Well I just called USCIS and they told me that I needed to wait for an RFE if they need the bank statements for proof I was there, in his town, in the last 2 years. There is no way of sending it now. So I guess I will wait.

Rob & Monika, it is hard to prove when you are not thinking ahead. I never dreamed that a few receipts that I could have kept when I bought something at the grocery store or when I bought things for my kids while I was there would be so important. Since I can use my US currency there, it makes it easy not to go and have monies exchanged and such. I too stay with him to cut down on costs and because we don't want to miss a minute apart.

When you go to visit the one you love, visas, proof, and such(for the future) never really enters a persons mind unless they already have it set that they are going to be petitioning for a visa. It was all about spending time with him. Now that we are in this process, I see that all those little things are evidence that I need.

I just wanted to point out that you will probably need the regular passport book eventually.. they will need to put the visa in there..



Actually I am the USC so I wont have a visa.. but, that is definitely a good point if I was needing a visa. :)

I had the exact same thing happen with my K1 petition, except that my pics were date stamped AND we held up a local newspaper to prove the date like kidnappers do. We were just asked for evidence at the end of april, and in it they said that any pictures are considered secondary evidence anyway. But apparently any debit or credit card statements from the petitioner showing purchases made in Canada from when he came up to visit me (not ones where I went down to see him, since Im not the petitioner) that show the city and country, date and his name on the statement are considered primary evidence. If I were you I would have whoever the petitioner is call immigration now and say that you noticed you left something out and ask if you cant send it now. It would hopefully save you from the grueling process I am in.

That is what i was wondering about because I have used my debit card there every time I have been there, just not a lot and my bank statements have my name and it shows everything. Hoping they will let me send it to be added to my file for when it is ready to be reviewed :)

You're doing great, so don't worry. Bank statements are very good proof, if it arises. They might just call up CPB records and see your entry/exits (which I think they can and do do). You used to be able to visit Canada without a passport, so if we want to look at things objectively, it's possible you saw him, say, 5 years ago and that is where the photos are from. I don't think passport issue date will be sufficient proof, but you'll figure it out either way. Good luck.



I would hope that they do call up CPB records because it will show that him and I are both flagged! They will see my entry times and it has also been recorded the 2 times he was denied entry with me because he was considered high risk for immigrating illegal because of our relationship.

They should at least help, because you need to establish being at the same time and space... Did you stay at a hotel? That should help too. It doesn't matter if the passport pictures look the same as the other, after all it does mean that you saw each other face to face..;. but yeah.. anything from the bank should help.

I have an additional suggestion, though. Report your own message to a mod and ask them to please move it to the Canadian Sub Forum.. I'm pretty sure you are not the first person to go through this.. because it's REALLY common for people to Canada to drive down to the US; so I'm almost certain that someone there may have suggestions and experiences to share with you.

thank you... we do have pictures of us together that I sent but they are not digitally time stamped. I did not stay in a hotel, I stayed with him.

It is a different situation since they started requiring passports several years back and to make it easier on us we can get the less expensive passport card. With that card, I can not travel by air, only cross a border by land.

hehe now to figure out how to report this posting... haven't figured out all the ins and outs here yet. :)

This is just difficult having to go back in time, when we really didn't expect to have to go through all of this. We were planning on him coming here to visit a few times, getting married here or there, then filing the appropriate paperwork. But then he got denied entry at the border. That is when I started researching everything and we decided that the K-1 was the best way to go. Lots of shoulda, coulda, wouldas now. **sigh**

I did write the dates on the back of the pictures that were taken in October of 2011. My passport was just issued in March of 2011, therefore the meeting in person could not have happened before that. I do not have passport copies with stamps because I do not have the standard passport book. My passport looks just like a driver's license and when I cross back into the US I just have to hold it out the window of my car as I approach the little border booth and it scans it electronically. I don't fly up there because it is cheaper to drive and I love the view.

For proof of meeting in the last 2 years, I sent the pictures. Probably wouldn't help any that we look exactly the same in our new passport photos we sent with the petition as we do in the pictures. Would my bank statements showing the debits I made in his town work when/if I receive an RFE?

Good idea about going straight to the bank.. I will do that tomorrow to have them ready.

Ok so I have been reading about the proof of meeting in last 2 years and I just ran across a comment that was made about photos needing to be digitally date stamped. I had never read that requirement before, only that I needed to write the name of the persons in the pictures, date taken, and place on the back of the picture.(which I don't many of and the only ones that had both us in them, I was in my pajamas *blushing*) Sent off my K-1 last month and am going.. oh geez I just know I will probably get a RFE... (yes I know I am paranoid) lol

So since I was thinking about this another issue has crossed my mind. If anyone else has dealt with the following, I would really appreciate any imput.

My fiance lives only about an 11hr drive from me and just about 45min inside the Canadian border. I never had a passport before meeting him so I applied for one with the intent of only using it to see him. Therefore, I got the land border passport card. I drive there, stay with him, use my debit card occasionally, but mostly I use cash. Never worried about keeping receipts, because I never anticipated doing the fiance visa. (This visit in July I will definitely do things differently! Lots more receipts, only using my debit card, and more pictures! This time to make sure I look halfway good and not in my pajamas.. lol)

So, here I am... no passport "book" with stamps, not much for receipts, no flight records, no hotel receipts and such. I went to get back bank records and my online banking only does 90 days back. Ugh!!

Ok.. I am done with my ranting and frustration :)

Canadayet another Evidence related question

I submitted photos of us together, dated on the back. I also had a few boarding passes from visits, but I wasn't confident that was enough. So I had 3 people complete signed affidavit letters stating that they were aware of our relationship and how long we had been together. One was a co-worker, one was a friend and the third was a family member. There was no issue and our I-130 was approved. Hope this helps :)


I was wondering about the letters and plan on doing them for our case. I can easily get those from a ton of people to prove ongoing.

I think the reason these questions are coming up about photos, is because when traveling by car you don't have all the copies of tickets and boarding passes. Also, it was stated in another thread on here that the photos were not proof alone and that there needed to be receipts and/or bank statements. Also photos, from my understanding, are only secondary proof to support primary proof. I too wrote names and dates and places on the back of my photos, but it was stated in another thread that they needed to be digitally stamped and not written on, another place stated that digitally stamped is not good because it can be faked.

There are to many different things that can be used and done and makes it very confusing to some of us who are trying to do everything perfect.

I totally agree with the posting above that stated you need to think like a lawyer! lol

Canadayet another Evidence related question

I hate to start yet another topic regarding this, but here it goes....

I posted this in someone else's thread, but it's gotten lost......I am in KY right now visiting my fiance and we are getting ready to submit.... I like other Canadians don't have really anything but pictures as proof. I actually thought about doing the "ransom" type picture with the newspaper and date as that really should work, but it seems like that isn't even enough.

I am not staying at a hotel so I don't have receipts, passport stamps or anything flight related as I drive. I guess my question regarding the whole just buy something so you have a receipt has me concerned.... how do they know I made the purchase? Anyone could have. I withdrew money here, but stupidly didn't get a receipt with that and when I look at my banking info it just shows up as a bunch of letters.... nothing stating that I made a withdrawal in somerset ky...

I've read so many threads regarding this and it seems like it all depends on the person who is working on it at the service center and what kind of mood they are in.

So what should I do? go make a purchase and submit the receipt with a printout of my bank statement? which will be off because of the currency conversion?



Someone had suggested phone bills with roaming charges..... I did go through and look at past bills.... I do have one from this past February that has roaming charges on it for brief convo's with my man..... it does state that I was making the call from Somerset, KY and his phone number..... will that help?


Again, I'm sorry for another topic on this. I just want to get my ducks in a row so we can get this out in the next day or 2.

Makes it very difficult to prove the meeting. I think it was on my thread actually that you posted this ;) From my understanding, now, you need to have the proof that the USC was in the foreign country as someone posted on my thread that they did not take into consideration the receipts and such of the beneficiary when they visited here in the US. Also, I am learning that you basically have to prove that you were in the city that the beneficiary lives in. Look for anything you have that proves you were there. Maybe your bank can pull a more detailed report of your withdrawal.. just a thought.

We will be having his interview in Vancouver as well. I will be going with him. We are hopefully getting close to that point. lol

If the question is about obligation under the I864, then termination of her status DOES NOT end the obligation of the sponsor under the I864.

 

The sponsor is relieved of the I864 status only if:

 

1.  LPR leaves the US permanently

2.  LPR dies

3.  Sponsor dies

4.  LPR acquires 40 quarters of credit under social security (this is where people get the ten year thing, but it could be longer than ten years)

5.  LPR becomes a US citizen

6.  LPR obtains a new adjustment of status (ie, someone else provides a new I864 to support LPR through a new process)

If she doesn't go, than eventually her petition will be denied, status terminated and she will be asked to leave US.

 

If you go and divorce later - depending on when the divorce happens - she may need to re-file with a divorce waiver or she will just get 10 years green card. Your responsibilities remain the same as long as she is LPR - if she does not remove conditions and her status is terminated, then obviously your sponsorship ends.

 

I think that is pretty correct, but how long are removal proceedings, and when do they start (i.e. deportation)?  I do not want that to happen in any case.

 

That is kind of what I was looking for (in an informative way...not negative).  Would Sponsorship end if conditions aren't removed, and residency expires?...Thank you.

 

Cuba is a problem though, as they are the only country that has "wet foot - dry foot" policy.  I'm not really concerned about that though in our case...she misses Cuba too much.

I understand that it's her process at this point.  However, my wife doesn't know how to drive, even given the driver's manual in Spanish, and some parking lot practice.  I would need to drive her, or a friend, or a taxi.  I don't think she realizes the consequences of missing biometrics, but we are having spousal problems.  Maybe she just wants to get "out of town"...Cuba.  I speak Spanish...language is not the problem for communication with us.

I'm a US Sponsor who brought my Cuban K-1 visa fiancé/bride to the US a couple years ago.  We are looking at divorce.  We are in the middle of "Lifting Conditions of Residency"...actually this afternoon (Pacific Time) she is scheduled for a biometrics appointment, but I don't think we are going to go.  What happens if we don't go?  What happens if we do go, and divorce later?  What are my responsibilities as sponsor...10 years still?  What if she just wants to go to Cuba, and not come back to US?  Is there a release of responsibility for sponsor, or can the conditional residency/green card just run out of time?

 

Time is of the essence :).

Since when is it illegal to get a BJ? Does it matter if the person is a prostitute (in this case it was not)?

Maybe it is illegal to pay for one, but a free one?

I read somewhere here that you can send the N400 within 90 days before your 3rd year anniversary, I don't know if I got that right but at the same time I need to send my application for removing conditions by July is that correct?


November 2007 - got married
October 2008 - "resident since" on my permanent resident card


And also my son as a followed to join K2 has different permanent resident card expiration obviously because he followed me after a year, his card expires at October 2011, what's the best thing to do? file the removal condition the same time as me or wait until the 90 days? He's 10 year old by the way
