Maybe you should try your local senator next. Did your congressman say you were in extra security checks or anything? Or did they just say 60 days with no explanation?

I wish I knew what it meant, but we seem to be in the same boat Icyspots. Perhaps they intend to still adjucate a few more piles of K1 visas at Nebraska, and this is the case. Maybe it is for extra security checks? I have to wait for the processing dates to change on the USCIS website before they will tell me this. When they do I'll let you know what they say.

There are others who filed before March 6 who had their petitions moved, correct? Thought I saw that.

At any rate, the 110 days is business days so I am far from that. Actual days I am over 110. I am wondering if the K1 processing dates will move if they supposudly no longer do K1s. They will not give me any information or do an investigation to my case until the date they have posted is 30 days past my NOA1 date. It is currently Feb. 20. Will they move this date anymore I wonder?

I am curious about these things. I wonder if my case got lost because there has been zero touches. Most of the people in security checks on VJ recieved touches. I am just trying to get some clues as to what happened to my case so I can try to plan my life accordingly. Yes, everyone waits, I know. Knowing what you are waiting on in nicer though.

Am I the only one (on VJ) whose application did not move from Nebraska and also have their standard message change (with no update to the date for me case - i.e. no touch)? It now does not have any time to complete processing. It reads as follows:

"Current Status:

Your I129F PETITION FOR FIANCE(E) was received on February 9, 2006. We will mail you a decision as soon as processing is complete. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates. "

I contacted our congressman and I got nowhere. All they ended up doing is ultimately giving me the same information that I already had from the USCIS website, etc. I don't know that they actually have any clout in getting things to move or getting details even. Anyone know? I'm in New Hampshire.


It is possible they saw the processing times online and decided you were not over the 'standard' processing time and gave you the stock answer.

I'm not saying that is true, but possible. I suggest trying again when your NOA1 date is before the 'processing on' date.

I'm not sure what your intentions are Mandi, but you shouldn't try to use your congressman until its been at least past the processing time on the USCIS website, or if your case has had something unusual happen to it. Are you asking for the future just in case? If you mail them now they will just say your application is being processed and to be patient.

I sent them a letter showing the circumstances of my petition, and what I had attempted to do to find out why it was delayed. If it becomes time for you to mail your congressman, I'd be happy to share the letter with you.

A congressman is a locally elected representive that represents and votes for you in Washington D.C. You can find your (USC's) representative here http://www.house.gov/ ,most have a website you can visit. You can get an email address, phone number, and postal address. My representitive had a link for immigration issues with a form that I downloaded that allows his office to recieve information on my behalf. Its just a formality, but it would need to be done for the office to investigate.

Basically send them a letter describing your circumstance. Explain that it has been well over the originally stated time it was supposed to take for this to be done and you have heard nothing from the USCIS concerning your case since Feburary 3rd. Then attach the release form and a copy of your NOA1.

I know in for some people this tactic has helped move along their case. At the very least it would seem that someone acting with the authority of your congressman is able to get more information on your case then you would be able to do with the channels available to you.

I recently drafted a letter to send to my congressman. I also dowloaded consent forms for my congressman's office to investigate my case. I do not know if either of these things will help in the slightest, but at least I felt like I was doing something. Perhaps it is something you can research and do. It can't hurt. Your case has been idle for a long time and I am sure it would be nice to at least know why.

Your petition has been transfered to California Service Centre. You need to give it more time as you are in the normal range. But the number is 1-800-375-5283. You will likely just get a standard answer.
NSC no longer processes K-1 petitions.

Called DOS to see if they could give me any update as to why the AP...computer says no show for interview mad.gif . after my husband spending from opening to closing at the embassy this is wacked. but it doesnt say anything about security checks. when I mentioned to the lady that at the interview they said AP she said "oh they wont put any notes, they wont say why the AP". so can anyone shed any light on this...the "NO SHOW" I find to be very confusing.

I guess it was really unexpected because I have read about so many that have been able to pick up there passport with visa the next working day at VFS. right now I dont even recall what type of visa those may have been but I placed too much hope in quick receipt of visa and this just gave me a punch in the gut.
This is encouraging news because the interview was successful in that we proved that we have a bona fide relationship whether they are accepting it or not must still come to light.

Thanks Tammy you really do help with the nerves. I guess when the blue paper says Adminstative processing you tend to think the worse...I really try to not be negative but afterall this is the US government we're talking about, they dont always do the smartest most logical of things.
Maybe because this is still so fresh I have been on a real roller coaster and I usually wake up in the morning being in the down mood, but as soon as I talk to my husband he is able to get me to feeling better quick. I am sure this all has to do with relationship...I was called at 3 am usa time and questioned by one officer while my husband was questioned by another in India. Of course my husband and I know each other very well and have spent considerable time together in person and on line (phone, text, chatting), there was no problems with answering any of their questions. now it is just waiting till they decide to give in and let us have the visa because we certainly have proven this marriage (relationship) is real, at least to a resonable person.
so the main question I had is if DOS doesnt get any information about AP does that indicate that the visa will be processed soon?

I called DOS this morning and there is nothing on the system yet about our case being in AP. Is it possible that it is just too soon (the consulate had one full working day since the interview)or is it possible that AP will never show on the DOS if it is going to be taken care of at the embassy?
I guess I am hoping that if DOS doesnt ever see AP that will mean that the consulate has decided that there is sufficient proof of bona fide relationship and they will issue the visa.
can anyone shed any light on this for me?
I found this and it gives me some hope:
The cable notes that consulates should not readjudicate petitions that have been approved by INS, since the approval of the petition leads to a presumption in favor of eligibility for the visa. Rather, revocation is appropriate only when the Consular Officer "knows, or has reason to believe, that the petition approval was obtained through fraud, misrepresentation or other unlawful means, or that the beneficiary is not entitled to the status conferred by the petition." The ground for the revocation would arise based on new information that was not known to INS. Revocations should be rare, and the Consular Officer needs to present "solid, factual evidence" as a basis for the revocation.

the uncertainty in a killer to sanity. the waiting we have endured seemed bad before but we at least knew there was a reason and a way of checking once we hit NVC. this is very unsettling, had to go to the doctor for sleep help...sleep deprivation can lead to insanity as well. I do feel a bit better today after a good nights sleep, just a long week end ahead (how crazy does that sound...most working people would like a long week end, now it non government working days when we know we wont hear anything dead.gif .

because I am stubborn and have a hard time waiting for things to happen I have called chennai embassy twice (last week and again tonight). last week the operator couldnt (or wouldnt give any indication of time frame for AP). tonight the operator again read from the computer "Administrative Prcessing" so I asked how much longer can we expect this to last? She said another week to 10 days ohmy.gif (could this be real?). at this point I told her I didnt know if the information I had given last week about my having major surgery had gotten to the officer in charge of our case. she asked if I had sent an email to the consulate (she was very sympothetic) becasue this was very important and told me to send an email right then explaining the situation.

What kind of information do they have on the computers and could she really know something?

Embassy operator mentioned document varification when I called to get status of visa. She said 1-2 weeks (10 days ago they said 1 week to 10 days). Now I know things dont move fast in India (and neither does US government) but can anybody say how long it took to varify documents in India (any body who has been through AP for document varification or has knowlege of timeframe).

When I started this whole process I was unaware of the AP that could turn my world upside down. If I had been aware of that as a posibility I dont think it would have hit me quite as hard (second guessing this one, but if I ever hear of any one going through this I do tell them AP is a posible detour so hold on)being fore warned is being fore armed.
Tammy, you have to be one tough lady to have lasted this long. Me-I am falling apart every other day. I am finding so hard to work. The stress keeps me so tight (I carry my stress in my shoulders) and 2 weeks ago I hurt my arm moving a patient, somthing I have done for years with out trouble. I went to my doctor after that realizing that the stress is making me more prone to injury and decided that maybe it is time for medication to help me survive the wait (I hate pills, but I am falling apart). Also Tammy I will be keeping you in my thoughts and prayers as you come to the next chapter in this saga of the visa journey. I look forward to hearing good news from you.

that seems to be my personality to think of all the possibilties to getting what I want the quickest way possible (not always so quick when I research it all out). As far as volunteering I have bills here I have to pay so where ever I went I would have to make comparible amount of money (the UK and Austrailia but after researching this it would take 6-9 months to get the visa's...and my husband could work in both places with my going as a RN) and I am sure he will be here by then. I just have to cool my jets. I live a roller coaster ride and my downs have been a bit farther down since the interview and AP.

the senators office got word from the embassy that " documents relating to the relationship to the petitioner are being varified". Just seems that 8 weeks would have been sufficient (but that is my impatience). I just learned that to work in austrailia it would take 6-9 month of waiting and a 2 year contract...my husband will be here by then. oh well, I guess this summer is a bust and I will have practiced patience more then I ever wanted to

Could you go to India temporarily to wait it out? At least that way he'd be close by to get the visa. . .plus it would make it obvious to the Embassy that you mean business.

I would love to go and spend even 2 weeks with my husband but I had major surgery and was off work for a month, if I had the money I cant take the time sad.gif . For the last 2 years I worked as a travel nurse and was able to take time off between contracts, after getting married I knew I needed to settle down for this process and now I am tied to a perm job till my husband arrives or else till I decide to leave the country(I cant work in India and make a living, I have bills here so I need to go where the money is enough to support my bills here and there).
Some times it just seems like everything is working against you (I know that is not true, I have so much to be thankful for but I always have to remind myself or have my husband remind me heart.gif ).
