Hope these help. Also I remember you asking on another topic about how to find out if your case is back in the US. You can check the status with USCIS. I was told by USCIS that your online case status will be updated when the case arrives. Not sure how accurate that is  Also having your senator or congressman on top of it should help get information quicker. If anything it feels better knowing someone is working on it on our side  Let me know if you have any other questions...I'll help as I can.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview process that went strange
Me and my wife had our interview yesterday. We went to the first window and the woman some how froze our case in the system trying to back out of it to many times. Then we went to wait at the number two window.

We were called up because my wife was pregnant and they were nice enough to give us two choices, wait there or call us later because our case was still frozen in the system.

We decided to wait there for the interview. Three hours later they called us back up and went ahead and conducted the interview part, but could not finish the finger prints for my wife. They asked me some questions and my wife also. The consular said they wanted to approve the visa but could not because my wife needed to come back the next day for finger prints.

My wife returned today alone because i had to fly home today and the finger prints were done, they said to her the visa was approved. We paid the delivery fee to have the paper work sent to her home.

My wife gets home and her mother tells her that the embassy called, and to call them back. My wife calls the visa unit number and they tell my wife she could not be approved at this time because of some record they need to get. They told her not to worry about it this happens and they would call her back in for another interview??? What The hell are they doing???

Then they say to my wife it's some Ap process, it could take weeks or a few months they said, but they knew she was pregnant and they already sent some telegram message to what ever record they needed. They would not give details as to what they are searching for. Could some one please advise us what to do or expect now? My wife is soooo sad and heart broken. We were told it was approved and my wife gets home and gets this freak en phone call.

K-1 Fiance(e) Visa Process & ProceduresFinancial support as proof of on-going relationship
Hello, as to your question sending anything that has your spouse and your name on the bank staement, or western Union this is a very good one. Anyting that you can prove with your name and hers on the statements you send the other person can be used for ongoing relationship proof. I send my wife western Union twice a month. It allows on the statement to have the senders information and the person receiving the information. That is the advise i can give. Also opening a life insurance policy helps allot to putting your spouse or loved one as the main beneficiary.

K-1 Fiance(e) Visa Process & Procedurestypical US Laywer fees for filing K-1 Visa?
QUOTE (anarcho @ Sep 6 2007, 07:40 PM) <{POST_SNAPBACK}>
What is the typical lawyer fees for filing a K-1 Visa. I was quoted over $3000 and that is not including any of the regular fees (application fee, work permit, etc...). I am a Canadian citizen looking to move to the USA to be with my fiance. The price seems steep just to fill out some papers and prepare us for the interview.

Also, once you are married there is a 2 year period that you must stay together in order to keep your residency, correct? During this 2 year period am I allowed to leave the USA at all (like on vacation)?

thank you

That is way too much!!! The basic fees I was quoted are generally around 1500-2,000 at most for a really good attorney. I can refer you to an attorney that specializes in the fiancé visas. She seems to be doing well for me. I’M doing a spousal visa petition. It does not matter where the attorney is or what state. They all do the paperwork the same. This attorney’s name is Deborah Webber. She is a Immigration attorney on is also registered with the immigration lawyers association. Here is her contact information and web sire. Canada is one of her specialties as well. I spent many weeks and hours looking for and attorney and even got hosed from th4e first attorney I hired. I fired him and found Deborah Webber. Tell Shane referred you. I paid 1400.00 for my case.

K-1 Fiance(e) Visa Process & ProceduresDomestic violence conviction and dismisal
You will be fine as long as she knows. they may try scaring her away in the interview maybe. Juts make sure she knows the storey. they may even present her at the interview with the court documents. I have heard of this happening. I to have a prior conviction from 11 years ago. My attorney said they may only try scaring the spouse away with this. But that is if my wife had no knowledge of my conviction. Do not worry. You may have to do a wavier at most. NO WORRIES... good.gif

QUOTE (jenjames @ Dec 23 2007, 09:15 PM) <{POST_SNAPBACK}>
Just an FYI-an immigration attorney told us that some names are thread into the Homeland Security list of 'dangerous names" or something. Your fiance could just share the namesake of so-called terrorist. In this case, it might take awhile for him to be cleared.

This is probably not the case in your situation---but I thought I would give you a heads up. Hang in there!--Great things are worth the wait! I can't believe there's such a long periond between the NAO2 and the NVC-what a bummer.

Yeah the wait time for it to go from the USCIS to the NVC was almost 2 months. It used to say on the letter they sent that it would take 30 days to go from the USCIS to the NVC. That letter has now changed to say 90 days. I thought it was crazy that it would take that long to go from one place in the US to another. Now we are dealing with this delay of our paperwork held up due to extra security measures put into place after 9/11 (which is what they told me over the phone at the NVC when I called.) I do not know if it is from a namesake or because of him moving 5 times in a short period. There are not even that many people with his last name in Sweden. Oh well, I'll keep on calling the NVC I guess (even though calling there is sometimes like hitting your head into a wall.) Thanks again for the replies, greatly appreciated and any other advice/tips are definitely welcome!

K-1 Fiance(e) Visa Process & ProceduresWaiting and waiting... new to the forum
Thank you for the reply. I think the reason it is going through a check is because he moved around a lot over a short period of time. It is the only thing I could think of that might have set off some sort of red flag in their eyes. I just hope it goes quickly and does not take months. It is hard to just.... wait, but I guess there is not much else that I can do.

K-1 Fiance(e) Visa Process & ProceduresWaiting and waiting... new to the forum
Hello! My name is Jennifer and I am in the process of getting a K1 visa for my fiance who is currently in Sweden. The petition was received at the USCIS in California May 29, 2007 and was approved September 19, 2007. The NVC received it and we got a letter on November 16th saying that within a week our petition was going to be sent to the American consulate in Sweden. However, that did not happen. I put in a call to the NVC and they said it had not been sent due to a background/security clearance check that had to clear first. I asked them how long it would take, and they said the process can take a while, but they had no estimated time. Then I contacted my lawyer who said this is a normal part of the procedure, and she has had some cases take over a year to be security cleared. A year? I don't want to wait a year! I want him here now! Has anyone else experienced this delay? It seems like the other cases I've read have not had this problem or delay. Any help or guidance on this is much appreciated. I am glad to have found this forum, it is so nice to know that we are not alone. Thanks!

K-1 Fiance(e) Visa Process & ProceduresNOA2 to NVC from CSC
QUOTE (Dias Melhores @ Dec 31 2007, 11:54 AM) <{POST_SNAPBACK}>
Got the NOA 2 on 12/13. Did the RFE trick and the officer informed me that my petition left CSC for NVC on 12/24. I spoke to an NVC person this morning and still no record of our petition at NVC. Not sure what to believe and questioning if it really left CSC on 12/24 (Of course, there are two holidays and transit time to NVC to take into consideration). Who knows??? All I know is that it takes too long!!! smile.gif

LONG It does! It took 2 months to get to the NVC once approved, and look....... ours is STILL sitting at the NVC... talk about waiting! Most spend 2 or 3 days at the NVC, ours... 6 weeks now.... so we waited for CSC and now we wait... again.... for NVC to send to the consulate in Sweden. Crazy!

Are they open today? I've tried calling the NVC like 10 times now and keep getting booted back to the automated system saying all of their operators are busy, call back later. Is it just that they are extremely busy today? I was thinking that maybe they were closed. I guess I will keep trying!

Happy New Year all!

I am engaged to a Candadian, who lives in Vancouver. My initial petition was received in Vermont on December 13th.

We have a whole wedding planned for the end of August and I am very nervous that this date will not be possible now.
Is there anything we can do to expidite the 6 month wait on the US side?!?! Not sure if it matters, but I have contracts, etc. to prove the plans.

If not, once the approval gets to the Consulate in Vancvouer, I understand that there is a cheklist of things for my fiance to obtain (medical, police records, etc) Can he do any of this in advance so that it is all ready to go and we can save a week or two and get an interview date ASAP?

Thanks for your help!!!!

Hi there and good luck! August is possible but it will definitely be cutting it close. My particular case is going to take close to a year to complete, we started in May and we hope to have an interview date by the end of this month. I am hoping for a wedding in April, but I am not booking anything yet. It certainly makes it complicated to plan ahead when you just don't really know when they will arrive.

I do not know of anything that can be done to expedite the wait on the US side. All you can do is wait and let the government wheels turn.

As far as what you need for him to obtain after your case gets to the consulate, he will need a police certificate, his original birth certificate, proof of your relationship, an affidavit of support from you that you will have to send to your fiance, the doctor report, divorce decrees if there are any, some passport photos, plus the paperwork he will get. Most of those things you can do ahead of time so they are ready. I didn't know that my fiance would need my divorce decree or I would have sent it before he got the Packet 3 from the consulate. Now that is all we are waiting for him to get before we can send in the Packet 3. I had already sent the affidavit of support forms and information before he got the Packet 3. Then we first have to let them know all that paperwork is done and then we get an interview date, and I have no idea how far out the date will be. I am assuming it will be some time in February.

Make sure all paperwork is correct and complete so you won't get any RFE's that can cause unnecessary delays. Otherwise I don't know what else to suggest other than to hope and pray things move quickly so you can keep that wedding date. Best of luck to you!

The U.S. Embassy in MNL site has now released the March interview schedule. So no more second guessing. Here's the link http://usembassy.sta...1/wwwh3227.html

K-1 Fiance(e) Visa Process & ProceduresCourier question manila

when Claudeth went through the process it was Manila that set up the appointments and had nothing to do with any other department or agency, at least for the K-1. What number did you call at the embassy? I used to call (632) 528-6300 and then go to extension 5184 or 5185 for information.

How long has your petition been in Manila?

I called the dept of state...they say manila sends them the information. It's the only other thing i can find to call. As far as i understand they are the over-see-ers of all of this.

K-1 Fiance(e) Visa Process & ProceduresCourier question manila
My packet 3 was mailed by the embassy on jan 26, with a medical of march 8 and a interview of march 15 (this is according to the Department of state)
The emabssay, when I called, claimed that she still has no appointment. I called the Dep of state and they informed me that they were 100% positive that she does in fact have appointments on that date and the packet was infact mailed.
Who should I believe? Are the people at Manila just some girls at a call center? And how do I find out if it was mailed and she just wasn't home? Do they use FedEx? or regular mail? any help would be greatly appriciated...thank you =D
