Well Mike. I was hired as a working Foreman. The last 5 years Ibeen sitting behind a desk and Unemployed for a year and a half with no physical activity really. What my brain knew VS what my body could do were 2 different things. Soon I found out. My legs felt like Rubberbands and it showed with my performance on the job.

Ok so i am thinking of having the same passport photos printed of my fiancee that we sent in with the original I-129F packet for her to take to her interview. I know they want recent photos but she looks exactly the same will this be an issue and how recent is recent in the eyes of the U.S government?


Recent Passport Pictures are 6 months or less. (maybe even 3 months or less) It depends on how "picky" the CO is.
You are not dealing with the eyes of the United States Goverment but dealing with a separate Entity and that Countries Rules. For the Interview and what comes next requireing Pictures. Recent.
I don't think I'd take a chance and (not) spend the few dollars required for new pictures and save the reciept which is dated.
On a safer note: her pictures will be updated for Arrival in the US and for AOS.

I sent our reply to the RFE on June 14th and USCIS received it June 17th. We have since heard nothing. Our case worker
at USCIS must be a chain smoking, caffeine addict. Too busy on smoke breaks and coffee breaks to do his/her ****ing job!
This is absolutely getting ridiculous. My fiance and I spent 189 days together in the past 12 months. How much more

This maynot be a Wise Choice. Your ealier post says you have not Filed yet but this post indicates "While the K-1 is being processed." Plain and simple: Your 129-F will indicate a Intent to Marry and come back and bite you hard. The Official Approval started with USCIS when you Filed your petition.
If you want to cause a problem for yourself this is a good way to start. You made a Contract with USCIS and finding Loopholes such as this will be caught. The Key Word is INTENT.

As to charges. You don't have to explain any charges against you (anyone can be charged with anything". CONVICTIONS is all that matters. As an example - you can be charged with simple assault, but during plea bargaining your attorney was able to downgrade charge to public disturbance, so you were CONVICTED of public disturbance and it all that counts. Or outcome of case was conditional discharge.... So guess what - you weren't even convicted, once that conditions are met). If you were't CONVICTED on crimes listed on I-129F and didn't have 3 or more CONVICTIONS on controlled substance - answer to question number 2 in "NO", and you didn't have to sent them any explanations or dispositions. There is very clear and simple guidance on which crimes they are looking at.


Please don't be my Attourney even if there are no fees.

Extra background checks can be added for a variety of reasons, criminal record being one. What they are actually investigating might vary - it may be just the criminal case but it may be that the information you provided set off a flag that has them checking other things more carefully as well. As far as I can tell, there is no way to get USCIS to tell you what parts of your background they are actually investigating.

In a lot of cases they only add an extra few weeks, sometimes they add months (my case so far). In very rare cases I've read about a year or more - but those had Adam Walsh Act issues. You may have to wait a bit longer than most petitioners without the red flags but should be approved eventually. Good luck!


:ot2: I don't think the Adam Walsh Act is admissable here. The OP knows his background and no mention. The OP would know he would need a Wavier if in fact a Violation of the Act and Hire a Immagration Attorney and still chances would be slim. It is not uncommom for awaiting a NOA2 when providing required information about background. Answering a question truthfully is not a Red Flag but avoiding a question is.

After inquiring with USCIS a few days ago about the possibility of having my I-129F case expedited based on financial emergency, I was rejected. The email sent by USCIS informing me of the rejection said the following about my case status:

"...Until the background investigation is completed, we cannot move forward on your case. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete."

Now, my question is to the nature of this background check. I informed USCIS of my past run-ins with the law--i.e. that I have a couple of misdemeanor marijuana possession charges as well as a misdemeanor simple assault charge--each of which date back to 2005 and prior. I have long since served the required probationary sentences, and have been without even a traffic ticket in years. I sent the USCIS certified documents from all of my local authorities. I believe that I was very thorough in my presentation of the facts concerning my background.

So, does anyone know if this deal with my criminal background is the reason for the postponement? Or could the statement above from USCIS include more than just criminal background--i.e. maybe the background of my relationship with Julia, my work background?

Quite simply, I am confounded as to why this case is taking so long to be approved. I see others all over Visa Journey who've received their NOA2 within two or three months, and I am now 6 months removed from my NOA1, and not a peep. Well, that is until yesterday when I received word that an expedite is not possible. I suppose I can be grateful that I heard that much!

Despite all of this: I truly believe you have a good chance for approval. You were honest. Pay more attention to staying in touch with your fiancee and keep records.

An Expedite is the least of your worries at this point. You have multiple criminal charges and more than likely will be deemed inadmissable. Not sure if a waiver is even possible.

An individual may be found inadmissible if he or she has been convicted of or admits committing a violation of (or conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance. Any drug conviction or admission of the essential elements of a controlled substance offense will render an individual inadmissible.


Respectfully, I think the petitioner is the one with issues. So there is no admissability issue about the beneficiary here from what I read. However, if the Petioner fails then the beneficiary lost as well. Only time will tell on this one.

The I-129F only asks for CERTAIN types of convictions many of which don't apply to the average person (besides domestic violence).

You are correct. Only offences that involve a spouse or a child. and / or drugs arrests. In 1987 I got mouthy witha Policeman and he arrested me for Disorderly Conduct. I got the desposition from the Courthouse and it showed I paid a fine. It was a Conviction but the Attourney said it was irrelevent to the 129-F and not ever disclosed. It was not an act against a child/female or drug related issue. Its on my record but USCIS did'nt care.

I don't think that the OP is suggesting the the assault charge was "simple". The charge was Simple Assault...as opposed to say Aggravated Assault. In most states its the difference between a felony and a misdemeanor.


Good thought ! The is a difference between a misdemeanor assault and a aggravated . Felony VS Misdemeanor. The OP stated simple assault (Whatever) VS Felony in which a Waivor would be required. The OP indicates to me from a simple post a misdemeanor but I'm guessing.

I seem to have read somewhere that only the Adam Walsh act would deny you the right to petittion. All other charges would be documented and presented to the recipient to make sure they were formally aware of any thing that was in your background. You opened a can of Worms requesting an expedite when you knew your Criminal Background. Alcohol is Legal, Mary-Jane is Not. The Assault Charge is NOT Considered "Simple". And it was less than 7 years ago. All you can do is wait.. It's good you sent Certified Reports to help speed up the process as best as posible. Good Luck.

I can see how these packets can get bigger and bigger. I put residence and employment together and it looks fine. Should these be an included document in the cover letter.

Also I do not have the passport stamps included as of yet. The are very blurry in the passport. I do have the copies of 4 (different trips) boarding passes.
It is necessary to include these stamps with the boarding pass? Also if yes the whole passport copied? Marked with highlighter? Or just specific pages?


What you wrote here looks fine. If the the stamp is blurry then it is. Get BEST COPY. AVOID a Highlighter on the Passport. (It would be a distortion of a Legal Document)

What would also help is a photocopy of the biographic data page of your passport, as well as the stamps to show the dates that you were in your fiancee's country at that time, that's what my fiance did. Also, if you could include some pictures taken of you and your fiancee with her family, that would also help.

Respectfully, Dale hotel rooms and lodging in your name mean nothing. You could have been there and never met your financee' Secondary Evidence is not a Motel Stub. Although pictures are considered secondary they are more important than a Motel Payment stub. However, its best to all the proof you can supply.

For my G-325a I need extra space for residence for last 5 years and employment last 5 years.

It is well known the 325-A has little room to write to cover the last 5 years. Simply make an Attachtment/Addemdum on a 8"x11 paper and cover those periods for the 5 years and Mark "Attachment to 325-A" It is very important you sign and date this paper as well.
Proof of a On-going relationship is for your interview and boarding passes are very important and pictures are already supplied in your 129-F Petition.

You are totally inaccurate here - she states she comes to see fiance - 100% legal. Nothing wrong with intent to meet someone (quote obvious she did not come to meet Statue of Liberty) either. USCIS will not open any can of worms - why would it ? Again, not sure when you read OP came here with intent to marry ? And to make it even more funny, intent to marry would be 100% legal too as long as she will not intend to stay. It is the immigration intent at the entry time that is not legal.

The form I-129F for K1 visa can be filed anytime by the USC. The process can begin before your authorized stay expires. As you are already aware, you will need to leave when your authorized stay ends.


I'm going to agree with Ryan on this. And disagree with Anh Map for these specific issues that will arrise later if you Marry on a Visitors Visa (when you stated I came really to see my Fiance) and now want to stay. If your Passport shows a Visitors Visa, Holiday, whatever and your true intent was to see your fiance and Marry and looking for a Loop-hole. To the System. RED FLAGS.
While your together get your paperwork together for either a K-1 or a Spousal Visa but you will still have to return to your Country and wait as we all do. You see, your real intent on your Visa was to see your fiance but you marked Visitor/Holiday (never heard of a 6 month Holiday Visa but I don't know everything.) How are you going to explain to USCIS this later? I strongly encourage Ryans advice and get your K-1 Petition going and Do not Attempt what you know is wrong or you would have never have asked "If We Know A Loophole." There is No answer to this but to me and I wish you luck would appear to be Visa Fraud and give your Fiance a big kiss if deported and banned. PLAY IT SAFE. Love Requires Rules and so does the System with USCIS.
I'm courious what Gary and Pushbrk will say. Just my thought.

K-1 Fiance(e) Visa Process & ProceduresReceived RFE in the mail today...

So I received my RFE in the mail today. Apparently I forgot to answer whether or not my fiance and I are related. The funny thing is, we already have the same surname, so it must have looked suspicious. Happy it is such an easy fix.

Does anyone know if I just refill out the original I-129F application with the original dates and all or should I update the application with the current date? Thanks for the advice!


This is my Best Guess and see what other Members think:

I would not suggest filling out another 129-F and back-dating the Original Document. Why: The 129-F has a date, the NOA1 has a date and the RFE has a date. Your answer to the RFE should be Currant to date.

What you could do is: #1. Fill in the answer on a Separate 129-F that addresses the question and sign and date it. Mark as "Attachment" for Request for Evidence.
# 2. Answer the question on a Separate Sheet of paper and sign and Date it. "Mark As Reponse to Rquest for Evidence"

This is guess work. Me, I would do both # 1 and # 2. It would also be a good idea to send a copy of the NOA1 and a Copy of the RFE with your reply.
