So I received my RFE in the mail today. Apparently I forgot to answer whether or not my fiance and I are related. The funny thing is, we already have the same surname, so it must have looked suspicious. Happy it is such an easy fix.

Does anyone know if I just refill out the original I-129F application with the original dates and all or should I update the application with the current date? Thanks for the advice!


This is my Best Guess and see what other Members think:

I would not suggest filling out another 129-F and back-dating the Original Document. Why: The 129-F has a date, the NOA1 has a date and the RFE has a date. Your answer to the RFE should be Currant to date.

What you could do is: #1. Fill in the answer on a Separate 129-F that addresses the question and sign and date it. Mark as "Attachment" for Request for Evidence.
# 2. Answer the question on a Separate Sheet of paper and sign and Date it. "Mark As Reponse to Rquest for Evidence"

This is guess work. Me, I would do both # 1 and # 2. It would also be a good idea to send a copy of the NOA1 and a Copy of the RFE with your reply.

I read you should only send copies and save the originals in case they lose them or are requested at a later time. However, on the "Letter of Intent" letters I had them both notarized at the US Embassy in the home country (Thailand) of my fiance (beneficiary). Should I send the originals or copies. Are there other docs that should be originals ?

One more question. Do I need to send only $340? I read somewhere about a fee for biometrics??

The letter of intent can be scanned but the signature and date must each be signed separately IN INK. One Letter of Intent for you and One letter of Intent for her. SEPARATE DOCUMENTS. The 129-F Fee is $340.00 made out to US Department of Homeland Security. Other fees come later.

Is there a reason your fiance cannot support you? That should probably be addressed first since you will not be able to work for some months after arrival (3-6 months usually) you will have a lot of expenses (more than $1000 just to file the AOS) and you cannot expect all these people you are going to will actually pay your living expenses, right?


Yes, The NOA2 is already approved and there is no deffinate Sponsor. It is all guess work. Parents, changed their minds, He has a friend I dont know I have a friend he don't know. Being a Co-Sponsor is a serious issue. The Economy is Rough but making $11.00 an hour to meet Income requirements should be obtainable. Not practicing what I don't preach. I'm looking for a $11.00 an hour job now. ($20.00 an hour don't matter at this time anymore) My case is already in Manila. I don't rely on a Co-Sponsor or even ask. How important is the rest of your life and how important is this to you. The Petitioner much REACH DOWN and try to succeed like I'm trying as well. Soon you may find yourself with a letter from the Embassey to schedule your appointment and find out like me you will have to schedule a delay if they approve it. Caution: They make that Decision. Yes, its late. There is no such thing as WE when Fiing the Petition. The Beneficiary dont count as income. The Petitioner must show 125% of the Poverty Level which is about $18,400.00. 2010 Taxes are good to have and a good idea to include. But, you indicate that 2011 and currant income will break that mark. Keep in mind:
Example: if your currant wage is $12.00 per hour and full-time then your annual income you will list is $12.00 per hour X 40 X 52 weeks. = $ Currant Income of $ 24,960.00 over and above the Poverty Line. Does not matter if you only started work in April. Currant pay stubs for 2011 are important and a letter from the Boss/Company.
AGAIN: If for example the currant wage wage is $12.00 per hour and show proof then your Annual Income is $ 24,960.00.

This is a Good Idea to include. There is a Child Involved and shows Support for both of you.. Save those payment reciepts and volunteer them if asked.

Of course he can accuse you. If he has evidence to back up his accusation then the US government may conclude you are guilty of visa fraud, and a finding of material misrepresentation would be entered into your case file. You'd never be able to come to the US again. On the other hand, if he doesn't have any evidence (which is likely) then his accusation would be entered into your case file, but the US government wouldn't draw any conclusions from that. However, a consular officer who is interviewing you for another non-immigrant visa would see that accusation in your case file, and they would be free to consider it when making the discretionary determination whether to grant a visa to you.

The consular officer has a lot of discretion in most types of visa cases, and they can give any derogatory information in your case file as much weight as they think it deserves. You'll be much better off if there is no derogatory information in your case file.


So this means to me Kamilla. Cover your Butt. Hard to accuse you of Visa Fraud on a K-1 if you Willfully declined it and never entered the US. Declined the Visa on your own and free will. Your reason maybe asked. I would say prior mental abuse. MENTAL ABUSE is threats, overpowering authority and fear.

The petition isn't closed when the visa is issued. It's closed when the visa is used to enter the US. The petitioner can still withdraw the petition.

The OP can return to the consulate and have the visa cancelled. The consulate will simply stamp the visa cancelled and enter the cancellation into their computer system. The visa itself should not be removed from the passport. You should never intentionally remove pages from your passport.

Kamilla, if you intend to apply for a student visa then you should probably stop communicating with your ex-fiance. An accusation of visa fraud against you may cause problems with your future visa applications.

I won't judge you. But you need to pursue canceling the Visa so it don't interfear with a posible student Visa. If your ex is threatening you with immigration topics against you. The petitioner is not needed. While the petition was the petitioner's, the visa application was the beneficiaries. The only action the petitioner could take would be to cancel the petition if it were still active and it is not.


Sorry but I might be confused. Read the First Post by the OP. The Visa seems 100% Active and is asking how to Cancel.

Do not destroy your passport, copy it have petitioner send a letter along with your notarized letter of intention. USCIS or DEPT of 'State will review this for your student visa. Sorry good luck.


Just to Cover Basis: And this is true. What if the Petitioner does not wish to help the Beneficiary. We dont know what Country so Members can't provide Links to the appropriate Embassy. I agree that if the decision is made that the relationship is over then the Beneficiary my provide proof that she wishes to decline her Visa. Remember though, we don't know if it a K-1 or a CR-1 or whatever. The situation my differ depending on the Visa. I'm sure other members could give better advice if more detail was included.

100% of the poverty Level is not enough unless Military. The 125% Level is required. Before taxes is Gross Income. In this rough economy even so: $ 10.00 an hour Full time exceeds 125% of that level. ($10.00 an hour x 8 X 40 X 52 weeks = $ 20,800.00) Which exceeds the poverty line for 2 which is about $18, 400.00.

Incorrect Answer : A copy of the Divorce Decree is needed but this usually is associated with the Approval of the 129-F or NOA2 Approval. What is needed is:
A Stamp or Seal on the Document from the Court House containing every page if the Decree. Signed/Initialed by the Country Clerk and dated. A scanned copy is No Good. Some Certification of the Document is needed and this is how it is done. Been there. done that. RFE for not knowing myself. The Original is needed.

That expiration is meaningless.....the Embassy has full control of your paperwork and can automatically extend things as they wish....there is nothing to do or worry about.


Respectfuly, not true. The Embassy does have full control of the paperwork. That expiration date is there for a reason. The extension is not always Automatic. A extention generally requires the Petitioner to request an extention. To think there going to do this for you without contact to that Embassy will result in refiling you Petition all over again and paying the fees/paperwork all over again. Giving someone advice to not worry about it is incorrect. Sorry Baron.

Yes, but needed for completion of a Visa. I just feel it would have been a good idea for the beneficairy to know this earlier. There is a question on this subject. It should'nt take that long to get a Passport. To me, that means "Procastinating". Not in a hurry for that Passport.:blush:

I see nothing about a Expedite in the OP. I see only that the beneficiary had No Passport at the time the K-1 was Filed/Petitioned. You cannot pay a Visa Fee or schedule an Appointment without it (Passport). One post above mentioned she should of already had a Passport (Good for 5 years in the Philipphines) My Attouney, before even filing the K-1 asked for hers but I have seen here that the beneficiaries Passport maynot be immediately needed legally but needed soon. Just thoughts on what I seen and the rules to getting a Passport. It was a mistake for the beneficiary not to get her 5 year Passport Earlier but I think if communication between the Embassy and the
Applicants to not thought of a Passport beforehand, but happens.....

hi everyone, finally in about 3 days from now my fiancee will be able to get her passport and pay her visa and schedule online for an interview. My concern is that our visa petition was approved in May 11, and because of the passport taking 3 months to be made delayed us this long, i was wondering if i should be aware of something expiring? i was going through the mails i have received from USCIS i notice from the I-797 notice of action has an expiration date of(9/102011) do i need to renew this? and is there anything else i should be concern about? thanks everyone.

Your Timeline is not up to date. The NVC should have issued a Philippines Case # or MNL.. You can't schedule an appointment to my knowledge without it. Call NVC at 1-603-334-0700 and double check.

I see no reason why you can't get an appointment. However, keep in mind you might be seen by a CRS Customer Service Representitive Only but, you never know. I would make the appointment if something is bothering you or on your mind. CSR's don't have all the information available to them on there screen. Take a Chance and make the Appointment.

I would assume you know more about your fiancee than "a man that claims to know the immigration laws." His knowledge of immigration law probably is greater than his knowledge of your fiancee, unless he knows her personally. I would think you determined the motivation of your fiancee before you asked her to marry you, if you had any doubts you would've had them long before your conversation with that guy.

You can not change her motivation (if it is not genuine) nor can you avoid the I-864. Let your doubt be based on your experience and not that planted by others.

Look at 90% of the replies. The 864 Form was completed by all of them and could'nt wait to do it.
If you listen to friends and even sometimes family and get persuaded to turn on your Finacee. Then call it quits now.
