Hi, you as a petitioner are not required to provide police certificates. USCIC will run all background checks on you during I-129F petition process.

Your fiance is required to provide police certifiate(s) during her interview process. Detailed requirements slighly differ from consulate to consulate but usually beneficiary is asked to provide certificat from country of residence and any other country they lived for 6-12 months since the turned 16. They are also asked to provide any police certificates from any coutry they have been arrested/convicted regardess period of stay.

Hi all,

DS-156 and DS-230 Questions

My fiancee is filling out DS-156 form, and I have several questions.  I did my best with the search, but didnt find answer I was looking for. 

On DS-156 question 36 Has Anyone Ever Filed an Immigrant Visa Petition on Your Behalf?  Naturally my answer was "No" because no one filed a petition for her before, she has been in the States 3 times on J1 visa. Then she has read somewhere that we should answer "Yes", because I filed for her.  Also K-1 is non imigrant visa.


On DS-230 Question 35 " List dates of all previous visits to or residence in the United States. "

She told me today that on her G-325 form that I sent with the petition in October, one of the dates she entered "to" field 10/2008, but stamp in her passport is 9/18/2008, I believe that's OK since the form only asks for month and year, so she rounded off to the closest month.  Is that the proper way to do this?  She never overstayed her visa.  I'm worried now, and don't want something like that to cause any issues.










 

The answer on DS-156 would be NO , your current petition doesn't count.

I don't think there will be a problem with a date on G-325 being slighly different, a lot of us don't remember exact dates of moving to different addresses or changing jobs etc.

So me and my fiance  have been doing really well collecting all our paper work for Packet 3 from the Naples, Italy office but we are confused about the DS-154 fee. The Packet which seems outdated talks about the BNL receipt of the Nonimmigrant visa but there are several you can pay. Is it the regular tourist visa fee of 128 euro. Hi all, I've been a reader on here for a couple weeks now, but never really came across this question. My fiance and I forgot to date stamp both sets of passport photos and the photographic evidence we sent with our petition. Does this mean a reason for an RFE or possible denial? My fiance (the USC) is currently in U.S Boot Camp so he would either have to have his parents reply to the RFE on his behalf or he waits til he graduates in August to send the requested fixes. Instructions for I-129F state that passport photographs should be signed (see 6B http://www.uscis.gov...i-129finstr.pdf ) so could be a possible RFE.

We sent in over 60 photos of us together, and with him and my family at family events (BBQ's, meals, birthdays) also.. along with plane tickets and restaurant receipt tickets including the one from the night he proposed, and also a few letters we sent to each other before he visited. However we forgot to include skype and facebook messages, with one message including a screen cap of a call of 25 hours we had. Hope we included enough evidence. Thanks for the reply smile.png

I just received packet 3 via e-mail and in the DS230 form it asks for employment history for the beneficiary. My fiancee is 21 years old and has only worked a couple under-the-table type jobs. Should we list these jobs or will they come up as a red flag in the interview? My concern is that they may think that when she comes to the US she will try to be getting money from the state or that she will also be working under-the-table non taxable jobs. I am thinking of just listing N/A because from age 19-20 she was studying abroad and since she is only 21 years old it would not be such a red flag that she hasn't had a real job. Now if she were older and never had a job I think that would be a red flag. So the question is: can I list N/A under employment history and it be ok? Is it common for a beneficiary to list N/A under employment history (I am sure there have been many cases)? I would love feedback about this situation! Thanks!

 

It won't be an experet answer, but if it was me I think I'd put Never Employed.  I.e in some countries school leavers cant find jobs for months sometimes so i don't think it would be a red flag, and again in my opinion cash in hand jobs like baby sitting or whatever shouldn't be listed unless someone is a professional nanny and is self employed etc.

Well, NVC received it on Friday, May 17th. It is set to be sent out any minute to....the wrong consulate! :(

NVC said we can email and put URGENT in the subject line with our info....and if they see it, fine....if not, well...it is out of their hands.

Address was changed with USCIS...I was told the consulate would change too...but, NVC says they still show old address. What in the world???

I guess if it does end up going, then I will call the Costa Rica U S Embassy and find out if they can do anything. Sweden is very far from Costa Rica and very expensive to fly there..not to mention, he will have to find a place to stay. He has no address out there anymore.

Oh well, I will wait and see what will happen. I am still very thankful to be at this stage. Extremely happy. I just would have liked for things to have gone where they were supposed to have gone.








Sorry to hear that, at least you know where your petition is and where are you standing. Isn't it annoying that information is not changed as requested by you?

Hope your email will be seen, put your nvc ref (if you asked for it) and/or uscis ref in the subject too.

In case if it will go to the wrong consulate I think they can transfer those files (especially it is their mistake) but it will slightly delay the application. Stay in touch with NVC for now to try and get petition forwarded to Costa Rica and after its sent to whichever contacting DOS who I found being most helpful of all will be mot appropriate.

Hello everyone!

I am a teensie-bit frantic right now, because I received the paper NOA2 by mail yesterday (only it was read to me by my Mother, because I am not currently home).

To give you some back story, I had changed my fiance's address to Costa Rica because he recently moved there. It was told to me that his consulate would be changed to Costa Rica too. This was by a tier 2 officer. Before, I made this change, I had a meeting with our local Uscis office and they told me the same thing.

After receiving our email confirming our NOA2 approval, I then called the USCIS NSC and spoke with a Tier 2 agent to confirm that our case will be sent to Costa Rica and NOT Norway. This was last Wednesday. She was unable to see anything, except that it was sent out on the 13th and told me to wait for the paper version of NOA2 for instructions. She said there is no consulate listed, but that doesnt really mean anything. If his address says Costa Rica, then it will be Costa Rica.

So, my Mother reads the NOA2 and says that they do not know which consulate. I must call an 800 number (not sure which one yet) and submit an 824 form if i need the consulate to be changed. I looked at this 824 form. The fee is $405!!!

What does all of this mean? Is it hanging out at CSC waiting for me to respond? If so, why didnt the Tier 2 person help me? Was it sent to NVC?

I dont believe I should have to fill out any more forms and pay outrageous fees because someone over there did not follow through.

Please, someone, give me some hope.

Hi,

Approved petitions are always sent to NVC first and then after few days (or weeks if put on AP) forwarded to the embassy.  Call NVC on 603-334-0700 see if they received your file (if the havent call every day or two to check)  NVC will know what embassy they plan to send it to after they finish processing your case and should be able to rectify this if it hasn't been done so yet.

Sorry to burst the happy bubble but NOA2 hardcopy is needed for Adjustment of Status.

 

If USCIS records show that a notice of approval ( NOA2) was sent to your address, you must file a Form I-824 (Application for Action on an Approved Application or Petition) with the filing fee in order to obtain a duplicate approval notice ( NOA2 ).

Ok I figured that. So will it be fine to exclude the tax return transcripts for 2010 and 2011 and only include the tax information for 2012 along with everything else I have ? According to the instruction on i134 it seems like that is more than enough what I already have.

A lot of people (especially with difficult consulates) prefer to have excessive documentation to take rather than having to resent something which will mean delays in getting the visa.

I had a letter of emplyment (fax - not original) and the CO was satisfied as soon as I provided them with that letter and didn't have to show tax return or W2.(which I also had just in case).

I am sure you already have sufficient information and should be fine. Good luck!

I grew up in the UK and left for Australia when I was 16 years and 6 months old. 
 
 
This table from the Australian embassy doesn't seem to say one way or the other  (http://canberra.usem...e_niv_appl.html).  
  If the applicant And Then the applicant needs a police certificate from is living in their country of nationality at their current residence for more than 6 months is 16 years old or older the police authorities of that locality. lived in a different part of their country of nationality for more than 6 months was 16 years or older at that time the police authorities of that locality. lived in a different country for more than 12 months was 16 years or older at that time the police authorities of that locality. was arrested for any reason, regardless of how long they lived there was any age at that time the police authorities of that locality.
You see, I lived in the UK for more than 12 months, but I was only 16 years or older there for 6 months. 
 
When I asked the Sydney consulate they just sent a generic 'we'll tell you if we need more documents when we give you an interview date'. But I'm so pushed for time with my visa that I want to know now if I have to order a UK police certificate as well. 
 
Anyone got experience with this issue? 
 
 
 













As oer embassy website I believe you'd need it if you'd have lived in UK for over 12 months after you turned 16. Unless you were arrested at any time of that stay then you'd need it reardless of how long you lived there for and how old were you.

On the I-134 form it asks for my fiancees address and of course the house address and the city boxes are fine however where it asks for the state is the issue. I am trying to do this on the computer but of course it only allows 2 letters like CA for example. Should I just print it out  the form and then write it in?
 
Also this is the question for the continued intent to marry affidavit. 
 
My parents, my fiancee, and I met in Vancouver. We are planning on using this evidence that we met in Vancouver to show that we stil have an ongoing relationship. I want to note that this is for the embassy stage. However there are two issues. The immigration person in Canada did not stamp my passport. Also my parents in an attempt to protect their privacy, are hesitant about giving me or allowing me to make a full fledged color copy of their passport front page and their  stamped page. Now we have other primary evidences like boarding passes, we do also have stamps of their passport pages that were stamped however there is nothing on the pages to confirm who they belong to, we also have all hotel receipts, then we have secondary evidence like pictures flight inteniary online confirmation. Are the passport stamp pictures something we can omit or is it something that would be recommended to have? Again I want to point out that this is going to be for the embassy stage.

Yes you can type the form and then fill state with a pen, as long as it legitimate it doesnt matter if you type or print. I am not sure how easy or diffucult your consulate is but I'd imagine if they require evidence of ongoing relationship then hotel receipts, photos, boarding passes and any sort of corespondence between you and fiance will be ok?
Remember at the interview your fiance needs to proof ongoing relationship not that you met in person. Some only provide printouts of chats, phone call records, letters etc.

I was reading an arcticle that it is not "necessary" to have the Vaccinations done before being issued the visa. Only that it is reccomended because it will have to be done before AOS.  I work for a Dr. and it would be free for him to get them once he is here as opposed to paying for them at or before his medical in Jamaica.
 
Does anyone know if this is indeed OK?
 
 
Immunization Requirements for Fiance Visa Applicants
Vaccination requirements do not apply to fiance visa applicants. However, it is suggested that they receive them during this examination.  The reason being that following entry to the United States and after the marriage to their US Citizen fiance, fiance visa holders must file the adjustment of status application to receive their green card.  It is at this time the US Government requires the applicants to receive the required vaccinations.  This information is submitted as the Vaccination Supplement. If the applicant has already received their vaccinations during their Panel Physician medical exam, they do not have to receive these vaccinations again. 
Therefore, it is advised that fiance visa applicants receive the required vaccinations during their Panel Physician medical exam and obtain a record of these vaccinations on a form DS-3025, Vaccination Documentation Worksheet. 







Is that doctor a civil surgeon? If not then trust me you want the vaccines done prior or during medical and your ds-3025 completed during the medical in jamaica. I rang about 25 civil surgeons in Orlando area and beyond and it was difficul to find one that didn't want to rip me off or was just ignorant to my explanation that I only need my vaccination record transribed on I-693 form which is required for AOS if your vacciness are not completed before or during medical in your home country. I succeeded at the end but still had to pay about $50.

I know this topic has been touched on briefly on this message board, but I could really use a little bit more clarification. 
 
My fiancé has been living in Italy for over 5 years, but he is an Albanian citizen.. (He moved to Italy when he was over 18 years of age.)
 
1. Since he currently resides in Italy for well over a year does he need the police certificates from Albania also? 
           
2. If yes, can someone please breakdown a little bit better where he needs to go to obtain the 3 police documents that are requested from Albania. I have read what it says on the USCIS website, but I wouldn't know how to explain that to my fiancé of where exactly to go in Albania.
 
3. If my fiancé has a typed birth certificate does he still have to go get a newly issued birth certificate? 
    
               - It says this on the USCIS website,
 
                                   "All civil documents presented in support of a visa application should be less than one year old at the time they are provided. Only machine-typed civil documents are acceptable; Albanian authorities are no longer authorized to issue hand-written civil documents. Albanian birth certificates should reflect the bearer's current marital status at the time of issuance, and are issued in the bearer's current name (i.e. in a woman's married name, not in her maiden name)." 
 
It seems like the answer is yes, but I just want to make sure as I'm a little confused.

The Ministry of Justice certificate alone is transmitted directly from the Albanian authorities to the U.S. Embassy Tirana; it may not be accepted directly from the applicant.

To obtain the document from the District Attorney's office concerning pending and final criminal and civil cases, the requestor needs to go to the District Attorney's office in the district of his or her residence, present an ID, and pay the necessary fee.

To obtain a document from the District Court concerning any active court cases, the requestor needs to go to the District Court office in his or her district of residence, present an ID, and pay the necessary fee.

To obtain a criminal court certificate from the Ministry of Justice (in Albanian - Deshmi Penaliteti or Vertetim i Gjendjes Gjyqesore, issued by Judicial Status Office, General Directorate of Prisons, Ministry of Justice), the requestor must submit a photocopy of his or her ID card or birth certificate through the Post Office, and must pay the necessary fee.

IMPORTANT: Applicants must clearly note on the court certificate application made at the post office that they are applying for a U.S. visa. By arrangement with the Albanian authorities, court certificates for applicants for U.S. visas are transferred directly to U.S. Embassy Tirana. Therefore the applicant will not receive an original copy of the criminal court certificate nor is it necessary for them to send the document to NVC. Only court certificates obtained directly through U.S. Embassy Tirana are acceptable; applicants may not present their own certificates. I ve red through the page for a while now and as my fiance and me have decided to file a K1 visa I have a few questions, I am sure most of them have been asked a billion times before and I apologize for that already I m trying to keep it short!
 
My fiance would like to hire an attorney as we ve had a rejected B2 visa already in June (Yeah I know no visa with a bf in the states we should ve known it), I m searching for an attorney right now and I m starting to get a bad feeling that either it ll cost a few thousand dollars on top of all the costs already or be a scam/ wasted money. I ve been looking through so many and none of them really seemed to be convincing to me or cost ~4500$ just for the filing stuff. Does anyone here know an affordable and competent lawyer?
 
So I thought about doing it on our own, do you think it will be too complicated with the already rejected B2?
 
We ve been living together here in Europe for a while now because my fiance was stationed here. So we have plenty of pictures etc.!
 
Next thing is my fiance managed to get his divorce done only now that he s back to the states (they ve been seperated for about 2 years now though) will that cause any issue because we ve been together although he was still officially married?
 
Is it true my fiance can come to the visa interview to the embassy with me if he happens to be here at that time?
 
I am very very scared of this process because I still feel like I messed up with the B2 visa, I am so scared of this process!

I've been helping my fiancé fill out the forms for the interview and came across something that concerned me. We filled out the DS156 form online first and for question 29 where you list all the times visiting the US, we rounded the time to say X weeks or X months instead of counting all the days. Well, his most recent trip to the US we said was 6 months even though it was a few days short of 6 months. I didn't think anything of it until we filled out DS230 later and saw question 30, where you list where you lived for at least 6 months. He has not lived anywhere outside his home country for at least 6 months so we put the entire time as living in Brazil. My concern is how it will look when viewing the two forms. I know we can't change the DS156 because we already submitted it online and its not truthful to say he lived at least 6 months in the US on DS230. Do you think this will cause an issue at the interview?


Visiting us doesnt equal living there. Id say it was extented vacation. I would only put adresses where you actually resided.

Check with DOS by using your USCIS ref. (or embassy ref. if you have it) on what stage is your application and what address do they have for beneficiary? Check what are the embassy packet 3 instructions for your embassy and find out how to go about having medical done?

Just a follow-up on this discussion. I communicated with the U.S. Embassy in Athens (via email ; the only way the immigrant visa unit will allow you to do so). Apparently, you need only supply police certificates from other countries if you've had 12 more more months of residence there. This is a bit in conflict with what the official website of the Dept. of State says which is 6 months.
 
Nonetheless, the embassy emphasized 12 months (in two separate emails) and my fiancee worked and lived in Rome for 10 months. Hopefully, there won't be some odd employee and everything will go through smoothly.

immigrant visa unit. I'll admit I'm a little worried as the Greek police were adamant that one no longer had to worry about
getting records from multiple places.

I doubt that greek or italian authorities will be able to give you correct info on what US immigrations may require for visa purposes. Check with US consular but I doubt you'll get answer you would like to hear.

Yes, for my interview in London I have provided both british and polish certificates.

Hope you'll get your answers and it wont take long for the italian certificate to come through!

I have a question for you, though I'm not sure whether I've posted it in the right forum. My fiancee has her K-1
visa interviewed for Sept. 17th at the U.S. Embassy in Greece. I'm very confident we have everything ready,
which includes packet 3 (which we sent back in), documents related to I-134 affidavit of financial support and
proof of ongoing relationship. She also had her medical exams done last week.
 
I'm fidgeting on one thing: My fiancee is Greek and has lived all her life in Greece but did spend one year (2009-2010)
working in Rome, Italy. The letter from the embassy requests her penal (criminal) records. Residents of Athens, Greece,
such as my fiancee, can obtain these from a special police office (Bureau of Penal Records Ministry of Justice). Specifically, this office transmits these directly to the embassy.
 
The Greek police officers at the Bureau of Penal Records assured her that she no longer needs to get any criminal records
from Rome, as the European Union now operates under the European Criminal Records Information System
(ECRIS ; see http://ec.europa.eu/...-justice/ecris/). ECRIS has been in effect since April 2012
and all European Union police agencies access a common penal record database. Hence, any penal record issued here
in Greece covers her for all of Europe.
 
My fiancee applied to have her penal records transmitted to the U.S. Embassy and the Bureau of Penal Records has
confirmed that these were indeed sent about a week ago.
 
I know I probably sound paranoid but I was wondering if anyone has been in the same position ? Will the Immigration
Visa Unit at the Embassy accept the ECRIS-based penal record or do they insist on going old school, i.e. going to Rome
(which would be a huge pain !), to obtain criminal records.
 
I guess I'm stressing out as I can't wait to see her and we have a ticket for her to come to the U.S. on Sept. 27th. Please bear with me.

Unfortunately as far as I am aware you have to obtain police certificate from each country separately regardless if they are part of EU or not. I have not come across any information about ECRIS before with connection to the police certificates within EU and from the website it seems as it is still in a pilot stage anyway.
You can find information on ho to obtain all documents from specific countries on tavel.state.gov website and for example this is page where you an find out how to get italian police certificate http://travel.state....?cid=8984#docs.

Police Records

Available. The Certificato Generale del Casellario Giudiziale is a certified national record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).The Certificato dei Carichi Pendenti is a certified record of pending criminal charges, or a statement that no such charges exist, from the office of the Procura della Repubblica in the applicant's place of residence. Both certificates are required from immigrant visa applicants residing in Italy.

Persons within Italy can obtain the Casellario Giudiziale by applying in person or by mail at any office of the Procura della Repubblica. The Carichi Pendenti must be obtained at the Procura della Repubblica in the area that the applicant resides. Such offices are located in all major cities and in many small cities and large towns. Those who apply in person must submit a written request, a photocopy of a photo ID and all fees; the certificates are usually provided the day of the request.

Persons outside of Italy can obtain the Casellario Giudiziale by writing to:

On I-134 we used the salary total as per letter from employer as this is what my then fiance had in his contract. The figure on W2s or tax return would vary, depending on bonuses, overtime, lost time due to sickness, maternity leave, premiums for working abroad and any other reason.
On I-864 during Aos its slightly easier as you actually have place to fill in yor tax return totals and your current income.
