This was new SHEET to me.

Family or friends stating you met means nothing...  Understand that.

Send your Evidence and money like everyone else does.

See the guides for help and its simple if you have met within the 2 year timeline of filing the the 129-F.

You simply need solid proof you met before filing.. up to the 2 year limit....

Surely, you can do that.

In general: Proof of a On-Going Relationship is after the submital of the 129-F until the time of the Interview. HOWEVER, Do send what you listed anyway. It's not out of line to do so and not front loading the Petition at all. You see: Later it will help show the relationship has grown since the submission of the Petition. Thats my thought. JUST DO IT!

Several months ago my American fiance got a notice in the mail saying he owes the government something like $5,000 in back taxes. It came as a surprise and was dated (?) by several years and the company he worked for back then just doesn't exist any more. He doesn't know how to "fight" it or what have you (sorry, don't know much about this kind of thing.) He is currently unable to pay it off, so that isn't really an option.

 

My question is, is what type of impact would this have on the K1 process? Specifically when I have to do the interview at the consulate and bring his financial information... We will be using a co-sponsor too, if that is relevant. I am really nervous about this, especially if it means we can't ever be together. Otherwise he has a new, pretty decent job with a company that has contracts with the government.

I do agree with Darnell to some respect with your question but there are questions unanswered.  Your Fiance knew back taxes were due.  Correct?  The IRS will work with a person based upon their Current Income.  He needs to make that call and set-up a Payment Arrangement.  The worse thing you need is a Garnishment to show on a Pay-Stub from the IRS.

In order for a garnishment of income the employer will know before the Employee.  Hence, make a payment arrangement and it will not show on your Petition.  What will show if he dose not is a posibilty of a lien on his NET pay after taxes. 

You don't want that.  Those payments will NOT reflect the K-1 process and/or will show as long as the IRS has No Involvement.

So, set-up this now before the letters he ignored become real.  That will affect your Petition. 

Do not offer to the IRS to take a deduction from his Paycheck.  Offer to send in Payments.

My ex-fiance did not cancel the K1/K2 and i don't have communication with him anymore.

 

My husband visit me here in the Philippines every month when he have off from his job and he just left back to the US last night.

We love each other and his Dad, my father in law is a lawyer and wants to get involve in the processing if there would be a problem.

 

Before we got married in May 2013. We talk to a US Consul in Cebu and we told him that i had ex fiance filed a K1/K2 for me before

and he told us that we don't have to worry because once we got married that I-129F that filed of my ex-fiance before will be cancelled

and they would accept ours because we are married.

 

Now me and my husband are worried if the previous I-129F will be the hindrance to our I-130??

I read all this and I'm going to agree with what the Consul qoated.  There might be a question or two.  You are Married and the 129-F definition was never completed so it is Null and Void!

Ok so I'm a little confused on a few things,
 
1. How are they going to cash the check when I made it out to USCIS and not US DEPT OF HOMELAND SECURITY??
 
2. Could this really get approved? I had only the I-129F form, that means I was missing

  • G-325A and passport style photo (Petitioner)
  • G-325A and passport style photo (Beneficiary)
  • Birth certificate/US Passport (Petitioner)
  • Letter certifying intent to marry (Petitioner and Beneficiary)
  • Proof of having met in person in the past two years
Proof of ongoing relationship
 
 
For how much of a pain it is to get the initial approval (From what some users have said in past posts) how could mine even come close to getting approved. I will call them on Monday but I have also heard they sometimes do not even bother sending a RFE or responding back to you in cases like this.

You only made the mistake of sending the check to the wrong Department. You fixed that. A request for evidence is never writing a check. LOL.. Your fine. You might have delayed your NOA1 for a week but thats about it if all else is correct in you Petition. Lets see? The Holidays. You'll get your NOA1 this coming week.

Again, I'm not sure how to properly file a waiver. What I did was a letter explaining my situation and why I didn't file or travel within two years after she had to leave. Is this letter I added to the package sent with the I-129f considered a waiver, os is there an actual form for this waiver.

Lumpy Oatmeal drives me crazy.  I do agree with the first responses.  But, heres a link.  You mentioned financial reasons and not heath matters.  That will not work.  The 2 year requirement is just what it is and rare to pass by.  Re-File and save yourself alot of stress.  You have proof you met that now.

No.  If there are no problems with background checks then do it alone, if there are get a Attorney.  A Agency is a bypass for people that either don't know what their doing with the initail paperwork and is a scam.  If you feel unsure, then hire the Agency..  You will regret that PAID simple documentation later as I did.

The requirements for a K-1 Visa are that you have been visited by your fiancé within the last 2 years, and that will most likely get your petition approved, but getting through the interview successfully may not be that easy.  Consider what other "red flags" (if any) you may have.  Only having visited once and for only one week is bad enough, but if you have any other issues they would consider a red flag, then it's going to be practically impossible.  Try having her visit again during the time between now and your interview....and stay longer this time.  I know someone who applied for a fiancé visa a few years ago. The fiancé went to Nigeria only once, but she stayed 3 weeks. I think that helped because they were approved.

Again your information is bad and not correct.

Not meeting in person within the last 2 years is incorrect.  Filing the 129-f within the 2 years with proof is Correct.

It is a huge mistake to think: Its No Big Deal when it comes to Immigration.

It is Rare for a RFE on an Initial 129-F Petition.

If you followed the instructions you would'nt have made this mistake.

Did they Cash your Check?  If so, there are time-limits to respond to the RFE.

I hope you sort this out immediately.

Make a copy of the 129-F your submitted and sign YES or NO.(In ink)  If there is something your wish to bring-up.  NOW IS THE TIME and provide Records if that Applies.

I have visited my fiance twice in Cambodia since we got engaged; I was trying to figure out where to offer details as to what we did together during these visits.  Any thoughts?

 

The Letters of Intent from each party do not require such information of how you met.  Pictures together is where I would put a Header Letter decribing in short your relationship and how you met.  Included, we are in love and wish to Marry.  The 129-F is a brief form for the initial Filing.  However, it must be correct to avoid a RFE.  I tried to make Rocket Science of this when starting the process.

I've been searching around on VJ for information about how to construct  a "Letter of Intent." Do most people use the sample provided on VJ?

 

This may be a silly question, but I have to be sure; on my letter of intent, do I put my mailing address in the U.S. and on the Fiance's letter of intent do we put his mailing address? Are addresses necessary?

 

How can we find our filing location? Is it just the Dallas Lockbox? I will be filing this from Chicago.

I never put addresses on The Letter of Intent.  All these are covered in other Documents in the 129-F Petition. (addresses are found on the 325 Forms.  It never would hurt to include a address on the letter of intent.)  {re: I plan to marry within 90 days of entry into the US of ADDRESS but not nessesary[

A letter of Intent is flexible but requires a commitment to follow the rules of the 129-F Requirements

The Location is Dallas and no other.

It is a source of temporary income. No it's not solid.  It will be included as INCOME when the Petitioner files 2013 Taxes.  Yes, temporay income.  The statement will be there.  It is counted as Income none-the-less but not tested means or charity.   The requirements of the Petition are the same.  Hopefully, the Petitioner has/or gained employment to date.

Unemployment Compensation IS Countable as Income.  It is not Free Benefits, it is Taxed and not Charity.

However, it is a temporary type of issuance of income as a means of searching for other employment or return to their former job as a result of a temporary lay-off.

The employer and employee paid into this fund.  It is countable as income but not considered stable.

Hi All,

Finally!! I completed the I-129F and all supplemental forms.  So now I'm ready to actually put the kit together to mail off.  Just wanted to know how you guys would recommend putting the actual kit together.  Did you put it in a folder? Did you put stickies and postage all over?  I know it should look presentable but should I put in extra attempt to make it look "prettier and user friendly" or just keep it as simple as possible, neat? 

 

Just looking for advice from anyone who has done it and successful.  This is an anxious time for me and my fiancee, just want to cross all the T's and dot those I's.

Sometimes and it happens.  add your check list before sending your package for members to see.  There have been results where someone like yourself made a simple error and other(s) caught it)

Example:  Check made out to: US Department of Homeland Security in the amount of;

                 Mail to:  Dallas Lockbox

                 Signed in Ink Letters of Intent   ETC.  These check list help but you may have that covered already.

 

These are screw-ups that get RFE's commonly as well as a Complete Dissolution of Marridge Copy with a Stamp and Seal that you are free to Marry if that applies.

 

No, the 129-F need not be fancy.  Just in some order and post-it and paperclips are fine.  It's not a big package when completed.

Warning:  Do not avoid what the 221g asked for.  Send the 2012 taxes.  It will be OK.

Send as proof of currant and past income send the 2013 W-2s (Copies and Tax Statement)

They will not really care about 2012 income when his currant income for 2013 is way above poverty levels.
