A  66 year-old US naturalized citizen (divorced, retired, own home with no mortgage, living on a monthly $1,000 social security & medicare) wants to petition for a K-1 Fiance visa (48 year-old lady).  I have not filed taxes since 2004 due to a fatal auto accident that resulted in the loss of 2 children, then caring for a quadriplegic ex-wife & traumatic brain injured daughter (now 17 years old).

I have an engineering professional license, doctor's degree & have taught in several universities for many years without any retirement benefits. Most likely, I will teach at local university as an adjunct professor upon their arrival. The foreign fiance & her 19 year-old step-daughter will be working in the US after adjustment of status to help with family expenses.

1. Are there a concern about the K1 visa approval?

2. Do I need a co-sponsor (my 42 year-old son from my first marriage or a brother)?

3. Did any one have similar experience? ideas? feedback? issues of concern? etc...

Sorry for your terrible losses in family.  2004 was years ago and you were of working age.  Contact the IRS about no return/filing.  Thats a leap forward to answer Question #1.  If money appears and No taxes paid thats a concern.

 

Yes, you will need a Co-Sonsor based upon your post.

 

Now, after years you desire to work.  Pay for teaching is Taxable.

 

Is your question more towards:  I evaded and now wish to Petition and it's coming back to haunt me now ?

You have to be Free to Marry.  A Certified Copy of the Divorce Decree is Required for the 129-F.  So you are kidding yourself..  Don't pay any Fees or submit anything without that.  You are just setting yourself up for a RFE and a Denial.  Thats my opinion.

Just to let to know, scanning photos of passport are not necessary for California. If you just send 2 or 3 photos of the two of you together and a plane ticket to your fiance's destination then that will be sufficient for California because that is all  we sent and had an approval in 4 months. 

 

Well, there it is.  Though it is not written in the VJ Guildlines....  A New Organizer. 

Anyone can get a Passport Stamped in a particular Country but that does prove you went to see her./ Writing on the back of a picture a date you guessed.  Not Solid Proof of the 2 year Requirement. 

OP:  You mentioned your going to visit again.  This time:  Get everything.

No insult meant to the above reply, I just Don't consider it Good Advice for other Members or Anyone.

This a Risky Manuever.  Not a Prudent decision of the Petitioner or submital.  They do not have to grant a 221G, they can simply deny the Petition based on incomplete paperwork or a Public Charge.  I recommend:  Have all papers completed for the interview.  There are No Shortcuts here.

How much is the apartment worth (free and clear- ie minus any mortgage, liens etc)?  How many in your household (ie any kids or other dependants)?

 

Commonly, a Apartment is an Apartment.  A rental.  Does not appear a Condo.  No Affidavit of Support documentation and appears no Co-Sponsor Documentation at this time.  its like going to The OK Corral with-out a Gun.

On the 129-F you are Only required to list convictions. However, take note: USCIS see's Arrest records whether proven innocent or guilty of previous crimes. For you background check.. Contact what Counties you were in and in trouble with. There is going to be a fee possibly.

NVC can tell you for free if or not you need to cancel the previous petition.

This is not your first time dealing with these matters.  Be sure she knows all the details of past relationships for the interview.

You could go either way, since she is using a co-sponsor, but I would personally wait until she can show at least 2 or 3 months of working her new job. I think her being able to list her current annual income on the I-134 will help the CO's decision. Also, you do not have to put 0 for everything on the form. If you are not using assets, then you do not need to list them and can leave those blank.

 

With all Respect Jay-Kay.  Your even confusing me if I was the OP. This is a New-Bee and the Beneficiary asking.

There is No I-134 even asked for at this. No Co-sponsor or Income requirements.

2 or 3 months of pay-stubs for current employment, that is not going to asked until the Interview.  Normal waiting periods for the NOA2 are about 6 months and then the Interview which adds more time.

I just think the OP is not aware and is trying to figure this out.  Lack of Knowledge but thats why were here.

Again, my advice is to  wait and save them pay-stubs.

Let me ease your thought. Update your timeline to start. You have a NOA1. There is plenty of time to gather check-stubs but No 134 is even asked for. So, family is signing invalid Affidavits.
The proof of income comes at the Interview way down the road. Yes Wait.. To provide proof. It is very Lovely for mom to co-sponsor but that would not be needed at this time. You have no-where to send it anyway. Wait for the NOA2 and follow procedure after that. Key Word is Relax and don't fill-out any forms until asked. So your answer is WAIT.

We suspect strongly that RFE is for either more proof of meeting which I already have in place to send over to my fiancée or something to do with her divorce papers. Well it help if she takes all the evidence with her as they can look at it and say if its acceptable or not? Can they print of the RFE there or tell us what it's for?

Help me here..  You don't what the RFE is for ?  Do you have an Attorney ?  They get the information first and only notify the Petitioner when "They get around to it".  How can you be prepared to answer a question without a question.  thats what a RFE is.

No.  But your reply will be processed faster.  They don't have the authority. time and means to do this immediately.  DO MAKE THAT APPOINTMENT and clear-up the matter what-ever it is.  It's paperwork.  They will note you were there and record the statement/paperwork of the RFE.  It's worth going.

Yes, possibly.  It looks like you are desperate to get the the US: 5 visa denials, and then you find a US person to marry.  That presumption can be overcome with extra proof of a bona fide relationship.

Theres something missing here.  Student Visa, Tourist Visa, and now 129-F.    What was the reason(s) for the previous denials.  Thats the Question to answer your question.  Only you can answer that if you choose too.  Then, you could get better advice than all the quess-work being said so far.  That is the ROOT of the problem.

I would think all is good up to now. Your case has no RFE (s). Have your Fiance' bring supportive legal documents to the interview if it becomes an issue which is doubtful, but you never know. If this is the only issue you are worrying about then supply proper evidence. I'm sure you'll be OK about this small mishape. Honestly, The I129-F focuses on the Petitioner and the Beneficiary to start and then progresses to minors and your File was looked at to include all in the Petition. Have you Fiance' ready to supply any/as much information in paper. I think your OK...

1. Does the letter need to be notarized?

2. Do the people need to be US residents?

For the Filing of a 129-F.  You need neither of these.  No Notary, No signed affidavits.  Who told you that ?  Make a timeline please.

Your Timeline indicates they approved your NOA1.  The letter of intent, etc was in that Petition.  You got by this one.

Don't make mistakes...  The Journey gets more complicated later. 

Study what you need after the NOA2.  It is possible to get a RFE but lets not jump to Conclusions for now.

LOL.  I started this process with an Attorney and this one of her mistakes.  I got a RFE for this problem as well.  What I meant to say was A scan is OK as well as a Fax for The Dissolution of Marridge of the Documents.  Be sure all pages of the Divorce Decree are include.  That Stamp and Seal from the Courthouse is of the Upmost importance.

He divorced at Harris County District Clerk Houston, TX.

You have the information to get what you need.

That Divorce Decree is on file in the State and County you stated here.  GO TO THE COUNTY COURTHOUSE. where they filed for Divorce.  It is there on record.

What he will need is:  Get a Copy in Full.  A Seal and Stamp and Initial by the County Clerk DATED.  About $5.00 US dollars is the charge.   He should call ahead to pull from the Archives of Records.  Not a big Deal.

A Copy is Fine to Fax and show.

We're having almost the same circumstances,my fiance is been working full time for almost 5months & we want to schedule interview at earliest possible time but we're not sure if were good to go because he havent made permanent yet.What i can add here is, you save at least 3-4 months of his pay stubs to substantiate the proof of his income & I think that would be a good idea also if he can ask favor from his superior a letter stating that he is working full time in the company.

My question has nothing to do with where I'm at in the Visa process as I am asking a question about the medical exam which I know will happen in the future. I also know when in the process this will happen. 

 

Thanks for your input, but I think my questions were very direct and I didn't ask if they ask me if I was convicted. I asked if they ask if I have ever USED drugs in the past. 

Just tell the truth.  I don't know about Canadians but almost all Americans 16 to 60 years old have done one type of drug or another.

And I was also clarifying that she should always be truthful to questions. Do you deny this?

Again, your Know it all deligence.  It applies to both the Petitioner and Beneficiary.  Background checks that await Approval. 

 

Yes, let both of them be truthful and they must.  The advise is relevent to both of them.

Your timeline indicates a NOA1  So, they cashed your Check and took the money,  The approval of the NOA2 is after a background check.  So, you are asking a question with a question.  To Answer your question:  Were you ever Convicted of Drug use?  If the answer is yes, then yes.  If no, then No. and not bring it up.  Is that a start... Please be more DIRECT with the topic..  Were you Convicted or Not...  you will get better replies..  To answer your question.

Why would you pay a Immigration Lawyer to provide the information you already have.  Does the 129-F ask for Affidavites?  No.. It's a simple form. 

This is your life ...   And of course hers. 

From the time you file the 129-F to the time of the interview you could gather so many proofs of your relationship beyond the filing of the 129-F.  Thats what they will want to see.

What they want to see NOW is a Complete 129-F which includes no LIB.  (You can if you wish)

Don't make the mistake I did of making a moutain out of a 129-F initial petition.

This was new SHEET to me.

Family or friends stating you met means nothing...  Understand that.

Send your Evidence and money like everyone else does.

See the guides for help and its simple if you have met within the 2 year timeline of filing the the 129-F.

You simply need solid proof you met before filing.. up to the 2 year limit....

Surely, you can do that.
