Some consulates do ask for an I-864 for a K visa, but they are a small minority. I haven't heard of the embassy in Manila doing this.

The only reason your attorney would want to see the police certificate is if she wanted to see for herself whether your fiancee was inadmissible for some crime, but an emailed or faxed copy would suffice. There's no reason to send the original halfway around the world and back.

Your attorney is not helping you. I suggest you either take over your case and finish it alone, or find another attorney.


It would be nice to finish it alone. The NOA2 is Approved. However, I signed a Contract with this Lawfirm and as I tell other Members it is binding and no guarantees. (Hence, no Refund but services rendered in the process are payable by the Petitioner and also, a signed agreement with an Attourney and Client is a Contract)
You cannot Fire Your Attourney and ask for a refund unless there are Unrefutable Circustances that affect the Law. So as, there is No legimate circumstance to act in this manner as far as the Attourney. You can Fire your Attourney but you are still bound by a Contract. So this I will not do and will work with her so the outcome of Mav getting here is positive. Have there been problems with my Attourney? Yes. Our Timeline "Indicates" a RFE.
When you get a RFE you generally have 30 Days to Respond. I got a call from my Attourney it was needed within "2" Days. (Well, how long was that sitting on her desk before she contacted me.) Additionally, It never showed on USCIS Updates so I knew nothing about it. They send almost everything to your Attourney and not you as the Petitioner. This is a fact when you hire an Attorney.
When you Hire an Attorney there is a hourly rate and/or a completion. (K-1 Approval) Still, No Guarantees of outcome.

Jim, Mav has No Criminal History at all. I'm the one with skeletons in the closet but minor.

After your case arrives at the U.S. Embassy Manila, they will send the beneficiary a letter saying the beneficiary is eligible to schedule an interview. The letter lists the documents the beneficiary must bring to their interview.

Yes, It did'nt sound right. I thought. Are you kidding me. Sending a I-184 Form for a K-1 Interview is like sending a Expired USCIS Application and even worse. I'm not afraid to bring this Issue up with the Attourney, thus, after replies from Members. I will tell her. LOOK :bonk:

I did not argue with her but I mentioned the I-134 document. She said: I send a I-184 ? (AOS I thought) For a K-1 Visa Interview. So, I'm up in the air on that.
Also, I brought-up Police Clearance. Mav's already done one but I'm sure it's exspired and a New One needed. My problem with that is she said. Have her mail it to you and you mail it to me. I SAID Why? Can't she take that to the Interview and not waste 30 days or more in the Mail. Did'nt sound right to me.
I'm happy with having help from my Attourney but wish that the correct Forms are Filed for this particular Petition in this Stage of the Visa process. I read Links: But state: I-134.

This Link was submitted by a Member this morning and No Mention of a I-184 for a K-1 Visa.

hi... me and my Filipina fiance is still preparing the I-129F package... we decided not to get a lawyer(is it ok if we don't have one?), we both researched and carefully followed the steps, hope everything goes smoothly... just want to ask some questions from you guys since you're quite ahead of us... should the letter of intent to marry be notarized by a lawyer or a letter with our signatures enough? I saw an example from a friend who also processed K1, their letter of intent was an affidavit and was notarized(they had a lawyer, I just thought...maybe it was overly done...)

The Letter of Intent is not required to be Notorized. However, Any good Attourney would ask that the Petitioner Notarize that letter and not needed to be Notarized by the Attourney . The Original should be in the 129-F package. . Always have a Copy. It's about a $ 8.00 fee but shows good intent.

I filed for my I-129F (for my fiancee) to come in from Canada. She has two questions:

1) When the application is granted, does the fiancee have to move right away or can she wait until her affairs are in order (how much time is granted?)

2) Will the fiancée visa will allow her to work or does she need to apply for a separate visa? If so where can she apply for it?

I found this site after having been given horrible advice by two immigration attorneys. So I decided to start doing my own research. I had consulted two immigration lawyers, and both had the same advice that my fiance should just come to the U.S. and visit and spontaneously decide to marry. Both my fiance and I were skeptical, so we did some research and realized that this appears to be illegal and could jeopardize her future. So, here we are, having had to pause our relationship to sort this out. There is a great knowledge base on this site, but we are confused as to where to start.

My fiance lives in Mexico, but works for an american company. She also has Spanish citizenship, but has not lived there since she was 6 years old (She is 26 now). The company that we work for would most surely sponsor her for a work visa, but we want to get married anyways. Is there any difference in processing times from either consulate?


I think, that both Immigration Attorneys gave you Bad Advice based on your post alone:
Reasoning: Yes, she/he could come as a Visitor/Work Visa and Marry and act like it was Spontanious.
Reason to Avoid this is: It will show when you file paperwork proving your relationship and I believe USCIS will see Immediate Fraud that the intent to enter was to Marry and play the system as others have done/others have failed. Is it worth it ? When the Intent is to Marry.
Read the supplement Forms for a I-129-F or a CR-1. It will ask Employment History. You stated: We work for the same Company. It will ask how long you known eachother sooner or later and they will catch a Intent to Marry and Stay using a Inappropriate Visa Status.
If you Love her/him. Play this by the book and avoid shortcuts that these Lawyers suggested.
The reason your asking is: You know there is something that don't sound right.

I don't think calling will help. You will have to wait and get a Hard Copy of the RFE and reply.

A RFE is Only asking for a Clarification of the paperwork submitted.
The NOA1 Only means: You submitted the correct paperwork and Paid Homeland Security. The NOA1 is nothing but a Reciept of payment.
The NOA2 is when they (USCIS) DIGS DEEPER into your Petition and if everything looks fine they will issue a NOA2. If they question the Petition, thats when a RFE falls into place. After a Response generally everything will be fine.
Getting a RFE before the Approval of the NOA1 means there was a Mistake in the Paperwork and deamed "Unacceptable". Therefore, a RFE.
Simple as that. Thats the way I see it.

Passports, Hotels, etc. What list for the 129-F Application did you read from? Facebook is acceptable for Conversations and a On-going Relationship, But I'm confused as to no Passport Stamps.. (You can't Travel without One) Maybe your Post was not Complete enough for us to Understand. Did you Travel there and have Proof besides Facebook. ?

If a particular line of requested information is Not Applicable, and the line contains several boxes/spaces for different pieces of information (employer, occupation, dates from and to) pertaining to that job, do I put N/A in all the boxes/spaces or just the leading box/space (the first box/space on the left)?


You are making this really hard on yourself. Not all members have a 129-F or 325 Form in front of us but we filled them out.
Your question is the Employment history. GO BACK 5 YEARS. "Easy".
It does not take a Rocket Scientist to get a NOA1. The NOA1 Only means: Your Paperwork was received and acceptable and they Cashed Your Check.

Re: the I-129F and G-325A forms, I have read posts in the past which indicated that EVERY box or space should be filled in. Even if it is only with a "None" or "N/A". Does this mean every space on a line in which the first box/space is entered as None or N/A? Let's suppose for example, that 5 years of employment history is satisfied on the first 2 lines of the employment section. If N/A is entered in the first box (Employer name and address)of the 3rd, 4th and 5th lines, do I still need to enter N/A in the boxes to the right under Occupation and the Dates from and to? Now that I have typed this, I know that it sounds a bit #######, But after months of assembling the documentation and information, I am within days of getting this in the mail. And these little things are driving me nuts. I just want this to go smoothly.

Example: If you had Only 2 Employers in the last 5 years which it sounds like. And there are 5 Lines to Fill-in. Write the Currant Employer and dates of Employment on Line #1. (Do Not leave out the addresses)
If there were any periods of Unemployment between the 2 Jobs, write Unemployed and give the dates . Line #2
Line #3. List the previous Employer and address as well and dates of Employment.
Line #4. N/A ( Employed: Give the Employers Name on Line #1. (Write the dates again, although repeated)
Line #5. N/A ( Employed: Give the Employers Name on Line #1. (Write the dates again, although repeated)
That covers 5 Years as required. I believe this is sufficient.

I had 1 touch which was right after my NOA 1. I didn't get another update until after I received the email that it was approved. I have heard people say that even after they get their NOA 2 the website still doesn't get updated. I wouldn't get too hung up on it. Touches really don't mean anything. It is just such a long process we all want to see some update so we can feel as if we are not forgotten.

As Tim/Mav said, wait until 5 months 31 days and then put in a request for expedite if you still haven't heard an update on your case.


There is a difference between a Service Request and A Expidite.
A Service Request is just what it is: Pull the File/Petition and Review.
A Expidite is different. That would be an Emergency.

When I put in my receipt number, all I see is this "initial review" part and nothing else. I keep seeing "touched" on this website over and over and anyhow pulling my hair out waiting and looking for any details. I signed up for updates via email from USCIS albeit not texts, but since January, I have nothing past the NOA1 receipt letter. My attorney wants me to wait and do nothing, I want to call my senator for an appointment, but I am deferring to his judgment at this time as he is a full time immigration attorney. Anyhow, I will be quiet so I can learn from others on this touched update and thanks!


Your Not Past Due until 5 months/31 days. If that occurs the you can call and ask for a Service Request for them to pull your Petition.
Don't worry to much about being "touched" . However, if you show no signs of your File being looked at I myself would worry alittle.
I can tell you that your Senator?Congressman will Not be able to help you until 5 months 31 days. This is what USCIS will tell you as far as A Service Request to pull your File.

I am really confused, my Packet 3 asks for form W-2 and form 1040.
I am the beneficiary, my fiance has the W-2 form and the tax transcript from last year that he requested from IRS, does the tax transcripts reeplace form 1040? If it does not where can we get a copy of the form 1040??

I've noticed that most people suggest that you take the last 3 years tax info, however my fiance has only been working since October 2010. She now earns more than enough to qualify to sponsor me, but as of yet will not have any tax info showing this.

Will an employer letter and bank statements be sufficient evidence as the tax info will all show she was not working.

There are several factors that will come into play here: Just my Opinion.
3 Years Tax returns are good to have. But you indicated Income for 2010 which generally requires a Tax Return Document. (Even if Low) Is the reason for no income for 2008/2009 due to school? Supply proof and a explaination.. Is the Employer from October 2010 still the Currant Employer?
The Employment letter is required anyway and Bank Statements "maybe" required if barely making it as far as Sponsoring.
Good news is: You just started. Just a NOA1. By the time the I-134 needs to submitted it will be 2012 and you will have a 2011 Tax Return to submit.
I can only go but what you posted.

I wish Success for you. So I wonder if your have triple checked a post you made a few months back about a Co-Sponsor.
You stated: The interview will be held in Jamaica. And They accept Co-Sponsors. But, She is Pinay and a Citizen of the Philippines. (Philippines rarely accept co-sponsors) As you know.
I remember the posts/replies to your questions indicated: She is a Philippine Citizen and the Embassy will let Philipphine Rules Govern. Hence; No Co-Sponsor allowed. Have you Triple Checked This Concern.
Even though she is in a different Country all her paperwork as far as Citizenship is in the Phils. I would have that concern.

Our last 3 years meet the Income Requirements but we both lack Proof of Currant Income. My Unemployment is BARELY above 125% but It will not be looked on as an Approval for Mav. Thats Common Sense.

Hey Tim you criticized me for being out of work in an earlier post when i mentioned i lost my job but it seems your in the same situation lol.


We always been in the same boat Mike. When I first joined VJ as a Newbie I asked alot of questions about not working. Also, many of my replies indicate the same. It's no secret.
Thats why I can relate so well to your Currant Position because it is just as mine.
