U.S. citizens who will be getting married to a foreign national in the United States may petition for a fiancé(e) classification (K-1) for their fiancé(e). You and your fiancé(e) must be free to marry. This means that both of you are unmarried, or that any previous marriages have ended through divorce, annulment or death. You must also have met with your fiancé(e) in person within the last two years prior beginning the K-1 Visa petition process (filing the I-129F). This requirement can be waived only if meeting the non US Citizen's fiancé(e) in person would violate long-established customs, or if it would create extreme hardship on the US Citizen.

Though a good thought. It really does not apply to the OP's question. However, it is a true post by the Member. The Petioner should be aware of this "I would Think". The OP is just starting the Journey and that as we know "SUCKS"!

Thank you all those answeres were helpful and special thanks to Tim/mav. Another question about the I-129 do i have to include a letter saying how I met my fiance and history of our conversation or does that come later. The reason I asked is Tim/Mav provided a link and in it it says a cover letter for I-129 saying how you met your fiance but on the instruction and the form it doesn't say provide a cover letter. I hope all those questions are not dumb but am still a bit confused. Thanks all.

The very first page of your Application/Petition is a Cover Letter.
Did you Meet on Facebook, Myspace, etc. How long you known eachother, how regular you talk (Skype, Yahoo) Send a few pages of proof with the petition. Thats all included in the Links.
Some VJ Guildlines are inaccurate but for the most part enough.

Yes, You are highly confused. Not to worry, so was I.
The 129-F is the Initial Petition for your Fiance (Thus, you are applying for a K-1 Visa) They are the same. But, you must File your 129-F and paperwork for the Petition and the result would be a K-1 Visa approved.
I would ask as many questions you need here. Based on the question: If I gave you a gun and told you to hit that Barn. And you missed. I would tell to you, get help or ask questions.

Ok, great! So another question is this... My "income" consists of child support and alimony. I do not have tax records for the past 3 yrs for this reason. Will this be a problem? Also, is the child support considered income? And are my 2 minor boys considered my dependents or my ex husbands dependents. I have full custody but he sees them every other weekend and pays child support? And do I count my fiance as my dependent while figuring out if my income is sufficient? Child Support is considered Income is you have records of continous Support by Bank Records, Payments, etc. If the Children reside with you over 50% of the time and you have Custody they are Considered YOUR DEPENDANTS. If petitioning then you will need to add another dependant. So the Household is 4..... (Finance) Alimony is also considered Income if steady and proof. No Tax returns will hurt. Meaning: Not working.
Are you on Goverment Assistance. (Food Stamps/Medical ?)
You have to determine what you Annual Income is. Someone can answer the requirements for a Family of 4 but I'm going to ASSUME about $28.000.00 per year. Thats hard to CUT.

Canada is very Strick I know. You may consider talking to an Attorney and see if you need a Wavior/Or/Whatever.
When you use the Words "Go to Criminal Rehab for 2 years indicates you did'nt follow guildlines of your probation but that maynot be true as your information is incomplete.

Just a short answer: no problem. As long as your fiancee did not lie on any of the 5 B1/B2 applications or interviews it will not affect your K1 at any stage.


All Tourist Visas were denied. Is there a reason? Yes Somewhere there is. But tell the OP Not to Worry about the K-1 Petition when it goes through the same Department that has a record that everything is OK. Well, thats Obsurd.
There is One good thing. The Petitioner will be given (Maybe) a RFE and have in writing a reason and allowed to give a reply.

yes i totally agree, i was just saying to tim/mav they do not have to give reason and if they do it may not be one that make any sense. Like i said for each of my 3 denials a different box was ticked. Also the first time i was denied i didnt even get denied at the interview i was told i would be getting the visa within a week. then my passport came back with the 214b which was strange to me. My only reason i cant think of is that i had spent a lot of time in the states already on other visas. but they never actually said that?

Ok, 9 FAM 41.21 does generally require that a consular officer provide written notice to a visa applicant explaining why their visa was denied, in accordance with INA 212(b)(1). However, INA 212(b)(2) and INA 212(b)(3) provide a huge caveat here. INA 212(b)(2) says that the Secretary of State (meaning, by inference, the Department of State and it's employees) can waive this requirement for any individual alien, any single class of alien, or multiple classes of aliens, entirely at their discretion. INA 212(b)(3) says that the written notice requirement does not apply to someone who is denied under INA 212(a)(2) and INA 212(a)(3), which covers most of the criminal and security grounds.

The real catch-all here is INA 212(b)(2), which basically allows a consular officer the discretion to decide whether to produce a written explanation of the denial for any individual alien.


With that said; I have seen several posts by which the OP tries to AVOID telling everything in hopes to get an Answer they want to hear. Assuming that they were denied on the basic of not being able to demonstrate enough ties to home country, then they will have no effect on your K-1 application.
Basically, the consulate is afraid that your fiancé is going to the US on tourist visa and will never come back and told her to wait for the right visa to be issued ( K-1)

Of course, there are also other reasons that make a person inadmissible to the USA such as drugs, criminal records and such. If she was not denied because of this then she you got nothing to worry about.

Your Timeline indicates: Petition sent January and NOA1 Approved. That only means they cashed your check and the paperwork was completed properly.
However, you state his tourist visa has been denied repeatedly. There has to be a reason? What is The Reason For Denial ?
Will this be an Issue with your K-1 Petition you ask ? Apparently, even before you Petition was filed he has been denied access to the US. So What is the reason for this ?

So I definitely do not want to meet my fiance before the wedding. This has to do mostly with my financial difficulties and I feel it will be simply too much emotional hassle waiting wedding if I see her before. This is an arranged marriage as well. Good day everyone:

Do I need letters from friends validating they have seen and witnessed my fiancee and I being together? I lived in the Philippines and dated her for 6 months prior to me leaving for US late August. We have many friends from all over the world that can validate our relationship if needed. Or will photos and everything else from checklist be enough? As mentioned in other posts, this is my second time going through the K1 as I hired an Attorney first time with my EX fiancee. My former Attorney had me obtain letters from friend which I now wonder maybe was not needed based on forums I am reading along with the guidelines from VJ.

That Answer is NO. You do not need letters from friends. Also USCIS does not ask or require this.
The Only Document I can think of is if the Beneficiary is underage and permission from the parents is needed.
However, if you please. She can provide friends wriiten statements for her interview but that is not needed as well.

Check NO on the 129-F. However. Though a Cival Issue with no Arrest you stated: A mandatory Protective Order(s). Those are ONLY signed by Judges. In hense, there is a record if in fact you were required to go before a Judge and they even dropped the Case(s). Dropped Cases do show on a Background Check. If related to an attack on another human being more so. Police can dismiss charges if they want, but only a Judge can give a final Order. Since the requirement of a Court Appearance and She/he never showed.
The problem would be if the reason for these Orders (even though dropped) was a result of Domestic Violence.
Moreover, 3 recent Charges. That just don't look good at all.
USCIS has a LEGAL Responsibilty to ensure the safety of a Beneficiary. Thats the way they will look at it.
Visit your Courthouse and get the paperwork on these charges/allegations but, you can check NO to your question and pray for NO RFE. Get Certified Copies and Stamped/Dated by the Court Admistrator.
Reality ... 2 Court Orders and a Stalking Order. You been busy.

Get a letter from your employer before you leave stating your wage and hours per week. When you start your new job get a letter from them stating your wage and hours per week. You will need to supply bank statements showing your pay deposited into your account. A letter explaining you were a fulltime student in 2010/11 should accompany this, as well as a receipt showing you paid for the semesters you were at school.


I Agree with the Employment Letter and being a Full-Time Student. But, a Bank letter? Proof of paying-off a Student Loan?. No, Not really. Irrelevant.

How long do I need to work at my current job in order to file the I-134 (affidavit of support) for my fiancee K1 Visa?

I have already sent the I-129f package (Fiance(e) Petition). My fiancee and I are engaged and having a baby, she is in the Philippines and I'm here in Seattle we been together for over 1 year now. I have been a student in college and was unemployed from 2010-2011. I now have a job that pays $11.50/an hour ($22,080 annually) and I just started this week at this new job now will this be a problem when I file for the I-134 since I did NOT have income tax filed for 2010 and 2011 but now I do have a job that is higher than the 100% poverty level it ask. Don't know what to send her when she goes for her interview and I'm kinda stress that it will be denied. Can someone fill me in please.

OBTW: I did work in 2009 and filed income tax for it but don't think it is enough though. I don't have unemployment benefits or any I just went to school after 2009. But I do have a saving but not that much.


Lets try to look at this picture in a Positive way.
You have not even got the NOA1 yet. Thats short, it will come.
You have a 4 to 5 month waiting time for a NOA2
You have about 2 to 3 months after that before her Interview.
IN TOTAL.. About 8 to 9 months from now. There is alot of time to gather paystubs.
The G-325-A would Document you were in School.
Don't quit your job and don't loose hope. You have lots of time before documenting income requirements for her interview.

I went to my lawyer today who was being very rude, he told me that I do not need a co-sponsor for a fiance visa although I made only $9200 2010 working August to December. He said that I will not need a co-sponsor until my fiance gets here and is adjusting his status...Could you guys please tell me whether or not I will need a co-sponsor ?

No it will not have a negative on your petition. The US Citizen (Petitioner) bares the financial responsibility for you. The only one that needs to have a job is the US Citizen (Petitioner). if the petitioner does not have a job or does not meet the poverty line requirements for US Poverty Line. The Petitioner will need to get a Co-sponser.


Correct ! Be sure the Petitioner meets the Income Requirements. Your Income as a Benificiary does not matter at all.
Warning: A K-1 Visa can be Denied even if a Co-Sponsor is listed in the Philippines. Case by Case review but entirely up to the Consulate.

Not sure whose address you think you have but NOBODY has MY address. I mean NOBODY. That's because I am currently homeless, while moving to another state. We own a home in China but I couldn't even tell you that address because we don't live there yet, don't even have the keys to the place yet because the building isn't released yet. All our stuff is in storage while we spend a couple months visiting the relatives in China.

Ya'll sleep well now. It's about time for Lunch in China.
