Our white form just means that they want more time to review our case before issuing or not issuing the visa. Maybe this is what's happening in your case as well. Good luck!!

You do not need to be there for your honey's interview, but it does seem to help if you are. I could not be at mine, and they did ask if I was there. I do think it helps if they can see you two together but it isnt required for you to be there.

Hi all,

A little background: I am the USC, my husband lives in England. We married a few weeks ago in the US, he has returned back to England, and I have already filed for i-130 and received NOA-1.

I planned and paid for a trip to visit him in a few weeks (Feb 10th to Feb 20th) in England, and I did this all before we got married.... My plane ticket, passport, and driver's license are all in my maiden name HOWEVER for work reasons and benefits through my job, I have already begun the name change process at the Social Security office and at work. I have not received my new social security card in the mail yet but all my work information has my new name on it....


My questions:

1. In general, is it ok for me to fly to visit my husband while in the cr-1 process? i know it's generally not easy (or not possible) for the beneficiary to visit the US during the process but I am unsure of how it works for the USC to visit them?

2. what documents should i bring, if any, to show them at customs in England that we are married but i do intend to return to the US? (will my return ticket, a letter from my employer stating the date i am expected back to work, and a copy of the NOA-1 notice to show we are in the visa process and are going about things the "right way" sufficient?)

3. will i be ok to fly still since my plane ticket, license and passport are all matching even though my name change process has begun in other sections? will just a copy of marriage certificate be ok for this in case there are questions for some reason about different names on anything else?

You should only need proof of your name change if your passport has a different name on it. I would take Marriage certificate and some other proof that you are in the process of the name change. As far as you going to England, you will have no problems visiting him. have fun in England

1. I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
2. You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position. Begin collecting these ASAP after your NOA2 arrives. You will also probably want to include other evidence such as your banking information and other assets as required by the I-134. Specifically you will need at least 2 of the 4 options mentioned in Section II-Supporting Evidence of the I-134. See this FAQ for more tips and ueful information on the Affidavit of Support Form.
3. A copy of the NOA2 that you received in the mail.

CSR said it could take 60 days longer because RFE. I seriously doubt that length of time..




They wanted my photos attached to paper.. I put them in envelope and placed in the folded documents.. I didn't staple or clip and now I pray they don't lose the photo's.


Funny, A RFE usally means your file is awaiting a faster process than hearing nothing at all. Alot of Members know this from experience. About 2 weeks in most cases. Lets hope that is your case as well. A Simple Passport Picture? Not bad.

I got my RFE for Passport photo of myself. It wasn't what they required style wise. What I was wondering is, if there were more RFE with my petition would they have come together on the same document??
When they go through the I-130 I would think they would go ever everything then ask for more evidence all at once..
I'm not quit sure how the RFE process is done.
I mailed Saturday and they received it today so I am hoping it's a quick and simple process.



Highly Unlikely, they reviewed your File and its content. They found the Passport picture NOT to meet the Standard. They would have informed you if anything else additional is needed but God only knows.

You can include your tax returns from last 3 years, which I am sure you filed.

That clearly show you were working as an ind comtractor and whtever income you had is clearly stated on the tax returns.
The only thing is your current client can write you letter which shows you are stillworking for them, means it could be asumed you would still be making approx same amount this year as well.


Excellent Answer. And have the Employer Attest to this in Company Letterhead and Signed.

Well Bob is just saying if you are using a letter for immigration keep is honest, if you are employe then say employe if you are not then dont ask your boss to put as emplye, coz that can create probs for both you and your employer.


Simply show Income. Gross Pay and last years Tax Return (If asked, have 2 years back) Show Currant Income GROSS PAY before taxes. PERIOD.
I myself, am struggling with this Issue.

You are making this way to complicated for yourself. Whether you are a Independant Contractor or as a Regular Employee. Your Income is what Counts. It does not matter whether you pay your own Taxes or if they are deducted from your Paycheck. (As long as you File at the end of the year and your Income meets the Requirements)
The other side of this is: Maybe, I don't know? 2010 maybe was shy a few dollars, I don't know. That can be made up for by Currant Income.
Even though your are Independent and your Employer will give you a letter stating GROSS INCOME. That is Sufficient.
Makes no Difference if your Independant and pay your own taxes or whether the Employer takes them out.

Searched the forum but was unable to find a direct answer. Have looked through LingChe NVC shortcut guide which was helpful, but I just want to make sure I understand what I read. So I received my NOA2... now I just call NVC to receive my case number and then wait again till they load my case info into their system?

Now for the harder question. My wife has a 3 year old daughter, recently looking back through my copy of the I-130 I sent in I noticed for some reason we never mentioned her on it. When is the time to do this? Will this cause an RFE or any other problems?

Now I the last 2 years before my most recent I made under the poverty line so therefore I do not think my last 2 years is going to make my most recent tax year look good which is 2010 recent

Should I just send in my 2010 tax return???? and leave out the other 2??

and if yes I should, what should I type in my AOS when asked for my last two years gross income N/A or what???? or should I go ahead and type in all 3 of my tax return gross income and only send in my 2010 recent tax return which i made over 20,000 dollars..???

Send 2010 Tax returns or transcripts and currant income. Avoid 2008 and 2009 if you can but have them if asked. With the 2010 returns have documented proof of Income. You know, letter from employer, rate of pay, INCOME. Over $20,000.00 annualy meets the requirements.. Currant Income is most important and if 2010 is looking good then your looking good.

First off..

1) My husband's eldest sister is getting married in August (in England) and I'm invited. I know the beneficiary has to do paperwork to get approval to travel to the US, but what about the petitioner to go to the beneficiary's country for a couple weeks?

2) I've been seeing people get their affidavit of support doc denied, and I've been a little scared. I haven't made enough in my past 3 tax returns due to going to university, but now that I've graduated I've held a steady job for the past six months. Would a letter from my employer stating my current employment plus salary and some pay stubs suffice as proof of income, or should I seek a cosponsor? My husband is from England so I don't know about how lenient they are concerning affidavits of support.. but I really do not want to bother my parents and ask them to co-sponsor. Any suggestions?


The question is alittle confusing on the first question (1) . I'm sure members would agree that it is better for the Petitioner to visit the Beneficiary and is fully allowed. (thus, documents more proof to the relationship.) I'm confused if this is a 2 Party question? One for you and One for her? I'm just alittle confused on Question (1)
Question #2.... The past 3 years Tax Returns are going to be Understandably low for attending School and you Graduated and have been gainfully employed for the last 6 months and that is a huge plus. So, it may depend on what that Income has been (Re: Over Poverty Line) since the beginning of 2011. Your application is fairly new so you will have 8 to 10 months of proof of Income before an interview and submital of an Affidavit of Support.
Just a thought.
If you can say what Income has been YTD. We could answer better. Non-the-Less... Good Luck!

Apparently when I asked USCIS over the phone, they told me they are not allowed to tell me what USCIS processing error is. What can a person actually do to get them to process a case properly?

Is the Petitioner making the calls to USCIS? They won't tell the beneficiary nothing.
After this amount of time the Petitioner has a Right to know what the Error is.
You mentioned: The Attourney even called. Did you fill out a Release so that the Attourney can talk for you from your Congressman?
Whats going on with this Case. You said: Not being touched. This Case has been touched more times than a Angelas Dancer.
This is to long of a wait time and being told "We can't Say". Hindi ! You paid the Fees like everyone did.
Try your Attourney and Congressman again tomarrow.

I am hoping to mail the first set of paperwork when I return to the United States in a few months, I am currently staying with my husband in Mexico. I am somewhat concerned about being rejected. My husband was brought to the United States illegaly when he was young, by his family. He was a very independant teenager and always kept a job going and practically lived on his own all through high school, where we met. We both were good kids and didn't have any criminal records. A couple years ago I was 17 and he had just turned 21 years old. We were arrested for burglary (which is totally nuts!! it was t- shirt in a clothing shop, his charge was reduced to petty theft in court). We were so so stupid I get angry thinking about it, but now we must deal with it and be patient and do everything right to get him back to the USA. Never ever will we do anything like that again. He went to jail (I was a minor so I was let go) and immediately had an immigration hold put on him. He served his four day sentence, the morning before an immigration attorney was going to meet with him in jail, ICE came and picked him up. He was dumped in Tijuana that night. That was the worst punishment, one of the worst things that could of happened. We spent 9 months apart, and then I came here to Mexico to live with him and his family and figure out what we are going to do about this mess. We were married November 2010.We really want to make things right, neither of us fit in here in Mexico at all, adn there is no way we could live here. This whole thing has really changed both of us for the better, even with how tuff it has been so far. My questions are:

Will me being arrested for burglary (I was not charged, and it was not even burglary, it was really petty theft.) when I was a minor be a problem?
Will him being charged with petty theft in the united states be a problem?
Will the fact that we were arrested together be a problem?

Petty theft is not a big offense, but will they make a huge deal about it?

Thank you for any time spent to read and reply. I am kinda scared for critisism about our stupid actions, please I know we were idiots, I have been kept awake all night for the last year and a half thinking about it.

You need the Counsil of a Good Immigration Attourney for this. Not VJ Members..
There are to many complications involved in this matter.

My husband was told by immigration officers that signing voluntary departure would not ban him from applying for residency, but I read online about all the possible bans for staying illegally in the country. He did not recieve any documentation or paperwork stating any ban was placed on him. Anyone have any further knowledge about this?

SSI of the Co-Sponsor covers Over the poverty line.
Liquid Assets are countable as well.

Also, your Post indicates I will make more than $40,000.00 this year. Well, USCIS will look at Currant Income. So what have you made for 2011 thus far and show proof. You maynot even need a Co-Sponsor but there might be more to this.

Unfortunately, I hired an incompetent, unreliable attorney, but that's another long, drawn-out story. Fortunately, I have been reading the posts in VisaJourney which has help me to direct him. I understand that I will need a co-sponsor and a friend (i.e., single man and no other dependents) has agreed to being our co-sponsor. As usual, my attorney sends me an iPhone text reply of "No", but does not give me any clarification as to how much total income or "adjusted gross income" the Guangzhou consulate needs to see along with my co-sponsor's 1-864. (My email and attorney's reply shown below.) Is this immigration attorney correct? If so, please tell me the minimum amounts of adjusted gross income the Guangzhou consulate needs to see? I can never get a straight answer from this attorney and working with him has been a nightmare. It's a shame I did not know about VisaJourney.com before I hired this guy. (I did erase this attorney's last name and email, but I would love to warn everyone about him.)

Furthermore, my co-sponsor has about $77,000 in the bank and another $250,000 invested as mortgages which could be easier sold - if needed. When I began this process I had about $98,000 in the bank and a "structured settlement" with a face value of $71,900 (i.e., $50,000 market value). I met my wife while working in Chengdu in commercial real estate development. It was a long document intake day. the finger scanner machine broke down. my wife and a friend were the last people to turn in their document, so i am expecting an interview time for my wife tommorow very late.

We stood in line at 12:30pm and we went in at 12:50pm, and we were done at 3:45pm so about 3 hours.

So do you suggestion everyone who has a signicant partner abroad should go check their blood for anything prior to a actuall visa medical review. If I knew that a couple months agon, I would have told her to go and a shot would have been given to her and a cured her. I wouldn't be leaving comments on vj.

Geez I didn't think this would dig me in a bigger hole of suspicion on our relationship. But I guess the vo will probably look more on her history of relationship.

How would I prepare for this in convincing the vo of my wife sexual action with me only and not anyone else. I would assume this is impossbile unless i have a video of her tape to a chair for the past 6 months and show it to the vo that she didn't leave her room. What if she had this 4 years ago when we never knew each other-

I see Darnell. I did run into that myself in the Phils and at the airport in Tokyo. Why would a Medical be different. These were Security Guards in Uniform as well. So that can be Correct.

The day of the Medical is not perfect timing. But as I said: That Visa is not important for now. This should had been addressed earlier I agree.

The visa will not be issued until she returns to the hospital sometime later and passes the test after treatment. This development is quite likely to bring significantly more scrutiny of the relationship bona fides, so be very well prepared for the interview. If there are red flags of any kind, they will be multiplied by this.

Syphilis is certainly curable and you may well not have it yourself. The Consular Officer's concern will be how and under what circumstances did SHE contract it. If not from you, from whom? Was it a boyfriend or a "client"? They may well not actually ask any of these questions directly. If from a boyfriend, that counts against your relationship. If from a client, it counts against the relationship and is reason for denial. Be informed and prepared.

Nota Bene - you may be getting set up for fraud at the Clinic - suggest you go to another Clinic on Tuesday, have another medical done. If indeed get same positive result for Syphilus, at least you got positive confirmation from a '2nd opinion'.


There is NO FRAUD in having a STD. The Member came Straight Forward about this but waited until the Medical Day. Somehow, it was in their minds and decided to ask us. They both need to be tested now. Not Only for a Visa but for their Health. It took a Courage to ask this question. Will the Visa be delayed? Maybe, does it matter, No. Not in this case. Their Health is more Important than a Visa.
The Fraud would be NOT Admitting a STD. True.

Will get result back from doctor on wednesday.
Was not aware of this, no signs or symptoms on both of us. so this caught us by surprise.
I will be also going for a test myself soon because of this even though I had my blood test for std last year. Note not a sexually active person nor she trust here. so this probably has been domaint in both or one of us since a couple years. but then again we are waiting the result on wednesday this is bascially our guess that we have it as of now.

Wednesday will be a big day for both of us, ignoring the fact of the visa and interview process now.

syphilis is totally curable, hopefully if we do have it is a single shot pencilin or a couple of time depending how long we had this .

this is not the kind of test i wanted for our relationship, but things happen for a reason. this subject made my heart stop a second then i realize I love her unconditional and she me...we go through this together...only time will tell..but its curable thank god...


I'm glad you made the right decision to get treatment NOW. The Medical will require a blood draw but I'm unsure what the tests are. Moreover, Get this taken care of. Wish the Best.

Is a medical exam with + for Syphilis an automtic visa admistravit review or other type of review that will delay a visa? Not a denial I know, but will she get a visa if she pass the interview day. If a medical fails would that be a no visa chance in the present time?

Bad news is never good news..


If the beneficiary has a STD such as you indicated and shows on the Medical Reports, yes I would think a delay until treated. I would think you will have to pay for another Medical after treatment.
If you were aware of this why did you not get treatment earlier? (beneficiary)
Is'nt that a cureable disease ? IS THERE A DOCTOR IN THE HOUSE ?
Is that going to look good at the Medical and/or Interview.
Left untreated that will decay a persons body. This is Insane. Hopefully, someone can answer this but I doubt Active Sypillis will result in a Visa when I THINK it is Cureable with Medications.

Still haven't received my RFE that USCIS says they sent out on 6/24. I called today since they couldn't do anything about it until the 15 day mark. The gentleman said that he would send a service request out and I should hear from them by 7/26.(is there anyway to follow this request?) I asked how long I had to respond to the RFE and he said 30 days. I asked him how that was going to be possible since it had already been 17 (sat was the 15 day mark) and I still have to wait to receive the new one in the mail. Plus have time to get together what ever they are requesting.
USCIS said that if I don't send in what they need with in the 30 days my application would be denied.
Has anyone else ever ran into this problem? Is there anything I can do about the time frame?

Based on what I read from this post reguarding the RFE.
If it was sent 6/24 you should already received it. I also think the Customer Service Rep was incorrect about 30 Days to respond or the Petition is Null and Void.
I know its a pain they won't tell you what the RFE is over the phone and you have to wait for Mail.
IF YOU HAVE'NT RECEIVED IT YET IN THE MAIL. Request that is LOST in the Mail and Not Received.
KEY NOTE: The RFE will have a Response Time for a Reply. " Carefully Open the Envelope and NOT TEAR the USPS Stamp which indicates the Delivery Date".

I'm alittle confused here... My wife applied for the CR-1 (so Petitioner) ? My brother in law is a Co-sponsor (US Citizen ?)
After marridge my wife left her job and is living with me. ? (What are the terms, conditions of the Visa, Passport ?)
It may come down too: Did she disclose to Immigration "Intent" for the stay and a pending Petition. Just a guess.

You won't be denied for a skin allergy, hives, pimples, etc. I would suggest a diagnosis from a local doctor before your interview/medical appointment. Best Wishes
