K-1 Fiance(e) Visa Process & ProceduresK1 Visa procedure once in America
... well a K1 visa is the visa that lets you enter the country with intent to marry. You are already in the country, so need to take a different route. Did you go to the US to marry but on a work permit?

From the sounds of it you are really going to have to work hard to prove this relationship. Since you have not seen each other since childhood I would recommend before jumping the gun that you take the financial pain in the bum and have a few visits to make sure that you are not only right for one another, but that you are right enough to take this bumpy and expensive road.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Military

OMG Tater!!!!! much respect for both of you - for your service. Please stay safe. I wish there as military forum, too haha! All the best of luck for you guys with your process. And as for military help line - hey, maybe in your case it can be actually helpful: after you get NOA1 which should be soon - if your fiance calls USCIS himself (if he can do it from far away of course) - he can actually tell that he is deployed, and ask for expedited process. Because what you wrote in cover letter - they might not even read it before they actually get to your case in 5 month. You know? So maybe this way military help line can actually help you speed the process up...

When i called i also wanted to mention the poccibility of soon deployment, but they wouldn't talk to me - they needed my fiance present or calling them himself to talk about specific case situation :(

The military helpline said the ONLY way to get it expedited is to write it in the cover letter and then you find out by how fast you're approved.... ya. My fiance called them from Iraq.

We are waiting for the NOA1 in the mail (I wish we'd get an electronic heads up), not sure if it'll get sent to his mom's or my address like we asked... but should be here this week. We will likely try calling again to request for expedite, we're really pushing for this. Because I just returned from my contracted tour I am not working, no point in busting my but for a job if I'm leaving in a few months anyways, and if I'm working we can't spend as much time together when he's back. He's my priority at the moment. We've already been forced apart over 7 months for touring and plus all the pre deployment training he had to leave for.

Thank you! My experience overseas is night and day compared to my fiance's. It was an amazing once and a lifetime experience. Many sad and hard days but it's what we're out there for. Working 7 days a week, living, eating and working with the same people in the sand and sun, and occasional flood. If my fiance were forced to do another tour I would go back in a heart beat. You don't need to be in the military to serve your country and the coalition =)

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Military

My fiance is about to finish his training, and we don't know yet where he will be stationed. So when we filed I-129F in January, we put his 'home of record' address everywhere, and put his training name and address as the most recent employer... Military help line was not too helpful in our case either - the information was not quite accurate, and it seemed like they didn't know what to answer to simple questions and had to check with somebody else before giving any information.

I agree. I wouldn't recommend any call them unless they are in a real pickle, and when they do call that they request to speak with a supervisor or something.

I wish there was a military members forum haha.

Tater

Can you tell me exactly how you guys did it on question 14 with supplemental form?
Did you guys put the address on question 14 or did you guys put see supplemental?
Did you guys use PO Box?

Thank You

V/R
Marvin Maricel

We put under address for #14 "See supplemental form page five" and then for city we put Fort Drum, state NY. The fifth page of the package, supplemental form page five we wrote out the question again and stated as a single man in the army he is provided a dorm within the barracks. Once married he can apply for living assistance, but can only do so with the marriage license in hand, and thus we cannot get a marriage license until I am legally able to enter the country on my visa to marry him. But worded a lot better :P

His 'home on record' is in MI, so we put that address for his home address, his mom lives there. Residential history ends with NY because from there he went on tour to Iraq, and it was the last place he did live. Under the military section he put his APO AE address.

So hopefully that won't be too confusing for them, BUT it is our situation and it is what it is. We have nothing to hide and nothing to stop our case, it's just a matter of luck now that we get someone who can pass it along quickly.

We also requested on our cover letter that it be expedited as we got engaged last summer but couldn't marry because of both of our deployments and are now starting it since he have an idea when he will be back.

I'll keep you posted, if we hear of anything that needs to be fixed I'll let you know.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Military
Hey! My fiance and I have the EXACT same problem, except he is currently deployed, but posted to NY, with an address in MI.

His address for everything we put in MI, it's where his mom lives and where his vehicle is registered and bills are mailed... and on his military docs he has it as his 'home of record'.

As for question number 14, I was advised to provide a supplemental form and stated that since he is single and in the barracks he cannot provide an address where we will live, but once married he will receive living expenses and at that time WE can live on post. They understand that.

Residence history on the G325A we put his address in MI followed by his address in NY until present.

We were originally going to file through VCS, but since technically his home is MI but living in NY we're going through CSC. I'll let you know how it goes! I hope all the info isn't too confusing to them.

PS: My fiance called that helpline and the info they provided him was incorrect... really disappointing. I hope you have better luck.

K-1 Fiance(e) Visa Process & ProceduresNeeding Canadian fiance to move to US
My fiance and I live less than 2hrs driving across the border so I have no stamps either (not to mention for a while we didn't even need passports to cross!). I printed a map with directions from my house to his showing how close we are... but our application is still in progress. When I do start crossing again I will be asking for stamps. It was also suggested to me by other members to show proof that you purchased gas for the trip. I know I don't keep old gas receipts but if you used your credit card that could always work!

K-1 Fiance(e) Visa Process & ProceduresFrom K-1 to K-3, or ... ?

Hi Valerie,

Not spooky. Schmoopy is my fiancee. :) I just thought I would fully explain our current situation and especially the financial part of things. I guess I should have done that in her thread. Do you have any suggestions given the information I have provided above? (do not meet the affidavit of support requirements, no sponsor)

All the info in the other thread is very use full, no one will tell you anything different. The supporting docs for both Visa's will be similar so if you 'need' a sponsor K-1 or 3 won't make a difference, only slow you down by another 11 months or so. Trust what people are telling you and stick with your current path.

Good luck.

I wouldn't note that he is deceased unless you are unable to get his birth info. Otherwise I'd just leave his date and place of birth as is.

K-1 Fiance(e) Visa Process & Procedurespositive TB test
I find it appalling that someone would look into finding a way around this! To put the person you love, as well as hundreds of others that they come in contact with each day in danger is truly a selfish act. I hope she is smart and continues to take her meds, I've seen what TB can do to people. It's not to be taken lightly. I would also never recommend seeking medical advice on the internet.

K-1 Fiance(e) Visa Process & ProceduresHow do you stop the K-1 Visa processing?
Point short, you'd be denied regardless if that's your real concern. If your real concern is time and you just want to be together than stay on the path you're on. It's the best one.

K-1 Fiance(e) Visa Process & ProceduresHow do you stop the K-1 Visa processing?
Well getting married in the US would require the visa so I would recommend waiting it out. If you opt out and go the other route it will take slightly longer and your fiance cannot live in the US, only visit and that's if customs allows it. Like I said, you've invested 3 months of time already, I am sure the petition will be approved soon. You're almost at the half way point. You'd be sacrificing so much more by cancelling it.

I don't think James said anything wrong, I think he was saying legitimately your case looks fine but maybe there was a signature or mistyped info somewhere. Doesn't mean something is 'WRONG' just that something needs fixing before it can be approved.

K-1 Fiance(e) Visa Process & Procedurespacket 3 to Montreal
It asks for black on packet 3... but ya I doubt they'll send it back! Who knows. To me it makes more sense to use blue because it's less obviously a photocopy.

QUESTION: I have filled it out and am confused what to do about one question on DS-230 #35... list all previous visits or residence to the US, give type of visa status. So I've been to the US like over 50 times in my life. Couldn't tell you all the dates. What do I do? On my DS-160 I listed my last 5 visits.

I wish I could have received an interview date that quick....for Montreal it looks like I will be waiting atleast a few months before I know....Goodluck with the interview, I'm sure everythign will be fine!

A lot of other countries don't have the extra steps we go through (and extra wait on top of that!). They just fill out the forms (DS230; DS156) and bring the rest to the interview, which is not normally much more than a month after the forms are filled out. It's a pain to be Canadian!

K-1 Fiance(e) Visa Process & ProceduresDS-160 and DS-156

I haven't filled out the DS-156 or DS-160 yet as required by the instructions from Montreal Embassy. I've heard that there may be trouble uploading photos. I don't have a scanner to scan a passport type photo. Are photos really necessary, or are we allowed to just bring them to the interview? I think I read on here somewhere that there are ways to just skip the photo part on the online forms and carry on. If anyone can enlighten me before I get started, I would appreciate it.

Also wondering what info is required on the DS-160 and DS-156 so I can have it ready before I fill them out online. Has anyone got an example?

Hi Erin,

I just used my webcam to take a picture and cropped it myself... the site accepted it no problem. I have a mac so photo editing is easy, but with the right program if you have a PC you may be able to do it too.

oh and for employment you will have to get a blank sheet of paper and identify it with your name case #, form # and the section you needed the extra space for.

Even if I don't know when I worked there?..... I was 16 years old at the time how could I remember (I don't even know the name of some of the places)! Geez. These immigration peeps have the nerve to be asking so many questions huh?

oo i am not sure - i am sure that you need one though...family?
also..fill out all the school info., i left it blank b/c i read somewhere...that we only had to for secondary and i only have h/s so, didnt bother, now i am kicking myself in the pants...does the consulate rfe as well?

I hope not! I am only listing the main jobs I had because I honestly have no idea when I had others. One of my jobs was with a company here in Ottawa, but technically I was working in a war zone in the middle east. I don't know what to put for location... because it's not like I was a resident... just on a Canadian base with a visa that they made us which wasnt real. Well I guess it was but I never applied for it, they just give them to us because our location was secret. I am putting Ottawa... the whole story is confusing and it was on a Canadian base even if it wasnt our land. Or maybe I'll put theater of operations or deployed operations. Ohh I don't know. Why did the Canadian Forces make this even more confusing for me!

I put my schooling all the way to elementary. Figured why not haha.

Are you having troubles with the site? Everytime I try and fill out the passport info, even though it only takes me a minute is says my session has expired and I have to do the entire thing all over again. It keeps doing it at the same step. What a nightmare... why couldn't it just be another print and fill out form huh?

K-1 Fiance(e) Visa Process & ProceduresK-1 While living abroad?
Both my fiance and I were in the middle east when we began filling. He has mail go to his mother's place regularly so we used her address and filled based on that state. He got back only a month ago and it didn't affect the process at all. The only pain however is getting your mail for you needs to be checking it and sending it to you which makes for more postal fees, but it's not too bad. Didn't slow us down.

K-1 Fiance(e) Visa Process & ProceduresPacket 3 Never Received - What next?
All the 'paperwork' everyone mentions is really for packet four. Packet 3 involves little paper. All you need to fill out is two separate forms and a checklist that they provide. The checklist has your name, DOB and case #... it may just be a print out but that's really what you're waiting for. Apparently the forms are changing because what I was asked for is different than all the other members. Most have been asked to fill out the DS-230 and DS-156; 156K, however I was asked to fill out the DS-230 and DS-160. All your packet 3 really is those forms filled out. To do the DS-160 you need to upload your own Visa pic because the form is filled out online. You can fill out DS-230 now and just hold onto it. You only need to fill out part 1. That way when you have it your forms will be filled out and it's just a matter sending it back the same day. Show them how easy it is to send mail :P

K-1 Fiance(e) Visa Process & ProceduresPacket 3 Never Received - What next?
Montreal is slow, it's possible they haven't sent it to you yet and lord knows how long they take to log it into their system for DOS to see. I just got mine yesterday. Technically, there are no official papers in it but you need your MTL case number and if you send the info without them knowing it may cause some chaos. I mean, if they have troubles sending out mail, what on earth will they do when things go backwards!

It sucks, I know but just keep calling DOS about packet 3... it should come any day now.

OOPS! You said Montreal DID send it out... well I have read in the Canadian forum that several times Montreal says they mail it out but it didn't go out yet... mine was mailed from Montreal on July 22 and I received it on the 27. If you have your case number try emailing Montreal... will take a few weeks for a response if any. Otherwise call DOS daily. Sorry :(

K-1 Fiance(e) Visa Process & ProceduresSo confused with this process :(

Hi guys!! My fiance and I are in the process of gathering all the documents and paperwork we need for I-129F but i'm so confused with some of the things that they said we need. First i don't get this criminal record thing, neither me or my fiance have ever been convicted, do we still need a certificate stating that we havnen't been legally prosecuted? Then, do we need a certificate stating that we have never been married before? Oh and another thing, how much really is this petition?? On some pages it says $350 and another says $455. :S
I would really appreciate all the info :))

I think the others who replied forgot to mention IF your fiance has no record you DO NOT need proof of that for the I-129F petition package, only when it comes to the consulate stage. So you don't need it right, only in a couple months.

What helps me was literally doing it only one step and a half at a time. I'd strictly read what I needed now, and what to expect from the next step and been going along fine. Things eventually come together and make sense so you can look further down the road.

He is kinda new on the neighborhood, so I don´t think anybody would really check it regurlarly :(
We got our NOA1 on July, 2nd..it´s been almost a month, regarding the fact that california service center seems to be working faster lately, we presume he will be gone when they send our NOA2... but as suggested I think he will just change his address to his mother´s for now(on uscis website), and then change it back to his actual address when he returns...
Thank you everybody for your help!

Sounds like the best plan then. Good luck!

K-1 Fiance(e) Visa Process & ProceduresHelp!!! Gone for 2 months, NOA2
Does he have a friend or neighbour who can check his mail box regularly? By the time your approved petition is fwd to NVC so on and so on it'll likely be more than two months. You just need someone to hold it safely in case it comes in.

K-1 Fiance(e) Visa Process & ProceduresApplying for 2 Visas at a time?
Did you meet your fiance after you moved to the US on the B-2 Visa? If so you likely do not need to file a K-1... just get married and apply for adjustment of status while you are still in the US. The Visa is to get you there so you can marry, but if you are already there and entered on honest terms then you don't need it as far as I know. IF your relationship was pre-exisiting prior to your Visa then I think you can go ahead with the K-1 Visa while there, but not both at the same time. I am not certain though so look out for a confirmed response.

Can they not just send a new certified record of your birth with an official statement saying why it's in that form? If they know it was lost then, then they know you're birth info obviously. I'd try calling again and make sure you speak with someone in charge... sounds a bit silly doesn't it?
