Police Records
Indian Police Clearance Certificates should be obtained as follows:
  • All Indian IV applicants aged 16 and above, residing in India, should obtain police certificates from the local Passport Office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance. Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.
  • Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.
  • Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.
  • Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.
  • Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.
I have read many have had difficulty with getting PCC's with out interview letter, I think if you know some body or know how to ask you should be able to with out difficulty. my husband managed to get his PCC with out any proof of visa application or pending interview. this was Vizag office

that is a good question and has plagued many people here. they really dont need it, my husband was able to get his without it. it seems that some offices are more difficult then others. if she can take it any document received from USCIS that cant hurt and explain that you cant get interview letter with out PCC. so many things have change this year, interview appts went from standard processing to appt. processing with dates set by NVC. this may be why some passport offices ask for interview letter.

there is a difference between the K visa's and the CR and IR visa, the K's are non immigrant. I know that the intent is to immigrate but in the case of my husband (now that we are beyond 2 years married) he will receive a 10 yr green card and will not have to adjust status. this is why I was thinking there may be a difference in the way it is handled at the consulate. from your time line it looks as though things are starting to speed up with the process, it has been 18 months since our interview. and nearly a year since our case was sent back. I am getting a little fed up with the way the USA is handling immigration, they want to give amnesty to illegals but hold up those who try to come legally.

I have only found information with K-1's, there was another here that was a CR-1 and her timeline didnt mention a new interview so I was wondering if there was a difference with CR-1's. I went to the consulate last year before the case was return and was treated very rudely, but was told that if my husbands case was reaffirmed they would issue his visa so I dont understand the reason for anather interview. Also I had contacted my congressmen to make an inquirey and they were told they were doing a background check. I am certain that this happened prior to our first interview if I am not mistaken.
I have decided to give DOS a call in a week and see if they will tell me anything.
If there is anyone else out there with a CR-1 going through the same thing I would sure be interested in hearing from you.

I have been searching here for approximate times for visa issue after reaffirmation. Can any one help me with this? My congressmen got information from USCIS that they were doing a background check then I received email stating they reaffirmed the approval of our case. I havent seen my husband for a year now and we are very anxious to finally begin our life together on a daily basis (not annual), so if any one can give us an idea of time frame I would greatly appreciate it.

There's no set time required for him to be there, as long as you have met in person within the last two years. One week would be fine. Simply having copies of his itinerary, his boarding passes, and some pictures should be fine to prove you have met. If you stay in a hotel, then having both of your names on the receipt would be good, you can also take a picture with a newspaper or something else that shows the date. Copies of letters, chat history, and cell records should also be used.

It can't be done online. I've heard you can wait until NOA2 from some people, and one person said their lawyer told them that too. Yet I spent an hour on the phone with USCIS. They kept saying to fill out the AR-11 form. I kept trying to explain why the AR-11 form could not be filled out because my fiancee doesn't have a POE, she's still in the Philippines. He said I needed a laywer if I didn't know how to fill out the form. Then after even more explaining, they finally told me to send a letter to my local service center in Portland, Oregon, showing the address change. I did so and received a return letter from them about two weeks later, through Christmas break, that they sent the CSC the information about my fiancee's address change.

He can't request a visitor visa for me because he will be investigated by his government. I can't request it alone because I will get a gov't guide and he will be investigated if we meet. Sounds like a country from a novel...YES! Nobody has an idea what we go through. Furthermore he can't come out of the country because he won't be able to return (that will mean jail...definitely...and for no reason) What can we do?? Does it sound like a reason for a waiver?? I have more reasons but that's the main problem...keeping him safe and being able to meet are not compatible things. I need advice before submitting the I-129F.

I have a residence here in the USA and always will, there will be no problem with me getting notices sent by USCIS in order for me to respond because I have family that will notify me just like they did when I worked as a traveling RN. I am not dropping the ball on this and will never give up on being with my husband. Some people get lucky with the officer they get at the interview and if our case was approved by USCIS the first time I think they might take offense at the consulate returning it with no proof of wrong doing especially when we can give them a mountain of further evidence. If we move to Canada there is always a chance at getting this case moved out of India and him getting an interview in Canada. Some riskes are worth takeing.

this attorney said he was a member of AILA, and what he said about USCIS not liking split cases had to do with part in one place and part in another. He said that if they got the new evidence that they would request that the pouch with our case in it be sent immediatly so this would speed the process. I have not yet retained him but he said I could feel free to contact him any time for advice. this way I wont be out a bunch of money (yet) and if I do send this further evidence early (all copies, photos in inexpensive albums, I always have the originals) all I will lose is a little money putting this together and the postage. If they do toss it I can put it all back together again. I think it is worth taking the chance if it truly helps speed this mess along. at least I know what the risk is by doing this.
the attorney also if it looks as though they revoke it is not worth the money to appeal it, I should cancel it before it is revoked and start fresh, this way there is no visa denial on his record. I am looking very seriously to moving to canada and bring my husband there too, already talked with employers up there that said this would not be hard at all. This would prove that he wasnt marrying me for a green card. with our economy being so bad here Canada may not be such a bad thing.

Yes. Luckily I had extra copies. They tossed the first set I sent them, but we got back my entire file I sent to dispute the NOIR.

the lawyer I spoke to today is a member of AILA and has done these cases before (as he said unfortunately), but at this point he gave me confidence in trying to deal with some of this on my own. he said to send as much additional proof to USCIS ASAP because they dont like to have split cases and they will request the case even if the pouch is not full (I dont have the number yet but will try to get it after the holiday). I am compiling all I can of chat logs, phone logs, and picture albums for 3 years of visits to my husband and pics with his family, statments from his family, and I hope to fill a small box with evidence. he said not only do they not like split cases but if it is a large amount of evidence they cant ignore it and will work on it sooner. this attorney also said even if I didnt retain him I could call him and meet with him for advice for the same consult fee I paid today (he was sympathetic to our case, and maybe a little impressed with the work I had done so far on our case, he gave a 1/2 price quote on the fee because I had done most of it). he also thought moving to canada and having my husband follow would be a good idea, we may be able to request having the case moved there if it is reaffirmed, and it would show my husband isnt just wanting a green card but wants to be with me.
he said the consulate was really out of line in sending this back (of course I agree).

only confirmation from DOS operator, that was nov 19th. My husband got a letter on the 18th(or visa versa). I have checked the USCIS web site and nothing as yet from the update page, still showing the date the case was completed and sent to NVC. I think there is a little time yet before it reaches USCIS. I am talking with attorney today and hopefully he will be good and see the need to do something beside take my money. I am interviewing him as much as he is interviewing the case. so far I know he has 7 years exerience in immigration law. sound like a good number???

Here I am just one more returned case to USCIS and not from morocco. I contacted my senator and congressmen way back when we were put into AP and when I returned from India with the news that the case was being returned (after the CO was very rude and hostile with me) I had them do another inquirey not relizing that I could actually fight this and try to keep it in the consulate. It seems a I am always a little behind on getting the information. I didnt even know about AP untill the interview and we were in it.
I am consulting with an attorney tomorrow in hopes of getting some help, I just cant (wont)take any more risk with getting my husband here with me. I am also looking into working in canada and having him join me there on a family visa. I have one advantage, I am a registered nurse and I can work almost anywhere. I know that it will be our second wedding anniversary before he gets his visa (one advatage to this, no removal of conditions) so the cr-1 goes to an IR-1. Have to look at the bright side when ever possible.

she does not have to go to the passport office but if you read that link you will see that you could get one from that office as well because as stated they tend to be more reliable.
if you are refering to NVC it has to be originals documents (certified are considered originals because they come from the issuing authority).

the information you need is on this page...if her passport is more then 6 months she will need a PCC from regional police station for each place she lived for 6 months or more, if the passport is 6 month or less then one from the passport office is enough.

I am sure you remember that we are in the same situation. When my husband was done with his interview the CO said he didnt need to bring anything else and he wouldnt need to return for another interview, just wait for her to call for him to submit his passport.
I have since talked with my senator and the information we have gotten back is they are varifying documents relating to our relationship (they kept his divorce papers and our marriage documents, everything else they gave back).
I have also learned from others that if you call DOS they would tell you if it is security or name checks. Luckily for us they have not said that...just AP.
check with the AP waivers forum for more answers, that is where I found so much information and many others going through the same thing.
Our papers were perfect and so was the interview, even I was called at 3 am here in the US to be interviewed. I never in my life thought (or even knew of) AP before this and it knocked the wind out of me. we are going on 9 weeks now (I dont think any government moves with any speed), so hang in there, many have survived much longer (11 months or more) but to be in the middle of the wait is pure torture, you have my sympathy.

The surgery went well and I am feeling much better physically, thanks for asking.
the number for DOS is 202-663-1225, when the recording comes hit #1 and then #0 this will take you to a visa specialist. they dont give a lot of info but I learned from the AP forum (tammy has been very helpful) about them saying if you were in security or name checks. I would look there for more information. we are going on 9 weeks now and nothing has changed and I have had the senator contact the embassy on 2 different occasions (immediately due to the shock of AP and at the 8 week mark) they havent done anything to speed it up (even for my surgery...major abdominal surgery) but confirmed they are varifying documents relating to our relationship. well we all know how fast any government moves (that means india too). remember getting your marriage registered?????
hang in there and just remember all the things that are going right in life, that is the only thing that keeps me sane right now.

according to the attorney all they should be concerned with is if the divorce is legal and our marriage legal, just be spouses are dovorced relationship (friendships) are irrelevent. People share history and children and too many times in India family (cousins being married). how do you not continue relationships when there are children involved.
as far as proof there was the first 2 trips, copies of bus and train ticket for our travel there, pictures of the first year and our wedding, his tax ID with USA address (mine), and he offered chat and phone logs at the interview and they said they didnt need them.
they just wanted to deny and looked for evidence to do it (and when not clear enough they stretched it). they made a home visit to his ex's during the ganesha festival week where he was visiting the kids. dont tell me they didnt plan that when our interview was 5 months prior. he told them he visits his kids often, so they I am sure knew he would be there for his kids.

you would have to go through the same document varification if it was cr-1 or k-3. I suppose you could call the embassy to see if you can change type of visa just because it would make a difference in when you would get your green card, but the varification would be the same, you have to be patient just like I do. We have been waiting 9 weeks now.
