K-1 Fiance(e) Visa Process & ProceduresCan the congressman help us?
QUOTE (Johny E. @ Sep 8 2008, 08:32 PM) <{POST_SNAPBACK}>
So my fiancee and I applied for a k1 in June. We hired a lawyer recomended by the Congressman of my state. Now my question is, does he (the congressman) have any influence with immigration cases? If we asked him to help us speed up our case in any way, will he be able to? Anyone who might know anything about it, please reply. thank u.

no I am afraid not. Believe me I have treid. They will respond to you but their response will be unless it is out of immigration timelines there is nothing they can do. Sorry

K-1 Fiance(e) Visa Process & ProceduresAnything I can do?
QUOTE (Lisaandtim @ Oct 14 2008, 10:09 AM) <{POST_SNAPBACK}>
Recently it has been discovered that my mother's lung cancer has gotten worse. It's stage 4, meaning its spread to other parts of the body. When my fiance was here with me, he helped me take care of her and was my emotional support and everything. I don't really have anyone else. And it's just my mother and me that live here. We rent. Is there anything I can do to get him here faster? They're stopping chemo in february and Im a september filer ><. Theyre not sure what cld happen. I can't really do i here without him and taking care of her and everything right now is such a strain, even my own health has started to decline. So i'm just wondering is there anything i can do? She's the only parent I have left, too.

If you look on the USCIS website there is an accelerated process. I do not know the details but it has worked for some vj members. Check it out. good luck and may God bless

K-1 Fiance(e) Visa Process & ProceduresOver a month no NOA1?
QUOTE (wasabi @ Nov 8 2008, 05:18 AM) <{POST_SNAPBACK}>
I am using a lawyer to proceed with the K1 visa. He is based in Bangkok where my Fiance lives. No need to debate the pros and cons of that here, I just wanted this to be clear.

My lawyer sent our I29F packet a little over a month ago to the VSC. We have not received any NOA1 from the VSC, he claims they are delayed in processing that it may take another month to get the NOA1 and there is no need for concern. He has stated that they have a big backlog mailing out the NOA1's but that doesn't mean my case isn't being processed and I should already have my place in the queue. He is the one sent the check so I can't review if it has been cashed or not nor look for a case number on the back. He is a very well known lawyer in Thailand and I do not have any reason to believe something is fishy but nevertheless I am stressed and just want to know our case is moving along. After reading through the threads here I can't find anyone else who is facing this kind of lag. Can I somehow contact the VSC myself just to get assurance they have received my packet and things are moving along?

I got my NOA1 a week after my check was cashed. two weeks total. unless something has changed I thought all applications were sent to Chicago for distribution.

K-1 Fiance(e) Visa Process & ProceduresTravel Questions
Hello all, my fiance and are are planning starting the filing process for a K1 in the near future but I have 2 travel questions I was hoping you could help me figure out.

A little background first and then I'll get to the questions. I am from the US and she is from and currently living in the UK. We have been lucky enough to be able to travel to see each other during our courtship quite a few times. My first question is once we file the I129 will she still be able to travel to the US? The 2nd question is once the K1 is granted and we are married will we be able to have a honeymoon outside of the united states?

Okay so I tried to search for this and couldn't find it which means one of 2 things either I am the only person confused by this document or my searching skills are flawed and I didn't find it.

1) Under section 1 I do not fill out anything for a-e? (I am a born American citizen)
2) Under section 8 I pay child support for my daughter. Would I check Partially Dependent?
3) Under section 10 Do I list my fiancee that I am filing this document for or does that not count?
4) Under section 11 I intend to support my fiancee and I intend to marry her... how do I quantify that on this document?

I completely freaked out.. ..I am so happy and relieved that I am having a hard time not crying right now...I sent Anna a quick e-mail and a few of my family and friends...It is so funny how upset I was last week, then decided that I would step back and give all my frustration and my Will over to God and let God handle things. On Friday, I had done a good job of letting things go....And on Easter of all days, this is what God gave me....I love you God!.....Thank you for everything, especially Anna....she is my Angel........Anyway, I am hoping and praying that everyone of you has a stress free process with your K-1s and other applications...You all are great people and so deserving of the love that each of you has found...That is shown in your caring for others in this process. I pray that I will be able to return your support a thousand fold......Thank you for sharing the joy, frustration and sorrow of others and yourselves....

Of course this is the first step in endless forms and applications however, soon enough, Anna and I will be going through that process together (physically together)...

K-1 Fiance(e) Visa Process & ProceduresWhich process will be best for us (K-1 or K-3)?

How could she have entered into a marriage that was only "his idea"?

What made the husband so sure she was cheating?

If she didn't want to talk to him because he upset her so much, why wouldn't she agree to a divorce?

There are too many red flags, one of which is that you've spent very little time in each others' company. You say she had an on-again-off-again relationship with her husband for a year, married on the spur of the moment, spent an afternoon with him, and then returned to a cruise ship? If this were fiction, it would be unbelievable. Doesn't it strike you as flip? Or bizarre? What makes you think history isn't repeating itself?

I agree with Jersey Girl.

Well, I don't know what the F*#k!! happened but all the e-mails I was saving in seperate folders in outlook express are gone!! over 500 e-mails between me and my fiancee from the start of our relationship. I guess I won't be using that as evidence at the interview. I'll just have to start saving the ones from this day on. I guess I'm lucky for printing a couple of them out a while ago. I have other stuff to give her for the interview but it would have been nice to have those!! computers can be the devil sometimes!!!!

K-1 Fiance(e) Visa Process & ProceduresMy fiance is on a plane right now, thanks to VJ

Thanks to all the VJ members here who gave me advice, told me to calm down and not worry, etc because my fiance is on that airplane right now and will arrive at JFK just before noon on Wednesday. I simply am in shock that the process was so much quicker than expected. I am way ahead of people who filed around the same time as Anh and I and I somehow avoided that IMBRA chaos, so praise be to God for that.

I just hope the customs officials do not try and take her DVD's and CD's. I've explained to Anh that the law is on her side, that she is allowed personal copies and should be polite, but stick stand her ground of the agent gives her problems.

You got that right...God is good all the time.

My fiancee passed her interview at the US Embassy in Manila, received her visa and was approved to come to the USA on a K1 Fiancee visa. I purchased plane tickets for myself and my fiancee and I will be leaving in October to the Philippines where I will stay for 2 weeks to help my fiancee pack her belongings and to spend time with her family before we fly back to gether to the US. Am I allowed to escort my fiancee back into the US ? Or does she have to fly here alone? I am asking because someone from this site said they did not think that was allowed and that my fiancee would have to fly to the US alone. Is that true? Does anyone know the answer to that. I never heard of such a thing.

Hi all,

I am a n00b here and have a questions. I have searched high and low but cannot find the clarification, so I apologize in advance for this question; I would greatly appreciate an answer:

Income requirements; I am under the impression that I must meet a minimum of 125% of the poverty level, etc. but my girl in Russia has just sent me a quote from her Russian translation of our American USCIC website, stating a minimum of over 40,000 USD annually. Can someone please clarify this for me?

IR-1 / CR-1 Spouse Visa Process & ProceduresAbout to send I-130 package, but have several questions
Thanks for all the great replies. I am not sending in originals at this time. Everything other than the I-130 and G-325A are copies. After further review I think I will take out the extra comments on the Red Flag issues, I think you guys are right it might cause them to ask more questions. I have also cut down the number of emails and created a chat log in Excel with the date time and duration of most of our chats. I will send all the transcripts, all the emails, and all our photos with my wife for the interview.

As far as the assembly of the package I plan to put things into sections with a TOC at the beginning and a TAB at the bottom of the page for each section. I agree I want to make it as easy as possible for the fine folks at USCIS and NVC to locate what they want.

Thanks and wish us luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresAbout to send I-130 package, but have several questions
Hello to all the great folks here.

I am about to send our I-130 package and have a couple of questions. I am second guessing myself on adding a sheet where I address some of the "red flag" questions that may come up. In my research I have read that the Consular Officer can only reject an approved Petition based on "is substantial evidence relevant to petition validity not previously considered by DHS". Specifically I attached a sheet trying to defuse three issues mentioned as "red flags". I addressed our short courtship which was 7 months, the short time between my arrival in China and our wedding, and lastly the communications and language issues (she speaks fair English and my Chinese is pitiful but we understand each other).

My question on this is AM I LIKELY TO CAUSE MYSELF MORE PROBLEMS by adding this to the package?

The other question is regarding the package, I just want confirmation that I am not missing anything.
1. Petitioner addresses potential questions.
2. Completed and signed form I-130.
3. Continuation sheet for I-130.
4. Check for I-130 filing fee.
5. Completed and signed form G-325A and photograph (petitioner).
6. Continuation sheet for petitioners G-325A.
7. Completed and signed form G-325A and photograph (beneficiary).
8. Continuation sheet for beneficiary G-325A.
9. Copy of my U.S Passport to prove U.S citizenship.
10. Copy of my birth certificate front and back.
11. Copy of our marriage certificate, translated and notarized.
12. Copy of divorce decree of petitioner.
13. Copy of divorce decree of beneficiary, translated and notarized.
14. Copy of beneficiary?s birth certificate translated and notarized.
15. Copy of passport pages of beneficiary as evidence of citizenship in P.R.C.
16. Evidence of relationship:
a. Evidence of travel to and in China. (boarding passes and baggage claim stubs receipts etc.)
b. Photos of us together along with family and friends. (Sending about 40 with 200 backup she will take to interview)
b. Evidence of efforts to combine finances. Unsuccessful but I have emails stating I can not, but she has two new credit cards!
c. Copies of affidavits sworn to and affirmed by third parties having personal knowledge of our bonafide marriage.
d. Evidence of gifts sent (Receipts and pictures).
e. Evidence of continuing communication in the form of email, phone calls, chat, and video chats.
about 40 emails with several hundred she will take to the interview, phone log showing about 100 phone calls and about 50 pages of
chat transcripts.
[/size]

Sorry about the long post but I'm nervous about this and don't want to miss anything. I thought about having an attorney look over our package but he wanted $1,000 to look at it. I think that is just too much for a couple hours of work.

Thanks in advance for your comments and suggestions.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnyone tried to buy a home and get the New First time home buyers tax credit
Good evening all,

I know this is not a tax forum but I was curious if any of my fellow Journeyers has tried to buy a home while they wait for the VISA process to plod along. My wife is still in China and we've thought about buying a home, which has got to help with the Proof of our marriage etc. I was looking into the $8,000 "First time home buyers tax credit". We qualify and can afford the home etc. But since I don't know how we can file a Joint Return until she has a SSN. If you have bought a home and or filed a Joint Tax Return I'd like to hear how you went about it.

Thanks,

Tom

QUOTE (junoonis @ Aug 4 2009, 04:13 PM) <{POST_SNAPBACK}>
Hello guys, I think I am ready to file my I-130 for my wife in Pakistan, Please check my list below and let me know if I am missing anything. I've made a cover letter and everything mentioned below is in the same sequence. Also, does it make a difference if my beneficiary was my relative even before the marriage, should I mention that anywhere in the coversheet.

  1. Completed and signed form I-130
  2. Check for I-130 filing fee
  3. Completed and signed form G-325A and photograph (Petitioner)
  4. Completed and signed form G-325A and photograph (Beneficiary)
  5. Copy of Petitioner U.S Passport to prove U.S citizenship OR Copy of my naturalization certificate to prove U.S citizenship
  6. Copy of Petitioner birth certificate
  7. Copy of Petitioner Social Security & Resident Alien
  8. Copy of our marriage certificate (Translated in English)
  9. Copy of our marriage certificate (Original in Urdu)
  10. Copy of beneficiary?s birth certificate
  11. Copy of beneficiary ID from Pakistan Stating Husband?s name (Evidence of a Bonifide Marriage)
  12. Wedding pictures

I do understand that there might few couple of things in my list not needed at this point but I am sending everything I have just in case. Any suggestions/comments are welcome.

It is best to "Front Load" your application, by that I mean put a little everything in the package to give them all they need to see the relationship is Bonified not just legal. I sent a sample of emails from the beginning and at various points in our relationship up to the point of the I-130,.I also added a statement listing the total number of emails available for review at the interview or whenever requested. I sent pictures of us along with family and friends in addition to the wedding pictures. I added notes to the pictures stating who was in the picture, where and when it was take. I just printed the pictures with the captions in Word along with a statement that the pictures and about 700 more would be available at the interview. I also included a couple of logs, one for phone calls and another for chats. I also included correspondence regarding a denial for adding my wife to my benefits and bank accounts until she has as SSN.

The idea is to paint a picture of the relationship and show that it is genuine. If they have a good snapshot of the relationship upfront it is easier to process and hopefully will not cause any unnecessary questions.

I see you're from sunny Fla. as well, I'm up in Daytona Beach, small world isn't it.

Hope this helps,

Tom

QUOTE (Bob 4 Anna @ Sep 22 2009, 11:46 AM) <{POST_SNAPBACK}>
Add your new spouse to your US Bank Accounts, yes it can be done without them having a SSN!

Also, be sure to add them as beneficiary to your 401(k) as this in now required by law.

Finally add them as beneficiary to your Life Insurance. You can even get the spouse a small ( > $50,000) Life Insurance Policy with you listed as primary beneficiary.

You can include copies of the bank statements in both names, the forms used to add beneficiary to 401(k) and Life Insurance as weel as getting something from the 401(k) Plan Manager and Life Insurance Company stating the spouse is primary beneficiary.

All of these demonstrate co-mingling of financial affairs.

How did you get your spouse added to your bank account? I tried 4 different banks and all denied my request. I have added my wife as the beneficiary to my IRA and added her to credit cards etc. However the rest has been a dead-end thus far...

Thanks,

Hi to everyone,

It sounds like we will have to go to Guangzhou for the interview and final part of the process. It seems like Guangzhou has a slightly different process and can be a little difficult at times. Now to the stupid question, can we request our VISA be processed at a different Embassy in China?

Other. And then specify: I-130 petition. This is according to the sample form on the website.

We made the silly mistake of checking Status as PR as it seems to be the most logical choice, so we called up USCIS and ensured that they understood we were pursuing a CR1.

Hi all..

Ok Sachinky, so let me tell u what I understand from this topic (correct me please if I'm wrong )

When the petitioner (the US citizen) submit the G-325A Form for himself he has to check: Other, and then Specify: I130 Petition - I wrote it exactly how it fits in the space available in the petition if it's filled out on the computer.

When the beneficiary (the spouse of US citizen) submit the G-325A Form for himself he has to check: Status as Permanent Resident

Thanks all in this matter!

so now there are 2 different takes on how to fill it out...hahaha. is there anyone that's completed the process that can confirm?

Well I'm not sure that this is the best way but I checked both PR and other and wrote in CR1 /i-130 and it was accepted. My thought was that it covered all the bases and left nothing to chance. I need to update my time line, but we have moved along with no RFE's so far and our paperwork has moved to NVC so I don't think the way we did it was unacceptable.

Good luck and keep the faith, it is a long and trying process.

IR-1 / CR-1 Spouse Visa Process & ProceduresLooks like things are moving quickly at GUZ
We submitted our I-130 package in July and things seemed to move at the pace we expected. In January the NVC sent the package to Guangzhou. We were expecting a wait of about 6 months or more before the interview. When Jialian came home from taking care of things for Qingming Festival she was greeted by the package from GUZ and an interview date one week later (April 14). This seems to be much faster than all the processing time lines and other personal accounts indicate. I am curious if everybody is seeing the process move at a faster pace. Shoot, she could be here in less than 10 months at this rate. I hope everyone receives this kind of nice little surprise.

IR-1 / CR-1 Spouse Visa Process & ProceduresService Center assignment
Hi all,

I am just starting on this journey and I'm sure it will be a ride we'll never forget. I got my NOA1 in the mail and went to the USCIS web site to check on our progress and I noticed that it had been sent to the California Service Center which made me wonder why. I live in Florida and it would seem there would be many centers closer that would make more sense. Does anybody have any idea on how and why they select the service center your case is assigned to? Also is this a good thing or is can I expect it to take longer than if it went to Vermont?

Thanks.
