I'm unsure of the new 2014 Income Requirements but they will not vary to much from 2013. 

Tax Transcripts are preferred rather than Tax returns due to they easier to read but I never seen a RFE requesting a Transcript in replace of a return properly filed with the IRS.

Do follow the 2014 Income Requirements and the amount in family under that Petition. 

Another member will post that I'm sure.

If you post or add you family members included in the Petition they can tell you the limits.

A United States Citizen can be a Sponsor.  However the Philippines is in most cases does not really wanting to accept Sponsors.

Each Case is different.  It does not matter where she lives.  But remember, most VJ'ers will agree the Philippines is pretty tough on Joint Sponsors

they applied for IR1.. he came .. but.. moment HE got the GC.. he booked... .. seems he might be returning to.. what he left in Dom..

I am not talking possibilities i am asking what it is the time frame.. that will cauase him to be revoked...
if she contacts officials and tells of her suspicions.. would it matter? or.. as we think.. she should just walk away.. and let him deal with what he needs. .. either. reenter whenever. .. facing revoke if he waits too long.. or.. wait for his 10 yr expires and he does what he needs on his own anyhow...
Either way... she did nothing wrong... is /was the wife... and as was before.. and is now.. is the single parent raising two children under the age of 12... .. once again.... another dead beat father walking.. and not tending to his responsibilities... ie. no support... ..

If this is the case then if he doesnt return within time.. how will they know he didnt maintain.? .oohhh. passport. pshaaa.. haha.. it will show in his passport that he left country right.. and then .. stamp showing when he returned.. but.. if he has greencard .. doesnt matter.. if he was out for xxx amount of time.. that greencard is revoked?

Hi Am here by request of a good friend.
She has been married close 12 or so years. during which time she and her husband have been seperated for almost most of them.. just after the birth of the children. youngest is 10. He remained in Dominican Rep.. she moved back home to states. has successfully raised the children.. but never divorced.. ok fast forward..
they decided to give it another go.. (for childrens sake) .. filed for IR1 two years ago.. finally this past spring. Apr 08 it was approved.. . May 08 he arrives.. .. they live together.. he still is very distant... things not working but .. she still wants to try.. for the kids..
anyhow..
End of June or so.. he gets his GREENCARD.... ... IR1 remember.. no waiting.. Second week in July.. he decides.. he doesnt fit in ... (whole time he was here he was very unemotional and disconnected) he tells her.. hes going back to Dominican Republic... (with green card in hand)

After much thinking.. she thinks.. he had to have different intentions other than the family...
she thinks.. he has to of had a SO back in DR.. that he wanted to return to... ..

It seems all this return and make it a go for the kids was all a scam to get his greencard... and since they were officially married for so long.. he got his GC fast...

NOW the question is... what can she do?

Can she file something to say she believes this was done in bad faith by him.. can she get his green card revoked? does she have any options..?
I know if you came on CR1 and it is gotten he will need to file AOS. .. and..change .. etc..
but since I am not familiar with the process of IR1.. and green card issues.. I am here to request .. knowlege to pass to her..

Hi all. I was talking to my daughters Volleyball coach. I learned that she and her husband have filed for IR1 back in 2005. She is filing via Dominican Republic.. and I understand it is extremely long wait for interview once the file is in the embassy there.
She has been given her info that the case is now in Dominican Republic.. that it left the USA and was sent to Dominican Republic with a prefernce date of 3 2006 but a acceptance date of 2 2006.. She has a number of where she is sitting in Que.. back in feb 2006 she was at 22000. We checked today and found out she is at 8000. the way it looks her husband might get his interview possibly by August? No idea of how or when...

The question I have and she also has... since she has already gotten her NOA1 for the I-130 back in 2006... should she chance it and apply for a K3?

I think that it is terrible that she will be waiting close to 2 years just for interview.. and that is with no AP.. no RFE.. nothing.. just sitting in Dom Republic waiting in que.. ..

Anyone have a idea as far as what she should do . or where to turn to next.?

Hi there. I was reading the CR1/IR1 guideline and it states that

"Also, if your relative is your wife or husband and you have been married for less then 2 years at the time of his/her arrival at a port of entry, then he/she will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status."

When we were married we knew each other less than two years so were under the CR1 status. My husband had his interview in June 2008 in Cairo and now we are waiting for the name check (we assume since it's all called AP) for him to get his visa. Should the embassy automatically change that to an IR1 since we've now been married over 2 years and he still isn't here or will we have to do that at the POE?

Also, does anyone know if JFK is the only POE that he can get his work permit through?

There is a section here in VJ with comments from one officer who used to work at the USCIS center. According to him it takes 15 MINUTES to adjudicate a petition. I can not justify waiting 10 months for a process that takes 15 minutes to complete. The files are not being "meticulously" reviewed and analyzed to protect and defend the Country. The files are simply piled up sitting in a room and get worked on randomly so these people have something to do and can keep collecting their paychecks.

If the government wanted to ensure the safety of the country and protect their citizens maybe they should be taking better care of those citizens that are following the law and jumping through endless hoops to meet their requirements instead of having open doors for anyone who wants to come into the Country illegaly and simply doesn't have to hasle with any of the problems mentioned in this forum.

And of all the petitions that are "swamping" the government, only a few involve families that are separated. People waiting for adjustment of status, citizenships, etc are ALREADY TOGETHER. They are waiting together. They are no longer apart. We are not even asking for someone to come to the U.S. so we "can get to know them better" and marry them here. We made the committment and got married under difficult circumstances and have formed a family and simply want to start our lives with our family. Why is that so difficult to understand?

I have no respect for a government that keeps families apart and specially for a government that lies to its people. The USCIS website shows the current date they are supposed to be working on but we all know that is not true. We all know that they do not work in any order. They do not work on a a first in, first out basis as they themselves state numerous times they do. This is unfair and unjust. It was supposed to be "a government of the people by the people for the people" This is no longer the case.

You will be mad, happy, confused, frustrated, angry as He** and wanting badly to yell at someone in the process. Believe me, it does no good. We have used our time getting to know each other better and when one is down, the other is up. We try to focus on the positive, even though it's hard after 2 years and 3 months of waiting. But the end result is worth it.

My husband and I talk every day, at least twice. Even if its just a minute long phone call or 6 hours on skype (thats just today), it makes the day go better. We take turns being positive and negative, we share every moment like we were together, try to stay busy and buy a lot of phone card minutes! Skype is awesome, yahoo sometimes, SMS and calling. Just stay in touch with each other as much as you can. Nothing actually makes this process easier, but knowing you're in it together sure helps. Be ready for the breakdowns, they will happen, but also know they will end. After 2 years of this, I have a feeling we've been through it all. But we are so much closer now than we ever could have imagined. Good luck and remember there's always support here in VJ!

Don't let it freak you out martini, it doesn't happen very often. We had some red flags (fast marriage and I didn't get to meet the folks) and they decided to test us for a year before touching our case. That's what I'm guessing. Thank you to those who replied to my concern. To give more accurate information on my current income is that I make 14.00 and hour I have worked this job about 6 months. In the letter I received from my employer states that I make a projected amount of 29,310 per year. I will not make that in 2007 because I just started this job about 6 months ago. Again my 2006 tax return was 23,000. I will not use my 2004 & 2005 tax information at all, unless requested. I do think going with the I-864ez that seems to be the response I got back that will help me? It is a major concern in my situation because I do not have a strong co-sponsor to help me. So my faith is strictly based on your guys, and God. So my question was very important to know.

In 2004 & 2005 I was not above poverty guidelines, I was a full time student. I make good money now and have been working full time this year for 6 months. Does anyone think I will need a co-sponser?

Needing some advise about security checks, that are done during the I-130 process? I'm the person getting my wife here from Bogotá, Colombia. I'm 32 years old and I have one prior conviction from when I was 21 years old from a stupid bar fight with a guy's night out. As embarrassed to admit my past stupidity I need to at least gain knowledge?

I have been told that they are mainly focused on my wife in an I-130 petition. I did not sign anything being able to disclose my conviction from 11 years ago. The advice I was given was to not file a K-3 status for the being of the prior conviction in 1996. That way I would not have to disclose my conviction and worry of administrative decision or any delays.

Does anyone have any ideas or advice and knowledge of the process of the I-130 process? Should I even worry of this?

Hello my name is Shane. I can at least give you the advise my attorney told me. I to have a criminal charge from 11 years ago that was for a stuped bar fight. I got charged with a class C felony. I'm the American citizen getting my wife here from Colombia. From my understanding as a minor it will not effect your Visa process. They check you as a adult. Now if they ask you about this BE Honest. that way they have no reason to deny you, because they want to see if you are honest if they ask. But if it was me I would go down and check into the courts there in your country and see about a expungment or records concealment, To be honest I would not worry for this. In fact you will be fine. But at least check into getting it concealed at least. Now I have a question for you? Did your I-130 get approved due to your husbands record and being in Prison? I'm worried of a minor felony from 11 years ago. My I-130 is pending now.

I have another question about the I130 Visa Interview.

My husband has 2 felonys and got out of jail around 2 years ago.
He has been on the straight and narrow, however he has a bad past.
He has got in trouble for drugs, aggravated robbery etc.
I am quite worried, as Im scared i will not be approved as I was arrested as a minor around 3 years ago.
I recieved a warning for shop lifting, and have not ever got into trouble since.
I have been awake for nights on end, trying to find some reassurance.
I know that they do not take it to seriously, as I was only 17 at the time, and although it was a crime of moral turpitude, as it only happend once and i was underage t shouldnt be a problem. However it was not 5 years ago. It has been just over 3.
Im worried that the officer will look at my husbands past, and then see that i made a mistake at 17, and make judgement on that.

If anyone could help i would appreciate it.

The fact is that they cannot get to behind schedule because if they do then all Hell will break lose, because all USCIS case handlers are being audited. The positive thing to remember is that we will be with our loved ones no matter what. As for patience and being negative will only impact matters worse. In fact I have been fighting with that my self. The frustration level increases and you start having problems with your other, then you are in trouble with the marriage or relationship before they even get the visa. ok important question here. Why on the I-130 petition do they not ask the same questions as the K-3 process or the K-1 process. My reason for asking is very important. The criminal charges they list on the I-129F are not on the I-130? On the I-130 i seem to hear that the back ground check is on the foreign person immigrating into the U.S. as for criminal issues?

yes my self may need one. I'm the American filing for my wife. My attorney told me no worries but again I still feel it's important to be prepared. We all know how anxious we are to get our loved one's home. last thing I want is to go to the interview and find out we need a wavier.

Just hang in there. My petition has been pending for 6 months now. since May 19, 2007. We still have heard nothing too. I'm writing a letter to my congressman is all it seems left I can do. they told me yesterday I have to wait a extra 31 days. I'm in much dis belief also. But remain strong and you will get through this.
