How were your letters of how you met? because I read its enough to write a few sentences not a whole story of how you met. I'm a little nervous because I plan on moving to the States the latest in May so that my daughter will get to know the new city and all that and can start school in August and so far I didnt send any files in


Yes, you must send the payment with the rest of the petition packet. Many people only write a few sentences but we did a page since I already had one written from when we applied for my Irish visa.

You can pay with a cashiers cheque and all petitions are now to be sent to Dallas for initial processing (they will then be forwarded to either Vermont or California).

Passport stamps serve as a good form of primary evidence. If you have other forms of evidence like hotel receipts or bank transactions showing account activity in your fiance's city then these will be helpful as well. Good Luck!

Anything that requires a signature needs to be copied AND THEN SIGNED (so you have multiple copies but all have original signatures.)

For the packet send copies and for the interview you can bring the originals (though they probably won't even request it, it's nice to have just in case.) Sending originals isn't recommended because in the event that it gets lost in the post or in the USCIS then you'll be stuck.

did any of my friend pay a premium fee? they said by oct 28 we should hear something.. we did not use an atty as I only received an advisement from one. (submitted I129f 05-26-10 NOA1 05-28-10 (no NOA2).

Premium fee? Who said by Oct 28th you should hear something? Unfortunately until you've gone out of normal processing time nothing can be done (and lawyers will not speed up the process). Just give it some time, I'm sure you'll hear something soon. :yes:

General processing time falls within a five month span, it could take less five months and it could also take more, really there's no way to be certain.

The updates are what VJ refers to as 'touches.' All petitions have their own bar-code and each time your petition is moved that bar-code gets scanned which registers as an update. Some people will get many of these during their Initial Review, where as others won't get any. Your petition will remain in Initial Review until it has been approved and you receive your 2nd Notice of Action.

yes, they received it yesterday and on the case status it says that they will notify us by mail when they make a decision or if they need something...
So I don't know, my fiance says I worry too much about it. I've' thought of calling USCIS and ask about this form. I don't know if we can just send it to them if they didn't ask for it.


Okay well then you'll will just have to sit tight and wait and see if you get another RFE (if you send it ahead without another RFE letter it will likely never get paired up with your petition). In the mean time it might be helpful to list here everything that you did include in your packet so we can let you know if there's anything else important you may have missed.

Hmmm...that's pretty odd that they would notice the need for more evidence but not the missing forms. I'd suggest filling them out, attaching the passport photos, and signing them so that you have them ready to go.

This is absolutely not correct. YES he will be required to show he meets the guidelines for income before the visa is issued and AGAIN for the AOS. As an artist he will be considered "self employed"

His income tax returns will be one form of verificatin, his bank deposits will be another. If he does not meet the guidelines he will need a co-sponsor for both the visa and the AOS


The way the question was worded implied that that the person in reference was the beneficiary:

"My fiance is an artist and musician. Will it be required that he show some sort of financial ability to live in usa? If so, what does that entail?"

In other words I took it as 'does the beneficiary have to prove that he will have what it takes to get a job in once he's in the US.'

Now when the next poster assumed the opposite I asked the poster for clarification. Regardless though, the USC or their co-sponsor must meet the income requirements. So correct me if I'm wrong, but aren't we saying the same thing but with different words?

Don't forget any evidence on phone calls. If you can get a log of phone calls, or internet calls, that can help on your 129F package. If the officer sees lots of phone calls to the same place, he'll get that you are in love.

S & M, evidence of a bonafide relationship isn't really necessary at the petition stage unless you're dealing with a difficult consulate. You can check with your regional forum to see if front loading your petition is recommended for your consulate; for Tokyo I don't believe it is. :)

For the I-129f only the US citizen needs to send their birth certificate. When you reach the embassy stage you'll need a translated version of your birth certificate. And yes the petition fee is still $455 :)

I've been looking up DCF alright, I don't know much about it really. He has been living here for 23 years. He's a dual citizen. I've heard DCF is easier and it's certainly quicker, so not sure what to do at all. any advice would be great. what stage are ye at with visa's?


We're (fiance and I) are in Cavan at the moment. I can't tell you much about the direct filing since we decided to go the K-1 route so we could have the civil ceremony in the US (and then the big wedding later in Ireland. Slangofoil can fill you in on it more, I believe she's done more research on it.

If you look down at the blue writing in my signature that's our timeline. This will tell you how far along people are in the process. We for instance are still in the initial review stage.

I am engaged to a US citizen and we were finding it hard to find a sponsor for the affidavit of support. We needed one because my US citizen fiance is living in Ireland and we plan to move to US together, so he couldn't sign for me.

Now I'm wondering if the person who agreed to sponsor us needs to file the affidavit for both of us or just me?

Also, would there be any complications about applying for K-1 visa seeing as my fiance is living with me in Ireland and not in US? can he still file to bring me over with him?

Only the non-USC needs a sponsor. And we're also both living in Ireland and applying for my fiance's visa from here without any difficulties. :)

Applying for the spousal visa, after you marry in April 2011, will not be enough time if you want him back in the US by September. Bank on 8 - 10 months for this process. Your best bet is to file the petition for a K-1 now. It will take a few months to process and when he applies and is accepted, he has 6 months to use the visa (in case it is approved BEFORE he is ready to leave)

Student fees and tuition for non-residents is VERY expensive, it will be beneficial for him to start school as a resident. Also, to obtain an F-1 student visa, he'll have to show that he intends to return to the UK after his visa expires. This may be difficult to do because, obviously, he doesn't intend on doing that.

My advice, follow the guides for a K-1 visa

Well with a K-1 he wouldn't be able to leave after the wedding until he had adjusted status. If he'd be leaving right away then I believe he could get married in the US while on a tourist visa and then you could apply for a spousal visa but I doubt it would be done by September. If he can get a student visa then that may be best and then you can just marry while he's there on that.

You can write the dates on the backs if you know them but pictures are only secondary evidence so it's more important that you have solid primary evidence.

If you look through the forum you'll see a big thread on this topic. You are allowed to visit but whether or not you're let in at point of entry is entirely up to the officer that day. You'll need to bring evidence to show that you have strong ties to Ireland (things that will prove you will return) like a letter from your employer, an ongoing lease, etc.

hey all. my fiance an me are starting the proccess in the new year and we have quite a few questions.

the main one is we are having a baby in the first week of november. will this work against or for us? and is it possible to use the babys birth cirtificate as part of our evidence of a bonafide relationship?

It couldn't hurt, but ours is and easy consulate so they probably won't even ask for it.

also we are very young. me being 19 and she being 18. im sure this probably will work against us but is there any way we can help this?

You're both legally of age to marry and you're close in age so this shouldn't be an issue.

we have lots of info about us, ive been to visit her 4 times now for a total of 3 months and more than likely 5 or 6 times by the time we have applied so theres gona be plenty of plane tickets. we have pictures and internet conversations and months of phone records, not even mentioning the piles of letters lol. how much do wee need to send and is there anything in particular they want to see?.

For the initial petition you just need proof that you've seen each other within the last two years so e-mails and phone records aren't necessary.

she would not be eligibly to sponcor me so her parents are co sponcoring me. is this an issue? also what information is required without going overboard, her parents arent too keen on sharing private information but are willing to help.

No this shouldn't be an issue, it's what most people here are doing. They will have to things like tax returns and such so private info is going to be seen.

and last but not least. does anyone have a rough cost from start to finish of the whole visa? seen as ill be the only one working as she will be looking after the baby so id like to know how much we need before we start. if it makes any difference im from Ireland and she is from ohio. sorry if the questions are a bit obvious but were afraid we might not be takin seriously because of our age or the fact were having a baby.

From Petition to A0S it's roughly going to be $2000 (app fee, medical fee, embassy fee, aos fee, mailing fees, printing fees, etc.

After reading that it is a good idea to frontload the petition package, I plan to do so. I wrote a supplement to the "How we Met" question, listing all visits, and then I was going to send one picture of each visit.

I was planning to cut and paste the digital photos into a Word document and type the name, date, location on each page, and print it out on my color printer. So, all the photos will be printed in color but not on photo paper. Is this ok, or do they want original "photo photos"? We will take those to the interview of course, but is there any reason why color copies on regular old printer paper shouldn't work for now?

ALSO: When sending in other documentation like phone bills and e-mails...do I need to label them on a separate piece of paper for organization purposes?


Printing them on normal printer paper is totally fine :thumbs:

Organise and label everything to the best of your ability so that the person going over your file will know exactly what is what.

No, your fiancee is going to need to sign other various things even if you don't include the cover letter. I would suggest; when you're done preparing the packet mail it to her first and have her to her bits and then she can mail it off to USCIS.

It's not going to be that big of a thing. They'll probably just RFE you for it which shouldn't hold you up more than a few weeks (many times after they receive your RFE response it's approved within a week). Just have it printed out and signed so you have it ready to send off. :thumbs:

The copies are mainly for if somehow the interviewer is missing parts of you packet, then you'd have the copies that you could pull out and give to them if you needed to. They probably won't ask for them but most people bring them as a precaution.
