For the first box (Family Name) put your last name (I put it in CAPS, just because the I-129F has you do it that way), First name then Middle.

Under Family Name Father-Put your fathers last name....mother-put her maiden name.

If you've always been unemployed you can state that you're a student and the appropriate dates (since that's the most present, list it first) after that if it does not fill the five years...list None and the appropriate dates. You could also just list None for all of it and that would be fine too.

"This form is submitted in connection with an application for:" You are correct: Mark other and write I-129F.

NEVER leave a question blank...write NONE for the A #.

Ok, so I asked before about a Birth Certificate question for my cousin which led to one for myself...

I could have sworn I read somewhere on here that both parents need to be listed on the Birth Certificate. My fiances Birth Certificate only lists his mother. Is this going to be a problem? I don't understand why his father is not listed on it, and he doesn't know why either. His parents have been married over 25 years (he is 23) and he has an older brother...so it's not like she didn't know who the father was. Anyway....is this something we need to worry about? My friend and her fiance want to file a k-1 visa. The problem is his mother (who has perm residence in the U.S.) filed for a family petiion in August 2009. the country is Jamaica...their relationship started 6 months before the family petition was filed....and there is proof of meeting in person March and August of 2009, as well as phone conversations. He has also filed for two travel visas in the last year to come see her and was denied...There is proof that their relationships started before any of his filings...and his intentions have all been to come see her.
So, Can you file a finace visa when a family petition is in process? And if so, will there will be any probems...or do you think they should just wait for the family petition to go through. Any idea how long that takes?

It almost sounds like he was asking about registering a marriage, not a no impediment - I have never heard of that before - You might want to call the RGD - he needs an affidavit from them that they searched their records and did not find a marriage recorded - the name of the person he is marrying is irrelevant.

I posted this question awhile ago..but only got cynical answers. I'm still hoping someone can help me answer it...I have a friend who has been dating a guy in Jamaica for 2 years now. His mother is here in the U.S and had petitioned for him to come over, during that time my friend and he started dating. They have since decided that they want to be together but are unsure of the route to take...

1)Can they apply for the Fiance Visa (and would it be faster for them) while the family based petition is processing?
2)If he was to be denied for the family petition, would it have an affect on the Fiance Visa?

He (the Fiance) insists that it will be a problem to do the K1 (and he would be denied) while his other petition is processing, so my friend would like to know if that is true and what is the best route for them to take at this point?

There are no forms to fill out with the NOA2. Your NOA2 looks much the same as your NOA1 it says I-797 at the top (instead of I-797C)...the main difference is below all the personal information instead of saying Receipt Notice, Processing Time etc....it will say: The above petition has been approved. It will also state that it has been sent to the NVC and that all furthur inquiries should be directed to the NVC. It states that you will be notified by mail when the NVC has sent your petition to the U.S. Embassy or Consulate. However, I recommend calling the NVC after you receive this letter (the NOA2) to see if they have received your petition yet, as the mail is SLOW. Keep calling and once they have received your petition not only can they tell you if it has been sent on to the Embassy but they will also give you your new case number that you will need when making inquiries to the consulate about your petition.

Once you know the NVC has sent your petition on wait about a week and then start inquiring to the Embassy. Ours had to be done through email and they were usually very prompt in answering my questions, each time it took about 3-4 days to get a reply...which I thought was timely in this process ;) AS SOON as you know the embassy has your petition don't even wait for packet 3-- email to the Embassy the beneficiary's DS-230 Part I and a scanned copy of the NOA2...this keeps the process going much faster. (Make sure emailing it in is acceptable to your embassy)

Don't know if you were looking for this detailed of a response, but I know when I was doing this every little detail was helpful and appreciated...so I'm just trying to pass on as much help as other VJers have given me! :)

While any other official documents would need to be translated into english, I think that as long as you can show on the emails that there were corresponding emails between the two of you they are fine. They say that you can black out any personal writings to each other anyway, so I don't think its really important what the emails say, just proof that you have a relationship and have been talking. Make sure though you show proof that it is your email and his email. Good Job on printing out the phone records that right there should be very good proof. Also, do you have any money transfers between the two of you? That would help as well. Good Luck with your Journey! :)

Thanks so much. Are the last 3 years tax returns completely necessary? My fiance is divorced and some of those old tax returns will have stuff like that on them, plus he doesnt work the same job as then so the income is pretty different than it is now.
I read on the instruction guide that paystubs work as well as letters from your bank and employer. Will that be enough plus maybe this years w2?


They say last 3 years to be safe, but if you could do tax returns for 2010/or W-2 and maybe 2009 tax returns, that would be good. A letter from the bank would help your case too, so good idea. I've seen people who have done that and they just state when the account was opened, how much money has been deposited into the account and current balance. I'd be afraid not to include any tax returns, so at least one years...However, just because he is divorced and both their income is on the tax returns from filing jointly: as long as his income alone is sufficient to meet poverty guidelines--that is all they need to see. Her income won't matter. For example, I used my mom as our Co-sponser and only had her sign the I-134, employer letter etc...Even though on their last 3 year tax returns my Dads income was on there too. But, it didnt' matter because they are only looking at the income of the Sponser. Hope I'm not confusing you...Let me know if you have any further questions.

You are perfectly fine by abbreviating AOS...that is what it stands for on here :) You do not need to worry about the I-864 until you are petitioning for AOS. During the K1 process and for the purpose of the K1 interview, you need the I-134. Make sure you also submit (for you and also for your co-sponser, if you have one) your last three years tax returns, copies of most recent pay stubs, and a letter from your employer, along with the I-134. If you are too anxious to wait for your NOA1,...and if you paid with a personal check, you can get your receipt number off there. Check your account online and view your cashed check, choose the back view of the check and it will have the receipt number that you need to register with USCIS. :)

Throughout this process the beneficiarys father name has been listed as unkown for everthing (birth certificate, form etc..) However, they would only do the non-impediment if his name was listed, so the beneficiary got it from his mother. My question is, will it appear on the non-impediment and if so will this cause a problem since all his other forms have listed the father as unkown? Thanks

Maybe that's a possibility?

Hi Chelle, I'm very sorry for your situation. I'm here to tell you that having to be apart is not the end of the world. It sucks, true, but it's do-able. Like Laura said, it's worth it in the end. I hope your sponsor works out for you. If not, I'd get my butt home and start raking in some cash for the 2008 tax proof to do it myself.

We hired a lawyer before I knew about this site! Now I'm tied into a contract so there's really no way out of finishing the case with her. But now that I found this site and all the great information, I find I'm telling HER what is happening with our case. I know more information about it than she does! Now all I'm using her for is to confirm what I already know. I must admit at first I was very glad to have her, as I had not the first clue how to start or what to do. I just wish someone had told me about this site first, I'd have saved myself a lot of money. Now, she has done a great job, and hasn't slowed anything down, and she is very fast at answering any question I may have, but I also see that we could have done this without her. You live and you learn I guess!

My divorce decree was 25 pages long, it was the WHOLE file pretty much, with the judge's signature on the last page. They certified it by placing a raised seal on it. The certification of the decree cost $5.00. I went to the courthouse to have this done.

Hope this helps, I have a similar issue as I do not make even half of the poverty level for a family of 3, so I am going on my bank account funds hoping it will be sufficient. This is what they require for assets:

and not just the assets.

Hopefully he has enough funds to meet this requirement. Otherwise, I would get a co-sponsor.

Well, airlines usually compensate for that by overbooking, plus people wait on stand-by knowing that not everyone who is booked on a flight is going to show up. They manage to fill the seats anyway! If we don't get an answer from someone here who knows I can write my lawyer and ask her because now I'm curious!

Hmm ours expired, and we didn't need to apply for an extension, the consulate officer in Sweden should automatically do that after they approve your case. We had no problem getting our visa after our NOA2 expired. Ours expired on January 18th, and our interview was on the 23rd. Quite a few people do not have their interviews within 4 months of receiving their NOA2, the consulates are used to dealing with that and should automatically extend them. I am not 100% sure on this, but I do believe it is how it works.

If you are worried about it, call the consulate and see what they have to say (1-3 PM Mon thru Thurs, Swedish time) They seem to be pretty helpful.

Hi there!

We didn't even know you could request that your visa be picked up at the consulate, so we didn't ask.

They are mailing it to us, which they say can take 7-14 days. Sweden does not deliver mail on weekends when my fiance is home.

Has anyone had their visa mailed to them? If so, were you home when the visa arrived? If you weren't, what did they do with it? Did it go back to the consulate? Did they ask you for a signature upon delivery? I'm curious because I didnt' think about the fact that he works all day and won't be home when the visa is delivered. His mom will be, but I do not know if they will leave the visa with her. To those of you who had their visas mailed to them, how did it work?

249 days? Ours took 246, so you might just be pushing it. I might book certain things that you can put down a deposit on just to reserve them, but I certainly would not pay full out for anything yet. Before I knew he had his visa the only things I booked were the hall where we plan to marry and I got my wedding dress. Now that I know he has the visa in hand, I'm busily booking everything else. Good luck and I hope things go quickly and smoothly for you so you can still have your wedding on your planned date.

Hi, I cried for a solid week every time Kim left to go back home. It did get easier. But I do know exactly how you are feeling. You are not meant to be apart, you are meant to be together.

Knowing you will be going back in 2-3 months is good, that really isnt that far away, and it might be the last time you two have to ever leave each other like that.

For me, I have no idea when I will see him again. It could be months, it could be years. We have been stuck on Administrative Processing after our interview and the wait could be an eternity. They probably won't even let him in the country if he tries to return for a visit to see me.

We just have to keep reminding ourselves we are NOT alone. We have someone out there who loves us very much. We also know it is just time that is separating us and eventually (though hopefully not as long for you as it will be for me) we WILL be together.

She does not need her passport in hand before you file for the petition. You do not need her passport for the petition but she will need it for the interview, sounds like you are OK for that. As for the English transliteration of her name...my wife does translations for Ukrainian and Russian fiancee visas, there are dozens of ways names are transliterated. The consulate in Kiev will accept any reasonable transliteration of her name on documents, do not worry about that. They will issue the visa in her name exactly as it is transliterated in her passport.

My wifes name is very simple...Alla. There is really only ONE way to transliterate it. But our sons had their names in no less three different spellings on various documents (Russian spelling, Ukrainian spelling and transliterated..such as Sergey, Sergei, Sergii for example) There were no problems with this at all. The US consulate in Kiev (and Moscow) are well aware of the "name game". Alla tries to make her translations consistent but it seems an impossible task sometimes. Don't worry about it though.

For the petition, which you file here (I-129f) you do not need her PASSPORT, or any copies of her passport.

You DO need a passport photo of her. It must be an original photo, 2x2 size. (5cm x 5cm) If she has it done in Ukraine, have her tell them it is for a US visa, the Ukrainian standard passport photo is smaller. Get lots of them. Before this is over, you will need about dozen or more, the USCIS and consulate are worse than grandmothers in wanting photos. She will need 3 photos for the medical exam (later) 2 photos for the visa interview, 2 photos to get her Ukrainian police certificate and more for the AOS and EAD. Just get them all at once, it is cheaper that way. We used the "same" photo for the entire process. There are small photo shops all over the cities in Ukraine that do passport photos and they are relatively cheap.


Oh, and I missed a part of your question...

YES she can scan and email the photo to you (or transmit a digital photo) and you can print it on photographic paper here, crop it to 2"x2". As long as it meets the passport photo standards in the instructions, yes, you can do that. She can take the picture herself, as long as it follows the standards. We did this for our son who was away at college, no problems.

She does not need her passport in hand before you file for the petition. You do not need her passport for the petition but she will need it for the interview, sounds like you are OK for that. As for the English transliteration of her name...my wife does translations for Ukrainian and Russian fiancee visas, there are dozens of ways names are transliterated. The consulate in Kiev will accept any reasonable transliteration of her name on documents, do not worry about that. They will issue the visa in her name exactly as it is transliterated in her passport.

My wifes name is very simple...Alla. There is really only ONE way to transliterate it. But our sons had their names in no less three different spellings on various documents (Russian spelling, Ukrainian spelling and transliterated..such as Sergey, Sergei, Sergii for example) There were no problems with this at all. The US consulate in Kiev (and Moscow) are well aware of the "name game". Alla tries to make her translations consistent but it seems an impossible task sometimes. Don't worry about it though.
