Hello everyone,

First of all I would like to thank everyone for all the helpful information. I have been reading here for a while and this is my first post.

I have a quick question. I am currently trying to get my papers together to apply for the I-130 for my wife. I was married previously and had a divorce overseas 3 years ago. For the part relating to the certified copy of the divorce document, what does that specifically mean? my divorce documents are in arabic and the courts there dont have the fancy raised seal that the courts have here. So should I just make a copy of it and have it notarized? thanks everyone for your help


Specifically, The Divorce Documentation will show you are Free to Marry as you know.
I Highly Suspect those Documents will need to be Translated in English to USCIS and I believe a Notary wont help if Not Translated.
A Copy of the Divorce will be required and a NEW SEAL Dated/Stamped/Signed is what I believe is Required. IN INK.
I maybe wrong but this is Normal for the REQUIRED Divorce Documentation to submit with any Petition.
I may stand Corrected but I think this what you need.

ok. Well I'll go straight to the point. I'm worried, I have NO income right now, and do not have a W2 form to file taxes for this year. and the previous years I didn't make much because I was going to school full time (Nursing School- just barely graduated - no job yet, I'm in the process of registration with the State).
So my finances Do Not look good at all right now, and unless I can find a Nursing job within the next few days my finances won't look any better in the forms.
I'm wondering if I have a good Co-sponsor, does it matter that I don't have an income? Will they take into consideration that I just graduated from Nursing School?

Nursing School could be CNA $10.00 per hour. LPN $ 18.00 per hour. RN $ 28.00 per hour.
It will matter to show Currant Income, the previous years of No Tax Statements can be explained you were in School. (That cannot be explained if a CNA since that is a 9 week Course)
You have paid the Fees already. You can delay. A Co-Sponsor would work as well.
Try and show at least 3 Months of Income if you can. I wish you best.

I don't think this applies. She is not in the States as of yet from what I read. Western Union Receipts are good with accompanying PROOF of a on-going relationship.

I don't think any qualify. I beleive there has to be a Primary Co-Sponsor who Alone exceeds the Poverty Guildlines. In other words having 3 Co-Sponsors is not going to work at all. I believe a Single Co-Sponsor. Not Multiples.
Someone Correct me if I'm wrong.

This question kind of comes up a lot but I didn't find the answer I need so...
The instructions for the IV application (in Brazil) require:

A passport must be valid for travel to the United States and must have at least 8 (eight) months' validity beyond the issuance date of the immigrant visa.
A copy of the passport page that contains the biographic information, passport number and photo must be sent to the consulate along with forms DS 2001 and DS 230 parts I and II and frontal picture.

So he has to send a copy of his passport to the Consulate before they give him an interview date. The problem is my husband's passport expires in October 2012 which is already less than the required 8 months. Can he use his soon to expire passport to set the interview date and then renew, hoping it will be ready in time for the interview?? Or does he have to have a (new) passport with the necessary 8 months before he sends his DS 230 to the Consulate??

(And does anyone know how long it could take to get a new passport in Brazil?)

...I really wish we had noticed this sooner :(

I might be wrong but I think PushBrk answered a similar question the other day. If the Validity of the Passport is valid only 8 months prior to Visa. The get a updated one. Do that now if I'm Correct. Keep a reciept of the payments. If it expires October/and only good for 8 months then its a worthless peice of paper. if I read correctly.
Additionally, Puskbrk mentioned the AOS and a Valid Passport....

We'll i decided to begin building and printing out needed documents. I Will be getting married around Oct 31, 2012 in The Philippines, I'm Never Married. Im 27 She'll be 21 years old. She's about to finish her college june 1st. We've been in the Relationship for nearly 1 year now, and I Traveled in met her in person One Time for about 2 weeks. I have been Supporting my Fiancee financially, Nearly sending her $9,000 U.S. Dollars in our 11 months together, I have about 35 Western Union Reciepts. DO I NEED TO INCLUDE ALL OF THEM? or does it even matter? Also im trying to build up some Chat records, most of our chats is done on Viber App,. and Calls to one another. I just dont have ability to prove it, But how many pages of Chat Logs should be included, or did you include? Also i have made $50,000 US The past 4 years, i have my W2's from the previous 3 years saved. (is this enough money the 125% poverty?) next. do i need to include a Police Record for myself? How many Pictures together did you Include ?


If your Income is $50,000.00 per year you have exceeded by far the Income requirements so thats not a worry. No Police Records are needed, they do that. Pictures? take many and proof of a relationship. (On-going)
Chat logs can be printed. Send her several. Pictures ? 6 to 8 is plenty. Some make a scrap book but not required.
The Western Union reciepts. I would include a few. Birthdays, etc. (Also not required)
Question. : Did you make $50,000.00 per year or combined in the last 4 years ? That would be a huge problem...

I agree Boiler. But I sense... That Last year and this year have not changed otherwise the OP would have mentioned that. Currant Income is most important and shows stability. So many Petitioners deal with this economy and others are OK. The OP's Original post indicates he does make enough last year and does not indicate this year is any better. Therefore, so as... Has indicated the familys denial to continue as a Co-Sponsors in the Petition. Thats personal between family.
The CO-Sponsor term is used so much. There are good reasons for each and every case. A Student about to Graduate and so on. I see no indication of this in the OP's post. I don't know the story? Were only here for random advice and let the OP make decisions on their own.
When someone asks a question here, they will get many opinions and that is helpful. They are read. Then, the OP has to take each one and determine what fits me best... The OP indicates the process has been completed with a Co-Sponsor so far, but that Option is Null. Now, there is No Sponsor.

You have gone along way in the process but now your reliance on a Co-Sponsor has dimishished. There must be a separate reason for the sudden Change. But, thats neither here nor there. Immediate family has decided "No"... Were not going to Sponsor your Love - Life and that is your responsibility. And, I agree.
Your in Mexico having a good time with your wife and relied upon family to walk you through the process with a signature. They got Smart, did'nt they? They might have figured NO CHANGE in your behavior as far as Support. So, I figure... They backed out! But, they did nothing wrong.
They Economy is rough I know, but residing in Mexico with the lower wages is not going to help. Jump the Border... Get a job. (I know there hard to find) With No Co-Sponsor and not meeting Income Requirements your dead.
So, what are you going to do ?
I would tell your parents: I need a place to stay. Go find work and do this without you. (Co-Sponsor) It is my responsibility... Or you can just sit there.
There is No easy way... My point is: You are responsible for your personal relationships/financials. Not your family.

Hi All

I was a retired American in Thailand for the past 5 years. I have returned to the states and established residence here.
We have an NOA 1 received and my wife is with me in the US on a tourist Visa. She will return to Thailand in the near future.

Question:
I have collected SS payments and I have an IRA that I have removed funds from each year.
The SS payment and the withdrawals from the IRA do reach the minimum income requirement for each of the past three years
(125% of poverty level)....Though I have not worked,

I wonder what effect my "not working" will have in this process. I believe I have sufficient funds in the bank as well to help me qualify for the income requirement

Retired and not working is not the issue your asking. Meeting the Poverty Lines is the question.
Not working has no bearing if the requirements are met. So with said: Can you supply members with more details:
Does your SS Income meet the poverty guilds alone or does it need a "push" to deduct from the Individual retirement account to meet guildlines?
Balance of the IRA..? Is a penalty based for early withdrawal? If not, the IRA is a good hedge. Funds in the Bank.
If you could be more specific about these balances and monthly payments you Will get better answers.

My friend met this guy thru me..they knew each other for 2 months now and they want to get married in the Philippines in January next year this will be his first visit..She wants to know if it's just okay for them to marry since they need lots lots of evidence in case they file for a spousal visa....and is there a possibility that she can pass the interview when he gets her over here?


I'm going to go out on a Limb here but I hope this helps. (Going out on a Limb means: 200 feet down and I'm afraid of heights)
As long as they are both free to Marry and legally divorced/single with proof at the time of the wedding that is acceptable.
The Petitioner must have a Valid Passport to travel of course. His flight ticket will require a round trip ticket and return in the 21 day or less period.
Customs will ask the reason for travel. Just say: to get Married.
Be aware there is a waiting period for a Marridge License (about 2 and half weeks) So plan on that when in Manila or request a extention at a cost.
There is going to be at least 8 months to a year after they file the Spousal Visa if the plan is get married in January. So they have plenty of time to show proof of a relationship. They should keep records of everything to a point.
They have'nt even met yet.. 2 months? But, I'm no judge. Trying add a few things to pass your friend. You will be told by other members: Keep flight boarding passes, reciepts of any sort which is good.
No, she will not Pass and interview when she gets here.. That will be held in Manila, thats where "they" must Pass.
Spur of the momment things without careful thought will lead to a negative outcome. Your friend should make an account and ask questions as well.

It really doesn't matter what you think. Even if the petitioner was currently on parole for armed robbery, it would have no bearing on a spouse visa process. Only petitioner criminal records related to the Adam Walsh Act would impact the process. IMBRA does not apply to a CR1 or IR1 process.

Consular officers follow the law. The law does not require that petitioners show evidence of rehabilitation for past crimes, so Consular Officers don't require it either.



I know you're more educated than me. But, that law sucks. If it was your daughter maybe you would disagree. You are giving the OP the idea that this will be a peice of cake. Really.

Tim/Mav gave you incorrect information with regards to spousal visa petitions, you are not required to submit any kind of waiver nor will you be required to send any evidence related to your past indiscretions. With that being said, a criminal background check will likely be done on you and at interview time, a CO will have that information and could ask your wife about the details of it.



There is no requirement for you to have been living together in order to file, you can answer "We have not yet lived together" for that question (that is the answer I gave). "None" is also an appropriate answer for that question. "N/A" is not an appropriate answer for that question because that question is applicable to you.

Furthermore, USCIS will also not expect couple living in separate countries to have things such as joint accounts, property or leases together, etc.


In retrospect: So, it is not required for a Spousal Visa Request. So, you implying she attend the interview with No Loaded Guns to defend the Petition and the Petitioner's past Criminal Activity? The beneficiary being aware of his past is good but that will not be on course. The CO is going to look at her safety based on Convictions/Felon. So, what happens is a case like this? Just because she knows about it don't mean much with the Petitioner's Background. To me, it would make better sense to provide Information/Documents related to treatment verification to insure the beneficiary will not be in harms way. I mean: Why go to an interview you can't win unless and maybe they ask for these documents later as I stated. Do it right the first time. Have everything there for the Interview the First time. They will definately throw this on the "back burner" or deny.. Would you Approve it without showing proof of rehabilitation of the Petitioner ? No. And the CO won't either I would think.

I dis-agree with so many of the replies from members I seen on this post.
Moral Turpitude Only applies to the Beneficiary and not the Petitioner. (The Petitioner's Criminal Background is looked at)
You have some SERIOUS CONVICTIONS against you. 10 years is not a long time and your Offences will be looked at seriously for her safety.
You have drugs, batterment, and a weapons charge on your record. As to a Convicted Felon.
You will need: A Waiver stating you are no threat. A Lawyer to file this but not required but I would'nt take that chance. Proof of Counciling and completion of required Court requirements.
This is a piece of the biggest Beef Jerky you will ever bite into. This is going to need assistance from every juridiction your came in contact with and a letter proving you are no threat/completed programs.
The $19.000.00 is Borderline for 2 but is OK. Thats your last worry for now.

IRS payments have no bearings on visa approval. As long as you meet the income guidelines you will be ok.


I differ from this comment respectfully. If there is money owed and a payment plan in place and met that should be OK and have no effect. However, a IRS Lien is a whole new story meeting Income Requirements or not. It is important to keep those payments up and not force the IRS to Judge a Lien. That would have possible ramifications to any type of Visa.

We have emails from back then but no screenshots of the website profiles and pics . Is it worth it to try to go back and look in the old accounts and get this stuff. Or is it ok just that we have communications with each other from then via email and yahoo messenger?

Your question is not really how did you meet your Spouse. Your are asking about currant proof of a on-going relationship for her interview.
E-mails and Yahoo Messenger are printable and dated. It is worth your time to print these. She has a User name and You do too, so you don't need to print the conversations. You can pick-out a few and use those as proof since they are dated. On Yahoo I occassionaly take screen pics of Mav and me with a Camera as well and can be printed. (Web Cams)...
So, if you know someone with a printer get on this soon. Mailing to the Philippines is slow. Fed-Ex Recommended.
If you have Facebook, you can use that too. You are not allowed electronic devices but they can look at it if they want by her giving her user name and password. Thats alittle extreme though. So, you will be fine. Get that off in the mail or have her print at a local Cafe.
Any internet Conversations are recorded. Use them to her advantage for her interview.

Unless you are directly in an area with active conflict you are not likely to have much luck. You would basicly need to so issues withing blocks of your home.


This is a lengthy process. There is No Guarantee of anything. Never heard of Proving Within Blocks of the Beneficiaries Residence ? This I question.

No,  I think not.  Your Petition already included past residences.  They look at that.  I never heard of a Police Requirement of the Petitioner.  Did you make a mistake or do something wrong in that Country ?  If not.  USCIS looks at YOU First.  and if you pass, then you have nothing to worry about....

As with Any USCIS Documents/Enclosures. Mail a Complete Packet. There is no such thing as Multiple Packets. Prolongs the Case and increases headaches. Mail all documents together.
The word is Packet.. Not Packets. Be patient and provide all information the first time and not multiple documents mailed at different times.

I'm unsure of the new 2014 Income Requirements but they will not vary to much from 2013. 

Tax Transcripts are preferred rather than Tax returns due to they easier to read but I never seen a RFE requesting a Transcript in replace of a return properly filed with the IRS.

Do follow the 2014 Income Requirements and the amount in family under that Petition. 

Another member will post that I'm sure.
