After everytime i went to visit... The count down to departure took forever... and after i Got there the weeks pass quickly and then when i return a week passes and it feels like months lol. but, yes, a visit really helps to give you the motivation to get through it. and think of it.,...this is the last wait for you, after she gets here you never have to aprt again....ever...you'll never have to worry about any of the worries that come with a long distance rtelationship...you can do AOS together it will be well worth it..
and think, if you can get through all this together...imagine how simple normal problems in a marrige will be eh? Good luck...don't let go of her that whole week!

It really isn't that hard to get all that.. If you can't get a letter from the bank guy, you can give statements or such. The employment letter is a must.. and if you want to get 3 years of taxes, it isnt that hard to do. They accept transcripts.. call the IRS at 1-800-829-1040 its an automated system that will send you the transcripts after 10-15 days. you can go back up to 3 years.
Do you have any pay stubs? I've been saing mine since i applyed...i sent them all.

I keep reading about the infamous packet three. What exactly is it? Who does it go to? I'm still waiting for NOA2 but want to get things together before I go see my fiance in a week. What should I take to him so he is prepared for all the paper work he'll have to do? Any advice is a big help. Thanks!

Packet 3/4 the packet your fiance gets after the embassy gets off their butt. They'll send it with app. for interview and medical. It has an appointment letter, ds 156, ds 156k's ds 157's etc. joyTIM had an excellent topic on it with copies. You need to make sure that your fiance has your cert. copy of divorce/ i-134 w/ supporting doc i.e. taxes, letter from boss, bank statements/letter from teller etc. Your fiance needs his/her own proof of relationship and meeting : e-mails, pics, etc. The app in manila at least is 100$ and the medical was 95$ after you finally get them over, you'll need cash for i-485 and all the AOS stuffs. fun fun :D

I think that having 2 different addresses is just going to confuse the powers that be. I don't know what you would do if you already sent them off- try to call someone to find out what is going on for sure, I wouldn't just leave something like that to the opinions of just us in here. That sounds like an important thing to take care of asap. If ya get another chance perhaps list the address that would make things easiest on you, like you said the one with all her info getting sent to it. Make it as easy as possible for yourself. I hope everything works out for you, and that you can get it taken care of withouit costing you too much time. :D

Sorry to say, but "No the petitioner is not allowed in". They have changed their policy and now will ONLY let the petitioner in if they blue slip you and request an interview with the petitioner. Even if you're (the petitioner) there waiting outside they will most likely not care and just request a new interview...they really don't care about the hardship it puts on you to make two trips...Just a Warning...

I'm glad this question was asked, because I feared that it would be cause for RFE.

When filling out our I-129F package I used the checklist listed on here on Visa Journey. Steps 7 and 9 of that checklist state:

"G-325A (all four pages) filled out by.................... and dated (see example)."

The old G-325 was 4pages (2 sheets front and back). The new G-325A is only 2 pages (1 sheet front and back). If people are assuming that phrase means "copies" then we're surely generating more unnecessary paperwork than what needs to be submitted. It would probably cause less confusion if the phrase "all four pages" was removed from this checklist and every other checklist for any of the other types of visa on.

Does anyone know whom to contact here at VJ to make those sort of corrections if they are valid?

I'm aware of the painful negative stereo-type of a single mom in the Pinay culture. I believe the purest intent of CR-1 visa is to unite husband and wife within the US and you've made it clear that this is not the going to be the case. And while I'm only a casual observer to this forum it sounds suspect and in my opinion would appear to be fraudulent for you to enter the US on a CR-1 since you're not intending to use it to unite with your spouse. I'm saddened for you, your child, and your situation, but I'm also saddened that you may end up with a greencard as a result of this situation.

We were approved on Oct. 26th and she received the visa by mail on oct. 29th. She is going to enter the country around Dec. 1st after he puts in her 2 weeks notice to her work and gets her things in order. My question is what do we do next besides get married? what forms do we fill out and which ones do we do first? I am just not sure of the next step after she enters the country.

Thanks for the advice. I was a little worried about that. Unfortunately I didn't use my credit card over there. I have printed out my trip intinerary from Expedia, copied my passport stamp, have my return trip boarding passes, and 5 pictures. Hope that will do it.

Yes indeed, have lived and worked with several people who immigrated from india or who have parents that did, and most all of then have arranged marriages/were strictly forbidden from seeing people outside of their nationality, religion, etc etc etc IF they could date at all (usually not allowed)... The foreigner thing would be a MAJOR issue imo


the foreigner issue is not such a big one; many indians are married to foreigners. the family is generally the biggest obstacle to that since yes, most all indian marriages are arranged, by the families. but family is not an issue in in this case since he has none.

he has no family, so no one to approve or disapprove. that part makes it easy, since that can be a gigantic hurdle in india!

my financial situation is this:

i have not worked since sept. '06. i lived in india the last six months. i am now doing some PT work for a previous employer, but the bulk of my work will writing a book that i went to india to do research for. (meeting my fiance was a surprise bonus ;))

i lost nearly four months of wages in '06, which shows last years salary below the poverty guidelines on my tax returns. i can get a letter from my employer, but that does not help with the tax returns. i do have adequate funds in the bank to support my fiance when he comes, so i just need to understand how to go about presenting this on the given forms. it looks like i need to do further research with re to the I864 to understand how "$50000 would substitute for $16666 shortfall".

my case is perhaps a bit unusual, so i have some questions that i am hoping someone maybe able to help with.

my fiance is indian. he is also a swami/sadhu/baba, a life that he was forced into by circumstance as an adolescent and one that he no longer wants. he wants a family life, and has proposed marriage.

we met in india this year, and spent three months together before i returned home to the u.s.

i am older than my fiance by 16 years.

what i am wondering is, will the fact that he is a swami and i am older than he raise red flags that may require professional help?

also, does having a bank account with a good sum of money (50k) help offset last years income that is a few thousand below the required levels (since i was in india for several months last year).

any help is greatly appreciated!

The latest versions of some of the PDFs can be filled out and saved using Acrobat 7+ versions. You can fill out and email those no problem.

You can fill them out but you cannot save the changes on most of them, I suspect the OP wants to fill them out then email the filled out copy.

I'm currently waiting for NOA2/approval of our I-129F petition for the K1 visa. It's reached the point where I don't believe we will have the visa in time for our projected wedding date. I don't know when the next time window for us to possibly to get married will be - I'm in the military and will be going overseas soon; there are a lot of unknowns.

Is it possible for me to stop the visa process right now (say, once the NOA2 is received) and continue pursuing it several months (possibly up to a year) down the road when we know more about our situation? Or will the application "expire" and we will have to restart the entire process?

I've tried reading around on here and on USCIS for answers but I haven't been able to find anything. I would appreciate any advice on this matter. Thanks.

sounds to me like thats enough evidence you sent there now. and i totally agree with you when you say rfe is very vague. an attorney once told me that the notices are very generic they didnt sit there and write it directly to you its sent to everyone with similar situations so its your job to figure out what parts of it actually applies to you. good luck

Okay, so my husband and I got married October 21st, 2010. I'm currently living with him, we haven't filed the paperwork, cause well we don't know where to start. We called the USCIS yesterday; which didn't really help... I think we were left with more questions then answers. My husband asked what we can do, since when I entered the United States on October 8th, they never stamped my passport. The guy he talked with said our best bet is for me to go back to Canada and then enter back into the US and ask them to stamp my passport. BUT, usually my luck going through the border is horrible and they always are difficult with me. So in order for us to file the I-130 (I think) I have to be here, in the States! Anyways, I guess I need anyone's help whose had to go through this. Also, my husband and I disagree about something, he thinks that when we file our paperwork if they ask if we planned to get married we say yes we did. But I don't think we should because we'd only been talking (more) seriously about it two days before. I dunno, like it wasn't completely planned.

I hope this makes some sense and anyone with good input about what we can do, would be awesome. We did have contact with an immigration attorney, but he's a flake and stopped returning calls. And considering the USCIS guy basically told my husband, send your wife back to Canada and then have her return and ask the customs officer to stamp her passport... that seems like our only option really. UGH, okay... feel free to ask questions and I'll try to answer them as best as I can.

I won't highlight any comments from members here because anytime the Adam Walsh Act is the reason for denial it is DEAD SERIOUS. You are legally married and asking for help. Well, a Conviction could vary to how extreme the Crime commited was but The Adam Walsh Act specifically says It was and is a Felony.
I'm not saying your deserve a second chance but maybe you do and have changed? I'm not a Judge.
So my question(s) to you is: Did you tell the truth on the Petition?
Did you Consult with an Attorney about a Wavier showing the time-span of the Offense/Conviction and show treatment for this Conviction. You can file this on your own but is highly un-recommended. (Wavier) Get an Attorney.
You will have to Prove you are rehabilitated, no danger to your spouse and ANY children and/or others.
I would get a Attorney if you fell you can show this and documentation.
If you can't do this, then divorce and let her go on.

Well here is goes....my husband's father was killed in November for "X" reasons...and the guy that killed him is threatening my husband as well. This is a serious matter and I get scared every time my husband leaves the house...so I wanted to know if that could be a reason to expedite his case seeing that his well being is at stake :crying: (I have his fathers death certificate stating the way he died as proof) so what do you guys think?


I would say No ! If in fact this person killed your husbands father he would be under arrest or in jail. Therefore, not a reason for Expedite.
You would need proof of threatening letters, calls, etc. and these would have to go to the police and verification of the reports. These reports would go to authorities and a investigation. The investigation would lead to an arrest or heresay and not enough proof against the assailant. This appears to be the case.
USCIS and/or NVC would take no action for such an Expidite based on accusations that your spouse is in danger.
I'm sorry about the traggic news but if this man is free he was never convicted. If he was tried in a court and got away with it and sends threats, that is different. But, the police would arrest this person immediately.
So I say No!

First of all I would like to thank everyone for all the helpful information. I have been reading here for a while and this is my first post.

I have a quick question. I am currently trying to get my papers together to apply for the I-130 for my wife. I was married previously and had a divorce overseas 3 years ago. For the part relating to the certified copy of the divorce document, what does that specifically mean? my divorce documents are in arabic and the courts there dont have the fancy raised seal that the courts have here. So should I just make a copy of it and have it notarized? thanks everyone for your help


Specifically, The Divorce Documentation will show you are Free to Marry as you know.
I Highly Suspect those Documents will need to be Translated in English to USCIS and I believe a Notary wont help if Not Translated.
A Copy of the Divorce will be required and a NEW SEAL Dated/Stamped/Signed is what I believe is Required. IN INK.
I maybe wrong but this is Normal for the REQUIRED Divorce Documentation to submit with any Petition.
I may stand Corrected but I think this what you need.
