That's great news about vonage, I use vonage i'll definately get that added. I was using nobelcom calling card, the talk thailand plan at about 1.2 cents a minute which isn't bad
especialy if your like me and most often use a cell phone.
I wonder what else people have learned now over the years of distance communications.

When I snail mail, at first I used Fed ex, which cost 45.00USD to send a few pages and photos (don't do this), now I always just go to the post office, and mail a letter or package for just a few dollars.
cheap and relaible.

When I need to send money, I opened another free checking account and just sent a card to my fiancee, now I can just pop into my online banking and transfer free,
She's gonna leave the card with her mom, so we can send her money too. (I didn't activate the card till it had arrived)

When I buy plane tickets, I always use farecompare.com

Thanks! We have tons of those. Photos, boarding passes, passport stamps and various other things that I think would work well as proof. :) I have loads of saved instant message conversations from over the years as well, if that might work. Also emails. Would a few of those be good to include?


I included some emails. Are they necessary? No. Are they good to include? I think so. They can help tie your case together, and if you get a very picky adjucator, why not give them as much as possible?

They can help make the case that you intend to marry, which you have to prove with the K1 application. You do not need to provide information about an ongoing relationship until the interview phase, where those emails will be more helpful. I wouldn't get too crazy about the number you put in. Just put in 4 or 5 of the ones that show you care about each other, and mention a few things about planning to meet or marry. You can 'black marker' out the private parts.

You will notice in the K1 guide published here on VJ http://www.visajourn...om&page=k1guide that they suggest to send emails.

Yes, you both fill out the G-325a forms for a total of 8 sheets of paper.

As far as the support issue, I agree with everyone else. Start the K1 process now, since you feel comfortable you will find people who will sign for you.

:help: Hi people..... I need some serious advice here. Or maybe just opinions :-)
My USC fiance lived with me here in Brazil for 2 years and during that time he suffered from depresion and anxiety. So the doctors here prescribed Rohypnol to help him sleep and to make the anxiety go away. When he went back to the US, the doctor wrote a prescription allowing him to use that pill on the plane so he took a few of those pills with him.
When he got to the US he started a treatment with an american doctor and stopped taking those pills after a few weeks, that was 6 months ago! Well, yesterday he got stopped by a police officer and when he searched the car... what did he find??? 4 of those pills were in the glove compartment!! He forgot them there since he wasn't taking them anymore(he still has the prescription he was given here in my country).... so they took him to jail and he spent the night there. Now he'll have to go to Circuit Court on Thursday because that's considered a felony!
I'm so afraid to ask this question but here it goes........ How much is that going to hurt our K1 visa process??? I can't imagine what my life would become if he actually went to jail(I really don't think that'll happen) or having to give up on the K1 Visa. :crying:

HIGHLY doubtful this will result in a felony. Make sure he has a lawyer. It doesn't really even need to be a good lawyer. He can plead guilty, explain the situation (through a lawyer) and get reduced sentence EASILY.

Anyway, I am sure he is doing all that so you shouldn't worry about it.

I can't believe we missed something!! Casey did not sign one page and our petition got sent back to him!!
On the bright side it was his signature not mine so he can sign it and get it off, and it was only a signature not anything major.

They reorganized stuff and put pictures in an envelope, stapled our passport pics together. Kind of interesting since they say no staples.

So now we are a week behind. I am remaining calm and orderly though. :D :unsure:



I know this is a little off subject, but where did you see/hear that the USCIS said no staples for the K1 applications?

BTW- I know how you feel. I found an error right before I sent the I-129F and now have to wait until I recieve new signed G-325a's from my fiance so we are a week behind now as well. :help: :blush:

This is been bothering me all night, i coudnt sleep. Ok, here's my situation, ive been living with my fiance for seven months and i dont have anything to show to prove our relationship. All we have is pictures and a joint bank account. Everything is in her mom's name, so our names are not on anything. We dont have a interview date yet so we still got a couple months to prepare, so i was wondering is there anything we can do to help make our case more solid ?


How about you get a letter from her mother (translated) then have her signiture certified/notarized or whatever you can do there in Thailand?

Hi. Have just been informed that photo I supplied for application is not up to scratch. Need to find some place in Dublin that fills the requirements (which I have to admit I don't fully understand). The other option is to just do it myself but am worried that I will be told again that it's rubbish. Photo was terrible and I'm just wondering if it's more of a case of keeping people who look like they've been dragged through a hedge backwards out. Seriously, if anyone could be of help I really appreciate it.

Yeah I know it doesn't need to be notarized. Well in fact, I work as a translator :yes: I just assumed it'd be better not to use myself.... hehe

But these translators here in my city can usually do both (certified or not certified translations), and the not certified ones are way cheaper! :thumbs:

The only doubt I had was if I should get it done here in Brazil or ask my fiance to find someone to do it for him in the US.

Just to add to this, it is doubtful you will be able to have your fiance recieve a K1 or K3 visa by June. From reading timelines and past experiences here you will see that it is very rare for a K1 to be issues within 5 months of initial application.

Looking at the timeline data you will also see that K1 tends to be faster and you are looking at 6-8 months if everything goes smoothly.

If she has never been married before, then yes that is all. If so, you need a copy of the divorce decree. If she has minor children you need a passport style photo of them. Also there is some information on the I-129F form itself that you want to be sure and get from your fiance. It may be handy to just have them fill in 'thier half' of the form and send it to you.

The problem isn't whether or not it's income per se as the IRS defines it. The problem is that for approval of the Affidavit of Support, a 'means tested benefit' cannot count towards the income.


Well I hope for the OP's sake that these benifits do not fall under "means tested". It would hardly seem fair.

I'd add that:
-Not all 'benefits' are created equal. What type and from which agency the USC gets benefits from may make a difference. His marital status may make a difference for his future benefits as well.

-The dollar figure is closer to 17K per year, not 13.

I still find it hard to believe that the OP got the correct information about what benefits she would be entitled to receive without the USC sponsor being held responsible for repayment. I've been reading on this topic in depth for over 4 years, and that is my opinion.

A Joint Sponsor would probably be the solution.


Anything that gets reported on your 1040 is considered income, correct? Disability benifits get reported on your 1040?? Maybe not taxable but reported??

I am asking these questions seriously. I do not know the answer. It seems logical to me though.

I know it may seem to a normal person a disabled person immigrating is a weight on the state etc. I qualify for emergency benefits (which are very little btw) because I have a serious life threatening health condition since birth. I have a number to apply for the emergency benefit and all the lady gave me for when the time comes. I double checked with her and I do qualify. The issue is if benefits are "income" when it comes to the k-1 visa forms. Ty all for your responces they are much appresiated.


I am not qualified to answer your question, HOWEVER, your potential husband does not need alot of income to qualify. I believe he needs to make just under 13k per yer to be considered qualified to support you. And yes, his benifits are considered income. I do not know about yours. I would wager he makes the qualifying amount. If not, maybe his parents can co-sponser.

According to the California Service Center, the file has been sent for "further processing". They said we could check again in 90 days. They are performing an in depth review of the petition, and could not give us a time-frame.
I wish I could give you a better response, but we cannot influence any decision made by the Agency. We will continue to check on the case for you.


I think I read from a previous case that the message means one of your names came up as 'flagged' and they need to do a further background check of some sort. I could be wrong. Hopefully one of the people with experience with this will post soon.

The form I just downloaded from USCIS says inthe insturctions that the photo should be 3/4 frontal view, but all the other info on their site says the photos are full frontal.

When I asked for a US passport photo at the photo shop, they gave me the full frontal... so that is what I have. Is that what people who have recently applied provided as well?

I kept my married name after my divorce. I included my divorce decree and my birth certificate in the package. However, they sent an RFE for me to show something that proved that the person on the birth certificate and divorce decree were one and the same.

Acceptable proof was listed as a copy of my marriage license (prior to divorce) or my passport. Not quite sure how my passport proved it, but it was what they listed.

Documentary Proof of Having Met in Person in the Past Two Years and an Ongoing Relationship:
Use as many of these items are possible. There is no minimum,
but the more you can provide the less likely you are that you will receive an RFE. 1. Copies of all airline 1.boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps), and other documentary evidence that you have met within the last two years. You may want to highlight or place post-it notes indicating the dates and locations on the copies (to make the adjudication easier) for the person reviewing your file.
2. Color Photo's of you and your fiance(e). Make sure you write your names, date, and location on the back of every photo. Provide two to five photo's. If you only have a single copy of the photo, then make a color copy and send that. If it is a digital photo, have it printed at a company such as ofoto.com. You can also make duplicates of photo's at your local photo store (Walgreeens, CVS, etc). Place photo's in a plastic bag or photo sheet and label the sheet. Note that you may not receive originals of photo's back.
3. Copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)
4. Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present.


This is what's causing confusion, I followed the guides here on vj. I probably sent too much, but I thought it is what was required to file. Maybe it should be updated-if it is incorrect?

Simple answer, yes. You would need to take pictures and keep all reciepts of travel.

I can only guess at what your circumstances are. It would seem you live in a country outside the US and you mentioned the Middle east. Your prospective fiance lives in the US and is nearly 18. Perhaps it is possible for him to visit your home country, and meet you without your parents knowledge?

I do not condone going behind your parents back of course. However, I do not think it is fair to deny you to see this man. It is a very diffucult situation obviously. I wish you the best of luck and I hope this all can be resolved and you can still have the support of your family.

Yes, in most cases, the fiance in the USA prepares the packet. It is sent to the Immigration office (USCIS) in the name of the American citizen as a petition for a K1 visa for the foriegn fiance. So... I am not sure if you have seen this page:

Does anyone know if the copies of the Tax Returns need to be the copies of the original ones that are signed. I only have copies of the forms before they were signed and dated.


You need copies of the returns that were signed. If you don't have them then request tax return transcripts from the IRS.


I have filed using an electronic signature for 4 or 5 years now. I assume that my copies I kept on my computer would be enough? Do I need notorization?

We've just noticed some of the evidence we have gathered were sent to us stapled. Is this ok to send with the RFE? We're not sure wheather it was just the passport photos not to be stapled or everything and anything. If nothings to be stapled do we just take the staples out will they accept that?


If it was sent back to you from the USCIS you can leave the staples there.

Also, there is no rule against using staples on your petition except for the photos.

Since it is abvious that you guys have had a relationship and her non-immigrant visa is not for a short time, it won't look like she is just trying to stay here. Get married and adjust her status. But again consult with an attorney to make sure this is legal and will not come back and bite you in %^&$

Immigration attorneys are useless if you have a straitforward case. If there is any deviation or extenuating circumstances, attorneys are helpful.

I guess the big kicker on pictures is really, what real proof does the adjucator have that it is really you and your fiance in the pictures? Sure you send passport photos, but it is something that is not too difficult to fake, unless you send copies of the actual passports with the persons photos.

You should have your fiance copy her passport whereever it was stamped upon entry into the USA. If I am not mistaken, her passport should have been stamped upon entry into the USA. Boarding passes to back this up would be nice, so ask her to she if she saved any. Though not nearly as good, ask her if she saved a flight itinerary from her travel agency.

You are a step ahead of some people because you met and lived together in the USA. Notorized copies of a lease or school records will be easy for you to get.

In the end, all you can do is gather everything you have and hope for the best.

Not by any stretch of the immigation are USCIS adjudicators contract employees. They are required by law to be government employees, and if you read their site, they are running ads looking for new employees. Their working level is GS-12 which is typical for government non-supervisory high level analysts.

Ive read that they people that anser the phones are contract workers which may be possible. But anyone who signs govt documents as approved or denied are govt employees. You cannot obligate the govt unless you work for the govt and have an authorization to obligate the govt (i.e. grant a visa, or approval an application). I was one for over 30 years.

They are Federal civil service workers, and Monday is a Federal holiday.



According to a recent article that was posted here, they are contract workers and do not actually work for the government ;) They are subject to the rules of the contract holder, and not the government employee rules... Having said that I think they have the day off anyway! :P
