K-1 Fiance(e) Visa Process & ProceduresApproved Today!!!

I cant believe it. Look at my signiture the timeline. I must have done something right or just lucky.

Or there must be an angel with a smile on her face.

Well, as I am sure most people know, Vermont was much faster before the fiasco with the I-129f and all the RFE's. It is not unreasonable to assume that they will handle the RFE's post IMBRA faster then the other service centers because they are, apparantly, the most efficient of the service centers.

I'm sure CSC will come around shortly though.

My pictures didn't come with a date on them. I didn't put a date on them. Is this a problem?

My pictures were dated and past 30 days, and my petition was approved. Whether this is exception or precedence I do not know. At least I can give you some confidence it may not matter about the date.

K-1 Fiance(e) Visa Process & ProceduresProof of Meeting question

I had read somewhere on the net the other day that if you haven't been able to go to the country where your fiance lives because it would cause financial hardship that it would still be ok. My question is.......could someone please help me locate this info for me? I can't remember where I found that and I would like examples or experiences or suggestions from anyone that can help. I can go there, but not before I file for the K1 Fiance Visa. I need help, suggestions, anything. Please? Thank you so much in advance.

This is a quote from the official I-129f instructions:

"Provide copies of evidence that you and yourfiancé(e) have personally met within the last two years;or if you have never met within the last two years, provide a detailed explanation and evidence ofthe extreme hardship or customary, cultural or socialpractices that have prohibited your meeting; and"

So yes, this is possible. I am not sure how you would show extreme hardship though. My guess it would have nothing to do with financial issues, but more along the lines of health issues such as a medical condition that does not allow you to travel. Perhaps I am wrong and someone will shed light on this matter.

However, you say you can travel after the K1 starts. I do not know why that is. If you can travel you should travel first, then file for a K1.

Good luck to you !!!

Good luck and I highly recommend you take Rahma's advice and check out the ME/NA forum as that region has a unique set of issues and problems to deal with.

K-1 Fiance(e) Visa Process & ProceduresNEW CSC PROCESSING DATE

Yeah its up there now as March 3 you may need to force a refresh on your browser.
I would assume though that the dates probably dont mean a whole lot if the couple of strange emails people have recieved the last day or so are actually approvals. If that is the case then it would look like there is no real pattern to this at all. But hopefully they will follow a first come first serve pattern and if so then this is good news to see!

Good Luck!

Yep I see Mar. 3 as well.

K-1 Fiance(e) Visa Process & ProceduresSenator help?
My petition had not been touched until I called my congressman and one of his aides contacted the NSC. You can draw your own conclusions from that, but I am glad I called. Be sure your case is outside processing times otherwise your congressional office will really have no reason to help you.

K-1 Fiance(e) Visa Process & ProceduresTouched ? Any Explanation ?

Hello People,

I am new to this site, but have noticed many times the mention of "Touched"

I have not seen anywhere that this is mentioned in INS, NVC or DOS Sites Can anyone PLEASE Explain this to me, I know we can all have a quick laugh and say we will feel "Touched" in the head before finishing this process, but It would be nice to hear some explaination of the use of the term and where everyone has been finding this.

Thanks
Henry

Do you have an account with the USCIS website? If you do, when you see your case online, the date will change in the 'last updated' field, but the status of your case will not change. This is called a touch. A touch is usually someone 'looking' at your case, or 'handling it' which could mean moving it to someone else's desk ... or who knows :) Something like that!

If that doesn't make sense, use the search function and type in 'touched' :) This topic comes up alot and I am sure you will find a thread on here explaining it better.

K-1 Fiance(e) Visa Process & ProceduresWhat form do I need if I am changing my address?

First off, sorry if this is not the place to post this, but I did some searches and couldn't find anything. Hopefully someone can help me out.

I am moving in a couple weeks and need to notify USCIS of my address change. I currently have a pending application for a K1 visa (I am one of the recalled cases, because of IMBRA). I found form "AR-11", however the directions say that it is for the non-US citizen to report a change of address. My question is, is this the form I would use to change the address for my application, or is their another form?

Thanks,

I have heard of others who have changed their address by a simple phone call to customer service (1-800-375-5283).

In fact if you read the NOA1 you recieved it states:

"...If you move while this case is pending, call customer service when you move."

Well there are forms and a letter of intent your potential bride must sign so YES! ask her first !!!

ChucklesMaleRussia2006-07-16 18:52:00
K-1 Fiance(e) Visa Process & ProceduresDoes my NOA1 have est processing time on it?
There is no 'official' processing time for NOA1s. They also removed the estimated processing times for NOA2s. This is your only reference for that now:

https://egov.immigra...nter=California

As far as NOA1s, expect 1 to 2 weeks. Thats a guess btw, nothing official.
ChucklesMaleRussia2006-07-17 14:30:00
K-1 Fiance(e) Visa Process & ProceduresYay! But still confused...
Check your NOA1. Nebraska has been sending all of its K1 petitions to California for processing. You should have been transferred there.
ChucklesMaleRussia2006-07-18 03:28:00
K-1 Fiance(e) Visa Process & ProceduresHow Low can you go...........
I know you are venting, but this is what I think you should do.

Call back and when they ask you if it has been 30 days since you last called, say no !!! :P

You also probably know this, but you are never talking directly with anyone at Vermont Service Center. The customer service line is someplace else and that person can have no effect on your petition. All they can do is look it up on the computer the same as you. The only thing that they can do that may be helpful for you is request an investigation, as far as I know. You are past the processing dates (I think) so you have a case.

Anyway, sorry to hear about your troubles and good luck getting answers in the future.

K-1 Fiance(e) Visa Process & Procedures??Change In % of Required Income??
The required amount in relation to the poverty level can vary from embassy to embassy. They all seem to be unique. As far as the AOS, it needs to be 125% and I have heard of no change.

I recommend you visit the UK sub forum and find out embassy specific info for your I-134 and income requirements.

K-1 Fiance(e) Visa Process & ProceduresBeen gone for a while.......
I don't have a clue why your case is been dragging on. I'm sure you have come to what must be the most logical conclusion, that your case had a name hit and was sent to Washington for further checks. Anyway, I wish you luck, and I bet your recent touch is good news. I recieved a touch, but did not recieve my NOA2 for several days. My NOA2 date ended up being the same as my 'touched' date.

K-1 Fiance(e) Visa Process & ProceduresAnswer from Colorado Senator
Just a note to the person who was told recieving a fiance visa from Russia is harder then other countries, that is completely and absolutly false.

It is in fact easier then most countries, probably on par with getting a fiancee visa from the UK (as far as wait times, requirements for the consulary, and amount of rejections). There is not a long wait for interviews, in general 2 months from when the embassy recieves your case from the NVC. I think desert fox would be suprised to learn there is only roughly 200 interviews per month for K visa's out of Moscow currently. Considering the size of Russia (largest country in the world) I don't see how that there is an 'epidemic' of marriage brokers using K visas...

Anyway, back to your regularly scheduled mud tossing !!!

K-1 Fiance(e) Visa Process & Proceduresabsent fathers

can anyone tell me the laws about bringing children to the usa of a K1 visa if they havent seen or heard from their father for several years, what evidence is needed from the mother thank you

I HIGHLY suggest you contact the UK embassy directly and ask them what they expect. There may be others who can give you advice about what they require, but I believe it would be much better for you to go to the source on this question. You do not want to 'make a mistake' and not find out until the interview.

There are really no 'laws' as far as the US is concerned. You must have permission from the father, other then that, you fall under UK jurisdiction as far as custody/support etc.

All I can tell you about my experience is that the embassy my fiance is using requires a signed statement from the father. It can be very different at your embassy.

K-1 Fiance(e) Visa Process & ProceduresHelp...How Do I track my case from NVC
Just as a side note, if you use the automated system and it asks you for your case # ,the system will not be able to find your case if you are filing K1. Chose option 2, I believe, and talk with an operater. If they have your case, they will let you know. They will say it is in administrative processing, but don't panic. That is what they call the normal processing there. It can go into 'extra' AP for further security checks as well. I believe 1-2 weeks is normal processing time.

K-1 Fiance(e) Visa Process & ProceduresIs it possible to use the USCIS case number to check about the NVC??
For K-1 petitions do not enter your case number on the automated phone system. It will say it is not on file. You will have to speak to a person. They can tell you if it has been recieved. They will say it is in administrative processing if they have it. Do not worry, that is what they call their normal processing. It can go into further AP, just ask them.

At least that is how it was for me a few months ago. Good luck.

K-1 Fiance(e) Visa Process & ProceduresTips on Letter to a congressman

When you write to, or call your congressman's office you need a valid reason for their help. Otherwise, there is nothing they can do for you. Unless you are past a posted date, such as the dates given on the the USCIS website (NOA1 processing dates), or you sent in an RFE and not heard back within 60 days, or AP or something like that, you are just wasting your time.

Some congressman are more helpful then others it seems. My congressman was helpful after my app went past the dates posted on the USCIS website. Unfortunatly, you applied at a bad time and things are just taking longer. Hang in there, it will happen sooner then you think.

i'm going on 195 days, Should I wait until 200 ? lol

Iceyspots, you just don't have the luck! I'm pulling for ya, I hope you get something soon.

Didn't you try your congressman/senator, but they ended up being usless?

K-1 Fiance(e) Visa Process & ProceduresK1 and bringing children
This is from the Moscow embassy website, and I can confirm this is true and current for Russia.

"Attention! If the immigrating parent does not have a document showing he/she has full legal custody of the child, the child immigrating with the parent may be required to submit the other parent’s notarized statement that he/she gives full permission for the child to leave Russia for the purpose of immigration to the United States meaning the stay is permanent and not temporary.

All original documents must be accompained by photocopies and English translations. If the original documents are in Russian, there is no need to have the translations notarized.

K-1 Fiance(e) Visa Process & ProceduresScared Cos Fiance Has Had Arrests..

Okaaaayy...
I have no idea what "Raider Nation" is... but I meant soccer, not 'football'. Anyway, yes, I know it doesn't
help but he's just told me that it was over 6 years ago... and apparently, being arrested and thrown in the tank means almost nothing over there.... he says as soon as you 'sober up' they send you home... so in other words, he's never had charges filed or anything of that sort, and has no 'record', other than the actual arrests themselves... I guess you just go home the next day.

Wish it was that easy here...

I didn't mean to make it sound like all Englishmen fight at Premier matches... but from what I've learned from dating one, it's a hell of a lot more common than here... so, sorry. :D

Well, getting deported certainly will show up on a record of some sort, somewhere. Maybe you should get the advice of a lawyer in your case.

I remember the photos I sent in where not exactly 2x2, or whatever they asked for. As long as you are close, you shouldn't have a problem. Since you have already sent the I-129f (I assume) then don't worry about it !!!! Of course, if you have a chance to make them perfect, do so.

K-1 Fiance(e) Visa Process & ProceduresMiddle name & Signature fields - Help please!

The signature whould be done as they individual normally signs their name. I highly doubt that that would be in English....

No blanks should be left on any spaces .. try something like [NONE] so they don't mistake it for the true middle name...

Bad advice, the instructions ask for a signature in English.

Where in the instructions does it ask that? Cite Please... You won't find it because it's not there...

There is nothing that asks that the signature in English.. On the contrary, your legal signature should be as you sign it all the time... I know of several individuals whose signatures have nothing to do with their names.. it does not diminish the legallity of the signature.

It is there. Interestingly the form on the USCIS site now leads you to the wrong form, so I can't give you a reliable link but this falls under the "must be completed in English unless otherwise indicated" portion.

K-1 Fiance(e) Visa Process & ProceduresMy Sordid Past

I am the USC on an I-129f. I understand that every name on the I-129f goes through a security check, and that the visa can be denied for certain crimes the beneficiary may have committed. What is the purpose then of the background check of the USC? Is it only to find out if they are currently in jail and/or wanted for questioning and/or a known terrorist? Seems to me most terrorists nowadays probably avoid the visa process.

I can see that after March 6, when the new law goes into effect, the USC background check is done to warn the beneficiary. But even that law doesn’t have a provision for denying a visa based on the USCs criminal history. Apparently, the USC may have committed murder, but if the beneficiary is OK with that, everything is fine. Weird law. Has anybody ever been denied a visa for crimes the USC may have committed?

And, in case you’re wondering, I’m asking this question because the police and I were well acquainted during the indiscretions of my youth. Thanks.

I don't know, but logical deduction tells me if you were linked to a terroist organization anyone you tried to get a visa for, K1 or otherwise, would be suspect. And yes, there are people in the USA as citizens the government considers linked to terrorist or crime organizations.
