I got a different answer in regards to paying back my RRSP homebuyers loan when selling my home. I was told I did NOT have to pay it all back right away and can you the 15 years or so allotted... provided I make my minimum payment every year. ... hmmm, me thinks I should check again! :(

Casual, comfy and clean  ... and CR1s do not pay extra $ :D

Don't sweat it... someone said it was like going to the bank... pretty much is just like that!

John and I opened our first joint account last week and the woman made me sign a form that said I was a "foreign alien non-resident"!!! :o I was so ticked off!!! That is so wrong! She refused to accept my temporary SSN even though the forms said I could. So now I have to go back to the bank when I get my real SSN... I preferred my interview at the Montreal Consulate! how freaky is that!!!

CanadaNew here and full of questions...
in my humble opinion... ;) and it IS VERY humble, if you apply for a K3 you need to get married first... but he STILL would not be able to find work in the US right away. :(

If you apply for a CR1, it takes longer but he can travel back and forth during the process and once he moves, he will be able to work. :)

There are pros and cons for each type of visa. I would suggest you sit down and make a pro/con list for each visa -- using the guides on this site of course -- and then decide form there.

Good luck!!! (F) (F)

CanadaNew here and full of questions...

if your fiance is self employed and a fiancee in the US, this could make travelling back and forth even more difficult for him.

If you decided to apply for some sort of visa for him and you get married, technically he must move permanently to the US. If he does the back and forth thing, it may work for a short while, but eventually US immigration will just cancel the visa because they'll see he has no intent to move permanently.

You'll have to decide if he'll move to the US permanently, or if you'll move to Canada. You can't really live in both countries unless you both get dual citizenship, which can take several years and requires permanent residency first.

I disagree. There are many people who live in one country and go back and forth to work. I am doing that.. until next week... Immigration officers have told me this is common because I have asked many times.

I cross over every week... first my permanent address was in Canada and I worked there, now my permanent address is in the US but I still work in Canada with a condo. No problem.

I do not know about travelling back and forth on a fiance visa, but if he can prove he has a home (lease, mortgage...) to go back to, then there should not be problems.

Good luck!!!

CanadaResident of the US but working in Canada...
Brunette,

I don't know which border crossing you went to but it sounds so wrong! :o Then again, the officers have all the power when we go across. I have encountered at least 8-10 and they all know I am finishing my contract in Canada but resident in the US. Even as I activated my visa we joked about my going back to finish working. At my crossing it is common I guess.

As for using the term activate: Some officers (not many) think they are the smartest thing since sliced bread  and others surely cannot be informed like we are -- that would mean we are intelligent, duh, gosh, golly! :P

Good luck... only a few days left!!!

I am in the same predicament. March 31st is my last day of work in Ottawa but I have been a US resident since February 10th. It will not affect EI from what I was told as you are still paying into the Canadian EI system. All I can say is MAN, will I ever mis my salary!!!

CanadaWorking for a Canadian company while waiting for EAD in USA ?
Once you have your K1 visa activated and you have gone down I don't think you will be able to work in Canada as you will need Advance Parole to leave the U.S.

Until your K1 is activated, you can continue to work in Canada. One note... a friend who had been at the same company for 13 years decided to give 2 months notice -- manager, 17 employees... blah blah blah... they escorted her out of the building that day, gave her 2 weeks pay in lieu of her notice. She had to take them to court -- won a nice severance pay which I think was 1 week pay per year of employment... of course her lawyer got most of it!

Just be careful and be prepared... there is no employer/employee loyalty anymore... I have also been asked to leave immediately when giving notice --- wasn't worth my time or $$ to fight but it sure hurt as I had made alot of friends and we were not able to properly part. I had NO CLUE that would happen!!! It is not always like this but just be prepared!!

Good luck!

You should have no problems. They seem to know the K-1 and K-3 visas but not the CR-1 and the IR-1. They tried to tell me I could only cross on a K-type visa.

This my my rant for the day...

I couldn't believe it! 3.5 years and I have never had trouble entering the U.S... pretty much every week too! This past week I drove back in and showed my passport with my CR1 visa stamped showing that I was a legal resident of the United States. The two officers at the gate said it was not valid because there was no I-94 attached. I politely told them I do not need an I -94 and that the CR1 visa is an I-551 and it says that "upon endorsement serves at temporary I-551 evidencing permanent residence for 1 yeaer" It was endorsed on Feb. 10... They STILL did not believe me!!!

I went inside and the officer there was trying to explain that 2 departments are amalgamating and they are still learning, blah blah blah... o.k... it wasn't a HUGE deal but it was still almost half an hour waiting for absolutely nothing!!!

O.k... rant done... I feel better now!!! Thanks for reading!!

I have made my husband promise to bring me to Canada for groceries every month or two... Flour... that is the biggest thing because I make my own bread. The other thing is brown sugar is a little different and I have yet to figure out how to change my dessert recipes to adapt. So, I bring down 10kg bags of flour and brown sugar among other things! I've also stocked up on Timmy's coffee, peanut butter...

Oh, how about Gravol? My husband has never heard of it but we use it alot (was part of his Christmas stocking the last couple of years!!!)

My I-129F was received in Chicago on February 26th. I haven’t received an NOA1 yet nor has the check been cashed. I received an NOA1 for my I-130 so quickly!

K-3 Spouse Visa Process & ProceduresIs the K-3 right for me?

My husband moved here in August 2004, funnilyl enough from Texas and we were married in September 2004. However, we were in the process of the canadian sponsorship process and underwent some difficulties and seperated in December 2005 when he returned to Texas. We reunited in July 2006 and started the canadian residency process all over again.

What form is used for the K3 is it the I129F?

Yep!

I too am a Canadian married to an American. My husband has lived in Ccanada since he was 10. He has dual citizenship. He recently accepted a position in Texas and has left. I also have a son from a previous marriage. We filed an I-130 for myself and my son and a K3. My son was included on the K3.

How long have you been married and how long has your husband lived in Canada?

K-3 Spouse Visa Process & ProceduresEntering the US while case is pending

Hello everyone! :)

I'm new to all of this. I'm a Canadian citizen and have been married to an American citizen for over a year. We haven't applied for my visa as yet as we're just trying to do research first to figure out how we go about filing everything while I'm in Canada.
I'm just curious/confused...Is everyone saying that they have been travelling back and forth while waiting for their K-3 visa's to go through? I was under the impression that you couldn't leave the country until the K-3 visa was approved. Am I mistaken? (I'm sorry maybe it's something else you're talking about, and I'm coming up with my own ideas. Like I said though I'm new to all of this, so please be patient with me.) :)

**I too would like to go visit my husband for the long weekend and I'm wondering if any of you know what happens if you're denied entry even before you start applying for the visa? Does that ruin your chances of having it approved? How does it affect your application?

Thanks in advance everyone for you patience and advice!
Canadian_Butterfly :)

By the way, I agree with having as much information to prove that you're coming back and that you're only going for a visit. Good luck with getting across and enjoy your time with your husband! :)

I have been denied twice. They felt I didn't have enough ties to Canada.

Come Interview time, I am not worried about it. I was honest at the Border and I will be honest at the Interview.

It does still make me a little mad. As a tourist I never had a problem travelling- now that I am married and going through the Legal process of Immigration, I get denied entry. Sigh.

You were denied twice? That's terrible! What didn't you have to convince them that you might not return?

I did get a letter from my employer today, we have round tickets, I'll bring my most current mortgage statement from the bank ... *sigh* ...

My fear is ... I'll get nervous ... like I'm doing something wrong!
