K-1 Fiance(e) Visa Process & ProceduresNOA2 Approval
QUOTE (mfalv @ Jul 31 2009, 05:53 AM) <{POST_SNAPBACK}>
Here are my questions:

Is it true that the documents necessary to meet the NOA2 vary from one couple to another?
Will it also matter in which state in America one’s fiancé lives?
Is it any helpful that my fiancé lives in California? Does CA welcome new immigrants at this period?
My fiancé had typed “Californa” instead of “California” on the I-129F form that he sent. Would that affect the process?
Does the USCIS already check tax matters before releasing the NOA2 or tax-related stuff arise during the NOA2 compliance?

1. Yes. There are the basic required documents for everybody (forms, letters of intent, photos, etc), and then there are the documents unique to your case.
In my case that included a divorce certificate, multiple name changes, and some documents for a dependent child.
Then, EVERY foreign document had to be translated, and EACH ONE had an affidavit that the translator was competent.

2. No.

3. a) makes no difference
b)That's more of a question about the current attitude of the populace, and not government process. The former is irrelevant.

4. probably not

5. I have no idea. Somebody else will have to give you an answer.

Is there a problem with your back taxes that you should straighten out before they look?

K-1 Fiance(e) Visa Process & ProceduresLost my ticket stubs, can a DNA test on the baby be proof of having met?
I couldnt find my boarding passes either, because I tend to throw that stuff out after I get home and clean the suitcase.
When I came home from meeting my fiance, I didn't know I was going to need all these things.
What I did have, and used for proof of meeting was the passport stamp and a receipt for cashing a travelers check in BKK - it had my passport # on it; along with some other receipts.

If you used your credit card to purchase anything while you were abroad, the receipt for that would serve as supporting evidence of being in-country.

along with a photo or two of course, but photos are secondary evidence (they can be faked).

Yes she needs to sign the G-325A and I would make sure and use the old form that has 4 copies and instructions for a total of 5 pages, she needs to sign all 4 pages.
The I-129F instructions still say to use the G-325A, so I don't think you need the G-325.
She also needs to sign the letter of intent to marry.
Thats really all that requires her signature, to be safe if you are having her send you these via mail then have her sign 2 sets in case something happens to one.

What he said.

I'd like to hear that, but I don't think it'll be a big hit. whistling.gif

K-1 Fiance(e) Visa Process & ProceduresK1 - petitioner got cold feet - final interview Monday (in 3 days in london) - What best to do
QUOTE (paul p @ Nov 20 2009, 04:37 AM) <{POST_SNAPBACK}>
Hi all;

My fiancee is the petitioner in the U.S. We have known each other for 18 months and have been going through the K1 oricess since April. My interview in London is 23rd November.

I want to cancel the meeting and go to the bottom of the queue, maybe 2 - 3 months later , where we can see where we are.

Is this the best idea. How do i do it? I see no numbers and they say in writing? People must get ill an not make these interviews. What happens?

Thoughts please

UK citizens don't need a visa to come here. Fiance can just jump on a plane and come over tomorrow and live with you for up to 3 months.

Don't know why you havent tried that before.. ya, it's gonna cost about $1k for a plane ticket, but sounds like it would be money well spent.

If you want to be sure, just call and reschedule the interview for a later date and live together for a couple of months.

Only problem I can see with that would be losing the job in UK but fiance was going to have to give that up anyway.

Married! in the us of a.
It was a small wedding ... and I had this funny idea ... the cover for the wedding invitations looked like envelope from USCIS .. and first page inside was a fake mockup of I-129F with a big red "APPROVED" stamp on it.

I'll try to find a pic of it.

In the meantime ... here we are at the Thai temple near Salem, OR:

Hello all ... just wanted to announce that On and I are now back in Oregon. YAAY

I flew to BKK on the 29th. We had a wedding ceremony in Hua Hin on Nov. 2, and returned to the states on Nov 7.

Kind of a whirlwind trip. And 2-1/2 days of that honeymoon was spent laid up in bed with sinus, chills, fever and lots of drugs ... but I lived through it and we're home now.

Now have to start planning the real wedding here.

Let me ask a question.

Did anyone here pay sin sot?

I did and she keeps the money except for one chunk of the cash went to take care of her aging father (a monk living at Wat Karam).

Mostly it's just for show. She even threw a bunch of her gold necklaces in the pile to make it look more impressive.

Here's a pic from the wedding .. everybody comes around to bless the sin sot:

K-1 Fiance(e) Visa Process & ProceduresCo-sponser and length between two visas

Question, why would it be necessary to have both parents as co-sponsor? Do you need both incomes to meet the requirement?

If you need both parents to meet the income requirement, then both parents must sign seperate I-134 forms.

Question 2. The K1 visia can be file for at any time, there is no need to wait.

Thanks....no I don't need both their income...just one would do, but since they are married and their tax return has both their names on it...I thought I would need both signatures for legal reasons.

K-1 Fiance(e) Visa Process & ProceduresCo-sponser and length between two visas
I have a couple questions:

1)My parents are going to be my co-sponsor. Since they are married and have joint income, do they both need to fill out their own I-134 form or can they both be on one and each of them sign it?

2)My cousins fiance just tried for a travel visa and was denied, is there a length of time they have to wait before they can do the fiance visa?

Thanks for the help!

I'm helping my cousin fill out her forms for the 129F. On her fiances G-325A (for the Beneficiary) he is not sure about anything for his biological father. Is this going to be a problem? Can he just write Unknown for his fathers first name, DOB, and place of birth?

Also, on the Beneficiary's Birth Certificate, is it required to have both parents names on it?

Thanks for any help you can give me :)

Do not leave any gaps for the 5 years of employment, account for everything. Even if he didn't have a job for a short time between jobs, state none and the dates he was unemployed...I don't think it would be a problem to write Student starting from whenever to present. However, it would also be appropriate to write None. As far as your second question, I agree with you. If the job was there when he returned then he still had the job, even if he was "on vacation" or took a leave of absence. Hope this helps! :)

As a recent person going through the process via CSC who has recently received my NOA2 in the last 3 weeks... (and without RFE's)... take this to the bank:

The form is G-325A from is 1 page (front and back).

You need to send:

1 G-325A with photo of the USC and
1 G-325A with photo of the beneficiary.

My Fiancee and I are just about ready for our interview. She lives in Ecuador and she is filling out the 2 documents required before we request our interview.Forms DS156 and DS156K. When she filled out the DS156 she made a couple mistakes, she put the wrong date on one of her visits to the US and the other mistakes was she misspelled my last name. keystroke error.... After you finish that document it gives you a number on the document and then it gets electronically sent somewhere and then it gives you the option of printing it. Well she decided to fill out a new document and made the corrections and of course it gave her a new number. What should we do now? There is two documents sent somewhere. does anyone have any ideas....HELP

K-1 Fiance(e) Visa Process & ProceduresPacket and letter
Hi all,
My fiancee is going to have her interview this Monday the 26th. We were on the list that the embassy puts out to give you permission to download the Packet #4. So we did and followed all the instructions and called when we had all completed. I was just wondering if we are supposed to have the official letter from the embassy. We have never got it in the mail. i guess cause the mail runs so slow in Ecuador. My question is [b]"Do we have to have the letter when we go to the interview?" She asked the appointment setter and she said we were on the list to go ahead and make the interview date.

K-1 Fiance(e) Visa Process & ProceduresI-129F Approval Help sent to Consulate General of Guayaquil, Ecuador??!?!
QUOTE (Allek @ Nov 9 2009, 04:02 PM) <{POST_SNAPBACK}>
Hello everyone. This is my 1st post and I really need some help. On September 9, 2009 the I-129F was approved and on September 14, 2009 the NVC sent the information down to the Consulate Genernal of Guayaquil, Ecuador.

The problem is that my fiance never got a Packet 4 in the mail. I contacted the consulate via this email, IVguayaquil@state.gov, and this is the exact response I received:

Thank you for your message. This office is ready to begin with the final processing of the immigrant visa case for Rosa Alarcon. Please read and follow all the instructions listed in "What to bring to your Immigrant Visa Interview" link located on this Consulate's web site at: http://guayaquil.usc..._interview.html

The visa applicant must download the Packet 4 (PK4). The PK4 is a packet that contains instructions on what documents are required for the visa interview and how to request an appointment through the Visa Information Service (VIS), once you have complied with all the instructions mentioned in it.

Sincerely,

Immigrant Visa Unit
American Consulate
Guayaquil, Ecuador

We got everything ready for the interview but now when she calls to try to setup the interview they say they don't have our case in their system and to try calling back in two weeks. They told her due to the holidays they still have not received the information from the NVC. That is BS because we don't have any major holidays nor do the Ecuadorian government between those time frames.

Has anyone else experienced this with this consulate? If so, what are the next steps I can take?

It is the normal business at the consulate. You are not acually taking to the consulate you are speaking to someone that wants you to use all of your minutes so they will tell you that they do not have your file. Just call back again and ask again. They did the samething to us. We called right back after getting another pin and they found our file. We have been thru the interview process and aproved and my fiancee has yet to receive a packet in the mail. When you do get to the interview process be ready to wait for at least 4-5 hours without food or water in a very little room waiting and waiting.

Actually, 2 questions...

I received my email on 9/30, no hard copy of the letter yet...I live in NJ, by regular mail times, it should have been here on last Friday...anyone else having this issue?

Also, has anyones paperwork been sent to the NVC? I hope hope hope hope HOPE the speed up at the VSC doesn't cause a giant slowdown at the NVC...as everyone knows, this waiting stuff is for the birds wacko.gif

Well, congrats to everyone who passed through! kicking.gif Good luck everyone at the NVC...

We received our NOA2 notification email on 9/29 and our hard copy of the letter came in the mail on 10/3. I am not sure how and when we should be notified of the NVC process? How do we find out? Is calling NVC the only way? Or do we find out when we get the letter from the embassy? Anyway, I tried calling as well and received a busy signal...

K-1 Fiance(e) Visa Process & Proceduresaddress change for my fiance
I was able to find this other thread talking about this:

http://www.visajourn...=change address

It sounds like you should wait it out until you receive NOA2. Then wait until the NVC has received the case
and call them to change it. If you miss that then change it at the embassy when the case if forwarded to
them. You can't change it at the USCIS because it's only for US citizens from what I understand.

Congrats!

It could be any number of things. It could go through to the Embassy in a matter of days or it could take a couple weeks. You could go into additional processing (AP) which could take up to 50 or 60 days. I was in AP but it was only 11 days. There is no real way to know. At least you are free of USCIS. NVC you can actually call and get an update (of sorts). If you are in AP there is no real update. It is either still in AP or sent on. hope that helps!

Please fill your timeline and that will help people answer questions about your situation better!

Thank you for your reply.I'm not sure what AP is..I will upload our timeline thanks again for your advice.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Tax Empeption
From what I remember the most recent year is required. 2006 and 2007 are not and optional. You do have to put your adjusted annual income down for those years though. If it were me I would just put 0 down for 2006 and put a note to the right explaining that you were a student that year.

K-1 Fiance(e) Visa Process & ProceduresDivorce decrees
When you file your I-129f.. you need to provide copies of the certificate of Divorce for both parties. you if you have been divorce and fiance if he/she is divorced.
If you file and only provide documents of the divorce and not the certification it will cause a RFE.. (request for evidence) You may be risking a few things if you submit with only the document and not the certified copy. One being the RFE.. causing a delay but.. the other.. .. godforbid.. but the certified copy having a differnt date. If you are not sure.. and the certified date ends up being AFTER you have applied, then you WILL be denied based on not meeting the criteria of being Divorced prior to applying. Chances are rather slim that the date is the later.. but if the divorce is a new divorce and not simply waiting on copies of the documents.. you can be taking a risk. This will delay longer for you will have to wait for teh process of denial and then have to re-apply costing not only time but a additional fee.

Make sure 110% that the documents required is what you have.. and that you HAVE proof that you have met within the 2 yr period or .this is all a waste..
best wishes.. not fun waiting for divorce documents... .. .. We are still on hold.. waiting for documents.. now. going on 5 months since we requested finalized papers of proof.. from India. He has been divorce for over 2 yrs. but we dont have a certified copy from court.. have notarized papers.. and documents from court.. and only way to get the "certified" copy is to return to court again... .. and she / the x is .. not co-operating... aughh we will wait.. .. that is all we can do... .. but not worth risking filing without this.. correctly

K-1 Fiance(e) Visa Process & Proceduresabt divorce papers for filing k1

(immigrating fiance') have to have his papers signed by Dept of Foreign Affairs?

The papers do not need to be signed by the Dept of Foreign Affairs. They do however need to be Court Documents.. not simply Nortarized authorization from Ministry.
This is where our problems lay. It is accepted from the USA for filing. Just make sure the Divorce decree is in translation this should be norarized in my opinion that it is true a translation.
However Please. check with the consulate you are going tru for your specifics of divorce.
Jan needs further documentation required not for USA but for interview in Mumbai. A close friend of his just was denied for visa using the same documents we have. that are acceptable for usa but India was being more difficult on the acceptance of his divorce decree. . So in short. this friend now needs to re-return to court.. refile.. and resubmit.
Best thing is to contact the consulate ask what is required for the interview as proof of his divorce. Is what you have acceptable to them.
I have found from USCIS that the are aware of many different documents from many different countries. Having it translated. and specifying that he is free to marry is main focus of what they are looking for.
Not all countries have "divorce decree" as we do here.. So if having the Foreign Affairs or simply a notary of the court document the translation.. should be sufficient
Best wishes

Persons like him.. will get their due.. .. best be when it affects him most.. ..
he will get his life rug pulled out from under him.. schumck.. ..

Main thing.. be strong.. .. Hold your head high... remember... your Son.. will learn.
Know that he sees the actions of this man... he will remember.. and will remember that
this is not a way any lady should be treated. If anything at all is learned from this whole situation
just knowing you and your son.. can stand on your own feet.. no matter where.. or how.. you
are much better without this..
It hurts.. yes.. but please dont cause this to get you to lose faith in men..
Your love will be there.. one day when you least expect it.. ..
Until then.. thank god that you found out now.. .. before.. something really bad happened..
