This is incorrect and hurtful. I double and triple checked my package against the guides and stickies here, posted questions, researched everything.

I got an RFE requesting a passport photo of myself, even though I had sent the two requested with the original petition. They must have lost the first round of photos.

Also, as Martin and Tricia posted, they got an RFE for a birth certificate even though they sent it with the original package. VSC lost it.

These RFEs are not our fault, which makes me suspicious VSC is just doing anything to buy time. Please do not post your incorrect judgments.


I seen alot of Supportive Comments (Except for One Know-it-All) Ignore that Comment Monyfer. That is one hell of a Time-Line.

Focus now on the Positive. The RFE was a Simple Passport Picture that USCIS should have told you about ALONG TIME AGO. They won't Admit they made a Mistake. But, the GOOD NEWS IS. A Simple RFE.

He states there are Criminal Matters that need to be addressed that should be included in the 129-F. Birth Certs. Also. Again, I may have read it wrong but, I think he's saying his Application is Incomplete. As far as the Signatures, April 2011 is fine. Don't get me in this Fight. I'm always in trouble.

K-1 Fiance(e) Visa Process & ProceduresMy I-134 questions

My apologies for any redundancy imposed by these questions... I did search "I-134" on the site and looked through numerous threads for my specific answers, but didn't find what I was looking for. I thought just asking would be faster.

1. It says on the form instructions to "Submit in duplicate evidence of income and resources, as appropriate". WHAT? Does this mean I need to submit two identical I-134 packages?

2. How far out can you send this form to your fiance? My fiance doesn't have an appointment scheduled yet - as we're waiting for some "appointment letter" or "letter of eligibility", among other things. Due to the rate of speed with which government entities operate in the Philippines, we may have to re-validate our approval anyway. I just want to know how "recent" the pay stubs need to be? Like if I send it next month, is that too soon - having no interview scheduled as of yet? Plus I need to account for the month that Philippine Customs will hoard the package... I just want to make sure she has this whenever she does interview.

3. The form on the USCIS website expires 5/31/2011. Where is the new version, so I can begin working on this?

4. What is the difference between a tax return and a tax transcript? I see many of you using the wording "tax transcript". Is this being used interchangeably with "tax return"? Like when I go into TurboTax and reprint what I filed to the IRS (for past 3 years), is that what they want?

5. If income is sufficient, must you still list and provide supporting documentation of all of your other property/assets? It doesn't say that these questions are Optional. Do they REALLY need to know the value of my stocks, home and life insurance? I would think my tax returns, W-2s, and pay stubs would be enough.

6. Why does the statement from the bank need to be from an officer? What does this need to say? Why can't I just go online to my bank and filter the direct deposits so that they can see the amount deposited is my income. I do all of my banking online. Is this item really necessary?

If your Income is sufficient then listing Assets and Property are not needed.
VJ members are separated as to a Bank Statement . Some will say Include it and others will say not needed if your Income is sufficient also.

I had a quick question. My fiancee and I got the K1 visa.
If she comes here from canada and in the three month period we do not get married, what happens next?
Does she have to go back instantly or is she able to stay for the six month period minus a day as if she was just visiting?
Can you get an extention on the K1 expire date before use? Or an extention onthe visa once crossed the border?
Has anyone had their K1 expire and then try to apply for another K1 with the same person? What are the issues with trying to apply for another K1 after having one expired, will it be harder?
I am also a Canadian citizen, if we let the K1 expire and I go up there and we get married...would they frown upon that if then we were married and I wanted to bring her to the usa?

I think Your K-1 Visa will be Null and Void for not meeting the90 day requirement in your Original 129-F Petition. You MAY have to start all over witht he process with a CR-1 and another time period separate.

Hi, I just finished filling out the first phase of the K1 visa packet! Yipee. I am also sending my fiance an exact duplicate packet and
a copy of the I-134 which I filled out... I do have a question. He doesn't make as much money as I do, and he doesn't have any assets or savings.
I am a school teacher and have a 401 k plan too but I don't own a house.

What is the minimal income that is needed? Do we still need an additional sponser?

If I am asking these questions about income, will the application be denied because I am not wealthy.


Your Timeline indicates a K-1 Petition and a 129-F Application. You sent a I-134 Form for no reason. That is later as far as Income Requirements. As far as the beneficiary's income will have no bearing on the Approval. The Petitioners Income is only counted. The Orignil 129-F is for backgrounds checks of the Petitoner/beneficiary.
For a Couple of 2 the Petitioner should have a a minium of $ 18,318.00 if alone going by GROSS Income. I have doubts about that because it might be $18,218.00 Gross Income.
If these requirements are hard to meet then Assets can be used. Well, it's a start.

My fiance is a horrible employee. Originally from Gingoog, she lived in Cagayan de Oro for three months and worked there for two, then went home, then went to Manila three months ago, worked less than a month, and just today told 'em take this job and shove it. She will go back home again soon. Now we're filling out out Bios, and we're wondering if we should even bother listing these things, or just put down the home address where she's lived her entire life, and only list her college under employment. Her mailing address has always been in Gingoog. Any experience with this issue?

Answer the questions on the 325 as truthfully as posible. Use the Parents mailing address for notifications and Documents if this is always what she uses as a address.
Does not matter if she can hold a job in the end. The Petitioner has to prove Income for his Fiancee'.
I will have to ask Mav later. How do I say " Take this job and shove it" in Tagalog later. I better get used to it because I'm sure she's going to tell me to "Shove It Alot"..

At I129F stage you do not need any pictures, only primary evidence. Just send boarding passes, and hotel receipt and copy of the entry stamp and you will be fine. You will need them at the interview stage though.

Oh. STOP THIS NONSENSE.. The OP's Original Thread States; I think I made a Mistake ! (After already Mailing the Application 3 days Ago.) Yes, it was a serious mistake but this is where we attempt to help the Member and NOT Lecture them.
I certainly agree 300 pages is not required and will not be read anyways by USCIS. A few will do (Communication.) I do admit that this member left out IMPORTANT DOCUMENTS "REQUIRED". Hard Lesson there !
USCIS "Cannot" Complete a Investigation of the Petitioner/Beneficiary without these documents. Thats why we wait 4 to 7 months in some cases.
I read VJ Forums alot and what Members Posted before I even met my Fiancee and after looking at good advice and bad advice hired an Attourney since there is such a separation of Good Advive, Bad Advice and Members Playing God on this Forum.
Seems for SOME MEMBERS ONLY, the futhur you get Approved for this and for that you forgot it is a HELP FORUM.
Personally, Me and Mav are still awaiting NOA2. (5 Months on this Tuesday.) But that does'nt stop me from trying to imput their situation when I think I might be able to help SOME.
Advice is good but not to Play God or act like an Attouney.
Looking at VJ. Thats why I hired an Attourney. When you post something: You never know if a HATER will reply. I don't think I would risk that.
I'm sure hate replies will come to me but, $1,500.00 for the Attourney for the rest of my life is better than watching the fighting here sometimes.

All Forms must be translated in English. Also, The RFE is sent to the Petitioner ONLY and/or Attourney if you have one.

The photos were in an envelope stapled to the I-129F. I will have my fiancee sign her form and mail it back to me.

Have her send "2" completed in ink and signed, you yourself as well. I would attempt what I wrote above ASAP. It maynot do anygood but you never know. As it stands now, you are really waiting for a RFE 4 to 5 months from now for not completeing the Required 325's. Good Luck

I would take a LONG SHOT and try this. Have "2" 325's filled out by each of you. Make ALWAYS a Copy of the NOA1 and send that with ONE OF EACH of the Signed and Completed 325's. Save the Other 2 for a posible RFE. Always send a Copy of the NOA1 with any Supportive Documents.

After a diligent search of the USCIS website, these forums, the Code of Federal Regulations, and commercial websites, I cannot determine when USCIS requires the submission of Form G-325a. The USCIS website does not mention it in its K1 Visa instructions.

Your 129-F Petition is Incomplete lacking the 325's and also states passport photo to be attached to the 325. Did you send Passport Style Pictures?

Never Erase your Facebook Messages between you and your Finacee. They are printable. Facebook shows a date and time and shows proof of Communication. Phone Bills show International Calls to a Specific Number. For my 129-F Application I only used Facebook and their was,nt a problem with the NOA1. I still keep records of Yahoo but, was told several times the are unadmissable.
We know the cost of International Calls is not cheap, but it is well worth it to document a phone bill each month. (Plus, we get to hear her Nag, LOL)

We filed Dec 28, NOA1 sent on Jan 5... March 6 I got a message that our case had been sent to NBC (National benefits center) and on March 16 another message that our case had been sent back to a USCIS location. It didn't say which one, but I assume it is CSC where it originally came from. Any one know why or if this is normal? Any feed back is appreciated! Thank you!

We didn't receive an RFE but it seems like those that do get their NOA2 very soon after the submit evidence requested.... good news is they are processing your case.

Well, I don't know really. But what I would ask is:

#1. How did you make payment. Watch for your check to be Cashed. (This happens pretty fast.)
#2. How long ago did you send the Packet?
#3. Did you pay for a Confirmation that your Packet was signed for and recieved. (did you get a tracking number?)
#4. Have you created an Account with USCIS yet to see if it was Accepted.

Depending on how long ago you mailed your petition and you have not seen any of the above listed. I too would be worried. Not just for the delay, but getting all my information back that took so long to put together.

If you have one --there is no harm in wearing it at the interview, and also they may not ask for it . Like May/Tim said --my fiancee has an engegement ring but does not wear it to work and when she goes out since she is agraid of losing it , or for it to get stolen .Her mom keeps it in a sfe place .I will ask her to wear at her interview as further proof since we took many pics of our the engagement ceremony with some with me on my knees proposing to her :lol: But as I said it just depends on whose consular officer interviews you .

Interesting Topic Rose. You know, I don't have an Answer to that. Mavylyn has a Engagement Ring but she does not wear it. She is concerned she will loose it, get stolen, etc. It is keeped in a safe place at her Nanay and Tatays and she only wears it when she visits her parents, then when she returns back to work and where she lives, her Nanay puts it away for her again in a safe place. I don't think its a big deal for the CO to see it. It is optional in the I-129F to show receipts for a Ring and not required. Mavylyn is planning on wearing it to the Interview if we get that far but I know after the Interview it will go back in Nanay's safe keeping. Most Philipina's are very shy and do not flaunt jewlery anyway. In humor, Philipina's cherrish a Cell Phone. LOL. They don't care about a ring.

A copy in full color of both our Passports Cover to Cover. Every Page (Blank or Not)
Both are Birth Certificates. BEST COPY and also translated if in another lauguange
Copies of plane tickets, hotel receipts.
Attourneys (though this is optional) ask the petitioner's Letter of Intent" to be Notorized.
Copy of Engagement Ring receipt. (optional)
Best Copy Pictures ( 8 to 12 ) of you together.
Double check the 325 for typos, names etc. and be sure there signed.
5 Year employment history with addresses. ( My Attourney added a Ademdum to my 325 since there is little room to write in that small box )

Photo copy pictures of you together and try and explain what you are doing that day and SMILE. Send about 12 pictures at least.
A Cover letter is also good telling the World and USCIS this is my Woman.
A "Letter of Intent" to Marry within 90 days of her Arrival to the US. Each is Individual and Signed by each of you. (Black Ink and Do not send a Copy) Send the Original. Not Required: But have yours Notorized as the Petitioner.
Documentation you are free to Marry and she is as well. (No such thing as I'm in between relationships)
Include Your last 5 Years of Employment history on the 325 and complete it. Addresses, etc. There is little room to write so add a Addemdem if you need more space. (Mark as Attchment to 325)
Passport Photos. 2x2 of each of you attached to the 325.

As far as having to know eachother 2 years is not true. Physical Touch in person is a requirement. Hope this helps.

A "Letter of Intent" to Marry within 90 days of her Arrival to the US. Each is Individual and Signed by each of you. (Black Ink and Do not send a Copy) Send the Original. Not Required: But have yours Notorized as the Petitioner.
Documentation you are free to Marry and she is as well. (No such thing as I'm in between relationships)
Include Your last 5 Years of Employment history on the 325 and complete it. Addresses, etc. There is little room to write so add a Addemdem if you need more space. (Mark as Attchment to 325)
Passport Photos. 2x2 of each of you attached to the 325.

As far as having to know eachother 2 years is not true. Physical Touch in person is a requirement. Hope this helps.
Be pre-pared for them (USCIS) to investigate everything. You have ONLY One Good Shot at your First Petition so do a good Job and study VJ. (I know alot of this because I did'nt feel I could handle it and Hired an Attourney)

My Attourney Supplied One of Each. For me and for her. 1 Original 129-F . (I was confused myself about 3 or 4 Copies of the G-325) On the 325 be sure and add Ademdems if there is not enough space to write in and Mark as Attachment to G-325.

The Basics for The Philipphines:
Pictures for Passport about $8.00. Passport about $100.00 and a month wait.
Plane ticket: About $1,300.00 Round trip. Taxi fare depending on how far she is from Manila. (Figure each way) cost me about $300.00. ($150.00 each way)
Motel room for about 2 weeks. (Was cheap, about $350.00)
Living expense vary but take her out and make her feel good.
I only brought carry-on so no extra baggage was charged.
Leaving Manila: This is funny: The guards asked for $3.00 USD to put me in front of the line and not have to wait in line with the others.
Tax for departing Manila was 750 pesos or less than $20.00.
Now, when you arrive home and assemble your petition:
$340.00 for the Petition for the I-129-F.
(more Passport pictures of you and your Fiance'. there not free)
Now wait for your NOA2.
Pay Approx. $ 350.00 for the Medical Exam. Not counting Cenomar, Transportation and a Overnight stay in Manila plus the Video required to watch that is also not free. Figure $550.00 or more.
If all goes good and the petition is Approved. Plan on a $1000.00 Plane Ticket one way and there is always EXTRA for baggage depending on the Airline you choose.
Get Married. There is no such thing as a Coupon for this so you get the idea.
Then the Adjustment of Status if K-1. I think about $1,070.00.

I'm sure More qualified Members that know the Philiphhines would say these figures are close: And This is WITHOUT A ATTOURNEY..

If you can do this without an Attourney (like I did) Good. My Attourney charged $1,500.00 for the petition alone.

Yes, .. It has also been a problem I have seen for people to fill-out the last 5 years of Employment history as well, The form even asked for Periods of Unemployement and still, your your supposed to write in the addresses in that little box. Doing it on the computor so it is readable to Immagration Services is good. BUT. Dont FORGET to SIGN AND DATE IN BLACK INK the Addemdum (Attachment to 325) Yours truly . Hope this helps
