Is it normal for these NVC operators to tell you it takes 2-4 weeks for them to receive the cases from VSC/CSC? Must be their standard answer for everyone.

Hey SankuNiku

Lets keep in touch, since we were approved almost at the same time... I was approved on Dec 12. And it was touched today... I am thinking they sent it today to NVC. I was looking at other peoples approval and how long it took theem to arrive at NVC... and concluded that USCIS sends applications to NVC on Mondays and Wednesdays. I cannot say this for a fact, but it is the pattern I was able to see. I believe our application should be arriving at NVC around Wednesday. I really hope so... lets see...

Take care

Kelvin

SankuNiku

Have you called NVC today?

Hello all,

I need to know what should I do since I've only filed federal income taxes this year. 2008 was the first time I filed. I am from Puerto Rico. I moved to Florida in January 2007. Before this I always lived in Puerto Rico. There I only filed state taxes, but never had to file federal. What should I submit for the I-864 form? Should I submitt the Puerto Rico income tax returns I filed? Or should I submitt some kind of letter stating I did not file federal income taxes? What should this letter say? Does anybody have a sample letter?

Please provide all the information possible in regards to this matter.

I really appreciate everyones help... Thank you to everyone!!!

Sending the last three tax years is an option on the I-864EZ. They ask for only one. Just call and ask if you think you need to send in three years as added insurance. They answer all of my questions and have helped me on 2 different occasions.

Who should I call? Do these forms need to be translated to english? If so ....WOW!!! that will be hard....

IR-1 / CR-1 Spouse Visa Process & ProceduresHow long for me to recieve NOA-1
QUOTE (CescFab @ May 9 2008, 08:18 AM) <{POST_SNAPBACK}>
You may already have an NOA1. Here's what happened to me...
I sent the I-130 to Chicago on March 19, 2008, but I never received a receipt/NOA1 in the mail. I saw that most people that filed at the same time had received their NOA1 within 1-2 weeks.

Did your check clear? If you can acces a photocopy of your cleared check from your bank, you will see that on the reverse side of the check in the upper left hand corner there is a number starting with three letters and 10 digits (EACXXXXXXXXXX). This should be your receipt number. Try to plug that number into the USCIS online status system. If a case show up, then that is your case. The Service Center will be listed on the notification screen.

If you receive an error, then try the same number, only increase the last digit by one. That's what happened to me. I even called the USCIS customer service to confirm that this was my case. They confirmed it and send me a confirmation letter in the mail, which I'm using as my NOA1 which never arrived to this day.

Hope this helps.

THANK YOU for your information.... I just called to see if the money order I sent had been cleared, but they told me that it still had not cleared... So I guess I just have to keep on waiting. They told me that it may take up to 5 days for them to be able to see that it has cleared.

Thanks again for your info....

Hello everyone, I would like to ask if anyone out there can help me to understand the timelines better and well just anything there is to know to make things clear ,, I don't understand I had sent our paperwork to Texas in October, but now its in Vermont , this part i understand what i don't get is the timelines, I check uscis.gov and for the
I-130 they are still in July, how is it that many other apps are moving like I-139F applications, and not ours,

also I don't understand how you know when your case is touched, please clue me in, I really don't know any of this, also I just filed I-130 not a K3 , because that would mean that I would have filed an I0129F with this am i right?

I am so frustrated this is our second time going through all of this and I am as clueless today as I was two years ago when I did try to file an I129F
which was denied they say because it expired but while it was in there hands, we did all we needed to do, my husband , well then fiance had the interview and the women drilled him for over an hour. and nothing

Please please help, I would be so grateful

Good luck to eveyone

thank you for all of your responses. let me clarify. my stepdaughter turned 18 after my wife and I were married.

This was a key question and your answer clearly indicated otherwise. If she's 19 now and you've been married less than a year, you married after she turned 18. If the marriage took place before the daughter turned 18 then all options were available at the time you filed the I-130 for your wife. Did you also file one for the child that originally intended to accompany your wife?

How about giving the older daughter's full birthdate and your wedding date so the conflict between your first and second answers can be clearly resolved.

I was married on march 14 2008. the daughter in question turned 19 1 month later in April. I hope this clears things up. She was 18 when we got married

Yes, it clears things up, back to the original. CR1 is not available to the 19 year old because the marriage took place after she was already 18. K4 is but her status cannot be adjusted.

Answering accurately is critical to getting the right answers. I asked you if you filed an I-130 for the younger child. The answer is critical. If you didn't, then K3 and K4 is the only reasonable path left to you anyway. If you did file an I-130 for the younger child, that's good but if both immigrate, CR visas are off the table as K4 cannot combine with CR.

On the other hand, armed with the knowledge the 19 year old cannot stay long, you may opt out of including her in your wife's immigration.

I am sorry I am not giving you all the information you need. I appreciate your patience. yes I filed the I130 for the younger child and our papers are being worked on now.

We got married on September 7th 2007 after dating for 5 years and sent in the paperwork for I-130 in October 2007. Vermont Service Center acknowledged receipt January 15th 2008. Our application was transferred to the California Service Center in August 2008, 26th I believe. To this day, still no answer. We are held in total darkness.

The processing dates for the California Service Center are now within 6 months according to their website. We are way behind in the process, way outside processing dates. I (Julie) am getting very discouraged, I can`t stand not knowing if I`m coming or going anymore. As far as I can read in the forums, people who filed after us are already approved and moving along. Anyone else in the same boat as we are? Any idea on what can cause such a delay?

I was outside the timelines to and was very frustrated.I tried my comgressman and senators with no help. I call the white house and they put me in touch with the state department. my paperwork was approved the next day. it is worth a try.

Any idea, why they are asking for this information - this late in the filing process?

Application Type: I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: REQUEST FOR INITIAL EVIDENCE SENT, CASE PLACED ON HOLD

On February 12, 2009, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires. Once you submit the evidence requested and a decision is made, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your mailing address.

I got this same message on my case. when I got the mail it stated they wanted the original copy of my divorce papers from previous marraige. I got that and sent it to them and the process resumed. I was approved 30 days later. good luck

Wife yes, stepdaughter... no

my tax attorney says I can claim her. do you know something I dont. please advise

have your tax attorney explain how your non-resident alien step-daughter qualifies as a dependant, who I assume has never stepped foot inside the USA and is NOT a USC. Your spouse gets resident alien tax status not by passing the resident alien "tests" (greencard or substantial presence) but by special exception afforded spouses of USC's. This exception does not allow a non resident (non USC) child/stepchild to ride the parental "coat tail".

she will be a resident with a ssn when they arrive here hopefully before tax time. I do appreciate your input. I dont want an audit

So, I guess it's ok to file as single for those people whose husband/wife is abroad. Can anyone share their opinion? Thanks.

because my wife should be here by april 15th and she will have a ssn I am waiting to file until she is here. if she is not here by april 15 i will file for an extension. the refund for adding my wife and stepdaughter is worth the wait

Wife yes, stepdaughter... no

my tax attorney says I can claim her. do you know something I dont. please advise

I know it was my decision and nobody put a gun in my forehead and forced me to married someone from outside US but If I could I will sue USCIS because I'm going blind and bold! I'm crying almost every night and my hair is falling due to stress I can't concentrate at work and I have abandoned my social life and it has only been 4 months ! I got exited last week with the touch on my 2 applications but now I'm desperate again because it doesn't seem like a new touch is coming any time soon and worst no approval sad.gif I'm so jealous on CSC people not in a bad way I mean I'm happy for them specially for those whose spouse countries are difficult government countries but I NEED MY HUSBAND HERE!!! I WANT BABIES AND I NEED TO FEEL LIKE I'M 100% MARRIED !!! don't get me wrong I'm 100% committed to my husband but it just doesn't feel like this is a true marriage! sorry about this but I had to let it out!

Hello SraCastillo,

I am totally with you... I know how you feel... I NEED MY WIFE BY MY SIDE.... NOWWWWWWWWWWWWWWWW!!!! I feel exactly the same way.

We just haveto take it easy... Pray... and ask God to help us and give us strength... I will have you in my prayers...

Take care...

IR-1 / CR-1 Spouse Visa Process & ProceduresI JUST CALLED USCIS

Hello guys,

I just called USCIS and asked to be transferred to VSC. After demanding (in a good way devil.gif ) this I was finally transffered. But to my surprised when the transfer was answered I asked if it was VSC... and NOPE... it was some office in Los Angeles. Well anyway, I was attended by a Cuban lady. I asked her to give me more information on my aplication, since it had been already more than 6 months and I had no new information since May. She told me that on November 6, 2008 a transfer notice was sent to me. I asked her where was my application transferred to and she said she did not know. Here she put me on hold and when she came back she said that she was having problems with her system. Well anyways.... I asked her again ... Where is my application being sent to... and she said the same... that it was being sent somewhere else but she did not know... Here I said so ... it should be sent to California because VSC and CSC are the ONLY 2 Service Centers that deal with I-130's.

I wanted to share this information with everybody here... and also ask: How is it possible that this doesn't appear on the USCIS website. I haven't had a touch since May 14. Well I haven't received any notice in the mail either. If this information given to me by this lady is true I should be receiving the notice at least by Friday.

I AM GETTING SO DESPERATE!!!!!!!!!!!

LETS SEE WHAT HAPPENS!!!

A lot of IR-1/CR-1 petitions that were originally sent to VSC are being transferred to CSC. I also heard they are having problems with their computers or something at VSC. A lot people being transferred to CSC have been getting their petitions approved pretty quickly also so if you truely did get transferred to CSC, it could mean a really quick approval. Good luck to you and your wife!

jurod16

THANKS JUROD16 A LOT FOR YOUR POSITIVE FEEDBACK!!!! I really hope in God we get our approval soon... really soon.
