thanks...2011 is not due until 2012 April 15, or 2012 October 15 with an extension. Unfortunatley, I cannot get a new accountant now. I do have a solid Co-sponsor who has completed paperwork. I appreciate eveyone's conjecture, but hope to hear from someone who has a definitive answer to my two questions. Thanks again to everyone! :)

David. I read the posts. You are highly unprepared for the interview. The best advice I seen was get a new Accountant. So, you have tax papers for 2007, 2008, 2009. No 2010 and 2011 is almost here. then currant income for 2012 maybe an issue. I hope your co-sponsor does not have the same accountant. I would reccomend getting something and solid proof of your co-sponsor's income. If you don't act now you will face denial or hopefuly a 221-g. The odds are against you but I seen it work before. I only write this because the information by members was a Guess game. YOU NEED TAX RETURNS WITH OR WITHOUT A SPONSOR

You need to do more homework on how this process works. You don't do anything with the NOA2, you can't let it expire. The NOA2 only means that your petition was approved by USCIS and then the case was sent to the NVC who did more checking and processing and then would have forwarded it to the Mexico Embassy. They would have done more checking and then sent your fiance the packet and scheduled an interview for them.

If they did not attend the interview, then the they would assume you abandoned the petition and would have returned it to USCIS who then would file it under abandoned. If this is the case, then you are free to start all over from the beginning. If you are in between NVC and have not yet had an interview scheduled, then you are good to go for that.


In some cases. the beneficiary will never even recieve a packet and a Lawyer/and/or/Petitioner will have to request it . The Consulate can grant an extention and not even notify the Petitioners and even their lawyer. Write/E-mail the embassey and see what happened.

I would double Check. I don't know about Mexico but the Philippines will extend but its up to the Consulate. If you wrote that will help before it expired. For all you know. It has been extended another 4 months

As long as OP is legal to be married and legally free to marry at the time of filing the petition it won't cause a denial. Before that 18th birthday I wouldn't even try to file anything even if the legal guardian agreed to sign papers. This is immigration, and the less hickups on the way, the better(IMO).

But I would suggest looking into a co-sponsor for the interview stage AND a joint sponsor later on for AOS already and not only worrying about the age difference. Play it safe by knowing if the two of you can't do this alone, and what is required, how much each step costs(filing petition - medical, travelling to medical and embassy, fees for visa interview, plane tickets, AOS etc).


Agreed and makes good sense. Wait until your 18. Then look at the picture again. Marridge is a huge responsibilty besides just supporting yourself. 9 out of 10 times I Guess your living at home. Correct.

The USC is 23 and she is 17. As Lilly mentioned I'm unsure about International Laws. Somehow, I don't think Filing a 129-F would be legal but, I'm unsure myself.
I know in the Sates you can but International Laws vary by Country.
So, hold onto those hormones for another year until reaching attainable age.
Update your timeline and Country and that would help. I know you have No timeline but list the Country.

I agree that marrying without having the divorce in hand from the previous marriage is not a good idea, but they haven't committed a fradulent act towards USCIS or the Consulate.

With the divorce of the petitioner's first marriage in hand, both parties are free to marry. THAT is the requirement to file I-129F. Their marriage was never legal or recognized by the US due to the petitioner still being legally married to the first woman.


Disagreed.. Yes, they will end up commiting an act of fraud to USCIS and the Consulate if they dont disclose the Null and Void Marridge in which the both partook in being a Fraud Knowingly.
It will disclosed on the K-1 129-F Petition don't you think. Also, there is a child invovled to be listed in the Petition. It will be in the G-325-A also.
The Consulate in her Country is the US Embassey and USCIS. NO RED FLAGS YOU THINK. THERE GOING TO HAVE TO TRUTHFUL WITH THE 129-F.

They have a marriage that is not recognoized by the USA due to the husband still being legally married at the time of their marriage. If it had occurred here in the USA it could be construed as polygamy but being that the marriage did not occur here there is no illegal action.

Filing for K-1 IS the correct choice because they are NOT legally married. It sounds like they have been together for some time now, so proving bonafied relationship should not be difficult for them at the interview stage.

In all likleyhood they will receive their K-1 without much of a problem. The petitoner is NOW divorced and fre to marry, they have seen each other within the last 2 years. THOSE are what USCIS adjudicates.


I think this will be an Issue. Both parties married in another Country and there must have been statements or papers Free to Marry on each behalf. I think both parties were aware the last marridge /divorce was NOT finalized but did it anyway. Now, they have to come to the realization of this Fraudulant Act.
Now looking for a way to evade that white lie they face now.

USCIS Guildlines were broken and now the parties need to come to bear with the outcome of their conduct. Yes, an Attorney is needed. I can't speculate the outcome. Alot of money is going to spent on an Attorney and maybe all in vein.

Hello. I am currently working with an immigration office here in my hometown. I had to find out on my own that I can ask for a expedite request. I have Multiple sclerosis and am asking the request based on medical reasons. My health is not doing so well and am working on getting the letter from my neurologist. My lawyer office said that they will take the letter to my area's congresswoman but I had also called the Customer Service center and filed a request and all I need to do is fax it to them directly. What should I do? Send it in myself or have my lawyer handle it. My fiance is in Mexico and the California Service has my application. He was caught and deported and I got my first NOA in August 15,2011. Any input would be great. Thank you.


Send it in yourself. Get your letter from your doctor. Waste money on the Attorney, write your Congresswoman and explain why he was here illegally and got deported. Thats a Start. Anyone can request a expedite. Have your papers in order.

i think it should be ok. while i cant guarantee this there is a good chance that they wont even ask for a co-sponsor and the wage slips should be enough for your fiancee. i do find it strange though that an employer wont take a few minutes just to write a letter but it does seem to be a very common thing now :)


I remember a case ( Not Mentioning the Members Names) who worked for (???) for over 20 years. We all know the name of the HUGE Corporation but refused to give him a letter. In the end, she is in the US and Married. He used his transcripts and recent paystubs and Approved.

As Tessa is just working part time at the moment her employer has told her that she can not be supplied with a letter of employment.. However she did give us a phone number which aparntly is the only way to get the information which would otherwise be provided in a letter. I hope this is acceptable as its all they are offering us


I see, alot of employers will not provide that letter from what I seen in the past. TRY AND GET SOMETHING that show any type of currant income whether you have a Co-Sponsor or not. In this case you do. Try and get something.. There has to be Paystubs that show Year to Date Earnings, Letter or not.

This happens all the time and Petitioners have this Mythical Belief they should have their NOA2 in 5 Months or less and start calling Congress.
No, that is not true. At the 6 Month Point you can call and ask for a Service Request for USCIS to pull your file. Be polite when you do ask. THERE IS NO 5 MONTH RULE. You are not out of USCIS timeframes.
One of 2 things will happen. You will get Your Noa2 or a RFE after they review the Petition. Thats the best you can ask for. If to no Avail after that time period, then contact your Representitives.

111 Days from Noa1, and just got a bad news that my man (USC) just got laid off. :( He will still get paid until the employer brings him back, the return date is March 1st. Just my opinion: Will it affect your petition ? No and maybe. Your Timeline indicates a NOA1 (3 1/2 months to date) At the time of your interview you will be showing the Petitioners 2011 Taxes and hopefuly over the 125% Level, However the month of December for 2011 will count even if its Unemployment . Keep Proof of payments.
If he/she wishes to search for a new job in these rough economic times that is OK but be sure they meet poverty line requirements.
If he/she has a Return to Work Date for March 1st then have the Employer have a letter stating: His return to work date, salary, hourly, full-time and permanent or part-time. The Unemployment Compensation he/she recieves in 2012 until MARCH 1st ? Is countable as Income or Currant Income. But, I understand the concern. You and I would both feel better to have Paystubs from a job. It is very important the Petitioner keep all records of his Gross Income for 2011 and 2012 and tell him/her to File 2011 Taxes As soon as posible for your interview.

Good information here but let us remember this is 129-F Application and not an interview.
Submitting a 129-F is like ingrediants in making a Cake. You have essentials to make it work. The question is what do I need to obtain my NOA1 and go from there.

Take advantage of the time you are present with your finacee and gather needed forms which will require her Signature for you 129-F Petition.
This will include : A Properly filled out and signed G-325A and signed and dated by her.
A Letter of Intent to Marry Upon Arrival in the US within 90 Days Signed and dated by her.
Pictures of you together and preferably also with family and friends.
A Cover letter explaining how you met, how you fell in love and stay in contact. Some e-mails and copies of letters,
You will also need: A Copy of her birth Certificate (Best Color Copy)
Copies of your Flight Boarding tickets
Motel/Hotel, Car rental, (anything that shows your presense)
A Color Copy of your Passport PAGE TO PAGE - Cover to Cover.
You will need: Your G-325-A properly filled out and signed and dated.
Your Birth Certificate
Your Separate Letter of Intent to Marry within 90 Days of her Arrival in the US Signed and dated.

And of Course. Fill out the 129-F Form and sign and date it. Send a Check with your Petition to US Department of Homeland Security .

Now I'm not saying don't read the guides but this is a big part of it and I think complete but who knows. I had a few beers and might have missed something.

2 things I'm unsure of members: Is the check $340.00 and are Passport Style pictures required to be attached to the G-325-A's ? See, told you I had a beer.

If you have already scheduled your interview, you can bring a copy of your interview appointment confirmation printout to St. Lukes in order to be admitted for your medical. However, it's not required. Instead, you can bring your USCIS NOA petition approval and your MNL case number.

The letter that you don't want to wait around for is the Embassy letter that tells you that you are eligible to schedule an interview and gives preparation instructions. That letter is here.


OK. I read that. I was hoping to just complete the Medical. I can send Mav the Visa Fee too. But, I don't want schedule an interview due to my employment (Poverty Lines) My Unemployment is over those guilds but I know I need a Job Substainable to those guilds. Not Unemployment Compensation.

Your post makes good enough sense to figure out. I don't know the answers.
My assuption is: You interviewed using 2010 Tax Returns and knew they were below Poverty Lines so you got a Co-Sponsor. You also indicate your currant employment surpasses those guildlines of 125% but you are unsure if they looked at it.
You indicated: Is Social Security Benefits Taxable.? http://ssa-custhelp....curity-benefits Not many people make more than $25,000.00 on Social Security and I believe only Taxable after $25,000.00 But its on a Link and I'm not a tax preparer.
Pensions and Annuities are Taxable.
If you are Over the Income Requirements and have a letter from your Employer as stated. They are giving you a hard time.
As far as who to Call. I don't know but I would reinforce your currant income again and see if the Tax preparer calculated the Co-Sponsors W-2 correctly.

I agree Baron. But lets throw the Guildlines OUT THE DOOR and talk Finances. Yes, I think property is liquid and can be sold for Cash. However, Just because the appraised amount is say $100.000.00 don't mean you can liquidate for that amount in less than 1 year. Additionally, there is no way you can pay property taxes on $15,000.00 a year Income (Gross) . Land, property values have went down as much as 55% and what you paid, Vs what you owe Vs what you payed means nothing. It is what you can sell for and Liquidate. No sense right. You have to have a place to live. There is a Morgage, electric, internet in which the OP has. On $15,000.00 a year? Got to eat. Got to pay for Gas to work, gotta pay vehicle insurance. A appraisal may work depending on what the Value is of the property or Assets. There is not enough information from the OP to decide that. But, I agree. it looks bleck. A co-Sponsor.

After reading again. Your post indicates you had a previous K-1 with the same person. Now you are re-filing again with that same person. (I Think) So its not an Overstay Issue but you decided not to Marry back then and want to try again. Yes, you should list it that there was a previous engagement to this very same person if I read it right. If this is true then just list it. No Law is Violated.

The OP never said her Fiance was going to be present. Think of how she fells. I think it's an encouragement for the Father or Father-in-Law to be present. So I disagree that it is Not a Benefit to her for Support. Are you saying: She should just go alone. Did it ever occur to you that her Father-in-Law might be her transportation to the Interview. If the Father-in-Law knows how things work in that Embassey to a certain extent and knows the people on a proffessional level then I think ITS A GREAT IDEA he goes. He won't even be allowed in the Interview. He is Moral Support and theres nothing wrong with that.

There is a reason he did'nt file so IMMEDIATELY ask him to Fax an Explaination for your interview.

I think it will fine if the paperwork was correct. I agree, that is to long. I think it will be OK. Delivery Confirmation of Documents is important.
