There is a difference between disability and welfare. Social Security Disability is for workers that have become unable to physically or mentally work. It is a process to qualify and doctors back them with evidence. As a US citizen, we pay into the Social Security fund out of our wages. Welfare on the other hand is a government program for people that do not work and have no income so the government gives them a check if they find them eligible. You shouldn't have anything to worry about with her being on disability. Good luck!

Im not sure.. I will need to speak to her and review what she can actually show. what are some things that show a "tie" aside from those we already mentioned?


What we were told was... a rental agreement or proof of owning property, job records showing he owns property, school enrollment, anything that shows that he had reason to go back.

We returned with documents of a rental agreement, bank statements, letters from the ministry where he volunteers, appointments that he had coming up that he had to come back for. We may have been told wrong, but he was again denied entry stating that because we were in a relationship that made it more risky for him to enter the US and actually stay. Border patrol told him to "go back to Canada get a job for 2 years, buy a house, and become a viable citizen there before ever thinking of coming to the US". Very harsh in my books but that is what sent us to look for different options and led me to VJ and filing for a K1.

Ahh you are pretty much in the same boat as me. Your about a month ahead.. How do you deal with the extended visits.. did they turn up to be an issue for you?


He has not been allowed to enter the US yet because he could not prove sufficient ties to Canada to out weigh the fact that we are engaged. I however travel there frequently and I am now starting to get questioned more and more at the land port of entry. They are wanting more documents for me to be able to enter as it looks as though I am trying to be there more than here.

Only problem I have seen was that once border patrol knew I was visiting my fiance, the need for more documentation arose for me to enter Canada.

I just figured that out last week.. so you are way ahead there.. My fiance is Canadian and K1 was the way to go for us because after we are married, we do not want to be apart anymore. He was denied entry at a land border crossing twice because of the risk of "illegally immigrating". We were told... "ya never know in the matters of love". So we started the K1 process and we are April filers.

I for one went by the guidelines posted here, used the sample cover sheets, and all the instructions on how to file ourselves. It seems overwhelming at first, but take it one step at a time and when you are finished, you will have a big stack of papers to send off but, you will know that you did everything with great advice and help from fellow members here that have been through what you are just starting.

well if you go off of the times you have to get married after approval, I would think there would be plenty of time. 6 months(if i understand correctly) to enter the US and another 90days to be married. That is close to 9 months if a person wanted to push it. As for us, we are waiting to do any planning because I have a feeling the minute he is approved he will want to come straight away, however, he may wait in Canada so that we have a bit of time to plan accordingly.

Sorry Hun but I just don't think you will have an approval before the day you want to get married. We are just a month behind you and not even planning on the possibility of being able to get married until the first of 2013. Can take 3mths or more waiting time after your adjudication date when your petition is approved before your interview. Other than preparing evidence of an ongoing relationship, it is my understanding that other things can not be done in advance.

Couldn't have said it better! First time my fiance will step foot on US soil is when our K-1 is approved. He was denied entry because of our relationship creating stronger ties for him in the US than in Canada. I see both sides to this. I have also spent a lot of time with my fiance in his country, hang out with his family and friends, and enjoy every day I have there. But, he has not had that privilege to be able to come to the states and meet my family because of being denied entry. We have even joked about packing up my whole family and taking them to him. lol

I am sitting here thinking that if it was a perfect world, it would be really nice that if once you submitted a K-1 petition, that with your NOA1 your fiance received a short visiting visa pass (30-60 days). They could then come and visit in the US to meet family and all and make sure everything was what they wanted before continuing through the process.

We have discussed this a lot and he doesn't care where we are as long as we are together, but the obvious choice is here in the US since I own my home and have children. We just keep reassuring each other that as long as we stay strong together, we can get through all the changes that will happen and differences him moving to the States will bring. What I wouldn't give to cook for him, not worry about us having to be apart, going for our walks, and yes even picking up his dirty socks on a daily basis! lol

I agree that the K-1 is to bring your fiance here to make plans for your wedding, not a trial period to see if you like it or not. However, I do see where people can get their information saying it is a trial period. I found the following statement here on VJ in the guides section under K-1.

I don't agree that it should be interpreted that way because I feel people should definitely know that they want to get married before they ever file the petition. So many of us desire to be married with our fiances and are waiting and waiting. I personally can not imagine going through all the processes and waiting for someone I was not certain I wanted to spend the rest of my life with.

Depends on how you send it. P.O. Box 660151, Dallas, Texas 75266 is the address to send it to if you are sending it via U.S.P.S. That is where we sent ours. I am also from Oregon so you should be routed to California from the Dallas lock box.

This is not correct. If you look at page 4 of your instructions it will state that checks and money orders are to be sent to "U.S. Department of Homeland Security" and it also states that it is to spelled out and to not use initials. We followed these directions and our check was cashed in just a couple days from the time they received out petition.

Please look at the instructions for the actual form for any other mis-guided information you have found other places. A good place to go is guides then select K1 visa.

Check is made out to "U.S. Department of Homeland Security" and it needs to be spelled out as such. My fiance is also from Canada and we are doing the K1 visa. My deciding factor for the K1 was that we did not want to be separated after we were married. California Service Center seems to be moving along very rapidly compared to Vermont. I am able to visit him in Canada while we are going through the process and just returned last week from a 3 week trip there. However, he has been denied at the border twice trying to come and visit me and it was stated by the border officer that he was high risk of immigrating illegally because we are in a relationship. So we make due with me being the one travelling. :)

I would suggest that you check out the comparisons for different visas as mentioned above to see what is right for your situation. Basically asking yourself if you want to be apart before or after you are married.

Another thing to remember is coming to the US with the intent to marry without appropriate visas is not only not allowed and against rules and regulations, but could potentially cause you problems in the future with your immigration process.

Ok so I did some calling around BC, Canada today so we could figure out how to prove Eddy has never been married and is free to marry. Got bad info because the courts don't do it but they gave me the number to Vital Statistics Headquarters. I called them and woohoo! They will do a search of his name and print out a "freedom to marry" certificate for $50 for the search. I hope this info will be helpful for any other Canadian members that may possibly come across this same issue.

Hooray :dance: just like I expected they will ask you to write them a letter...hey wish you a good luck for gathering ALL the evidence...also, my advice if you send your RFE...use overnight w/waiver for signature due to PO BOX address…make sure check what is the CUT OFF HOURS for the USPS office you’re going…usually before 3pm .

Ok well I just got off the phone with USCIS and talked to a really nice lady named Christie. She stated that because because the RFE for the divorce decree has already been sent out that it definitely needs responded to(which I already knew). She said since it is impossible for me to provide a document that does not exist, that I need to write a letter explaining why I am unable to provide a divorce decree (since he has never been married) and provide a notarized statement from him stating that he has never been married and legally free to marry and if I wanted to "over do" it just to make sure, have him get a copy of a name check in the marriage and divorces from the court house showing that his name has no records associated with it notarized by the court clerk.

As for the proof of having met in the last 2 years for me, she stated to also write a letter why I do not have boarding passes, passport stamps, hotel receipts, but that I do have phone bills indicating that I was roaming in Canada and my bank statements showing debits in his home town and surrounding area.

She told me the biggest thing is that if you don't have all the evidence you think you need for a certain topic, by writing a letter explaining, it gives the adjudicator a heads up before they look at what evidence you have and they already realize why you don't have certain items. This helps them by not expecting to see certain items of evidence they normally receive for evidence before they start going through what you sent. She told me that if I sent the pieces of evidence we talked about, we should be "good to go" and there should be "no problem". I know she is not the one adjudicating the petition, but it really made me feel better hearing how to go about sending it in and the tips for having a letter explaining each section and stating why you sent what you did.

Sooo, today I will be busy getting this ready to go back and letting him know what he needs to do and send to me. :)

I have been over and over my forms, however I do see that on the I-129F i did miss putting "none" in the prior spouses box on the petition even though he did put "none" in the box on his G-325A. Am thinking maybe that triggered something because the box did not have a response. And knowing me I am way over thinking this..Just wish i got the RFE in the middle of the week instead of on a weekend so i didn't end up sitting around and dwelling on it lol

SINGLE and NEVER MARRIED are two very different things.


I agree, but when the choices are married, single, widowed, or divorced.... i am assuming single does mean never married in this instance and those are the options given on the I-129F.

Also on his G-325A we wrote "none" in the "Current husband or wife" box and in the "former husband or wife" box.

Our RFE during the i-129f adventure was for the exact same thing. My husband has never been married before.

Anyways, USCIS was of no help - ofcourse, since they can't provide any legal help or info on how to get a document stating you've never been married because such document for a USC only exists when going overseas and getting married if the foreign country requires it. So after looking into the options, we went for 2 things(none of them affidavits from friends/relatives);
1 - a new, sworn and signed statement saying he was, and had always been, legally free to marry.
2 - a search peformed in each county he had lived in after he was legally free to marry. Country clerk's office searched his name and the marriage records, no hits came up, the piece of paper was signed by the county clerk and we sent copies of that to make sure that the new sworn statement from my husband was accepted with supporting evidence. I am absolutely not certain that this was needed however by this tme, we just wanted to get a NOA2 in the mail.

Before you jump to any conclusion and start gathering a bunch of documents, is it possible for you to see the exact wording of your fiance's letter of intent?

I have seen the exact wording on his letter of intent as we used the example forms here on VJ to write our letters. I also have a copy of his letter of intent here with our petition package copies.

If they are requesting evidence of meeting, bank statements aren't going to NEARLY enough to satisfy that. What did you send in before? You're going to need passport stamps, boarding passes, hotel receipts, pictures together...


I sent pictures before.. there are no boarding passes as I drive there.... there are no passport stamps as I have a land border crossing passport card, no hotel receipts since I stayed with him and his family. But I have bank statements of withdrawals and purchases made in Canada for 3 separate visits.

On the RFE it states "The petitioner Carol A. XXXXX may submit bank statements and/or credit card statements and receipts showing that withdrawal/purchase was made in canada."

I have no less than 100 transactions showing I was in his home town and surrounding area.

Just got my hard copy of my RFE. They listed 2 subjects they need more evidence on.

MARRIAGE TERMINATION:: Submit a legible copy of the final divorce decree signed by a judge or magistrate that shows proof of filing, or the death certificate issued by the civil authorities, that terminated the prior marriage(s) between Edward X. XXXXXXXXXXX and any prior spouses.

First of all, he has never been married before and I doubled checked all the boxes for marital status on the forms and they all are marked correctly with either "single" or "never married" and in the sections for previous spouses, we wrote "none". I am really confused why we got this part of the RFE. If anyone has had this happen or have suggestions about it I would appreciated it. Of course I can't call now until monday. lol

#2 was the requirement that we had met in person in the last 2 years. I knew that one was coming so I have bank statements for the 3 visits I made there before filing all ready to go.

From my understanding it should not be a problem at all. My fiance was denied entry twice from Canada trying to come here for a visit. Last month when I came home from seeing him in Canada, I was questioned at the POE. The officer and I discussed the K-1 petition I had filed for Eddy and I brought up the fact he was denied entry. The officer told me as long as the K-1 was in order we should have no problems and "congratulations on your engagement".

For K-1 visa you only need to submit proof of face-to-face meeting with the petition. That would include your receipts for your travel from your home town in the US to her home town in Canada. Dates of trips taken, itineraries, hotel receipts, debit/credit card receipts of purchases you made in her home town. If you Click on "guides" up in the blue bar at the top of the pages here, you will see a guide for K-1. Take some time to read through it.. It is very helpful.

edit: I didn't mean the ONLY proof you send was of the face-to-face meeting. There are other evidences that need sent with the forms such as intent to marry, freedom to marry and such, but that you have meet in the last 2 years in person is the requirement. The "continuing relationship" proof/evidence is taken at the time of the interview.

You will be fine. I travel to Canada to visit my fiance and POE is Sumas, WA. As a matter of fact I am here in Canada now on a vacation with him. At the border I tell them I am visiting my fiance, they ask how we met, I tell them online war game, they ask which one, if I have been to Canada before, and how long my trip will be this time and send me on my way. I get these questions everytime I enter. :)

I will as when I call Monday. Not sure whether Canada has such a document to prove he is single or not. Thank you for your response. :)

Just got my hard copy of my RFE. They listed 2 subjects they need more evidence on.

MARRIAGE TERMINATION:: Submit a legible copy of the final divorce decree signed by a judge or magistrate that shows proof of filing, or the death certificate issued by the civil authorities, that terminated the prior marriage(s) between Edward X. XXXXXXXXXXX and any prior spouses.

First of all, he has never been married before and I doubled checked all the boxes for marital status on the forms and they all are marked correctly with either "single" or "never married" and in the sections for previous spouses, we wrote "none". I am really confused why we got this part of the RFE. If anyone has had this happen or have suggestions about it I would appreciated it. Of course I can't call now until monday. lol

#2 was the requirement that we had met in person in the last 2 years. I knew that one was coming so I have bank statements for the 3 visits I made there before filing all ready to go. :)

I respect your advice Rumba and Claudia, but I’m not convinced that the “carta de invitacion” isn’t necessary for those applying for a K-1 visa. We made it clear that we were doing a fiancé visa at the Havana immigration office, and they still told us it was necessary to submit “carta de invitacion” to Washington DC. I believe the purpose of the “carta de invitacion” is to assure that the Cuban will be fully financially supported in the US for a short term visit (30 day vacation/visit), or even for the duration of the 90 day fiancé visa. I think they want evidence of this support for whatever the reason the exit is. I have the impression that the “carta de invitacion” is the application (so to speak) for the “carta blanca”, but is the “carta blanca” different from any other exit permit (PVE, PRE, PSI) put in the cuban’s passport? Is a PVE, PRE, PSI considered a “carta blanca”?

While on the subject, I understand that for a K-1 visa, the Cuban must apply for a PVE, and after marriage in the US they can adjust to a PSI ONLY here in the US. I don’t believe PRE is an option for here in the US (ONLY OTHER COUNTRIES).

The Cuban “Carta de Invitacion” is confusing to me, and I have searched other posts on the topic in the VJ Cuba Portal and elsewhere on the internet. I just returned from Cuba this week, and at the immigration office in Havana, they told us that the invitation needs to be submitted to the Cuban Embassy/Consulate here in Washington DC. I’m not sure we even need one for a K-1 Fiance visa…Do we need this? And where have other K-1 petitioners applied? How do we apply if necessary? Is there a form, or just a letter from the K-1 petitioner? I’m not sure what is required, or of what to submit. I’d also like to know the timing for when to submit the “Carta de Invitacion”. I understand it’s valid for 1 year, but is it required to have a US K-1 visa first?...We don’t want to wait months for the “Carta Blanca” after receiving the US visa if possible. Any recent experience with the Cuban exit process is much appreciated. Best wishes to all.
