In i-129f you just need sufficient proof of meeting within 2 years and prove both are legally able to marry. The evidence for relationship is presented later as well as support materials. You should be able to get those during the waiting period.

And for the income, heck, I was not working for the last 2 years, just a small pension and I just now gotten a good job starting at end of this month, and I am coming up on 6 1/2 weeks into the k1.


What David is trying to say here is correct. (to a Point and then changes directions based on each individuals case)
There is No requirement that you know eachother 2 years only that you met and have proof of being together within that 2 years. (most common are Passport and pictures, etc.)
What I mean by change of direction on a individuals case is David has a Small Pension that will always be counted as Income and a reliable source of Income + whatever he chooses to make on top of that as extra. Semi-retired. I'm not retired so no Pension as of yet.
However, David is correct that there is time to gather Paystubs, employment letter, etc during this time of waiting.
Everyone is trying to help I see that. But, David: :rofl: Your MORE THAN 6 1/2 weeks into the K1. OMG!

Tim/Mav - Our Yahoo Messenger conversations go back to late August, when I was still in Thailand. I briefly met Cherie in the Philippines before I went to Thailand, then saw her again in the Philippines before I came back to the US. We had been chat friends for three years before that, though we never intended to meet. I have only two emails from that time, a few months before I came to Asia.

I didn't get any documents from her. I could have her mail them to me, but that could be a problem, since I'm an over-the-road trucker right now and only see home once every few months. Now that you mention the need for those docs, I guess I might as well just wait . . . :(

The requirement is only that you met in the last 2 years and proof of a relationship. You have pictures. I know Truck Stops have mailboxes. Pre-Address envelopes and send her letters. (She must keep them as proof) If you are a OTR Trucker you are making more than the Requirements is my thought.

Ok...trying to find all of the fellow ppl that have had their case denied at the embassy. My fiance received the 221(g) Refusal Worksheet at the 2nd interview 6/14/2010 and we are still waiting for it to get back to USCIS. Any one else been through this? Think we need a place to compare notes...anybody else? :D They are looking in to adding ways to track this on the timelines. :thumbs:

I am sorry to hear about your returned petition. Refile, do what you need to do.

My petition also got returned and the conul suggested for the petition to be revoked.. cause we dont have a real relationship.. WTH... then he slapped us with 212(a)5(a)

It took like 3 months for the petition to actually made it back to VSC... since then we were able to refile and merged the 2 petitions. Urhghgh


How do u merge the casees? thought u couldn't refile K1 till the previous expired??

I think the biggest problem is that we aren't in AP....we are in "Recommended to Revoke Approval"....is there anactual area for this, cuz it seems like the "Waivers (I-601 and I-212) and Administrative Processes (221g)" forum is NOT for us...because we aren't in AP :wacko: I'll search and see if i can find a forum for us fighting off denial...if anyone knows of any, please let me know :thumbs:

The interview was fine but they put the case under administrative review. After 7 months of review they sent the petition back. The embassy refused to give me the reason for return.



Our interview went "fine" also....but you could still tell by the questions they asked what they were concerned about. They only ask questions for a reason, so make sure you know exactly what they asked...if they repeated anything, etc. And truthfully, they sometimes just send them back to test your relationship, because its rough to get through a denial & there are many relationships that don't make it through them. Which is why I think they do this....test the relationship (which legally they have to have a specific reason...not an observation)....they figure if you refile then you are serious...if you don't, then you weren't. Does that make sense? It's frustrating & annoying, but I also can see their side of it. Also your congressman or senator might be able to find out some more info for you....some are more helpful & successful then others :) Best of luck.

I think going through the interview questions can help you figure out the possible reasons, and did your fiance ask why they were denied? I created a letter covering any possible red flag that I thought they may be worried about from the interview questions & what was stated at the refusal. I've heard of the FOIA, but was told they didn't really get anything of use, but it looks like if you request the notes from the interview that would help get the correct info. An issue I see is that I was told that any request put on the case holds it up...but i guess if its going to or is expired already any way...lol :wacko: :bonk: this whole process is crazy.

we were told at our first interview that everything was good too...said they just wanted to review the evidence we gave them & to prepare for the 2nd interview...which the 2nd interview was a flat out refusal. So you never know with what they say. And as for coming for the interview...i don't think they really view any trips after the application in their consideration, because we have been together in person for 4 mths out of the 1.5 yrs we've known eachother...it didn't matter. With Casa you just never know.

we are going through the same thing. you should be able to determine possible reasons by going over the interview queestions, and also, did you ask why when they denied it? they usually don't tell you the full reason, but any information that tell you could be helpful. So what you first need to do is look over the entire interview...what was said, and how. They never ask a question for no reason...every question has a purpose. feel free to ask if you have questions. sounds like you got the letter from Vermont saying the case was expired/closed...so now you are free to refile the K1 or marry and do the CR1 (which i usually quicker & harder to deny). Fighting a new K1 with no new evidence won't work. They have something in their heads that they didn't like, so u need to definitely figure out what that is before you file again. What are the red flags, etc. Feel free to message me also if you want...i know all of this is not easy.

did they tell u that it expired or r u going by the original NOA2 that u recieved? Because Casa has been extending to expiration dates on the NOA2s that get returned to give CSC time to review them. I this is the case, they could be reviewing it. The problem is, that can take a lot of time to happen. As for refiling if you don't have a letter stating it has expired...I'm not sure. I know I've heard of others refiling K1s to "push" the other through quicker....not sure if this was after an expiration or not. I'm more suprised on how quickly your case got back to the US. But as others have mentioned...refiling won't do you any good unless you know the original reason for the 1st denial, because if you don't fix that they will just redeny you. That why there was the suggestion for the CR1....CR1s are more difficult to fully deny, because you are legally bonded & the expiration isn't so short. So before u decide to do anything I'd figure out your red flags & how u can fix them & go from there. Best of luck to u both!!

Glad to help. As for doing the NOID...well i was luck to get it from CSC to start with & also I had just gotten back from spending 3.5 mths there with my daughter & couldn't afford to go right back to get married, so we figured we'd wait & see what happened with our case & we got lucky enough to get the NOID & able to rebuttle. As for the NOID being denied..from what I read by Marc Ellis, a pc6 marker (fraud marker) is put on the case when refused at the consulate & if the Service Center also denies the case (in other words, agrees with the consulates findings), the pc6 marker is found to be valid & so bans entrance in to the US. I read that you can try to fight the pc6, but its very difficult. I just rather not think about it though. Focus on what you do have control over. The questions should show u the exact reasons for the denial. I wrote a rebuttle letter just based on the interview questions & when i received the NOID, the exact reasons were exactly what I thought they would be. Did your fiance ask why they denied him?

Almost forgot....as for DOS saying the case is still in review...the consolate can deny giving a visa, but they can't deny the actual petition without the Service Center (CSC or VSC) also denying it. So they send the case back with the 221(g) recommending that the service center revoke the original NOA2 approval. There r usually a few things that can happen with these cases: u can stop it & get it reopened at the consulate (VERY rare), the service center will review the case & send u a NOID so u can rebuttle the case (and they decide to deny or reaffirm), you can go get married (which will make the K1 useless, but the reason for the denial can still come back when u file for CR1), or they will just let the case expire (at while time u can refile the K1, or get married & file CR1...but the reason for the original denial will probably still be brought up). Hope that's not too confusing. This whole process is crazy.

Just got off phone with dept of state. According to them, a 212g means a decison has not been made, the case is still under review. She said there is nothing in the computer that states our visa was denied......could still be denied but as of right now it is still under review. Any experience or comments???


Ok Nicole...first off BREATH...many of us have been through this...we got our 221(g) in June. 1st thing u need to do is call & email the consulate...find out what they tell u, see if the case has been returned yet. Also u need to contact your senator or congressman. We r working with our Senator. Also, has your fiance sent u a copy of the form they gave him yet? I'm assuming it is a refussal worksheet marked 221(g). If the consulate replies back that your case as been returned to USCIS & give u the diplomatic pouch #, then u can call the pouch tracking # (i believe i posted it on here: Sent Back to USCIS thread (If u can't find it, feel free to msg me) If there is a pouch #, then the case should have left the consulate (according to how they r handled...no pouch # is assigned till the case is leaving). If not, call and try to speak with the conular chief, get as many details as u can, go through the questions asked at the interview (everything is asked for a reason). Also, if its still at the consulate you can try sending in a rebuttle letter (after u figure out the reason from the interview questions) & get letters of support from family & friends. Don't let up...do the same with the Senator's office, each office has an individual that handles visa cases...find them & send them all your info. The more u push, the more serious u seem, and hopefully the quicker the case will be reviewed. Are u through CSC or VSC? (i don't remember...sorry) CSC seems to be reviewing the returned K1s now...u can also make sure that they renew the expiration on your case to give it time to be reviewed, etc.

When you get denied, for the case to get back to the consulate for an interview is has to be reviewed by the Service Center you apply with. Which is what happens when you get the NOID/NOIR...(from what i understand) the reason for the 1st denial still has to be reviewed before a new application (K1, K3, or CR1) can be approved, even if the original K1 expires (thus not reviewed until a new application is filed). I believe it probably also depends on your case on if they will send a notice to you for more information regarding the denial or not. For example, if ppl wait for a long time to reapply, it may prove wrong the concerns brought up in the denial, etc. And so the original denial would be considered irrelivant, because the Service Center decided that the reasoning for the denial is not valid or accurate. I hope this makes sense...lol...please ask if you have any other questions, or if this doesn't make sense.

I never got a NOID or notice of expiration. I did refile a k1 3 years later but that was because my husband (fiance then) went back to school. We thought we would have heard back from USCIS during that time but NOTHING. When we refiled the 1st petition was addressed with what knowledge we had from the 1st interview. They had no grounds for denial the 2nd time around and he is now with me in the USA :)


Yeah...that's the good thing...they can't deny u for the same reason they originally denied u for if the service center approves it again.

Also u should know that back in June I was told be the Consular Chief at the time that there was a new policy making it required to extend the expiration date to the maximum amount BEFORE they returned it to the US, so you may also want to confirm that...you may have another 4 mths from the date sent. And u will get a NOID with the K1 :) I've heard of others refiling the K1 and then getting the NOID after refiling or after getting married & filing the CR-1. You need to be sure and read all of the info for each way & be sure to respond to EVERYTHING you receive in regards to the originial application...don't wanna a pc6 marker for not responding...I read about a lot of those on USCIS. Hope this helps & best of luck...just be sure not to rush anything as far as reapplying without knowing exactly what can happen either way.

Hi guys. Well things have been a little different last few days. I sent On some links to look at about the visa process and now she's totally into it.

I think one link from here or siam legal about the process, and all the questions that she might get asked at the embassy. One of the links was in Thai so even though her English is quite good, the Thai helped her a lot more (maybe from thai4visa?) anyway, I'm so glad she's understanding what I've been trying to tell her.

She's already wondering about the medical and police report and all the other stuff she'll have to do.

Meanwhile we're still waiting for NOA2 sad.gif ... soon, soon (see my sig.)

This is so great. Once she gets it in her mind to do something, she doesnt give up. Part of why I love her.

I'm tired of waiting...I even re-upped my WoW subscription just to pass the time. argh.

I second that. Used them bunches of times myself, no problems and always an above average experience. They do seem to add a delivery charge for flowers sent to more remote areas of Isan though, but it still seems relatively reasonable and that charge doesn't apply to non-flower gifts.

You could consider next-day flower delivery service. I've done those for Birthday, Valentines, etc.
There are several in the country. I've used http://www.forever-f...t-thailand.com/ and was pleased.
If you order now, you can still have delivery on Sunday I think. Especially if she lives in a major city or town.

Alan, welcome to the form.... This is a good place to find all kinds of support and information about the K1 process. But I found the support to be the best, this hasn't been easy but being able to vent and chat with others in the same hell as you will be comforting.... good.gif

Remember, NEVER leave anything blank. Where it says File Number with the A write NONE.

oh...I just saw your other question...It only asks your City and Country of birth (as well as your parents if known--otherwise don't leave it blank write unknown)
