If there is any one out there that can help me plz, how many days prior to the interview should my husband have the medical done? he has to travel from Hyderabad for the interview and would not like to stay in Chennai for more days then is nessessary. would it be better to make 2 trips, one for the medical and another for the interview?

Applicants whose Indian passport was issued within the past six months may present just the Passport Office Police Certificate, and need not obtain additional police clearances.
Applicants over age 16, whose passports were issued more than six months previous to visa application, must also obtain a police clearance from the District Police Office serving the applicant's place of residence.
Indian passport holders applying for visas outside India should obtain a statement from their local embassy or consulate confirming they have no criminal record.
Non-Indian IV applicants residing in India should obtain police certificates from the District Police Station serving their area of residence.
Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

Here is another question for any one out there. My husband had his passport renewed and was given back the old passport, he said it is an "offense" to show the old one but I am wondering if they would allow him into the consulate with that one and a copy of the new, but of course I dont want his to get into trouble showing the old one. Under these circumstances would there be any legal trouble from Indian government or US by showing old passport to get entry?

He showed his interview letter and the receipt. He was told that if they were not done with the varification and if he took his passport for the interview it would take another month to do the PCC all over again. Caught between a rock and a hard place. I need to know if the consulate will allow him to interview with only a copy of his passport and distric PCC since the passport office PCC is pending and they are holding his passport, (this practice is ridiculous to me, I have had FBI clearance and state police clearance and all they needed was fingerprints...why hold the passport????)

I need an answer urgently to this question. My husbands interview is Dec. 10th and he started getting his PCC's as soon as we were informed of the intervew date but the passport office is not done yet with that PCC. I am afraid to reschedule and have a new date over a month away (we havent seen each other for over a year and this is the second interview ..."reaffirmed petition"). Would the consulate allow him to go to the interview showing a copy of his passport and another form of picture ID and submit the PCC and passport to VFS after receiving it (that will be next week when he gets it)?
I hope some one has information on this or I will have to reschedule the interview in the next 12+ hours.

I just finished filing I-129F for my fiancee. She is going to try to get her police clearance from Brunei now, but she cannot get 50 Brunei dollars while she is in Taiwan or when she goes back to the Philippines. Can she send US dollars instead? If not, show can she get Brunei dollars? Should she be sending cash with the request? If not, what is an acceptable method for sending the money? How long will it take?

She is working in Taiwan right now, and will go home to the Philippines in about 1.5 months. She will wait there for her interview and K1 visa. If she requests her police clearance from Brunei now, should she ask them to send it the Philippines? I was thinking about writing her a letter to send with the request explaining her plans to move back home and requesting they send it to the Philippines even though her request letter is coming from Taiwan. Do you think this will work?

Her other option is to wait until she gets back home and then go to the embassy in the Philippines to request the police clearance from Brunei. The only problem we have with this option is that we're afraid it might take too long and slow down the K1 process. We think it might be best to try and get the clearance now instead of waiting. Any thoughts on this?

Why not just call (or e-mail) the Brunei Embassy in the Philippines and ask them if they will accept a bank draft/demand draft in US$?


First of all, the Brunei Embassy in the Philippines doesn't ever seem to answer the phone. My fiancee has already been there once. They told her she needs a request for the US embassy for a police clearance. This is our problem if going that route. Paying for it there should not be a problem.

Our other option is to follow the instructions on travel.state.org which does not list a requirement to get a request letter from the US embassy. However, this option requires mailing a request for police clearance to Brunei with $50 Brunei dollars. How do we pay for that? How can we confirm they will take a US money order or cashier's check? It will be going to:

My fiancee and I are waiting for NOA2 on our petition for her K-1 visa. We are trying to get the last of her police clearance documents while we are waiting. In order to get police clearance from Brunei, my fiancee and I only know two ways:
1. Request directly to Brunei (requirements posted on travel.state.org)
2. Request through Brunei Embassy in Philippines. (extra requirements not on travel.state.org)

So far, we have hit a snag attempting either one.

In order to request directly to Brunei, we are not sure how to send the 50 Brunei dollars. So far my fiancee has been unable to get Brunei dollars in the Philippines. Is there another way to send the money that they will accept?

In order to request through the Brunei Embassy in the Phillipines, they seem to have a different set of requirements than what is posted on travel.state.org. In order to get police clearance through them, they want a "Photocopy of the request letter from the embassy concerned." How do we get that?

Any help here would be apprecieated. So far, any posts I've made on this topic have only repeated the link to travel.state.org for the list of requirements to request directly to Brunei. I have this. I just don't know how to pay the Brunei dollars.

I called the USCIS service center today. They were not able to give me any information on how to get a request from the US embassy for police clearance from Brunei. They simply refered me back to travel.state.gov. They also could not give me a phone number for the US embassy in the Philippines.

I hope someone can help me here. Will the "Request for Police Clearance" come automatically from the US ebassy after my petition for K-1 visa is approved? How long after NOA2 will that be? Is there any way to speed things up to get the request sooner? I think it might take two months to get the police clearance from Brunei after the US embassy gives us a request.

it took about a month from time i mailed all my info and fingerprints to hong kong [dhl or lbc carrier or one of the major ones i forget which one even fed ex]with tracking number then hong kong mails it to embassy in manila but i tracked it with hong kongs carrier tracking number to manila post office then the us embassy in manila picks up there own mail from the post office with embassy personel!!!!i was on phone with every one alot!!! just making sure

Thanks for the information. I hope we can get it that quickly too. I don't think we will be mailing anything to Brunei, but instead, the Brunei embassy will do it when we give them the required documents. Hopefully they will be quick and maybe give us someway to track the delivery as you did.

I assume it did not take long to get the request letter from the US embassy after your case was transfered there.

Please forgive me for posting this again, but I really need someone's help and haven't gotten anything that helps yet.

I need to get Police Clearance from Brunei for my fiancee in the Philippines. The instructions to do so are posted at http://travel.state.....html?cid=3522. However, when my fiancee went to the Brunei Embassy in Manila, they gave her a list of requirements different than what is posted on the link. They want her to give them a "Photocopy of the request letter from the embassy concerned." They even gave her a paper called "Requirements for Certificate of Good Conduct" which states the request letter is needed. All other requirements on this paper match what is posted on travel.state.gov. Without the request letter, they will not give her the police clearance.

How do we get a "Request letter from the embassy concerned" in regards to getting a police clearance from Brunei for a K-1 Visa? I assume "the embassy of concern" is the US Embassy in Manila. However, since my I-129F is not approved yet, I don't know if they will help. Do we need to wait for the I-129F to be approved and the case sent to Manila? We do not want to wait for that since it might prolong the visa process. If we do have to wait, how do we get the request letter after the case is sent to Manila? I need this request letter as soon as possible.

Its sad how long this takes, it is brutal. I mean in reality how long does it take to look over one of these packets? I can just imagine my packet sitting on someones desk collecting dust. Also its wierd why do some people seem to get there approved in as little as a month? I also see many cases where it takes between 60 and 90 days. Shouldnt the processing time be the same for all of us or in a periodic order when recieved?

The other day I was quite frustrated too. I'm tired of waiting. Ever since I turned in my I-129F, the average waiting time has only gone up, about double. During my boredom I look at the statistics to see what has been happening. This is what I have found for the CSC. I don't know about the VSC.

Over the last 1.5 years, the average number of completed I-129F's at the CSC is about 2200 per month. However, lately the numbers haven't been that high. In April, the number of completions were almost 3000. But starting in May, there has been less that 2000 per month. To make things worse, August only had 1000 completions, and September only had 900. This is way below average.

The graphs I looked at didn't show the number of new applicantions, but it did show the number of applicantions still processing each month. By knowing the change in applications processing from one month to another, and the number of completions done that month, I could estimate the number of new applications received. The average new applications seems to be about 2100 per month over the last 1.5 years. This has remained somewhat accurate over the last several months, maybe only slightly higher than average at 2200 per month.

So the conclusion is, if the number of new applicants is consistently near the average value from one month to another, and the number of completions is dropping to less than half the average, the waiting period to get approval is bound to go up. Unless we see the number of completions go above the number of new applications, 2100 per month, the waiting time will not get shorter. If they continue with only 900 completions per month, the waiting time is bound to get even worse.

I hope they get more people to work on the cases and bump the number of completions back to 3000 per month like last April. This might save us a couple weeks on our waiting time.

Hi all, Im new to the site but have already found it very useful but after applying for a K-1 visa for my fiance to come over and for us to get married I am worried that I will not get approved becasue of the support test.

I sent in my completed package and on Sept 8, 2010 I got my NOA1 letter. It has now been 100 days tomorow and I have not heard back anyhting, the average time according to the statistics is 86 days from NOA1 to NOA2 so I am getting nervous, but my real concern is if and when they finally approve it I have to send the Afidavit of support that I make more then the poverty line, but here's the problem. I am only 21 and I am in my last semester of College for accounting, I live at home wiht my mother who completely supports me, so I have $0 income as of now, once I graduate in the summer I will have a very good salary but obviously that means nothing to the situation at hand. My question is basically what can I do I hope this will not jepradize my fiance getting approved. Is the afivdavit of support basically like sponsorship? Do I have to be the one to do the sponsoring or can I use someone else to sponsor her, like my mother or other relative? IT doesnt say on the USCIS website that the petitioner has to be the one furnishing the support it just says that the person who does the affidavit of support must be over the poverty line.

Please HELP!! I dont know what I would do if she gets denied and I have to do it all over again next year.

I'm using the California Service Center and they are running at 140 days between NOA1 and NOA2. Our timelines are similar. I received my NOA2 document in the mail on Sept 16. I too have heard nothing. I figure I will hear something around the end of January or early Februrary. Very sad.

I believe I have read about people using other sponsors for the support, but I don't know the details.

Do copies of the tax returns need to be signed?

I have the same question. It would be much easier to just sign them than request a summary. However, since they were electronically filed, is this appropriate?

By the way, I was told to have a complete copy of the taxes by someone I trust to know what they are talking about. He told me to make sure to include all forms, schedules, W-2's, and 1099's. I don't think a summary would even come close to that.

When looking at the I-134 example on VJ, it shows neither box checked for question 11 when filing for a K-1 visa. However, if you accidentally check one of the boxes on the PDF form, you cannot remove the check mark. You can change the mark to the other box, but you can't uncheck both. Does this mean I have to start the form over again or can I leave one of the boxes checked?

I would think one should be checked, but which one? The example says to put this for the answer: N/A ( K1 visa process for permanent residence )

I would hate to check the wrong one and have a problem.

Is your salary alone enough to qualify? If so, then that's what you should list on the I-134. That should be the same number that's on your letter of employment.

Unless the bonuses are guaranteed by your employee contract then you can't count on getting that money every year. If the company's profits tank then your bonus could be reduced or eliminated. If the stocks you're referring to are options that vest over time then you can't count on getting income from those, either. The stock price could drop below your option price, which would leave your vested shares worthless. If the stocks are part of an employee stock purchase plan then you're guaranteed to get the margin between the current purchase plan price and the market value, but only if you sell the shares the day they are purchased under the plan. If you sit on the shares and the price drops then you could end up losing money.

You're more or less assured of getting your base salary. If that alone is enough to qualify then that's all you need to list on the I-134.

Great. I'll just use my salary then. It should be plenty and it makes things much easier. Yes, you are correct about the options, but my company quit giving those out to as many people after the back dating issues. Instead, my stocks are RSUs, vesting like options but becoming fully mine upon vesting. They'll always be worth something unless the stock goes to zero or I lose my job. ESPP is always sold the day after purchase, guaranteeing the minimum earnings, however, it's usually much larger. Bonuses are given out every year, but not guaranteed. It's funny, for the government you say not to count these things, but during my divorce, of course they counted it all assuming the stock would continue to grow as it has lately.

Gross income is what you report as current income. Ignore all issues related to your ex-spouse but yes, count your kids. If your income alone is more than sufficient, its best to leave all asset questions blank. They are optional.

I have a verification letter from my company that says what my salary is. 1. Do I need to report my USC ex-wife as a partial dependent on my I-134 form in regards to my K-1 fiancee? My ex will be receiving alimony for another 5 years.

2. What about my children who I pay child support for, but I do not get to claim on my taxes? I assume I still report them as partially dependent since they live with me 35% of the time.

3. When reporting income, do I report my total annual income, without removing the amount paid for alimony and stock to my ex?

4. What if I don't have money in a savings account, but keep some extra as cash instead? Will that matter that I report none for savings? I have stock that vests quarterly from my company that I plan to report instead.

5. Should I report my 401k?

6. Do I need to report that my ex wife gets half of my unvested stock for the next 2 years as it vests? Should I only report the amount of unvested stock I have after subtracting what my ex gets?

7. I'm hoping that I should be able to include my total income without subtracting amounts that I pay my ex. Either way, the amount will be plenty, so I don't have to worry about that. I just think that payments to an ex are like debt that they don't care about, just like other debt. If they want that info, they can get it from my divorce decree. Things would be a lot easier if I just reported my W-2 income and didn't have to mention my ex or subtract her amounts, especially since the amount is high either way. What do you think?

8. When reporting my house value and mortgage, do I only report half since my ex gets half when it is sold in 3 years? Maybe I report the total value of the house and then put my ex's portion as part of the mortgage, leaving a difference matching the value I have in it?

9. When reporting life insurance, what do they mean by cash surrender value? I have life insurance equal to 5x my annual salary through work, 3x of which goes to my ex, and the other 2x to my father to give to my fiancee until she gets a SSN. I think the full value is given out if I die, so is that the surrender value? Do I put the full value as both the insurance amount and the cash surrender value?

hi i just wondering if visa interview fee is now only 6,100 pesos? coz i paid mine today and the teller only asked me to pay 6,100 for K1 interview fee...
i thought it was $350 ??? do they have promo now?? lol i dnt wanna have problem coz of this..thanks

My fiancee just paid 15,400 pesos about a week ago. I wouldn't believe them. Pay the $350.

As everyone above has stated, you can go with just the NVC letter and case #. My fiancee recently did this for the same concerns as you have. See our timeline in my signature.

Make sure to make copies of your passport because they will keep it at St. Lukes. You may need the copies for other reasons before you receive the passport back.

does the address really matter? coz i really cant do anything on the address of the letter of intent i sent my fiancee.

It's too late to send her a new one now, so hopefully it won't matter. To be on the safe side, why not make another with the right address, scan it, and email it to her. I know it won't be an original signature, but if combined with the other one, you may be less likely to have a problem.

I know this is an old post, but my fiancee went to the Brunei embassy in Calgary today and they said it would be $40. and a 3 to 4 month wait! I really hope what they told her is wrong, and the http://travel.state.gov info of 2 weeks is right!

Wow. Three to four months? Mabye your fiancee can have the interview without it.

In order for my fiancee to get her police clearance from Brunei, she had to get a request letter from the US embassy in Manila that it was needed. To get this, she had to wait for her case to get from the NVC to the embassy. They would not give her a request letter until the case was already there. Once the case arrived, she received her request letter from the US embassy and gave everything that was needed to the Brunei embassy. We went ahead and scheduled her interview, hoping the police clearance would come in time. When she went to the interview, she still hadn't received the police clearance. She showed them that she had requested it, but just hadn't received it yet. They passed her without it. The funning thing is, when she got home that day, the police clearance had just arrived.

I'm in the same situation as Chris regarding sufficient 2007, 2008, 2009 income, and insufficient 2010 income, but did start a new job late 2010 that will provide sufficient income moving forward. Unfortunately our interview will definitely be after the April 15 tax deadline, so I'm also wondering if recent paystubs, along with an employer letter stating that I'm in a full-time/permanent position would be adequate. I hate to risk not showing any tax returns (although supposedly not required), but if I do, I will need to show the insufficient 2010 tax return as well. Any more thoughts would be greatly appreciated.

I never said you did say there was a consulate in Cuba, but we were moved to the consulate forum. Whatever is best, but perhaps Cuba can at least be listed under the "embassy info" tab?

The "embassy info" tab has embassy, and consulate information for most countries, but omits Cuba. It was very hard to find, and as far as I can see, one can only find information on the US Interest Section in Cuba through the Cuba Portal under the "consulate info" link. Maybe there would be a better showing of Cuba members on VJ if Cuba was added under the "embassy info" tab too. Thanks, I'm not knocking you. It's just a suggestion, and I assume you're an administrator on VJ. Please forward, or let me know who to forward this suggestion to. I think it would help.
