Yes, I sent a Letter of Intent from myself and she sent one for herself, both signed and dated. Maybe they just got lost in the shuffle.

Good day to everyone long time follower first time poster on the process. We filed for our K-1 back on August 3rd for the Vermont Service Center and just now got our RFE notice stating the lacking evidence is the Fiancee Letter of Intent. But that was sent off signed and dated by my Fiancee using a common format found here such as "I "insert name" do hereby state that I am willing and legally able to marry "insert name here" and am planning to do so before 90 days upon my arrival in the US on the K-1 Visa"

We get the notice from them they spelled my Fiancee's name wrong all over this notice, and i just get a general sense of incompetence. But I'm not sure where to go from here, we had one in the packet, signed by her. Do we send that again? What if they didnt like it for whatever reason and want something different? I feel like I'm lacking specifics is there anyway to even get the person working my case on the phone to find out specifically "this was in the packet did you see here on this tab is this not good enough?" I'm a man of details and their lack of it really frustrates me, this is where my tax dollars go?

Its worth mentioning when i did a service request they put my Fiancee's name at the top at my US address and said because we were neither the Petitioner or the Applicant that they cant give us any information. So i call them again and told them that how can I call on the phone give them the proper information identify myself at petitioner and get a letter saying I'm not the petitioner on the address for our application? I sent a follow up email expressing my discontent with the lack of overall attention to detail and just general ####### job they did.

But rounding back to my issue should i take a chance and resend what we sent before? If that wasnt good enough will they flat out deny me? Do i sent something different? Granted I may of forgotten to put it in the packet i sent off but that seems highly unlikely due to the fact i went page by page over her copy. their copy and my copy.

Magic! Thanks for your quick response! I actually just did a bit more digging and found most of this out. But I guess there's no silly questions here. :)
So my Fiancé' has only been in work for 6 months, and before that was unemployed/a student for a couple of years. Her Dad will be sponsoring me, but do they both still have to fill out the form.

Hi guys, this is my first post!
Myself and Adrienne received out NOA1 on July 27th so I'm hoping we are just weeks away from a decision. I'm in the process of getting together everything needed for the Interview, birth cert', police record etc. I'm wondering though if I will need the I864 because I've read some conflicting posts on here.
I've been on the London US embassy site and came across this:
What about the fiancé(e) of a U.S. citizen who is applying for a fiancé(e) visa?

An I-864 is not required when applying for a fiancé(e) visa. An I-864 will be required at the time the fiancé(e) visa holder applies to adjust his or her status from nonimmigrant to conditional resident with the United States Citizenship and Immigration Services(USCIS).

Is this correct or has anyone been caught out at the interview for not having one?
Any info would be great :)

You can get married in Russia and apply for the i-130 and i129f concurrently. Whichever the NVC process first, you will use that to your advantage. you can bring your spouse here as your spouse, or bring her her as your spouse and await for the interview here. you can also bring her as your fiancee and then marry her here in the U.S. You can definetely use your parents as your sponsor. I was under the same dillema with my wife. What I did was, I went to Brazil and spent the whole time for the immigration process i-130 at the USCIS to be approved. That took 7 months. As the USCIS approved the i-130 form, it sent to the NVC for further process as it takes more time to process immigrant visas. If you have the time to wait or if you just want her to be here, you can go there and marry her or just wait for the USCIS to process the i-129f as it probably is going to take around 4 to 5 months to be processed. Good luck on your endeavour.

I have a question for the very first document to send, they ask the address where the wife intend to leave (in the us). As we are both now in french and don't have any address in the us, should we just put the town your goind to move to and leave a note saying we are not currently leaving in the us?


We are going to be living with my parents until we have jobs to pay for our own apartment so I listed their address. You're going to need some sort of plan with an address attached to it so start considering this now.

The requirements for the I-129F do not require that you are in the US at the time of filing, however, you may find it to be easier if you have a US mailing address, as the process can take some time.


I gave the USCIS option of either posting to my overseas address or using my Parent's address in the US if it would be more convenient for them, and they have sent everything to me directly here in Ireland and it only took a week to arrive. So I don't think this will be an issue for you :)

Where can we find the link to the qualifying income that the consulate would be looking at for the affidavit? Is it a table/income bracket for one househould kind of thing? He has 3 kids, two lives with him but the 1 does not? is that 3 people in a household or 4 excluding myself?

If you look through the timelines you'll see that California is just now getting started on June NOA2s so it's reasonable to say you may get yours in the next month or two. With that in mind check out the processing times for your consulate to see the average time it takes to get your interview date.

For the petition you'll need the USC's birth cert, once the case goes to the consulate you'll need yours.

I know it needs to be certified but I'm not sure how since my Fiance had his certified translation done years ago.

I highly doubt they'll accept your maternity benefits as income, would you be able to get a co-sponsor?

Unless you're dealing with a difficult consulate this type of proof isn't necessary until the interview stage. If you want to include some anyways just try not to overwhelm them because this could mean it takes a lot longer for your petition to get read. Just make sure you are including primary and secondary evidence that you've seen each other within the last two years.

Not to worry, living abroad won't affect your processing time.

Did you send it registered mail so that you could track it and it would require a signature upon delivery? If you didn't send it first class it will probably have taken a week to get there so it may not be that far out of range.

I haven't gone back and read that part of the forms. BUT with that being said, you've only received a NOA1 thus far and can't be positive what kind of problems you might have! ;)



On the top of our packet I placed a typed noticed stating that I was currently living abroad with my fiance and if they would prefer they could use my Parent's US address instead of my address in Ireland. They didn't have any issues with posting to me abroad (which is what would be the most logical reason for them to have a problem with it). Really I see this as only strengthening our case since it shows we have been able to maintain a long term relationship while living together and that we've made sacrifices to be near each other. An additional bonus would be that because I'm here with him in his country (with oodles of proof) there won't be any doubts that we've seen each other with in the last two years.

Oh and in answer to your other question there's no need to play down your living together, the USCIS isn't the Catholic church so they could care less. :P And you don't need to mention the co-sponsor until the consulate stage.

I received my I797 on MAY 26TH. We have been waitng and i did send the packet in later than the original application . I asked Uscis about his before i did it this way and they said its ok to send the packet later bacuase the processing times are so long.

Okay so I take it this wasn't the reason for your denial then. Definitely find out their reasoning first before doing anything. Was it an immediate denial or was there a RFE first? Can you fill out a timeline so we can see what's been done so far?

I know that you're anxious to get married but unfortunately the process takes a lot longer than 2 months to be completed. :(

Lawyers do not speed up the process, they only help to sort out issues if you have a difficult case.

i know that if an address or something dose not fit, you just put that info on another paper and just put see additional sheet, can we abbreviate words like U.S.A. or do we have to spell it out? and if it dont fit that do we have to put that info on the additional sheet as well? because most of the addresses will not fit on he form.


Abbreviations are acceptable but if you're still having trouble fitting everything you might try printing it out and writing it on by hand.

also, when it asks for her address, i have to put her complete mailing address or just the street name and number?

also i dont know my birth mother, she left me and my dad when i was 6 months old and sent my half brother to his dad (all on the same night), the only thing i have on her is whats on my birth certificate, i asked my dad and he dose not remember her birth day due to that fact that he hasn't seen her in 24 years, how much of a problem is this going to be? is there a way i can get this info, i asked my brother and he has gave me a date but hes not a 100% sure
