I am the USC on an I-129f. I understand that every name on the I-129f goes through a security check, and that the visa can be denied for certain crimes the beneficiary may have committed. What is the purpose then of the background check of the USC? Is it only to find out if they are currently in jail and/or wanted for questioning and/or a known terrorist? Seems to me most terrorists nowadays probably avoid the visa process.

I can see that after March 6, when the new law goes into effect, the USC background check is done to warn the beneficiary. But even that law doesn’t have a provision for denying a visa based on the USCs criminal history. Apparently, the USC may have committed murder, but if the beneficiary is OK with that, everything is fine. Weird law. Has anybody ever been denied a visa for crimes the USC may have committed?

And, in case you’re wondering, I’m asking this question because the police and I were well acquainted during the indiscretions of my youth. Thanks.


I don't know, but logical deduction tells me if you were linked to a terroist organization anyone you tried to get a visa for, K1 or otherwise, would be suspect. And yes, there are people in the USA as citizens the government considers linked to terrorist or crime organizations.

You are right, the K2 information is thin and hard to find. Some suggestions I would have for you is to be sure and get all vaccination records for your child, including those that you get at the immigration medical appointment. Bring the original birth certificate for your child.

You (or your fiance) will file for your AOS and the child's at the same time. Make two different applications (I485) and send them in the same envelope. USCIS will figure it out from there. Your interviews will be scheduled for the same day and time. I have not done the adoption process, but I would wait until after the AOS process is done so you do not complicate matters. This is just my personal opinion.

You may have to drive a few miles, but it is what it is. Try to find a Civil Surgeon who understands your spouse does not need another pshyical, but only needs vaccinations and vaccination confirmation. Ask what they charge, it shouldn't be more then 20-30 bucks. I got my wife's done in portland for 5 dollars.

I was wondering If anyone knows what back round checks they do on the benefitor, I have nothing to hide. But I had problems woth council tax one do they look at things like Credit reports ?

I don't want to mess up the prosess for her

And FYI, it's taking 2 1/2 to 3 months for approvals through the CSC. I just got my NOA2 and it was almost 3 months to the day. I live about 5 miles from the CSC so maybe I'll go ask them to speed yours along!!!!!

First of all, this site is GREAT. I had initially planned on hiring a Lawyer to handle my filings, but this site has really helped me prepare to do it myself.

I am in the beginning stages of filing my I-129F and G-325A forms for my finace in Colombia. We are both obtaining the documents needed to complete the packet. Question: I understand that by filling out the I-129F form, it allows my fiance to bring her 4 year old daughter to the US on the same visa. (We are planning our wedding within the 90 day window granted by the K-1) Once they arrive in the US on the K-1 and after we are married, do I then file the I-130 for her daughter? Or do I go ahead and file it the same time I file for the I-129F? I understand the additional filings for "change of status" once we are married, but the I-130 is somewhat confusing.

Any help and suggestions will be appreciated.

Its case to case basis...some got it early...some dont have it yet...just like us huhuhuhu....though some also said that its not really needed as long as they cashed your check..and have the receipt number on the check which starts with 3 letters. Register an account at USCIS website and there you can track your application....they send us the notice last April 24 and until now NO NOA1 !!!!!! :crying: ..We sent it express mail and after 2 days they received it....they will send back to you the request noticed that you signed if you have one, after the service center receive your packet.

yes it can be included in the petition of K1,include all their names in the 129F forms and all other forms until the end of the process, call it as K1 derivatives, but if they decided to follow after a year and its a separate process......if its a K1 derivatives doesn't follow the surname unless he is willing to adopt them.....

It's now early in the morning. Later this Thursday, some helpful people will surely give you a more detailed response.


Right now, I just want to remind you that one of the major causes of delay in the visa process is waiting for the police clearance. Whenever your fiancee steps in Taiwan for the last time, she has to make sure that she gets her police clearance before she leaves.


If she continues working in Taiwan, don't worry about when she'd have to return to the Philippines. Let's say you file the I-129F in late March or in April (definitely after your meeting with all the pictures and other evidence for the I-129F) and receive the NOA2 in June or July, you could decide to have the interview in November. The NOA2 is valid for four months. Just make sure, too, that she takes the medical exam a week or two before the interview. Even if the NOA2 expires, you could always do something to renew or extend it, whatever the right term is.

More about the police clearance though. She also worked in another foreign country before Taiwan. Does she need police clearance from there too? She was there about 8 months. I am preparing to start the K-1 process with my fiancé by reading and collecting information. I am a US citizen living and working in the US. My fiancé is from the Philippines, however, she has been working in Taiwan for more than a year now. Her contract in Taiwan does not end until October of this year. We met about 1 1/2 years ago before she left to Taiwan when I went to the Philippines for a business trip. I plan to go back to the Philippines in late March for another business trip.

While I am in the Philippines, we are hoping she will be able to go back home so we can see each other once again. Before she leaves, we need to decide if she will be going home for a vacation and return to Taiwan to complete her contract, or if she should quit her job, paying a hefty fine for ending the contract, and go home permanently to start the visa process. If possible, she would like to finish her contract, avoiding the fine and continuing to help support herself and her family. However, we do not want to wait until October to start the visa process.

So here's my question: Can we start the visa process while she is still working in Taiwan by me filing the I-129F forms when I return from my trip in late March. After reading the time line it looks like it will take 2-3 wks to get NOA1, and then 3-5 months to get NOA2. This is a long time for her to be in the Philippines, most likely unemployed, when she could be continuing her job in Taiwan. Not only will this create more of a financial hardship for us and her family, but she is concerned about being too bored at home without a job to keep her busy or me to keep her company. If she can continue working in Taiwan, at what point in the time line will she have to return home and wait for the final approval? It would be great if she could wait until the US Embassy mails her the forms she needs to complete. However, I don't want anything like this to create problems or make things complicated.

I have searched for previous answers to something like this, but have been unable to find any information about the beneficiary working in a foreign country. There are several topics that discuss the petitioner working in a foreign country, but that's a completely different topic. Any help understanding what is required and the impacts of her staying in Taiwan would be greatly appreciated. Thanks.

Can someone please tell me if my fiance from the philippines will need to get a quit claim from her daughter's father in order to bring her to the usa after we get married. The father is not on the birth certificate and has had no contact with the daughter who is three years old. Currently my fiance does not know where to find him in order to sign the quit claim. If we do need a quit claim, where can I find and example so that we are sure it says everything that it needs to say? Any help would be greatly appreciated. Thanks.

By the way, I just noticed today the new I-129f and I-130 filing instuctions and filing location. It has changed in the last 3 months compared to the instructions released earlier in the year. It sounds like things may take longer if the new location is not used because it will have to be forwarded. Just figured I would mention it if your instructions are from earlier this year.

I just finished waiting for a long divorce to finish before filing I-129F for my financee to come here from the Philippines. After the judge signed the divorce papers, I had my fiancee sign and date her G-325A and letter of intent to marry me. She then mailed them to me so I could put them with my I-129F. However, it ended up taking over a month for the courts to file my divorce papers and give me access to a copy. Now it has been about 40 days since my fiancee signed and dated her G-325A and letter of intent. Are they too old to use now? Do I have to wait for her to send me more copies before I can file?

My fiancée, the beneficiary, has recently moved from Taiwan back to the Philippines after I filed I-129F for her K-1 Visa. We have already received NOA1, but are still waiting for NOA2, with another two or three months to go. I have read what to do to change her address, but have a couple questions.

First, we have to call the NCSC and tell them the address. Can I do this for her?

Second, she needs to file AR-11 form. However, in the online form, it asks about her entering the US, and where her point of entry was. But she hasn't been here in the US yet, so how do I answer this? Also, what new address should I use for her? She is staying in Batangas with her parents while waiting for her visa, but she fears it is too hard to receive mail reliably there. She wants to use her sister's address in Alabang, where she frequently visits. Is it okay to use her sister's address even though she is not living there?

Is there a time limit that she must change her address by? I have read 10 days, but I think that is for someone in the US. What if that time has already passed? I think it has been 3 weeks now.

A petition was filed for both my fiance and her daughter. Both the K1 and K2 paperwork were sent together. However, when I recently received the Notice of Action, only my fiance's name is listed as a beneficiary. Her 3-year-old daughter's name is not listed. Should her daughter's name be listed on the Notice of Action? If so, what should I do?


I'm curious. What paperwork did you send for a K2? I thought you only send the I-129F packet for the K1 visa and list the child on the I-129F form. Doesn't the paperwork for the K2 visa come later with one of the packets from the embassy?

I just filed I-129F three months ago and listed my fiancee's child on the petition. I haven't done anything else and haven't seen anything in the guides saying to do more than that. Did I miss something?

I'm confused now. I'm reading over the change address section on uscis.gov and there is really nothing I can find that says what you are to do if you need to change the beneficiaries address.

Join the crew. I'm confused too, and have been for 3 months about this. I have posted several times in the past, but never got any straight answers, usually being told to file AR-11. When I asked about the POE questions on that form, no one replied with answers.

I wish they USCIS was clearer on when to file the AR-11. They say you must file within 10 days if you are not a US citizen. That is not very clear. Do they mean non US citizen living in the US? Or any non US citizen with a pending application for a visa?

the best thing to do is to let her stay in Manila while on this process. It will not affect the petition as long as she will not get married to any of those men. Filipina has their lawful rights to choose whom they want to get married no matter how many Muslims proposed to her.

Ok...so she has 6 months to use it to COME to the USA.
Once in the USA....she has 90 days to get married to you until it expires.

No...the 6 months is seperate...the 6 months is for her to use it to come to the states. Once she uses it to come to the states...its done...its a one time entry. Then the 90 day (3 month) clock starts for the marriage to happen.

What is the reason for making copies? And does this mean of checks as well?

That's great news about vonage, I use vonage i'll definately get that added. I was using nobelcom calling card, the talk thailand plan at about 1.2 cents a minute which isn't bad
especialy if your like me and most often use a cell phone.
I wonder what else people have learned now over the years of distance communications.

When I snail mail, at first I used Fed ex, which cost 45.00USD to send a few pages and photos (don't do this), now I always just go to the post office, and mail a letter or package for just a few dollars.

When I need to send money, I opened another free checking account and just sent a card to my fiancee, now I can just pop into my online banking and transfer free,
She's gonna leave the card with her mom, so we can send her money too. (I didn't activate the card till it had arrived)

When I buy plane tickets, I always use farecompare.com
