Past 6 Months is when you can request a Service Request to pull your File with NO RFE's which I see you have No RFE to date.

They are Secondary Evidence. As Dan stated above proof of Passport Stamps. Reciepts from Travel.
Pictures are NOT required to have Date Stamps what-so-ever. Are you positive that a friend or family member did'nt take a picture of you both and can e-mail to you?
I'n more confusion: What did you apply for? K-1 ? Maybe not. But the RFE will have to be replied too. I would Contact the Agency that sent the RFE and have them explain.

I can't even thank you enough for helping me out. It's an unusual situation and nobody until now that I spoke with has had any experience with it.

I'm curious: do you still have a copy of this document that the clerk provided you with? It would be awesome if you could maybe email me that so I can see what it looks like. My main concern is that everyone (the police and courts) have refused to give me a letter saying that the records were "destroyed" but I got a certified document from the police saying "No Records Exist" Did your letter indicate they had been destroyed or just that they don't exist?

Read everything I wrote 5 times. ( save a shortcut to this page ) In case of a RFE. It maynot happen that an RFE arises.
The Clerk wrote one page as I listed above. "CONTACT US IF YOU HAVE ANY QUESTIONS" You can supply the phone number and fax number of the Courthouse in case along with your other documents but I don't know where that will go.

Yes they are certified with the stamp and signature. Also, the police record I got that says "No Records Exist" is certified with a raised seal.


You look good to go. I just don't want you to get a RFE. I sure as hell never mean to give bad advice on this one since I been through it.

I would think YES. Take them back and pay a small fee to have them Stamped/Sealed and Initialed by the Clerk. OK

Yes to both questions. There are NO POLICE RECORDS. See, Your records went to the Court you were tried in and now the Courthouse DESTROYED THEM. There is no Record of Police Reports. (The Police turned over the evidence years ago to the Courts and does not keep a separate file
The Clerk would indicate that in the Letter mentioned above.
THERE ARE NO POLICE REPORTS.

Tim/Mav, you were RFE'd for the police record only or were you missing court records? I was clinging to the hope that since I have the court records which include the charges and dispositions that they might excuse the police record. I talked to the clerk at the courthouse when I went to get my court records and she said they don't have police records and that I need to talk to the police department to get those. She gave me what she called a "case narrative" but the heading just says Predisposition Record and has nothing resembling a police report on it.


The letter from the Clerk stated No Records Exist. Its not so much USCIS wants the Police Records but the disposition and outcome of the Courts. A Juvenile and records destroyed.
The Clerk would not give me anything at first. My Attorney called the Clerk and the next day I had a simple one page letter. With all the information I listed above. Again, they would'nt give me anything at first.
Be persiatant: Take the clerk an Apple or Rose and beg for her to write a simple letter. Yes, I gave her a Rose because it solved my RFE.
I paid $1,500.00 for an Attorney and I'm giving you this for free! :wacko:

Heres what I did and was a RFE. Though it was not drug related it was stated in the 129-F. I had the same problem, the records were destroyed after 10 years.
You are looking towards the Police Department for information. NO, thats not what you need. (Or where you need to go)
You need to remember where you appeared. Was it in Circuit Court, Municipal Court or Juvenile Court and go tho that Clerks Office and obtain a letter stating records were destroyed in this case as to not being a serious offense. (Juvenial/Mideamenor).
You need that on the Courts Letterhead and signed and dated in ink with the Courts Seal/Stamp. Signed and dated by the Clerk of that Court. Ask them to write: If you have any questions feel free to contact us.
Without the Seal/Stamp and signature from the Clerk on Courthouse letterhead then it would be maybe a RFE (For me it was and this was what my Attorney did and approved NOA2 2 weeks later.

OK Have it your way. Read the Guildlines like other members will tell you.

Have her schedule her Medical Pay the fee. (About $215.00 USD) and provide transportation costs and plan on a at least a 2 day visit which in most cases is Overnight. There is No Appointment needed for the Medical.
You can Schedule the Interview anytime. That Fee is already included in your Original Petition.

I will let other members tell you what you need for her Interview.

Do not fabricate evidence. Just be honest.

And look to the request and how to answer it.

100 photos of the two of you together may not equal a single photo with an affidavit that the photo was taken within the last two years / a specific date.

As well, you should have passport stamps. A photo copy of the passport stamps are a nice addition.

Don't bury them with useless data. Give them what they need.

And don't make stuff up. If you don't have letters that meet their needs, do not write them for the RFE.

Hi all! My name is Jessica, my fiance is Tobi. I'm in Oregon, he's in Germany. We've been together for 3 years. I've been there twice - 4 weeks total, he's been here twice - just under 6 months total.

He proposed this past September when I was there! Yaaay! Now on to the fun part. lol.

I'm not near as overwhelmed as I was before. I've done a lot of research and reading (all over the web, and here). The part I'm struggling with the most is finding the money to actually file. I plan to use my tax return in February. I make enough on paper to sponsor him, but reality is I have a lot on my plate. I am a single mom with 3 kids. I don't receive any help from the government, nor do I receive any monetary support from my ex-husband.

I'm really excited to have found y'all and just a forewarning. I'm the Queen of Questions.

Oh, this is BS. Sponsorship has its requirements. Gary is Correct. Though we disagree on some things but I never said I was right.
How in the hell can you be on tested means of benefits alone/single and ask the Goverment to support another? Also, who going to pay the plane flight, fees, etc. #######. How? If you qualify for food stamps and have no income. OMG! Good luck at that Interview!
Seems like a Dead-End............... I'm not perfect myself. I make less than the requirements at this time and A Interview for Mav would be Useless. NO BRAINER.
Think through this process. It will have conplications and alot of money in fees and no guarantee that you win. Being on Food Stamps or other benefits. GET REAL. Being Legally Disabled is one thing (but requirements still apply).
I know the economy is hard. I'm living it. Please, think before you go futher.. Also, they may ask where you got the money to GO FUTHUR. Love/Infactuation will do that to you!

I have tried to do some research about this topic, but I can't seem to find an answer that I can feel comfortable with. What I want to know is whether or not me apply for Food Stamps will mess up my fiances K1 eligibility or not. I do have a job & I am working full-time, but I just need a little help right now. I'm sorry, I don't BUY this post: Not the Food Stamp question but the way I interpit it.
On $1,000.00 per month a single person would qualify for Food Stamps. That effect on USCIS may show or may not. But, $ 1,000.00 per month if you did your research is very short of USCIS Poverty Requirements.
You state: You are working Full-time now. NO. Not in the USA. Even at the lowest wage you have to be making at least $ 348.00 per week (40 hours) X 52 weeks = $ 18,096.00 per year but still is short $ 600.00 to Guildlines. (Based on $ 8.70 per hour - 40 hours per week X 52 weeks)
I'm just saying: (thinking) You can't be working full-time and only have a Gross Income of $ 1,000.00 per month.
YOU TELL ME.
Remember, its not the Net Income on your Check from your Employer but the Gross Income that USCIS looks at....

I'll give you a little "Cute" Calculator on the Link below... Better to make more than less. And NEVER say your working Full-Time and make $ 1,000.00 per month to USCIS and/or to DHS for Food Stamps.

OP.. I disagree with your doctor. Your vacation got you pregnant and thats OK. Your should be asking for a signed Medical Reason from your Doctor stating it is not in the best Interest of the Unborn Children to travel because your Stress reflects on the Unborn Children and he should have these papers for the Interview. Signed by your doctor. Anyone with a brain will tell you: The Stress is enough without being pregnant and traveling. You will encounter Stress, apitite changes and sleep loss. Not Good for Carrying children. It may or maynot be important you show at the interview but if they ask: You cannot attent in the Best Interest of the Children.

If the Petitioner is not delequent on childsupport enforceable by law and no order stating legal garnishments and/or sanctions against Income I see no bearing. I see one child involved that of the USC. The information will be in the USC Divorce Decree and Documents which we don't know. The OP is more concerned about Income Requirements.

We already discused Income/Paystubs.. Bank savings is good. Bank savings is countable as an Asset.
When you say he has one dependant and living with the mother I THINK your petition is based solely upon you and Fiance. Meanning: The $18,500.00 Annual Income requirement. If he added a dependant it would be more money to meet the requirements. I don't think that applies since not in his Primary Care.
If his Currant Income is sufficient I would evade using a Bank statement unless there is alot of money in that Account.
So, others can add. But, tell me this. What is his wage per hour or salary. USCIS uses a ratio for ANTICIPATED INCOME. Meaning: 2012 when you Interview. (full/part-time)

Well, no has Filed 2011 tax returns because the year is not over. Hopefully he made at least $18,500.00. But his Currant Income at the time of your interview is most important. Your going to be showing 2011 tax returns .. and currant income for 2012. Some Consulates on only ask for last years Income Tax returns and Currant Income. Some Consulates ask for the last 3 years but some just Last years. The focus is Currant Income and a GOOD Employer Letter. Are you a family of 2 or are there other dependants involved.

No, you can't update a 129-F. You have your NOA1. Thats good. There is no such thing as updating a NOA1/129-F . With NO RFE's your should get your NOA2 soon. His new job will be a feature for the Interveiw. SAVE THEM CHECK STUBS. Congrats on the new job.
REMEMBER, no where did it ask for Income on your 129-F or 325-A. The Income requirements will be on the 134 at your Interview. Good Luck

thanks...2011 is not due until 2012 April 15, or 2012 October 15 with an extension. Unfortunatley, I cannot get a new accountant now. I do have a solid Co-sponsor who has completed paperwork.
