I have a quick question, i'm reading all these forums and people are saying they have already booked their medical and everything... I'm getting kind of nervous that we are missing something, we got our NOA 1 letter on September 26 and with that we received our case # that starts with EAC. Since then, i've been checking our case status on USCIS, but it always says it can't find it.. My fiance called and asked and they said they were having a problem, it should be fixed by the end of the month (October). But the lady on the phone indicated that everything seemed fine. Are you supposed to wait until you get your NOA 2 to book your medical? Will NOA2 indicate all we need for our medical and interview and then that's it? All these people in the other forum are really confusing me and I don't want to be stressing for nothing if I don't have to. On another note, happy 2 months to ya'll (see my Southern accent? :) ) My hubby is coming up for Christmas, 8 more days until he's here.. I can't wait until all this junk of a mess is over with and we can finally be together.

Hi everyone, I applied for the I-129F, we got our N0A2 and everything, and when I called last week, they indicated that my Packet 3 was sent from Montreal the day before. It's been 1 weeek, and I live about 40 mins away from Montreal, so it should take 2 days TOPS.

I've been trying to find what I need to send back to Montreal. I know there are a few forms, but i'm wondering if I have the right ones, DS-156 (2 copies), DS-156K and DS-230? This is a fiance visa. I'm wondering if I can send everything now to get the process going a little faster?

Any help would be greatly appreciated.

This might be a little complicated, but i'll start from the beginning..

My fiance's grandmother passed away. His mother moved into his Grandmothers place, and he moved in to his mother's house and is renting out his house to his brother.

Now, I received my Packet 3, should I indicate the new address on those forms? All utility bills are at the mothers address.

So confused, called NVC, it's not in their hands anymore, so no help there and MTL Consulate don't answer phone calls... I'm lost and confused..

We don't want to change the address if its going to cause any delays, but don't want to be in trouble if we don't change it.

Yeah you are absolutely right 'thetreble', but in this case, the place where I got my X-Rays done do not have a Radiologist on site. That person comes in a few times a week and writes up all the reports. Probably cost cutting !!

Had my CR-1 interview today at the Montreal consulate and am APPROVED !!!

Here is the experience:

Tuesday, Jan 13, 2009: Left Ottawa around 1:00PM to pick up my medical reports as the office closes at 5:00PM. Got the the Sanagex Medicine du Travail at around 3:30 PM. Picked up my sealed X-Ray and reports and went straight to the hotel (Hyatt).

Wednesday, Jan 14, 2009: After a pretty much sleepless night, left for the consulate at around 7:05 AM. The temperature hovered around -20C with windchills bringing that down to -30C (well it felt like that).

7:15 AM: Got to the consulate and there was just one person waiting in front of me (a nice guy waiting for a IR-1 interview). We complained about the weather and got to know each other while a few more people showed up.

7:30 AM: The security personnel opened the doors and we were welcomed inside. A nice break from the chill outside. Somehow there was no order and I got cleared from security, etc faster than the guy waiting for the IR-1 interview.

7:45 AM: We all were waiting in front of the elevator for the security guard to escort us to the appropriate floor. I took this opportunity to apologize to the IR-1 guy about the fact that I innocently was moved ahead of him. He was 'OK' with that.

8:30 - 9:00 AM: After being moved to the 19th floor, I was asked to show up at Window 9 to deposit my expresspost envelope and medical, etc. The person at the window was asking me random questions about my marriage, with regards to where does my wife work in California, and verification of the spellings on the forms that we had submitted. All went well and I was sent back only to be called again in a few minutes for the fingerprints and sent back again :-)

9:10 AM: Called in in a room ( number 8 if my memory serves me right) where I met a very welcoming officer who asked me to swear and all to tell the truth. We then chatted informally about how me and my wife met; What both of us did for a living (Me - A Project Manager, Her- an electrical engineer); where does she live (San Diego)? Did we meet after our marriage and how and where (Yeah a lot of times in the US & Canada -- I had proof but he never asked for it)? Was I ever stopped at the border (NO); and yeah he also verified my right index finger print. He also asked me about the nature of my job -- a typical project that I have worked on !! (Strange but he was probably verifying if I was a real project manager ... maybe I do not look like one ;-))

9:25 AM: APPROVED ... the passport with the visa will arrive in the mail.

12:45 PM: Back in Ottawa at work .... Tired and sleepy .. but relieved !!

But hey .. a BIG BIG THANK YOU to everyone on this forum. This is just a wealth of information which is invaluable. Do not really know what I would have done without you guys !! YOU ROCK !!

I am flying to LAX today from Ottawa via Toronto with my CR-1 visa. A few questions regarding Port of Entry:

- Would Pearson TO would be my port of entry ?

- Apart from the sealed package and my visa, do I need to take anything else?

- I have a two hours layover in TO before my flight to LAX. Is this time enough to get the immigration cleared (if this happens in TO)?

Any other suggestions welcome too !!

Do I need to apply explicitly for a SSN ?? I thought that if you check off that option in the DS-230 (I think) one would not need to apply for it.

I entered the US on a CR-1 visa on Feb 12,2009 and my POE was the Pearson Airport in Toronto. It has been almost a month now and I haven't received any welcome letter or GC.

Any suggestions on what I should do regarding this ?

Also a bit of background on my entry:

At the Pearson airport, I handed over my documents package and visa to the immigration officer at the booth. He started looking at them and had a look on his face that depicted that he had no clue. I in my head was going "Oooo OOOOOO". He opened my sealed package and then asked someone else for help. After he got some clue he sent me off to the room closeby where some plain rude officers took my fingerprints, etc. I was told to sit down only to be called in a few seconds.

The officer was angry about the fact that the package had been opened. I was calm and told her that one of ur officers at the booth did that. Thereafter I gave em his name and asked to confirm with the same guy.

Anyways the rest of the stuff goes on fine ... no major questions .. no welcome speech .. nada !! My visa was stamped as admitted with CR-1 written by hand between the stamp.

Now I am just confused ... its been a month and I had to come back to ottawa to finish work n all ... My wife in Cali hasn't received anything from anyone !!

Dear VJ'ers !!

It has been two years since I got married to my USC wife. We have had a rocky relationship since a few months after our marriage and I suppose there is no one to blame for this. I am a Canadian citizen married my wife in San Diego. She was working there at the time. My GC process took almost a year just because my paperwork was delayed over and over again mostly coz of incomplete paperwork submitted by my wife. Anyways all's well that ends well. I ultimately got my GC in Feb 09.

I am not going to bore you with my personal problems and the reason for this turbulence in my married life. But now I am working in San Francisco and my wife has a job in LA.

We did file a joint tax return for the year 2008 and I have numerous airline itineraries to prove that I have visited her and vice-a-versa, marriage pics, other vacation pics.

I will file for the removal of my conditional residency 3 months before my GC (Nov 2010). Can you please help me in determining all that I need if I file by myself?

Dear VJ'ers,

Need your help about a very stressful and tricky situation that I am facing at the moment. I am not sure if I have posted this in the correct section, but mods please feel free to move this if you seem necessary.

I am a Canadian citizen and got married to my wife (a USC) in Dec 2007 and registered our marriage in San Diego, California in Feb 2008 where she was working at that time. As I was completing my MBA during 2008 and our immigration process took longer than expected and I received my GC in Feb 2009.

All this time, we tried our best to maintain a long distance relationship by meeting in person every few months by taking vacations, etc. (I have numerous flight itineraries and pictures to prove the same) In November 2009, my wife was laid off from work and moved with her parents in L.A. And due to the bad economy etc, I did not move to San Francisco, CA until Oct 2009 though I had been interviewing for jobs in LA and San Diego earlier. At that time my wife had a job in Los Angeles, CA and I urged/tried to convince her to move to SF which was not was not taken well.

In the March of 2010, my wife filed for an Annulment of our marriage based on 'Fraud' citing that I married her only to get a GC and did not intend to live with her; which is totally false. I tried my best to reconcile with her and us working even harder on making our marriage work. The economic factors and not the lack of emotions or commitment to make our relationship work, was which that jeopardized our marriage.

In my opinion, the only reason that she is filing for an Annulment is to get a clean chit :(

I have consulted with a family law attorney who has given me mixed reactions to my case. I am very concerned about the same and would like any feedback that you may have.

Append the current application with your decree and whatever else is asked in the RFE. Also write a request to adjudicate your application as a good faith waiver. What your lawyer says is not wrong, its just different way of thinking. I have seen both ways successful.


Umm I did file a good faith waiver from the beginning. My lawyer is asking me to do this all over again just due to the fact that my divorce decree is dated June, whereas we filed the waiver expecting that it would be granted with a Feb date.

I had submitted by removal of conditions application in Feb (a day before my conditional GC expired) and my divorce wasn't final at that time. A few weeks ago I got my RFE and now I have my divorce decree in hand which is dated Jun 06, 2011. This was the day the judge signed it though the decision was made in Feb, which happened due to the error in the application earlier.

Now my attorney is advising me to file the I-751 all over again as earlier we have checked off that the marriage ended due to dissolution or nullity. Should I refile everything or is my immigration attorney just trying to make money off me?

Any advice from your end would be much appreciated. Thanks!!

Removing Conditions on Residency General DiscussionI751 waiver approved ... but .. an error
Friends,

My I751 waiver application was approved after an interview (a very unique one which I will share). The approval letter came today in mail 2 days after the interview. Very glad to have received it but somehow my last name was spelled incorrectly on the mailing label (its missing a letter).

So should I contact USCIS about this issue or should I wait for the actual GC to see if everything is correct? This maybe a minor typo as my application, etc had the correct last name.

Please advise!!

PS: I am very happy nonetheless

Hello Guys,

I entered the US on a CR-1 visa and my POE was Pearson, Toronto. I stayed in the US for a weekend and then came back to Canada for work. Need to wrap up some commitments at work. It has been almost a month from my date of entry and have not received anything yet.

What is the usual timeline to receive a GC?

Also, as I checked the box to send my info to the SSN guys so that I do not have to apply separately for a SSN card. Whats the timeline to get that ?

Is there a place online where I can check the progress?

Like the others have said, there's tons of info on this same topic in VJ.

I was denied entry once and then after for 15 times crossing I had to have strong ties to Canada and got pulled in every single time to prove it. It was such a hassle, but on my 15ht time I got through with a breeze and was totally shocked. There after when I crossed I never told them anything unless they asked. Especially taht I was going to see my then "boyfriend".
Never had a problem and soon next month I won't have to worry about his ever again..yay!!

CanadaCan I travel to the US during the process?
My husband and I just started our application process and sent in the I-130 form on January 4, 2011. I would like to travel to the US while the process is taking place. Is this possible or will I be turned down? Has anyone else done this? Will the application be deemed abandoned if I cross the border into the US? By the way, I am from Canada.

Any thoughts would be appreciated.

I have my interview on September 6th at 8am and I was looking at a hotel to stay at for the night before. From what I read, the hotel across the street had bedbug problems last year and have had a few credit card issues just recently. I'm looking for something that won't cost me too much and where I can keep my luggage until after the interview as it seems that I cannot bring anything but papers with me to the interview. Would anyone have any ideas or recommendations. Thanks for your help.

We just got the notice that our visa petition was approved (NOA2). Oh joy! Oh bliss! What an amazing day that was (Monday).

Now were looking at what happens next. I was wondering if there are any Canadians who have gotten their interview date in Montreal who can tell me what to expect next. Is the application going to go to New Hampshire or Montreal? and of course how much time it took between getting the NOA2 and the DS-3032? One step at a time.

I am so looking forward to the day that I am actually crossing the border and that they stamp my passport. I hope it's not much longer (crossing my fingers).

In case you're reading this post I wanted to let you know some new information. In the day that I actually immigrated, which was a week later, the officer processing my papers asked me if I was actually immigrating that day. I said yes. She said that the reason she was asking is that she read that I tried to process my papers a week earlier. I told her that I was previously told that I can process the papers prior to actually moving. She said that this was in fact true. That I should have been able to process the papers a week earlier. So I guess the officer that I got that day just didn't feel like doing it.

Anyway, I just wanted to let you know that the information was confirmed, that you can in fact process your papers before you actually move, in case you were wondering. Just keep in mind that some of the officers are whimsical and may choose not to do it.

Hi All,

Just wanted to let you all know what happened when I went to the POE yesterday.

First of all, 2 months ago, I crossed the border to do some shopping with my sister and mother. I asked the CBP officer at the time if it would be alright when I got my visa to cross to get my stamp and then return to Canada the same day and then finally go to the States a few days later. He said it was alright and that in fact a lot of people do it and as long as I move to the States within a year there is no problem. The reason I told him that I wanted to do it was to have my family with me so that we could celebrate together because if I do it at the airport I am alone.

So with that in mind, I went to the Ogdensburg POE yesterday (Sunday) - the same POE by the way. When we (my father, mother, brother, sister and I) pulled up to the border in our van, we told the officer that we were going for lunch and shopping and at the same time I wanted to process my entry into the states. Immediately, he said we don't normally do it but there was another officer and she said that she would do it. So we parked the car and walked in. It was 11:40am.

Our passports were passed on to another officer who asked us why we were going to the states. She told me that they don't normally process a person for immigration until they are actually immigrating. She asked us to sit and about 10 minutes later, she asked me where I work. I gave her the information and told her that my last day would be Thursday and I sat back down again.

40 minutes later she gave us back our passports and told me that she wasn't going to process my immigration because they don't normally do that until the person is actually moving and that she doesn't know who told me that I could but they were wrong. And then she snidely said that immigrating to the States is a privilege. She also said there was no proof that I was actually immigrating even though I provided her with my airline ticket. I wasn't going to argue with her because I didn't want to cause myself any problems when I actually leave this coming Saturday. So I said thank you and walked away. I was so upset and angry and tried very hard not to let this ruin the afternoon with my family.

Anyway, I thought I would share this information in case it helps anyone else.
