Actually I asked because my friend was writing it up and asked me what she should write. I thought I would ask you all, since there is such vast knowledge. It was notarized, and I actually spoke with an agent yesterday at the USCIS and he said that I can't send too much. The more I send, the better. So while it may not seem necessary, I do not want an RFE. We've been together for 3.5 years and I'm tired of waiting.

Not speculating but in actual experience related here over and over...

reciepts of sending money for a FIANCEE (not spouse) have usually TWO responses

1. None
2. Bad

In most consulates, low fraud, no one cares. It is not in itself proof of a relationship. In some consultes it is considered a RED FLAG of paying for a fiancee. Best not to do it. If they ask your fiacee if you send money (I doubt it) then just answer honestly. Otherwise it is a non-issue.

I DID send some money for immigration related expenses (medical exams, shipping costs, veterinary costs, train tickets to Kiev for Alla and the boys, etc.) I DID have receipts at the interview, they never showed any interest in looking at them and asked no questions about it.

I would say to concentrate on other things

And what step are you at? Fr the petition you do not need ANY of this, nor any financial information, nor any proof of relationship. If you are doing the petition you do not need any such thing

I apologize for my bluntness. In this case: The petitioner waited until the bitter end. My point was: You can extend the NOA2 if you follow Rules and the Counsulate will decide. There are lots of reasons to BEG for an extention and some are approved.
You can LOCK-IN a NOA2 by staying in touch. Pay the Visa Fee good for 1 year and no need to ask for extentions. As I said: The Medical is good for 6 months.

Extending the petition won't do any good if it is determined they did not meet the two year requirement. It must be met at the time the petition is filed or the petition will be denied. Certainly if he meets with her again that will count as having met within two years for a new petition.
Either way, if this petition is accepted or not, the OP really, really needs to have another meeting with his fiance, if not for filing a new petition then for the visa interview.

I know this already, What I am asking is for information regarding those forms because My fiance is not capable of filling these out herself and compiling them accurately. I am going to see her in 1 week. With me, I am bringing all the paper work she needs to sign. When I get home I will then send in my I-129F. I will not be able to return to see her to help her fill out the forms for the next step. So I would like to bring them with me now so that she can sign everything she needs to and at a later date I will compile all the paper work she needs for the interview and send them to her. That is why I am thinking ahead.


The ONLY Documents she needs to sign is: The 325-A
Letter of Intent to Marry Upon her Arrival withing 90 days in the USA

However, I you choose not to listen about Cover to Cover Passports, Choose to not listen about sending more than one Passport Photo of each of you attached to each 325-A then do that. (Send 2) And get extras for later in the Process.
Even VJ for a 129-F does not tell you to send all this ####### for a 129-F Petition.
PS. Have fun and take pictures and save reciepts on your trip.

You are way ahead of yourself. Your are doing a 129-F. And as far as thinking a Birth Certificate is the Same as a Passport. ??? I'm so happy you know what is best and submit it as is then. You will have to update all this later.
The Beneficiary Only has to Prove she has a Heartbeat and is alive at the interview. Your doing a 129-F. All that proof is later.

WHAT ! This is a simple 129-F Petition. There is No DS- This or that involved. That Financial ####### is asked later. This is a Simple Petition and everyone does it.
I see 2 or 3 wrong OP.
1. You said the front page of your Passport. No, COVER TO COVER in Color. Reasoning is: Who knows where you traveled with that Passport is what they might think.
2. One Passport Style Photo of each of you attached to the 325-A. I suggest 2 of each of you.
3. Plane Ticket, No.. Boarding Passes and the Plane Ticket also.
4. Motel Reciepts, Meals, ETC.
5. She should also supply (though not required a Passport in Color Cover to if you can.
6. As other posts indicated, being free to Marry. Obtain Signed, Dated Documents.

How recent does the letter need to be? We had one dated in July with our filing packet, and a second one dated December as part of our RFE. Assuming we get fortunate and receive the NOA before the end of the year, should I do a third letter of intent to send to him?


If I'm reading this correctly. You filed in July and recieved a RFE for No Letter of Intent in December. OK. You responded.. You now await your NOA2. (Timeline) Yes, for the Interview I suggest a New Letter of Intent. Want to go down that road again. ? No... You have lots of Time.
It is Odd for a RFE for this when you say it was sent.

A third 129-F application, even within a 10 year period, would trigger a waiver process.

It sounds like the waiver for a second application, albeit within the 24 month period, is no biggie.
Any opinion on whether a third application would be much more difficult?

If I'm reading your post correctly, You had a previous 129-F and she arrived an within 90 days you decided not marry. She went home unmarried, correct?
Your post does not indicate if you have intent to File again for a different future spouse at this time or maybe later after a new relationship.
I think the answer is No. (Its should not matter) But, they look at how many times you filed before, the length of time between each relationship, solid proof of the future spouse and your relationship.
She will be asked (posible) at the interview for the reason of your last break-up and other questions about HOW WELL DO YOU KNOW YOUR FINACE.
If this is a second attempt to a 129-F Petition and the above relates it should not be huge. If its a 3rd Petition. You have problems. They have all records.

Lil or No knowledge of Spouse/fiancee
Large Cultural/Age diff in some consulates
Request for more evidence (not an outrite denial)
Child abuse/criminal record against the petitioner
These r just part of it and varies from each countries


I would say this is: Best Answer since the OP has already recieved the NOA1 and waiting. The Time difference between a NOA1 and NOA2 is background Checks. If they find something that they don't like you will get a RFE before issuing a NOA2.
So I say: Best Answer is Above. THAT INTERVIEW IS THE MOST IMPORTANT WHEN YOU PASS THE OTHER STAGES. (NOA1/NOA2)

Then your evidence, passport stamps, boarding pass copies, restaurant receipts, currency exchange receipts, hotel receipts, and photos will bear out this meeting in that city during those dates.

That's it. Keep it simple. If you are free to marry now, they don't care if you were not free then. USCIS are not marriage counselars.


This is a 129-F/K-1 Petition. That Application to not to Confuse the OP is ONLY HOW YOU MET. That Simple.

DO NOT INCLUDE "I was Visiting my Ex" Only write a brief statement of how you met. Simply said. I met her and include some information and your in Love. This is a K-1 / 129-F Petition and NOT A COURT OF LAW. There is NO NEED to Mention The Ex Wife. This should be One Page. Sign it and date it and Submit with your Petition.

So I am sure the interview will be after april since we are in the Vermont Service Center. Things look slow there. So 2011 and 2010 with a co sponsor should be ok? Do they check when its in the service center if i filed my taxes too? Or is that something they dont look at.


The Worst thing you can do is to use excuses for not Filing and state. I have a Co-Sponsor to cover that loophole. That is not a loophole.
If your under the limits and have a Co-Sponsor that is good. But, do File 2011 Taxes no matter what they read .
Yes, there are exceptions to not File. But, think about that first

If your interview is after January 1 and before April 15 you could use either 2010 or 2011, whichever is ready. If the interview is after April 15 you would use 2011.

You only need one return for the interview but you need to report your gross income for THREE years for the AOS. OR provide an explanation why you did not file and cite the tax codes that exempt you.

You should have 2010 Taxes and 2009 as well. But, I underestand what your saying. You will need 2011 for the interview. You should have all these but, if your well over poverty lines for 2011 returns and currant income it might be safe. Provide a letter of Employment as well for the interview.

She applied for a tourist visa in the past but she was rejected then fiancee visa followed. She thinks that they are scrutinizing her records because of that first failed attempt to get in the US.


Not relevent to the OP in this case. Were not talking about other cases since they all differ. Replies should be focused on the information supplied and NO Assumptions made. (This includes taxes, tourists Visas).

I agree with this. Maybe your fiancee misunderstood and I'm sure nervous. From what you wrote: Youre Fiancee is 99.9% Approved. .. The miscommunication might be what your fiancee told you. I'm sure she was nervous. But they took all her paperwork and Passport. Again, I see a Visa in the mail coming soon. :dance:
