I'm sure you well over Poverty Guildlines. Save every paystub. Your Tax Returns will show who you worked for as well. Why, your Employer won't do a letterhead after 21 years baffles me.
Don't worry about 2010 taxes, they wont come up and if you feel you (which you should ) make a payment arrangement.
2010 Income and Currant Income will come up. Don't send Theary to that Interview with no Ammunition.
If your Income is Sufficient then it would be a good idea to keep logs of your communication in the mean time.

Oh, no!

I think the stress of this process makes many wonder about "throwing in the towel" before NOA2 arrives. I remember feeling specially desparate and frustrated just before our petition was approved. Once the petition is approved, things move fairly fast! I do not know whether they will honor your "withdrawal cancellation request," but thank you for sharing your story as a warning to those who might be thiking about giving in.

I remember the Original Post to withdraw. I never commented but understood there is a stress factor and doubts of decisions. It is quite common to argue and have doubts through the process. I agree with Pushbrk that it will not stop the process but, I'm Courious, did you have the withdrawel Letter Notorized. Follow-up on Calls to be sure you cancelled. If unsure. Make a Info-Pass Appointment. (talk to a human being) . Good luck !

You are Correct LovelelyJoy. The documents are best sent Fed-Ex with a confirmation they are recieved by the Fiancee. This is her First and Last impression on the Consulate.. Sorry, I weak today. Dam Surgury and pain pills. If you have a copy of your Original 129-F with you and only if asked present it and go from there. Only answer questions you are asked. Don't Ramble (Talk to much) Your NOA2 is Approved, they will mostly be looking for Income Requirements from this point. I think It all looks good. And I'm sure the 60 pages is proof of a ongoing relationship on the most part. I would get this sent-out out early as Posible so your Fiance knows you got the paperwork. Sheet ! Happens! Take this time to talk to eachother about questions a Consulate may or/maynot ask. Birthdates, parents names, Children (names) I Don't know. I'm higher than a Kite right now. The Letters of Intent to Marry and the G325A Form...Do they have to be notorized? I dont remember reading on the guide that it did. Just wondering. Thanks


The 325 is not needed to be Notorized but Attourneys always say the Letter of Intent by the petitioner is Not required but a plus when Notorized. (I don't know why, I had mine Notorized.) My Attourney said: It would be better if I did.
I might be wrong, but you said One Passport 2x2 picture. I thought it was 2 pictures.
I did not see in your Petition: (although it maynot apply) Free to Marry on each P/B for the 129-F. As Far as what you listed. (It's required anyway with your petition)
Other than that, you look like you did a good job with the Application.

TOS Means: Terms of Service or your agreement with a website or server to conduct yourself in a ethical manner. So Now, we all know what TOS is. I believe it was a ethical topic for a K-1 Application even though I hold my thoughts on a Approval. It was not the OP's fault what lead-up to this but she is forced to ask a question from VJ Members and get a Honest reply. I bet she cried. Then, after that. Krikit... Your post. Enough is enough. There are two kinds of crimes that the petitioner can be convicted of that would affect a petition. The first are crimes that are covered by the IMBRA. The second are crimes that are covered by the Adam Walsh Act.

IMBRA crimes must be disclosed, and all related court records have to be submitted with the petition. The IMBRA is all about disclosure. If the petitioner and beneficiary met through an International Marriage Broker (an IMB) then the IMB is required to collect this information from the US citizen and disclose it to the foreign beneficiary before they initiate contact between the two. If they didn't meet through an IMB (most people don't) then USCIS will forward the court records to the Department of State, who will forward them to the consulate, who will give them to the beneficiary before they schedule the visa interview. The IMBRA requires the beneficiary to be informed about the petitioner's relevant criminal history before they come to the US. The crimes covered by the IMBRA are described in the I-129F instructions, and are mostly violent crimes and substance abuse crimes. They WON'T deny your petition if you have a conviction for an IMBRA related crime. They just need to inform the beneficiary about it.

Someone convicted of a crime covered by the Adam Walsh Act is not eligible to submit a petition without a waiver. The waivers are tough to get. There's a VJ subforum specifically dealing with AWA waivers. AWA crimes are mostly sex crimes involving a minor.

USCIS requires any relevant conviction to be disclosed, even if the records were sealed, expunged, or otherwise cleared by a judge, magistrate, or other official. FWIW, a judge's order that a record be sealed or expunged does NOT make all records of the crime disappear. Federal law enforcement agencies might still have a record of the crime, and private firms that maintain databases for background checks never clear their files.

The Key WORD is WAS HE CONVICTED and on his Record. If that be the case: Have him talk to an Attourney showing that he recieved Counseling, ETC. TEC. The list goes on and on. A waiver would be best answered by someone else that it would be Approved.

Was your record expunged or sealed? If so, then by law your are allowed to treat it as if it never happened and you would not be considered untruthful for not disclosing.

I am the U.S. Citizens. I didn't avoid this question on purpose. I answered the question as posed truthfully and quite frankly the legal problem was so long ago that I didn't even remember it. I did call USCIS and was told that it is up to the adjudicator on my case. If I wanted to clear this up, I can make an infopass appoint. What do you guys think?


This is what I would (And did and done before I even filed the 129-F) Call me weird. Tried to remember every run-in with the law I had. I personally paid for fingerprints of me a Full background check on Convictions. (Only one in Oregon and a misdemeanor in 1987) I also remembered in South Corolina in 1986 I got mouthy with a Cop and was cited for disorderly conduct and went to jail for 1 hour and was bailed out, the fine was $65.00. The point is I aquired all these records on myself. When I went to my Attourney BEFORE I Hired Her, I had this information with me when I first met her to review the posibility of a Approval of the 129-F.

You must remember the State, County (Municipal or District Court) and request records for the outcome and final senerio for that event. Google it.. These are usaully free if you remember approximately where and when. (they also can Fax these) Then you are more pre-pared for a Info-Pass Appointment if needed. I will tell you that when I reviewed my Attourneys 129-F Application she left out the Disorderly Conduct. I said why? She said it DOES NOT Pertain to the Application whatsoever. What do I know. I said OK. I would get this information FIRST. Then go from there.. It's a start. Good Luck!

Hello all,

I'm new to the Visa process and I was wondering how long it's taking everyone else to get their NOA2. We received the first letter on December 17 and it's been 4 months already. Has anyone else received their letters yet that got their letters during December. I'm starting to get worried.


Me and Mav are December 17th since NOA1 same as you. December Filers according to Igor's List are 55% Approved as of last Friday. Tomarrows a new day. (A Business Day) and a new week ahaed.. Hang in there.. A Good post to watch is Dizzy_Lox (member) He/she updates that regularly. (The 55% is based on CSC which seems to move faster)
Life is a JigSaw Puzzel. Why spend a year putting it together for a frame and then at the end find-out ! ONE PIECE IS MISSING. Lol. Humor. Not long to go is what I'm saying.. Good Luck !

I read this before somewhere but not on VJ. So I would be cautious about highlighting. When scanned it may show BLACK and what you meant to highlight will not show. Maybe Underlining.

Vermont seems to take Longer the California Service Center. It's a guessing game really. Everything about Immigration is a guess and time estimate.. You are very close to Vermont Filers for November.
Seems Vermont is about 6 months with Approvals and some Approved NOA2's earlier than 5 months. It's a guessing game but just try and be patient for a few more weeks. I'm CSC and not Approved yet myself. I just have to wait. Good Luck

His native language is Spanish but yes, he understands enough to fill out the form. I was just curious if all forms and letter of intention that need his signature have to be in his native language and then translated to English. I'm just trying to avoid all problems or RFE's :)

Other Memeber double check my advice here, but All Forms need to Translated and In English. Right down to the birth certificate, letter of intent, 325, everything. Don't matter who fills them out but has to be signed and dated by him/her. Paying Child Support is not an Issue. All Immediate family members (sons/daughter) are to be included on the application whether you are seeking a Visa for them for now or later.

Best Answer is Above. How far are you into the process. NOA1/NOA2 ? A Letter of Intent so assume the Original 129-F is my guess. (waiting on NOA1) Thats a Bummer to Start-Out with a RFE on a I-129-F. As far as Plane Tickets (Copies or Originals) I think Copies are fine. However, it might be wise to have the Originals for the interview but seems highly unlikely if the rest of your Petition was Filed Correctly. I think my Attourney made Copies of the Plane tickets and Boarding Passes and sent the Originals. So, Other Member add what you think? PS. Make a Timeline, it will help us to understand other questions you may have later.

Thank you Tim/mav and to the rest of you as well for your help! she called the facility she was taken to and they told her that they dont have any paperwork but in their system it shows that she was arrested, she was handcuff and taken to sober up. so I think we will put yes to the Have you been arrested question and explain in detail what happened, Wish me luck guys! I will let you know how everything went after our interview. We dont have an interview yet, but we are getting ready for it. Good luck to all who are in the same boat. I Agree Harsh with that but, They are unclear if it is considered an arrest or not. I don't know and you don't know. Only the Courthouse records know. So She was asking do I put Yes/No on a arrest for this incident? We don't know what the record says. So to tell them not to mention it and act like it never happened without knowing what the final outcome was, if any at all is not a good recommendation to my thoughts. They need to go into to Public Records so they can answer the Form Question Honestly so it will not come back and BITE THEM. Simple as that. Minor as it is, the question on the Form Says Yes/No. Get the FACTS then Answer the Question

This is where Tricks come into play. I wanted to mention get a Full Police report from the Local Courthouse on this Incident. Have that paperwork with you IF ASKED. If in fact it was an Arrest. YES, declare it. Sounds like this is minor but NEVER lie on a Application. My question would be to you is did they use handcuffs, did they fingerprint you. did you have to go to Court over this matter? Or just hold and release. Important: Get the records from the Courthouse and go from there. Your far into the process so the Petioner has already passed a background check. I believe this is Minor to your application but I would get all the paperwork on this incident as Posible.
So, YOUR QUESTION IS: Was it an Arrest/or/Not? Only you can get the paperwork to answer the question on the Form. Get the police/courthouse reports. It is free and is public information. I sense you will be fine but Better Safe/Than Sorry.

Hi My Fiancee, the beneficiary! was arrested in 2007 in the U.S. for drinking in public, it was outside her friends house, they held her for only 3 hours, she wasnt convicted or charged with anything. She had a tourist visa at the time, do you guys think that this can have an impact in our petition? We already received our NO2. What can we do???? is this going to be a problem?? I have experience with this. I was arrested for an accusation a roommate made. Spent the night in jail, but no charges were pressed. It caused no trouble at all with our K1 since I was not convicted of anything at all. It never even needed to be mentioned. Hope that helps! :)

(P.S. My roommate was just a brat and lied to the cops anyway. I didn't do anything to her.)


Moral Turpitude is the beneficiaries background. I know Jim will look this up for sure. but, I think I read NO MORE THAN 3 Convictions related to Alcohal. This sounds like a single incident and will not hurt the application.

Public intoxication is not a crime involving moral turpitude, and alcohol is not a controlled substance. Public drunkenness is not an inadmissible crime, even if there was a conviction or admission of guilt.

It's irrelevant. Don't worry about it.


I agree with Jim on his quote: However, repeated Arrests and Convictions of Alcohal Abuse legal or not will be looked at. It does fall under Moral Turpitude on the beneficiary and is also submitable if the Petitionary is a repeat offender. Sounds just one Offense so you should not worry about it as Jim said.

Hi, do I (beneficiary) need a notorized copy of the petitioner's divorce papers to take to interview?

No Notory is needed. The dissslution of divorce will have a seal by the Courthouse and a effective date. It will be signed by a Judge as well. Having a Copy is good. But as the other post mentioned: This was already covered in your Original I-129-F Application and has been Accepted already.
If they questioned the the divorce decree you would have got a RFE already.

I see a lot of "touched" updates in signatures and such - how do you know when your case has been touched?

I signed up for email notification the USCIS website - but when I check my status it just gives a general "your in review"...am I looking in the wrong place?

No Your in the right place if you signed into the USCIS website. First and most Important is they Cashed your Check. Your are automatically in the System. Don't fret by not seeing a Notice soon. It can take 2 weeks to 2 months. If they cashed your check, you are in the System. Also you can call 1-800-375-5283 for the Automated System which you already know.
The NOA1 is the start.

Get Your She_____! together. Your so close. LOL. I think You'll be fine. Wish I had the Link to show you Military Requirements. They are 100% of the Poverty Line and not 125% when you Non-Military. But, remember the AOS will require 125% I'm pretty sure but, I maybe Corrected. Good Luck!

OK, how many in the family. The Requirement for 2 is about $ 18,400.00. Also, if he is active military then only the 100% of the Poverty Line is needed. If your looking at Adjusted Gross Income you are worried about nothing. However, how many in the family are in the Petition?

The Adjustment of Status will require 125% though. But, thats later.
