Gross Income. before taxes. Not Adjusted Income. (After Taxes). Your Total Earnings for a Annual Year or Year to Date on your Currant Income before Taxes.
If your making $11.00 an hour and work 40 hours per week. Your GROSS Income is : $440.00 per week and times that by 52 weeks your GROSS Income is : $ 22,880.00
Adjusted Income is after Taxes. They will go on Gross Income

Your question is not really silly do I use black or blue ink to fill-out documents. We think, it's ink! thats OK. I read the above comments and in the future suggest a ( Fine) Black ball point pen. I don't think its a really big deal but documents are scanned and blue will look LIGHT on a document. Documents are black and white and blue is a off color to the scanned Document.
So, your question is not silly but I suggest using A fine black ink pen in the future.
(If my Attourney filled-out a Form in Blue ink I would have said: What are you doing?) Get the hint. Good Luck

Hi everyone I am a 22 year old college student. I have maybe about one year from now until I graduate and can apply for a better job/career. I have been in a relationship with my gf/fiance for two years today. I have visited her twice now and plan for a third. Our plan was for me to petition for her later this month. I have a full time job at a nursing home and I am a full time student. I make minimum wage though and I think overall it will be just under the requirements for financial support. She has already finished college once and is currently in college again and about to finish her second bachelors degree. She is older than me by 3 years. She will come live with me and my mom along with my stepdad. My mom and stepdad are not married but thats because my mom has not been able to divorce her last husband. But they have been together for 5 years now and are planning to get a home together. My mom currently is working as a caretaker but part time so I was going to ask my stepdad to co-sponsor for me because he makes nearly 50 grand a year. But my gf is filipina and I keep hearing not all co-sponsors are accepted there. I hope that doesnt affect us because I have a full-time job even while in college and soon will graduate so I am working hard towards my future. My girlfriend will also be finishing college a second time and has a full-time job as well. My stepdad and I are close of course and we all get along real well and he of course loves my mom. Any chance I might get denied?

You asked a fair question and gave alot of information so you can get an idea of a posible: 129-F Approval. (based on the currant situation and deciding to apply now and chance of a denial.) I cannot answer that but I read your post and it appears to me this way:
Your up against 2 major factors with the USCIS and even more with the Philipphine Consolate: Short of Income for the Poverty Requirements filing on your own. / and 2 that the Phils "normally" don't accept a Co-sponsor but I have heard they do in rare cases;
That would be a close family member and you mentioned "Your Step-father" Legally, he's not your Step Father because he is not married to your mom.
Not to be negative but, you will soon (one year) be out of School. You can File the 129-F about 4 months before Graduation and in hopes of not being Full-time in School and working to meet the Income Requirements at the time of her interview with proof.
They will look at you being Colledge Educated and Look at her being Colledge Educated as not to become a Public Charge.
Might be best to wait and not ask the Stepfather.

As your stepdad isn;t your official stepdad, yes I think there is a good chance of denial as Manila is very strict on co-sponsors for the K1. Would you consider getting married on your enxt trip and file for the CR-1 spousal visa instead? You can have a co-sponsor for that.

Other than temporary jobs and work I could just get my hands on I haven't worked because of medical reasons that I'm no longer having problems with which is the reason I listed my gpa. As a result I have a couple of bills unpaid yet. I plan to take care of those soon as I can find another job. Just wondering if either will affect our case or any questions will come up because of them.


USCIS does not care what your GPA is. Your bills don't matter. They don't know and don't care. You are in Love and I understand. But, the Income requirement seems to be your only problem. And trust me: Your not alone..

No Financial information is asked from USCIS. They say: Submit your application and Fee.
Now, what you are really going through for 5 to 6 months is a background investigation based upon your 325 that you submitted. (providing you submitted supportive documents of your finance/fiancee) As required in the 129-F Initial Application.
The background check will involve Moral Charactor of the petitioner and also the beneficiary.
Credit Checks, I don't think so. But if the petition has TAX leins that might be different.

I noticed that on the letter of which my fiancee wrote, my middle name (which has two parts) has a space between them (for example, this isn't my middle name but lets say michael ray). On my passport, my middle name doesn't have a space. This is totally my fault as I failed to inform my fiancee that the middle name shouldn't have been without a space. Does this present any issues for the application process?


I don't think it will be a big Issue. USCIS will compare the signature to other signatures submitted in the documents.

From viewing timelines here, it would appear that many people receive thier NOA2 within a few weeks of receiving their RFEs. I would give it 2-3 weeks from the time you sent the additional information back to them. At least you know that your petition is on an adjucator's desk, and not lost in the shuffle somewhere! :)


If this was the Reason for the RFE. I would say: This is Best Answer.

If you fill out a 129-F and it says: List the last 5 years of Employment History. Fill it in.
It Simply asks: What have you been doing for the Last 5 Years (No matter what you been doing).
If you leave it Blank . They will cash your Check and send you a RFE later.

Lol I understood the question Tim/Mav.

I may not have signed the I-129F but I was there with him to fill it up because we did it together last year when I was in the US on a TN visa. My point is just that my hubby didn't have 5 years of employment history so he just put what he had which was a month back then and that was fine. By the time of the interview he had a whopping total of 5 months of employment :)

Edit. we wrote 1 month of work and then 4 years of college..

I read your posts. The last 5 years don't matter but on the Original 129-F it asks to go back 5 years. It is required. But, his currant Income was most Important.

You don't need to have worked for certain amount of time, but you need to provide info on what you've done for the last 5 years.

E.g. I only have 4 years of employment history; I was in uni before that. So therefore, I have 4 years of employment.

My fiance has only ever had one job, which he's been in for the last 6 years - so that's his employment history sorted.

The question is about the 129-F. It is not even required that your Signature be there since (back then) you were the beneficiary.
The I-129-F is filled out by the Petitioner alone. other Supportive Documents require 325's, letter of Intent, etc etc.
This is a simple 129-F. Look at VJ Applications for a 129-F Application and tell me I'm Wrong.

The I-129F does not ask for Tax Transcripts or Financial information what-so-ever. Thats later.
It does ask for 5 years of employment history.
The I-129F wants to go back 5 years. (Even if you had periods of Unemployment you are required to fill it in)

What about State Disability? Somebody told me they would not accept it because it was considered state assistance even if you would get it for several years.

Don't push the Limits. I only know SSI is OK. You go into State "Welfare" you are asking for trouble. Another Member might better answer this. If your SSI and/or Assets Qualify. LEAVE IT ALONE.

As long as it is Stable and Guaranteed Income and not temporary and other income and assets meets the Income Guildlines. SSI is acceptable as long as the requirements are met. Off Topic: The Consular (I don't know what Country you Filed in) will "Unsaid" look at the beneficiaries Posible Income at a future date based on her Education and past work history. It's a Guessing Game.

Following on from the RFE we received, the necessary information was sent to Vermont and we now have a RESPONSE REVIEW,where it is stated this can take up to another 60 days before we receive a decision. It is now almost 7 months since our NOA1, are we really looking at the possibility of another 2 months of waiting.


I think members that have been through this can give you good suggestions.
Some might say: 2 weeks and you'll have it.
Some might say Contact Your Congressman
I can't truthfully give you experience but there are plenty of Members who can.

Well, I know what I filed, it was an I29F, for my fiance' and I received the RFE for this petition asking for 2 pages worth of additional documentation, including the financial information I stated. I don't want to hijack this thread, I am simply stating that I was not misleading anyone, it may be odd, but, it is what I received and what I was asked to provide. I was also supposed to provide school transcripts showing where my fiance' learned English, despite the numerous emails and IM conversations I had previously provided which were all in English...... I am still in the initial application stage, awaiting an NOA2, currently returned my first RFE.


I would say: That any Senior Member with years of experience would say this is odd for a 129-F Application.
Maybe Pushbrk and Jim will read this thread. You are not changing the subject though or the thread. It is up to the OP.

This is not misleading, this is what they asked for. I posted the copy of my RFE in the RFE section. I understand it sounds misleading, but, this IS what they asked for.....


Looking at it they did and you replied. Any Member would say this is odd. The Original 129-F is a basic breif by USCIS for Documents and a Check. The 129-F is a basic Form that looks into Backgrounds of the petitioner/beneficiay. Homeland Security, etc.
Seems Odd to get a RFE already asking for Income Requirements. IS THAT COUNTRY DIFFERENT? Odd. It's a US Embassy that approves the NOA2.
I'm not right all the time but this baffles me!

I don't mean to keep disagreeing with this, but, I have to. I submitted every "required" piece of initial evidence in our application. I have a copy of EVERYTHING I submitted and I did not miss anything. I still got an RFE asking for not only initial evidence already submitted, but also documents such as my bank statements for two months prior and following each trip to see my fiance', statements from my parent's acknowledging the relationship, a letter from my employer indicating what my job title, pay rate and vacation status was throughout each of my trips. I had submitted my passport showing entrance and exit from the country, also hotel receipts and airline purchases. I have now had to submit my credit card statements showing I paid for my own trips. Believe me, I am a very type A personality when it comes to paperwork and I did not miss dotting one "i" or crossing one "t" because I went back and rechecked everything I had submitted when I got my RFE.

I am not upset about the RFE process, I understand it is a necessary part of USCIS doing their job. What I am upset about is people saying that if I had submitted everything properly I would not have gotten an RFE. My case is "exceptional" for whatever reason and I will do what they ask of me because we have nothing to hide. I just don't agree that every case is as simple as supplying the required documents........


This is Incorrect and misleading. Your doing a 129-F. They did'nt ask for Financials. Thats later. Your in NOA1 process with a 129-F. Not Financials at this time.
