Thanks for your reply. So I think this might come down to some details that are too difficult for even a lawyer to answer. Wisconsin apparently unconstitutionally exerts its authority to prevent my remarriage anywhere in the world for 6 months, although they have absolutely no way to enforce that. Probably any other state without this waiting period wouldn't care and would allow me to walk into a courthouse and remarry, as per their own laws. My problem will then be how on earth the federal authorities reviewing the visa petition would perceive this. The state in question where I would most likely be legally allowed to remarry is California. So at the same time it'll be legally prohibited and legally allowed for me to remarry, and I have no idea what the USCIS would decide about it. Nice way to get caught between a rock and a hard place...


Again, only a opinion. But Wisconsin is Not Relevent to your Petition. USCIS is going to be reviewing your Petition and that takes Months. Then you have an extra 90 after the arrival of the Beneficiary. That process is about 9 months. In addition: If the Visa is Approved it is good for 6 months. This could last well over a year. Way over if you wish.
Your State has nothing to do with a Petition to Marry, you are not getting married. Your not saying I DO. Thats a long time from now. YOU PETITION IS NOT GOING TO THE STATE OF WISCOSIN. When you Finalize your Divorces. In my heart, I fell you are free to execute a proper 129-F/Fiance Visa request.

As Dan stated you have to be free to Marry before Filing. OK. Thats said.
Your asking after both PAST Marridges are Disolved and legally File a 129-F you know there is a length of time for the whole process, by that time this 6 month law I never heard of would have passed. Therefore, in line with State Policy and USCIS.
The best answer is not from me, but I just wanted to clarify your position so other members understand what your asking.
The 129-F only asks: Are you both free to marry. The process takes months and months. Your Petition is not going to the State but USCIS. I think you will be fine. But only a Opinion. I think it is safe to File after the marridges are dissolved. It will take time for your Petition to get approved and thus, free to marry again after this 6 month rule I never heard of. I'm thinking of the time it takes for approval and also the 90 day requirement to marry. You got alot of time there if what I think is true

The 129-F does not really ask How you met. Thats clarified in the Petition. Its a simple page. Myspace, Facebook, through a friend, work, etc.
My Attorney wrote: We met Online 3 years ago and we wish to marry upon her arrival in the US within 90 days. We are in Love. Thats it.
Your other documents meet proof of meeting within 2 years.

I agree with this 100%. The Beneficiary would have to transfer funds 100% into the Petitioners Account/Not a Joint Account. That kind of money for a Young Couple seems hard to have to me.
As Gary said: Even falling short of a lump sum into your Account would require a Co-Sponsor in which, yes. Assets could be used as well.
You have'nt even Filed the 129-F as yet. Your not working right now. It's not over, take your time. Don't quit school. Life is not that much of a hurry. Think like USCIS would think.

I did not read all of the replies,, but to say they lied is pretty strong. Overly optimistic might be closer to the truth.


We are on track from submission to visa in hand of just under 6 months and that is with 1 RFE.


A lot of things to be factored in not to mention that Vermont has always been slower and is extremely slow compared to California right now 122 vs. 66 days. I personal do not recommend an immigration lawyer at ($1000's) but unless you have the time to research, I do recommend the visa services at ($100's) to speed up the process. I am using YFW visa services as they specialize in Filipino and know that process very well.

My thought why Attorneys and Visa Services and alike say they can speed up the Immigration Process. Its the paperwork .. Most people get overwhelmed by the forms and requirements and will sit there for weeks looking at it. (Like I did) Then, we give up and seek help. So there promise of speeding up the process is true. (IF YOUR STARING AT IT AND NEVER FILE THEN THAT SLOWS THE PROCESS) They make money filing your paperwork that we did'nt fully understand and were afraid to do it alone. So thats why they say we can get it done faster and is a legal statement. As far as the legal USCIS process it is no faster than you filed yourself.

I started a new job on February 1, 2012 after being unemployed since my graduation from graduate school in May 2011. My current salary is well over the 125% of the federal poverty guidelines for my household size, so I know that that part of my affidavit will be adequate. I am wondering how much significance my previous unemployment, and before that, living off of student loans for 2 years while in graduate school, while have on whether my affidavit of support is approved.

Being in School is a good reason for unemployment. There is a 9 month Null from the time of Graduation to a Full-time job.
Make a Time-line. How long ago did you File the Petition? There is plenty of time to show income for the interview/and or delay the Petition.
Keep Currant with the Student Loan Payments and show proof to your Finace'Fiancee' if asked at the Interview.
The Employment Letter is the most Important of things here to show Support.
Make a Time-Line. Makes it easier to answer questions.

If you wanted to write DEPARTMENT OF HOMELAND SECURITY but there was only enough room to write DEPARTMENT OF HMLDSCY I'm sure it will be fine. If it said DAVID COPPERFIELD then you will have issues. I have yet to hear of any money order being challenged if it is not stolen. Intent goes a long way with checks, I have cashed them with my name spelled very wrong, and you can always deposit a check or money order with ANY name on it. No one looks.


Some/Most Money Orders ask for the Name of The Payee and Full Address. Not needed Really and there is no room to write.
The reason I do not recommend MO's is if they get lost or a incorrect payment amount they are NOT immediately refunded and can take weeks to get the Funds back.

It's fraud to use someones card unless your name is on it without the cardholder present. You can actually get into a mess of trouble.


I agree, the cardholder is the only person to know the PIN# as well. The Bank will not honor transaction fraud if that Pin# is shared by anyone other than the Cardholder's Name.

It's not the class/type of crime, but whether it is a crime that involved 'moral turpitude', I believe?

For Immigration purposes: Moral Turpitude Offenses apply to the Alien and not the USC. Thats a different Boat. Notice the word "Alien" used in the above link. Any acts of the USC in Violation of the Law are considered Misdemeanor/Felony but also it is A Violation of Moral Tupitude but is Not Classified that way for USCIS.
USCIS will ask for other documents that will pertain to the USC's Conviction.
It really would matter what the Felony was in the case of filing. Be prepared to have Court Records, Rehabilitation, ETC.
Do not Attempt to File your 129-F without these Documents/Certified.
If the OP would come forward and State the Felony then he/she could get better advice and see if a Waivor might be a good choice.

The only place this seems to exist is if you are going to the USA from the Philippines as an immigrant. It seems some Philippine airlines may offer some type of discount but that is all.


Inky, I Only see it a Sales to the Customer to make a Commission making them think they got a good deal. The Only trick is to do homework on different Carriers and Book in Advance.
There is No such thing as A Immigrant Plane Flight. If I owed that Plane, I would be out of Business in a Month.
Someone show me that where-as there is such a Airline. And if they did, It would be mis-leading. Search Rates by different Carriers and book ahead in advance with Visa in hand. The best DEALS are Non-Refundable you know.

Not to be Negative but I never seen that. Airlines are "For Profit". Whats worse is the increase in Fuel Prices passed-on to the Consumer. Winter months do help for a Flight but this is not Winter but Spring.
The best you can do is book a Month in Advance for the best deal and a LOCK-IN a Seat. That will Save you money. But, hard question as to Book a Seat without Visa in Hand.

Interesting Post OP.. You left alot of Members guessing with no Timeline. I see you have posted a Timeline and makes it easier to reply.
To begin with: There is No extention to a 129-F - NOA1-NOA2. You MUST Understand that your File was transfered to the Philippines and you have a MNL# . As other posts/replys indicated you, THE PETITIONER must ask for an Extention. The Philippines will allow extra time automaticaly in most cases but not a guarantee if you don't contact them. Your Case is In The Philippines. The NVC knows your MNL#. 1-603-334-0700.
Here is what you do. Listen. Have your Fiancee go to BPI and pay the Visa Fee. That is good for 1 Year. Your case is Locked in...... She will need ID, MNL#.
This will give you time and less worries. Pay the Visa Fee. !
When things are in Order take the Medical which is good for 6 Months.

I'll try and Clarify whats going on.
Assuming with NO RFE's after 6 months you can put in a Service Request for USCIS to review your Petition. I assume this is what you did and your Congressman. However, they need a few days to review the File. Your timeline shows 6 months and a few days. Its a week-end and today is Sunday.
There is a record of calling USCIS and a record from your Congressman. GIVE IT A FEW DAYS NOW. One of 2 things will/should happen. NOA2 or RFE.
You should hear something by e-mail or NOA2 soon. This is the best I can do based on what you posted today. Patience I guess.
Did you and your Congressman use the word "Service Request"

This appears to be an OUTRIGHT Denial. I'm not sure if you can Appeal the decision or have to start again.
