now. UGH :crying: My NOA2 will definitely be expired by then!!!

BTW - My K3 is with the Consulate right now. I called about 3 weeks ago and they told me I should get an interview sometime in January. I just called again since as of January 19th I'm homeless in Canada (sold my house) - and they are now telling me February or March for interview !!! ARRRGGGGG

In a nutshell: Born in New Brunswick...lived all over NB till I was 10, then moved to Ottawa for 6 mo

Then moved to Hong Kong, then Switzerland, then Germany, now been in Ottawa since 1994. Iconsider OTTAWA home now.

Moving to Norfolk, VA next summer for 3 months where we'll get married.... then who knows where my fiance's next assignment will be??? we are keeping fingers crossed for RI! Nice and close to Canadian border :P

At least you are going to be together that's great! I can only speak from my own experience. But since we filed for our I129 in August, I have flown down to visit my fiance once a month and never had any problems with the POE. Mind you, I always find the Oficers at the Ottawa airport super nice. Of course, I have to go through some questions, and I have a ton of paperwork showing ties to Canada (mortgage, full time job...) and I always keep with me my visa paperwork just in case. But have never had to show anything.

I think the only other thing I can think of doing while "waiting" is trying to work as much as I can to not think so much of the wait, and make as much money as possible cause I'll be unemployed until I get my EAD!!! God knows I feel bad my hunny has to support me for everything monetary the first while.... but he gets me in return :dance:

I bought a ticket for Dec 27-Jan 1 for the upcoming holidays...even though he is coming to Ottawa from Dec 17-27, I just didn't want to say goodbye yet cause he'll be deployed for 6 months....so Merry xmas to him, I haven't told him yet!!! Hopefully he'll like the surprise and hopefully the POE wont give me a hard time. So far so good... I've travelled to the USA 6 times in the last 6 months, never had a problem. Always, always, carry proof of ties to Canada and answer truthfully to their questions and you should be good to go! Oh yes, and I always have my K1 paperwork with me as well.

There is definitely a slow down on handing out interview dates everywhere due to upcoming holidays!!! I was so sure I would get something for January, but now I've been told Feb. Count your lucky stars you got your date and good luck with the interview!

Hi y'all

Just received an email from my fiancee (USC) informing me that he got his list of choices for his next duty assignment. Seems like there is going to be a chance that he will have orders to Devon, UK!!! How does this work if I enter the U.S. on a K-1 and after we get married we get posted overseas? Will I have to go through the entire process from England with the K-3 since we'll be married before he leaves?. It is my understanding that I won't be able to go through AOS if I am leaving the country.

Any insight on this? I was planning on phoning the Consulate to see what they say but thought i would run it by my VJ friends first :)

We should find out in the next month or so what he gets, I just want to be prepared.

I also didn't want to rent a U-Haul truck to move my stuff because of the nightmare stories I heard. Instead, we are going to use my fiance's pick up truck and haul a U-haul trailer (12ft) cause he has a hitch. That way we are sure that nothing mechanical can happen. :P

My fiancé and I just got engaged in NYC this past weekend during Fleet Week!!! YEY...except that now I am stressed out with all this immigration stuff to go through. I am a Canadian citizen, he is a US citizen. I understand he needs to file a petition for me to get a K-1 visa... then I go down to the US, I have 90 days to get married..... no problem, we plan on doing this in December!! BUT- he is getting deployed overseas after we get married and I need to come back to Canada to sell my house, and I still have a job I want to stay in while he is overseas. My question is- after we get married, can I come back to Canada and enter in the USA 4-6 months later? I heard somewhere that I can't travel until my status changes, is this the case? HELP...

It sounds like you are not yet ready to immigrate to the US. Why don't you get married, return to Canada to live and work and work on a spousal visa process while your husband is away? With timing and luck, you'll have that finished by the time he returns?
A K-1 just doesn't seem very appropriate for your situation.

I plan on going through the Montreal Consulat since I live in Ottawa.... but I am really confused as to what I should be doing... which visas I should be applying for? K-1 or K-3?

We want to get married in December in the US, and since I have to come back to Canada for 6 months while my fiance is deployed overseas then would I simply apply for a K-3 (spousal)? Would that work? How long does it take to get a K-3? Someone I know told me it toke him a year before he got his papers approved, I think that is soooo long!

I can't give you much advice on K-1 as I'm not well-versed with that particular visa. But I just wanted to ask you which consulate (Vancouver or Montreal) you think you'll be having your interview. The reason I ask is that people in Vancouver seem to be getting their interviews faster than the ones in Montreal. If you want to get married in December in the US, you may have to figure out if you'll make that deadline. Do you think you'll be able get through the entire process in 7 months? :( I hope so... but one never knows.

There's also this new law - IMBRA. It's just added security checks for K visa applicants. Anyway, I suggest you look at timelines of K-1 applicants in Canada as well as looking into the other types of visas.

I think I might be ahead of myself!!! I knew that we would be applying for a K-1 so I went ahead and got my police records from when I lived in Europe when I was 16-19 yrs old. I was told it could take time so I went ahead and applied for them, but surprisingly got them within weeks. But now I realize that my interview won't be for longer than 3 months..... does this mean they will be null and void even though I haven't been back to Germany and Switzerland in the past 12 yrs? I'm in Canada now and that police record will be within the 3 months time frame.

Is this something I should phone the Consulat about or does someone know anything about this?

I have all of my police records...one of them is in German cause I lived in Bonn when I was 19. Does anyone know if it needs to be "Officially" translated or can I simply translate it myself? I speak German so it would be easy to do... finding a translating company in Ottawa might be a little more difficult!

Your logic is misguided...

The USCIS uses a priority system policy where earlier cases will be sent for adjudication before later cases...

Let's say that the form comes out next Friday, June 23. If you send in the old I-129F today and it arrives let's say next Tuesday, June 20th. That means in essence that your petition will be sent for adjudication between 3 to 7 days before the guy that waits. Your petition get to the adjudicator and he sees that it was with the old form and immediately issues an RFE. You then have to wait for that RFE to be generated and sent out to you and when it arrives at your house about a week and a half later, the guy that waited until the new form went out is now sitting on the desk. Seeing that it's the new form, the adjudicator proceeds to adjudicate it, approves it, and sends it on it's way to the NVC..

All while you're waiting for your RFE...

Believe me this has crossed my mind and I agree with you. Thing is that we do not really know for sure that the new form will become avail on June 23rd......know what I mean? Who knows for sure when it will be out.

My question here then would be this..... If I send out my K-1 petition tmw Friday. How long aproximatley would it take for me to get my RFE?? I know there is no true way of knowing, but how long aprox has it taken those here to recieve any sort of RFE?? one month? 2 weeks? 3 weeks??

I guess that is the question then for me..... because if it take 1 month until I get the RFE, then maybe I should wait for the new forms and hope they get here by the end of the month.

I'm also in the same boat as you.... and after spending weeks on this site educating myself with everyone's extremely valuable insight, I have decided to wait until the end of the month and file when I go meet my fiance in the US on July 1. The current I-129f says it expires on June 30th so I am hopefull (or wishful :hehe: ) that the new form will be available by then. In yesterday's press release, they did say it would be available by the end of the month and I'm thinking it will, I don't think they would have confidently make that kind of statement to the whole world and risk not having it ready.

That's just my 2 cents worth. Bottom line is you have to decide for yourself, personally, the less paper work the better for me, so I would rather only have to fill out forms once!

I would go ahead and file if you have everything ready. By filing with the old I-129F, you know you will receive a RFE which will add a week or 2 to your time but at least you will have the process started and you will get your NOA1.

Now, hopefully for everyone here who is waiting, the new form comes out today but there is always the possibility that it won't be available until tomrrow, next week, next month, etc. With all the problems I had with USCIS (I am STILL waiting for my NOA2), I don't trust them very much. I guess it is a choice that you will have to make.

Actually right now.. I would wait...

Their website states that they want to get the form by the end of June. You can send it in now, and wait for the time for them to get you an RFE and you to send it back (which could take a month), or you could wait a couple of weeks for the new form and avoid all that. IMHO, anyone who needs to file a I-129F should hold on until the new form comes out... It would likely result in a net gain in processing time versus filing with the old form.

I have a question... I thought that the"long" birth certificate was only for the foreign fiance and that the USC could just send in short BC... or passport. Can someone confirm this? It doesn't say long version of BC anywhere on the I-129f? I'm sending the K-1 next week and want to make sure we have everything right!
