I received the same notice on my noa2. Your petition has been sent to the nvc. From the nvc it will be sent to the consulate.  I received my case number within a day of being at the nvc and it was shipped to the consulate in two days.  It just arrived today and we are waiting for a interview date.

FYI - to obtain citizenship you need to be in the USA for 3 years not just an LPR.  If you're out of the country for months at a time, that extends the period of time until you can become a citizen if that is what you want.

You can travel for moths at a time as long as no individual trip is 6 moths or more and you have spent a total of at least 18 months in the U.S. when you apply for citizenship.

 

You can find the physical presence rule under the same link you posted:

If I remember correctly assets (like a house) counts as 1/3 when showing that you have enough money. If the house is worth 3x 125% of the poverty level then you should be OK and not need a co sponsor. When my wife sponsored me we didn't use a co-sponsor. Instead we showed that we had at least $60k in a bank account.

I have read online that I can use my Medical from K1 VISA for my AOS once inside thte United States.  If I have to give the consulate the CD and the Medical package how is it that I can re-use it?  Do they just check on file to see that it is still valid?  I cannot open the medical package as it is sealed for the consulate.  Can anyone shed some light on this?

Are you needing to use the money in your bank as an asset to make up for a lack in your income? If you qualify with your income alone, then the bank letter and statements do not really matter. Prove your current income with a letter from your employer and most recent pay stub(s). If you need to show assets, then you can use bank statements to show the activity and amount in your account. Go back 6 months to a year in order to show you did not just recently deposit the money to use for the I-134.


Yes, I do need the money to make up for lack of income. I didn't even come close to the poverty guidelines on my tax return but then again, I was a student last year. I just graduated, I have 2 jobs now and expect to make more this year ( I doubt it'll still be enough). I can go back to August with my bank statements with my current bank. That's when I moved to Florida and opened my accounts with them. But I have been making large deposits with my bank since August because I was either:
1. transferring funds from my old checking account to the new checking/savings. My old checking account is still open but not very active.
2. My fiance as been slowly but surely bring up some of his savings to deposit in my account to have on hand while we're filing for AOS and waiting for the EAD.

So in a way, the recent deposit was for the i-134, but even if we weren't at that step in the K1 process, I would have made the deposit anyway for the same reason listed above.

Also, I my dad is co-sponsoring me and my fiance. He has a sufficient income as well as stocks and bonds for assets.

helpful to us with other issues so im sure they could help us if there are any more issues.

has anyone else had issues gettig verification letters from the bank or had to have USCIS or NVC or the embassy send the bank and letter or fax telling them to give you a verification letter? What did you do?

i got a verification letter from my bank on feb. 28th for my i-134. I've since deposited about $2000. And i want a new letter to show the new balance. But now with some new bank policy they can'tj ust print me one like last time. They want immigration to fax them a letter or something.

So my question is will the month and a half old letter and a current bank statement be sufficient or will the embassy need a more current letter? Our interview is in a couple weeks in Chile.

Tell him to be as honest and truthful if he should be asked about the denial.  Even if he cannot recall the type of visa he will certainly be able to discuss the circumstances under which he applied.  The consulate has the denial on record, so all he has to do is answer any questions they  may have.  It is really not a big deal.
 

 

 

I agree with the post above. If they ask about it, be honest. Considering the circumstances surrounding it, it shouldn't be a big deal.

 

In regards to the DS-157, we were kind of in your situation with that one. We actually received 2 of the same packets from the embassy: One in the mail and one we picked up from the embassy (that in itself is another story). Only one of them had the DS-157 and said to bring it, the other didn't. However, I found on travel.state.gov that immigrating males ages 16-45 need to fill one out for their interview. You'll be able to find it on travel.state.gov if you do some digging. So I would print it out, fill it out, and bring it with you anyway. It's better to be over prepared than under prepared and risk your visa being denied.

I'm pretty sure for Jamaica vaccines are required. Remember a visa does not gaurantee you admission into US its up to POE. So, to be safe I would pay for vaccines. Its about 8,000 JA for the vaccines and another 11,000-12,000JA for the medical. My fiance went to Mo'Bay Hope

 

Did he have his vaccinations done at the medical?  I guees this is going to be the easiest way.  You don't happen to have any info on getting the police report do you?  The ony number I can find for the Summit station in Mobay never answers so I don't know what days they do the reports.  Thanks!

Sorry, I read it as the OP *wanted* to get the vaccinations anyway, rather than not wanting them regardless of what the country specifies is "required".  

 

Free in Jamaica is certainly going to be cheaper than any Dr in the US is gonna charge for 'em. wink.png

 

It's the opposite actually. We wouod have to pay for them in Jamaica (his country) as opposed to not having to pay for them once he get's to the US. So if he can get by with not getting them at his Medical and still be OK with getting the visa, that would be preferable.

I was reading an arcticle that it is not "necessary" to have the Vaccinations done before being issued the visa. Only that it is reccomended because it will have to be done before AOS.  I work for a Dr. and it would be free for him to get them once he is here as opposed to paying for them at or before his medical in Jamaica.

 

Does anyone know if this is indeed OK?

Vaccination requirements do not apply to fiance visa applicants. However, it is suggested that they receive them during this examination.  The reason being that following entry to the United States and after the marriage to their US Citizen fiance, fiance visa holders must file the adjustment of status application to receive their green card.  It is at this time the US Government requires the applicants to receive the required vaccinations.  This information is submitted as the Vaccination Supplement. If the applicant has already received their vaccinations during their Panel Physician medical exam, they do not have to receive these vaccinations again. 

Therefore, it is advised that fiance visa applicants receive the required vaccinations during their Panel Physician medical exam and obtain a record of these vaccinations on a form DS-3025, Vaccination Documentation Worksheet.

You only need i-134 with a letter from your employer, W-2's for two years, plus 6 months of checkstubs for K-1. Yes you do need a copy of your birth certificate. It has nothing to do with your proof of citizenship.

 

Am I reading this right...that my fiance will need a copy of my Birth Certificate for the interview? For the original petition I just copied all pages of my passport and that apparently was OK since they approved it.  I'm not sure where mine is so I'm wondering if I should quick and order a copy? I just received my I-797 Notice of Action letter today in the mail and I had a few questions.

#1 How long will it take for my fiance in Brazil to have her interview with the Consulate?
#2 We want to live together in the USA in Dec/Jan of 2014, what is the best way to make sure my fiance in Brazil will be able to come within that window of time? Note, can the 6 month extension for the fiance to come to the USA be extended? If so, how and who do I talk with?
#3 What in general should I expect now after receiving this I-797 NOA?

So once the Embassy in Brazil has my case and if we request an extension for the K1 visa for instance lets say to schedule my fiance's interview December 15th based upon personal reasons, then it would not matter that my I-797 NOA2 has expired from the 8/18/2013 date?

 

We are thinking of sending the embassy an email stating our reason for requesting an extension " on VJ i heard it was called a "reissuance of K1 visa".  Do you have any comments about how to properly go about doing this, I'm guessing send that email once the Embassy in Brazil has contacted my fiance to come for the interview.

 

Is there anything else I should be aware of with my situation? I appreciate your help alot! Thank you so much!

I have another question for anyone who may know the answer.  So Fernanda and I had a discussion tonight and we now think it may be best to just request a reissue of the K1 visa so that she can schedule her interview sometime in December.  What we are thinking is that I am still in college and in December I plan to have a full-time job to be able to support us as right now I don't really have too much income. Also, Fernanda can't get off for work to go all the way to Rio to do her interview until Brazilian summer in mid-December. So we feel that for those reasons we want to request a reissue or extension of my NOA2, I am not sure how to go about doing this and I am looking for advice. Since the NOA2 has already been approved and is in the process of being sent to Fernanda to have her interview scheduled, should Fernanda just call the consulate once they notify her to schedule an interview?

 

I heard from a few posts that people must write a written request for the extension of the K1 visa, is this true?  Also, is there anything I must do back here in the US to help make sure this transition works smoothly?

That was the solution I was trying to figure out buy you totally make sense.  So if my fiance in Brazil took her medical exam and interview before 8/18/2013 which would be when my I-127 (NOA2) expires THEN her K1 6month time would start from the day she gets approved from her interview.  Theoretically, if she gets approved 8/15/2013 for example we would have until 2/18/2014 for her to come to the USA and then 90 days to get married from that point.  Does this all seem logical?

I received my NOA1 September 14th 2012 and received my NOA2 (I-797) April 19th 2013.  It says "Notice Type: Approval Notice Valid from 04/19/2013 to 08/18/2013." Does this mean that my fiance has to come to the USA to live with me before 08/18/2013? 

 

Below on the form that it will take a few weeks for the NVC to process the approved fiance petition and send it to the US Embassy in Brazil where my fiance is from.  I am currently in school and will graduate around December 15th 2013 which is when we originally planned for my fiance Fernanda to come and live with me and then we would get married. 

 

Does anyone know what the exact final date my fiance would have to come to the USA to live with me? Does it go from the date of her interview in Brazil or is it the date on this I-797?  Also, is there ANY way to extend the 6 month time frame because I don't want my fiance to come to the USA to live me with while I am still in school and because she teaching and would like to finish out the year in December.  Once I graduate we will be much more stable financially as well as it will be a perfect time for her to come live with me.  

 

What are your thoughts? Have anybody had any similar experiences or know of any stories about this type of situation?

We ideally would like to schedule Fernanda's interview in December because that is the only time she can travel and get off work to go to the interview in Rio from Sao Paulo. Does anybody know how the "scheduling" works for the K1 visa interview in Rio? 

 

Also, on my NOA2 it has a "validation" date on it from 4/19/2013 t 08/18/2013. What validation date does this exactly mean? Does this mean that Fernanda must receive her K1 visa before the expiration date of 8/18/2013 or what does this validation date specifically mean?

Someone recently got a K-1 reissued.  It's possible.  You pay the visa fee again, get new PCCs, etc, based off the already approved petition.

Let me cut right to it. My fiance received her K-1 visa in May 2012. Well we didn't use it. She never entered the country and we didn't apply for any extensions. Now in August 2013 we are ready to pull the trigger. Is there any way to re-validate this visa? If not, would the best option be to marry abroad and just apply for a different visa type? I am working stateside now and she is in Dubai.

 

What are my options? Any help you all could provide would be highly appreciated!

Hey everyone,

 

We're approaching the 5-month mark since filing our petition and haven't heard anything yet, which is fine as I understand this is the absolute minimum it'll take and could be closer to 9 months...  I was planning to visit the US in September for a couple of months (for a 6-week long Halloween event in Orlando and, time permitting, staying for Thanksgiving) but was wondering what to do if we get approved for an interview between now and then.  For anyone who's gone through this stage already, when you are notified that you can go to an interview, a) is that interview in the US or at an embassy in your own country (for me, the UK), and b) do you get given a specific time and date, or can you schedule it yourself?  And if so, how far out?

 

I haven't booked my flights yet and will wait until a month before, most likely, but wanted to know what to do if I'm requested to attend an interview at a time when I'll already be over there.

No, I would defintiely wait until you have all the documents to submit. You might want to call the consulate to confirm that. I know in Haiti if you send incomplete info it will prolong the process
