Hi All,
This is my first post, cuz we've had no hiccups till now.  My Russian fiancee has her interview appointment scheduled in Moscow for December 4 and I'll be there with her.  Everything's in place except the police certificates.  Her Russian certificate is on order and should arrive next week.  When she was younger (but over age 16) her family lived for seven years in what is now Latvia (1975-1982) and so we figure she needs a Latvian police certificate.  She lives out in Kaliningrad oblast and so she went to the Latvian Chancery there yesterday to order it.  She tells me that they tell her that because her Latvian residence was so long ago, her records are no longer in their database and would need to be special ordered out of the archives, taking 1-3 months.  Further, since those records would be under her maiden name (she subsequently married and divorced and now has her ex-husband's family name), a certificate of name change would need to first be obrtained from a "registry office", but that this office no longer exists so we're basically SOL.  Some of this may be translation difficulties between fiancee and I, and this all seems implausible.  But I thought I would see if anyone in the community has experience or suggestions before I start firing off emails to the Latvian Chancery in Kaliningrad or their main offices in Riga.  Might her Russian police certificate cover all of the time that she was living in what was then the Soviet Union, even if subsequently her place of residence for a portiion of that time became a different country?  Thanks all, Jay

I have completed my I-134 and received the letter from my employer today and my income does not match. The letter rec'd from my employer only has my base salary. I asked them to write another letter with my salary to include the guaranteed overtime and bonuses (of which I've already been paid) on it and they said no. There is a HUGE discrepancy between what they said I make and what I actually make. Even with said discrepancy, I am well above the 125% poverty, but I'm concerned with the numbers being all over the place. I have check stubs as well as my tax transcripts that reflect my correct annual salary. Will this be any kind of issue? 

As long as base salary is over 125% you are fine.  It is normal for an employee to have a base salary that does not include bonuses, overtime or time lost due to sickness or absence etc.

Hi, I realize this question has been addressed elsewhere, but we have a question about a nuance I haven't been able to find answered. 
 
The beneficiary is currently visiting me from France. We are filing the Petition I-129f. Part 2, question 15 asks if the person is currently in the USA. The answer is yes, so we need to fill out the information. However, we don't know what to put for "I-94 arrival/departure record number" as is requested for question 15.b. Moreover, we don't know what to put for "Travel Document Number" as is requested by question 15.f (the passport number is requested in 15.e, so it is odd if the form asks the same question twice in a row).
 
She entered the USA as normal tourist/visitor, she doesn't have a special Visa number or documentation. What should we put for those specific questions (15.b and 15.f)? Any help will be appreciated.

Did she enter under VWP? If so maybe you' should write N/A under I-94 as they are not given to tourists on vwp.

Hello all - I can't find the answer to this in the guides.  I am looking at the Packet 3 checklist I have to sign, and it says to make sure I have "Police certificates from each country in which the applicant has resided for one year or longer".  What is that?  Do I have to get something from the police, and if so, what?  I have no arrest record or criminal convictions, does that apply to everyone, and if so, what is it, what do I ask the cops for when I go to get it, is it just a criminal record check?

At the present moment I´m 30 years, when I was 21 I went to study to India, and I lived there for about 6 and a half years.

Indian Police Clearance Certificates should be obtained as follows:

All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office.
Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.
Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.
Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

I used the search function, but couldn't find the reply to my question anywhere, so I'll try it this way.
 
I am filing for the K1 Visa and am filling out the G-325A for myself.
 
My parents were both born in Poland and both their first names and their birthplace use special characters.
Do I put the right symbols in (for example: ?ód? instead of Lodz) or does it not matter?
I know there is a space to put non-roman letters in if MY name has different letters (luckily that is not the case), but there is no such space for my parents' names.

Hi i typed the form on the computer without polish characters but then added those characters by pen (couldn't be bothered to change settings on my laptop to enable polish keyboard settings etc).

If you have an option to type it then I'd do that or just add it by pen too.

My American fiance has been living with me in Australia for almost 2 years. We have decided that we want to permanently move to America - she's from Minnesota. 
 
We've just started looking through the documents for the fiance visa and have some questions I'm hoping someone can help with:
 
1. Can we apply for the visa while she's living in Australia, or does she need to travel back to the States?
2. We've noticed there is a section where she needs to provide proof of financial support. She's currently working fulltime in Australia, but does anyone know how this works for the visa? Does she need to be working in the States to satisfy this section?

My fiancée sent me the affidavit of support with a tax return from 2012 and W2s all from 2012. Is this going to be ok?


London is quite easy on evidence. They only took faxed copy of employer letter in my case out of all tax returns,w2s etc. For peace of mind though I'd get w2 's from 2013 and some paystubs/letter of employer to prove current income rather than 2012 income, I think thats what they are more interested in.

I literally put "We met in xxxx, UK in 20xx. We have been dating since and our relationship is progressing really well. We travelled together to Paris on mm/dd/yyyy. " We didn't even mention falling in love (not their business) or engagement as in fact we didn't get engaged until a month after sending the paperwork :-)
We attached 2 photos of us (1 in front of eiffel tower) and a print out of an email confirmation of our tickets to Paris so in theory i only had secondary evidence. No RFE.

Of course thats me, put as much evidence as you want but just to prove you have been physically meeting in the last 2 years, you may have a chance proving your 7year relationship on your interview but for example in London they NEVER ask for any relationship proofs, just ask few standard questions :-)

Hey you guys, 
 
It's me again. As stated in my previous message, we are currently in our initial application process for the K-1. 
To document our entire 7 year relationship, we have accumulated a lot of photos, emails, postcards, facebook messages, skype records, copies of flight records, receipts, movie tickets, train tickets, etc. 
It's all so much, in fact, that we've just had to upgrade our application to a 5" binder in order to fit everything. 
 
A few months ago, we were able to briefly talk to an immigration attorney for free (we can't really afford one, though) and she kept mentioning to put in "everything but the kitchen sink". On the other hand, it's the records of our Skype conversations, which have taken up the bulk of the binder. We could fill several books with them if we wanted to, since, for the most part of our relationship, we used to talk on Skype every day for several hours. 
We have included about one Skype call/chat a day, but it's still so much. 
 
My question is: How does USCIS look at these kinds of things? Is there such a thing as too much evidence? 
Is there a way to lessen the load without the person reviewing this to think "Why did they only Skype once a month?"

Do you expect any issues with your petition, do you have any red flags? If not save yourself a lot of hassle and postage money. Front-loading is required/recommended in high fraud and countries with worse economic situation which Germany is far from that.
Normally you only need to write down a simple statement when filling I-129f about how you met in the last 2 years and support it with evidence like boarding passes, copies of all passport pages showing entry stamps, few pictures.
A lot of vj users statement is short enough that it fits in the space provided on the form and go smoothly through the process.

Hi everyone,
I have a few questions regarding my fiance's and my own G-325A form.
As far as the information regarding my fiance's father/mother, he was raised by a single mother.  Although we know who his biological father is, he was never in the picture.  Do we have to include him on this document or can we just list his mother?  On top of that, we know that his biological father lived in the States for a while but we are unsure if he was there legally or not and we do not want any ties to any immigration issues he might be a part of (especially since he has never been a part of my fiance's life and it seems crazy that we would have to link ourselves to him.)
 
As for me, I have been spending extended periods of time in Nicaragua with Yamir over the past year.  I have gone in and out, always getting using a tourist visa as I have no intention of living here long term.  When my G-325 asks for my residences... are these "legal" residences? As in where I am a legal resident (Illinois?) Would I include "long term stays" in NIcaragua, or my college years in Indiana? When I studied abroad in Chile for a year? Or would it only be where I was legally residing (so technically always Illinois?)

If his father is listed on birth certificate then i'd add him on g-325a. (He'll need his birth certificate for interview).

With regards to the addresses i'd only put my residential addresses so did not include extended vacation but would put college and other studies.

If the person looking into your case has some common sense (i.e you live 50min apart) then you should be ok without RFE. There is no declaration of meeting in person.  Its just one or two sentences to answer that question on the form.
 
I would suggest to NOT make a list of all your meetings.  USCIS only cares about one meeting; you do not get extra credit for additional meetings.
 
The problem in listing tons of meetings is that you confuse them and your evidence supporting the meetings is not adequate.
 
List one meeting, especially the one that you have solid evidence of that meeting.  Save the multiple listings for the interview.







Totally agree. Just state when you met first and that you've been maintaining ongoing relationship since and you met in (Place) on (Date) recently- supported by evidence.

Hi folks,

Can I first say how much of a relief it is to have found such a site and community! I have learnt so much and had my mind put at ease with regards to many issues (mostly being able to travel to the US while the whole K-1 process is underway -- we all know how unclear or ambiguous already these matters can appear).

My enquiry related to the declaration we're expected to include in our I-129F packages. I have attempted to find examples of such a declaration, basically just for a template of how to go about composing the declaration. Should it be to-the-point and approached from a 'timeline' basis, keeping unnecessary detail to a minimum, or should it read as more of a journal? I don't really know how best to approach this.

Apologies if this has been covered elsewhere, but I haven't been able to find anything on it using my -- albeit limited -- searching skills.

Any help and advise would be absolutely marvelous.

Do you mean the answer to the question on how you met within last 2 years?
Some use timeline, this is especially recommended if know each other for longer than couple of years, just highlighting dates and places of all the trips.
Some just put couple of sentences like... We first met in London in July 2011 and have been dating since. We last met in in New York in January 2014.
Some provide a 1-2 page love story.
What's most important is to support whatever you write with a solid proof of actually meeting in last 2 years.

Police certificates (Certificación de Antecedentes Penales, in Spanish) are available free of charge to Venezuelans and non-Venezuelans over the age of 18 who are physically present in Venezuela and have either a national identity card (cédula de identidad, in Spanish) or passport. Applicants must apply in person at the División de Antecedentes Penales del Ministerio de Interior y Justicia, Edificio Paris, piso 5, La Candelaria, Caracas, Venezuela. Venezuelans residing outside of Venezuela can obtain their police certificate by having a close relative resident in Venezuela submit a request (this option is not available to non-Venezuelans).

Alternatively, the any applicant may obtain a police certificate online. Consult the following web site http://www.mpprij.gob.ve/ and select the option "certificaciones para trámites intercionales".

I was denied tourist visa prior to applying for K1, it wasn't an issue.

K-1 Fiance(e) Visa Process & ProceduresEntering Atlanta POE on a K1
I went through Atlanta, with ma US fiance. We went through citizen line (long line but not as long as tourist) but after checking my husband and taking my biometrics we were sent over to the "Tripod" area. The paperwork was handed to the officer and we were waiting for about 20 min before being seen. I was them told we have 90 days to get married and that was it.
