Could you go to India temporarily to wait it out? At least that way he'd be close by to get the visa. . .plus it would make it obvious to the Embassy that you mean business.

I would love to go and spend even 2 weeks with my husband but I had major surgery and was off work for a month, if I had the money I cant take the time sad.gif . For the last 2 years I worked as a travel nurse and was able to take time off between contracts, after getting married I knew I needed to settle down for this process and now I am tied to a perm job till my husband arrives or else till I decide to leave the country(I cant work in India and make a living, I have bills here so I need to go where the money is enough to support my bills here and there).
Some times it just seems like everything is working against you (I know that is not true, I have so much to be thankful for but I always have to remind myself or have my husband remind me heart.gif ).

We have been in AP now for more then 8 weeks and I know that is not as long as so many here. I cant stand this LIMBO so I have been looking into options to be with my husband. I am an RN so there is always the possibility of working in Australia or the UK for a 1 year contract doing temporary work (RN's are needed everywhere, that is to my advantage). I need to know if we do go to an other country for temporary work can anyone tell me if the visa can be collected at another embassy or would my husband have to return his passport to the Chennai embassy to receive his visa?

Another thought that has come to my mind is can an attorney do any good with AP or are we just at the mercy of the consulate to issue visa when they are ready?

I have already contacted senator and this AP is for document verification not for security or name checks. I would have thought 8 weeks was enough but I guess not. My patience has been weary this for some time but I keep hanging in there because I know this will eventually end with my husband getting his visa, but I see time going by so fast and there are so many things I wanted to do this summer with him (another year gone by so fast).

I hope there is some one who can give me some answers then I will have a better idea on how to procede. I have already contacted to agencies for work contracts in the UK and Austraila (did that today so no info yet), but I think it really sucks that I have to leave my country to be with my husband.

I do beleive everything happens for a reason. I havent seen my husband for 14 months now and I have been wanting to go since before his interview in June. Now that I have been told I cant work due to 2 slipped dics in my neck related to work injury and I am sitting around that house with nothing to do I decided to take that last of my savings and go to see him. This is the first time I have been in India for a festival (Diwali and I am excited) and we will make a trip to the embassy. Now if I hadnt been injured at work (that was very depressing), and later told I cant work, I would not have had the time away from work to make this trip. God is in control and has made it possible for my husband and I to be together again if even for just a short time, but we will take a chance and go to the embassy and see if we can speed things along.
some times the things that happen we cant make sense of untill the time comes that we should understand.

There was no BS when it came to Thuys petition.. but they still had us in AP for 8 months after the interview and they called my ex, her ex, her mom , her and me to ask a list of questions... most of the calls all happened at the same time to keep anyone from letting someone else know it was coming... the call came around 1130 pm and they questioned me for over a half hour.. kept Thuy on the line for over an hour... oh yeah and then there was the guys that showed up at her house asking neighbors questions about her and us...

When it comes to the interview and evidence, they often dont look at what is brought to the interview or at best they just flip through some things.. They usually have a decision of sorts made before they sit down at the interview... many have said the pink was waiting when it started and others have said a blue was already prepared.. this is why many here say frontloading is a big deal..

when you ask if it was just to immigrate then why would I/we do #$%^.. Those that are doing this for immigration only are willing to do anything they can to get past the CO... including trips, ceremonies and anything else that could help...

The CO's IMO seem to have a sort of expected time frame/cultural norm and evolution of relationship that they look for and anything outside of that they look at funny... At this stage there isnt alot that can be done other than trying to get evidence ready should they accept it and if the blue comes, have plenty ready to submit when the opportunity comes... dont be surprised if they give her a blue or even a second blue slip..
I seperated in January 09 and finalized my and Thuys divorces 4 or 5 months later.. we filed as soon as we could (june) and that threw red flags in our case.. we had the formal Dam hoi etc but that was after I sent the K1 and IMO most of the time anything that happens after the initial filing isnt looked at when they make the decision at the interview...

I dont want to sound gloom and doom.. it isnt that bad.. just expect a hurdle or two and have everything you can have ready for them if the opportunity arises... remember that its not quantity its quality when it comes to submitting evidence... have everything as well organized as possible... it will likely be April or May or so before she gets the interview the way things are going lately.. so there is time to get things together...


Wow. This is not good news for me. I will hate to break this kind of news to my fiancee. We have both been waiting for so long.

I met my fiancee in the Philippines in Aug. 2008, separated from my wife in america in Feb. 2009, filed for divorce in April 2009, but wasn't able to get the divorce final until July 2010. I filed for K-1 petition for my fiancee in Sept 2010, 2 months after my divorce was signed.

In the last two years, I saw my fiancee in March 2010, before the divorce was final, and again in Nov 2010, after the divorce was final. We were really hoping to get NOA2 in Feb and have her here in american by April 2011. But now you're making me think we would be very lucky if it went smoothly like that.

Would preparing a letter for my fiancee's interview help in this situation? What about pointing out in the divorce judgment where it says the date I separated from my ex wife?

Just sent the RFE last June 15 2010. Anybody who have an idea how long will I get result or response regarding our submitted RFE...they just asked to submit the same FORM G325a for the 2nd time and a photo of my husband..not so complicated docs tho..Hoping to get the result soon....

You can look at people's timelines recently to see how long they took. I think it takes a couple of weeks from what I've seen on timelines.

I had to ask how to find the right links even after creating an account. After you have an account set up with your receipt number, go to uscis.gov, click on "check case status", then click on "sign-in to my account". You'll see a table with a date when your case was last updated. We've never had a touch. Ours still says our NOA1 date, even though it's been 4.5 months, and I've even requested a change of address for the beneficiary 2 months ago.

Hello Ann + Aties,
My fiance went last week to havanatours celimar to find out about the tix to LAX, they said she has to purchase round trip 869cuc. Then I read about the option to go through Cancun and that ticket is 390 RT. She went to the mexican consulate to check about a visa, they said K-1 visa and plane ticket to leave that day is OK. She went to immigration to ask if she needs one way or round trip, they said they don't care.
She is leaving with PVE, coming to get married, does she need a RT ticket?

Please if anyone has info regarding this matter will be appreciated.

That’s good news to hear that a Mexican visa isn’t needed for a K-1 traveling through Mexico. Thank your fiancee for us for going to the Mexican consulate, and asking. I had asked a Mexican immigration officer as I was passing through there once, and they told me that my fiancee would need a “transit” visa, but I suspect they issue that when they arrive in Mexico…just like our tourist visas. What you say makes sense, as I know if you travel “transit” (same day), there’s no airport tax charged either. Also, I’ve noticed a separate door/hall at the Cancun immigration that says something like “transit passengers” when I arrive from Cuba…There’s never been a line here of any sort. I suspect that our Cuban fiancées would pass through this area, and be escorted to the other terminal in Cancun “behind the ropes” so to speak…I’ve always gone through the long immigration line, which exits you to the outside world with a “tourist” visa, and then I walk or shuttle to the other terminal for flights to the US.

I’m by no means an expert on the Cuban exit process, and I’m probably as confused as everyone else seems to be about this. But, I believe everyone unmarried is required to exit Cuba with the PVE, and then when they’re married here in the US, they can adjust status to PSI with the Cuban Interests Section in the US (Washington DC). I believe you had mentioned in a different post, that your fiancee is waiting for her letter of invitation to arrive. This stood out to me, and frankly makes me nervous…Is your fiancé doing a “salida indefinitiva” (SI), or a “salida definitiva” (SD)? I believe a letter of invitation is ONLY required for the “salida indefinitiva” (SI). This might be why they are saying you need a round trip plane ticket as well…They expect the Cuban to return with a “salida indefinitiva” (SI).

I’ve read a lot about this stuff, but it’s very confusing to everyone, and there’s a LOT of conflicting information out there. Don’t take my understanding as 100%. We’ve gone to the Cuban immigration several times, and even their information is very different depending on the person you ask, and the time of day…You know how it is.

They don't leave the airport so no visa is required.

The cost of the flight Havana to LAX is $608 CUC, so it's expensive. I still think it is about the same as going to Miami ($208 CUC) plus my going to Miami to get him and then spending the night, and then both of us flying back to the Bay Area. And I really didn't want to have to go to Miami.


Yikes!...That is expensive 1-way. I normally visit through Cancun, Mexico and flights to/from Cuba are in a different terminal than flights to/from the US...I'm just wondering about the logistics since you have to "leave the airport" to get to the other terminal...I'd rather go this route if possible I think, so I could travel with my fiancee.

my grandmother has the Spaniard citizenship and you will lose everything if you dont come back to cuba within 11 months..thats the maximum she can leave the country for otherwise she becomes elegible to be resident not here but in different countries too..and yes i wanna say depends how you exit cuba to wether or not you have to pay for the exam. we did. and yes thanks god he is already here long process..good luck and no problem thats why we are here to learn from eachother..same way not many people know that as soon as the fiance comes from k1 visa he can obtain his social security number..hope this help its on vj..


Aaaaaaaa!!…That’s unique Claudia. I don’t know the laws/ins-and-outs of your grandmother’s Spanish citizenship…but I’ve read about Spanish heritage being a privilege in the past…I really don’t know much about it though. It sounds like your grandmother has a PVE exit status though more or less…the same 11 month rule applies for my fiancée’s PVE. Once we are married though, she can apply to adjust her status to PSI (Permiso Salida Indefinitiva) though. With the PSI status, I understand that she can maintain most of her Cuban rights, without the need to return to Cuba within 11 months (it could be years later)…also, she will be allowed to stay in Cuba for up to 11 months when visiting…all the while maintaining Cuban rights. This whole process is hard for everyone, but I feel that it’s more difficult for Cuba because of the necessity for an “exit permit”, and the contradictions that the US and Cuba impose on each other…It can be done though with persistence and patience…don’t be discouraged anyone.

Good point about the Social Security Number Claudia…We tried for my fiancée 2 weeks after POE, but there was yet another roadblock. The POE officer made not just 1, but 2!!! spelling mistakes in her name…Social Security said that they matched our “account” with DHS (and SS made a note…ja ja), but basically they told us that we had to make an “Infopass” appointment and visit in person, in a city 2 hours away to fix their typo…ridiculous!!! Trust me…We tried by phone several times.

He has like any other cuban that comes with a visa to visit USA. Let me know if I wrong but my grandma its a cuban citizen and she comes back and for because we dont want to lose our house over there..remember cuba is different with everything..



Claudia...It's possible that you can save money for the "medical exam", but not certain...it really depends on the relationship with the Cuban immigration officer in our experience...We did indeed pay for the medical exam in the end, but we were told otherwise previously. As far as "privileges", a Cuban can maintain more privileges if they do the Letter of Invitation, but they aren't precisely identified on any legal website/document that I've researched. I value experiences of those that have recently preceded us. By the way, "after a year once he becomes eligible to for AOS" is not correct.

Many Cubans and Americans don't understand their rights though...It's not your fault, not my fault, or anyone's fault that I'm related to though...ja ja. WE have to deal with it though.

Claudia, could you please let us know what visa your grandma has?...I'm sure it's not a K-1 Fiance Visa...ja ja All these visas have different rights, and I have only studied K-1 Fiance Visas more or less. We're happy for you, and your fiance/husband, but grandma is a different story/visa I imagine.

We were really hoping that we’d receive more responses from others that have gone through this “Cuban exit process” in the near past though. I’d really like to hear about (or see) a K-1 visa applicant’s exit visa that has gone through the “Carta de Invitacion” process though…I believe it’s different. The thing about the blue slash…I’ve only read once, and I cannot find it again…It could be very old…but there is a big difference of Cuban rights, depending on how one exits Cuba…I’m sure of that.

We don’t know your personal circumstances Ann & Aties, but it sounds like your fiancé’s visa is the “Salida Definitiva” (SD) type. This link is from Canada, but it basically says that “Salida Definitiva” is the same as “Permiso de Emigracion” printed on your fiancé’s visa: http://www.unhcr.org.../4dd219302.html

I believe your fiancé has a migrant visa, and may lose most of his Cuban rights. If one does the “Carta de Invitacion”, the Cuban can maintain most of their Cuban rights with a non-immigrant visa (PVE).

I don’t write about this to be a “know-it-all”. I hope everyone understands that I just write about the knowledge that I’ve mostly gained, only to help others that follow, and I don’t know everything...We can all help though. Without VJ, and the help we’ve received…I can’t imagine where we would be at this point.

Hi all,

I’m specifically speaking to Cuban K-1 fiancé visa applicants that wish to enter the USA. I’m very frustrated with the Cuban exit process (carta blanca), and we’ve studied it very much here in the US and in Cuba for over a year. Most of all…I hate for anyone to go down the wrong path uninformed. Almost everyone on VJ says that a Carta de Invitacion isn’t necessary, and I believe this is completely true, but I don’t believe everyone knows their options or rights. This is a VERY IMPORTANT DECISION though, and it depends on how you view the future together. With a K-1 fiancé visa, you really only have two options with Cuban Immigrations…“Salida Definitiva” (SD), or “Salida Indefinitiva” (SI).

If you choose “Salida Definitiva” (SD), the Cuban loses all rights to own property, there’s no free medical, no rations, and they also have more limited visitation rights to Cuba.

If you choose “Salida Indefinida” (SI), the Cuban maintains rights to own property, free medical, rations, and also longer term visitation rights.

The “Salida Indefinida” (SI) DOES require a Letter of Invitation though…and a week or two more of waiting for it at a cost of $156 USD. This shouldn’t be a huge deal though after waiting the previous year for your fiancé. Also, it shouldn’t be necessary to pay $400 CUC for the medical exam with “Salida Indefinida” (SI), since free medical is still the Cuban’s right, but I see that this varies depending on the immigration officer you talk to.

I’d guess that 90% of VJ member do the “Salida Definitiva” (SD)…I generally think this is foolish, but I don’t know everyone’s situation. Personally, I’d like to own a house in Cuba for my future mother-in-law there, and us. I don’t see much negative for having free medical there either. The worst that could happen is if we defaulted on “Salida Indefinitiva” to “Salida Definitiva”…so why not start out at the higher level?...It’s actually less expensive if payment for the medical check isn’t necessary.

I’m asking for all of your help Cuban VJ’s…Please post photos of your “Cuban Exit Visas” on VJ or send them to me via PM/email…Of course block out personal information. I’ve searched, and searched, but I can’t find an image of “Cuban exit visas” (PVE, PSI). I’ve read before that if one does (SD) or (SI), they both get PVE’s…the difference is that one has a distinguishing mark to indicate loss of Cuban rights. I believe it’s a “light blue” slash across the PVE that indicates (SD).

Please help for all to follow, and feel free to correct any of my misconceptions. My goal is to just make a well informed post about the Cuban exit process now. Hopefully we can help others as they have helped us.

He has a legitimate concern for many Cuban’s…and VJ is BURYING IT! Do people not ask Philippines specific questions? Why doesn’t VJ include a consulate for Cuba in their “consulate listing”? Officially it’s not a consulate, but rather an “interests section”, but it functions the same. VJ does have Cuba listed for “consulate reviews” however…fix it Please…This isn’t the first time this has been asked (I can personally guarantee that!...ha ha). Also, Cubans can’t post directly into their Portal (However I’m not sure if others can either, but I’d like to know if they can or can’t). Please respond, and help. Thanks.

CaribbeanSingle Status Certificate for Cuba?

I'm sorry if this topic has been rehashed many times.

Since it appears that my K1 visa is doomed to fail, I've decided, on the advice of an immigration lawyer, to travel to Cuba and marry my fiancee there.

I've been told they want a single status certificate to prove I'm not already married, and the US doesn't appear to issue anything like that.

Does anyone know what they will accept in it's place? Like a sworn statement from Apostille US or something like that?

If you already think you're doomed, you WILL FAIL, and lose money with the lawyer too. The US doesn't issue this to you...it's just a matter of marriage/divorce records here, but your Cuban fiance will need to get this there in Cuba, and they do issue it quite easily. I can't remember the agency, but we went together one day, and the very next day, we picked up her "solteria"/single certificate...It was probably the easiest thing in the whole process, and if you marry there, you will still need to go through this step. Don't give up, or you WILL FAIL. Get a new lawyer if you really need to, but VJ can help you out with almost anything if you study, and ask...It's not easy.
