K-1 Fiance(e) Visa Process & ProceduresPolice Certificate

my fiance lived in her town since for like 1 year at 16, then she moved to another city (all russia). But right now she lives with her aunt and attends the university. It is not her apt and no bills are on her. The only thing is the university. What you guys recommend. I hear police certificates expire? If she gets a police certificate from that town will it expire by the interview date?

Its really too early for you to start worrying about Police certificates.

K-1 Fiance(e) Visa Process & ProceduresFinally!!!!! Petition approved!!!!!!!!!

Hi Kara!
I'm so excited for you getting your approval! It's been 141 days for me desparately hoping to get a sign of life from CSC about my fiance visa (NOA1 01/18/06). I was wondering what you meant by "touched". How do you know it's "touched" and where do you find that out?
Thanks for any and all help you can pass my way!!
Carm

Hi guys!!!
I'm so freaking excited right now! There is light at the end of the long, dark CSC tunnel! I just got 8, yes, 8 emails saying that our petition for our fiance visa was approved yesterday! Honestly, it's about time! I had recently emailed CSC and they told me not to contact them for another 45 days and I also contacted a senator but hadn't heard anything back. Needless to say, I wasn't really expecting this now but hey, it's really great! I know there are a lot of people still waiting out there - it took 125 days for this approval to come. Hopefully CSC will keep on moving. Best of luck to all and thanks for letting me vent along the way!!!!!!! Have a great day!
Kara

Can you fill out your timeline information Carm? It makes it easier for people to assist you and is helpful in compiling statistics at VJ.

Does this mean everyone will have to do this or just those past March 6th? Sorry but I was wondering.

You are not affected since you filed long before March 6. Have you contacted them regarding your long wait time? On May 26 you were at 120 days - isn't that the date when you have permission from the gods to contact them and ask them what the hold up is about?

Actually no. 120 days holds no significance. Your NOA1 must have been 30 days prior to the 'date being processed' on the web site.

I recieved a touch today which was the first time my case has been 'updated' in 126 days. My case is still in Nebraska.

I recently contacted my congressman so I am sure it is simply them pulling my case to tell his office what is happening with the case, but I am excited that at least I will know something soon either way! It also goes to show if your case is moving slow it is worthwhile to contact your represenative.

How long after you submit your petition would you suggest someone contact a congressman?

Personally I suggest waiting until after your NOA1 date gets passed by the processing date on the USCIS website.

A little update to this, I called my congressman's office and the man there who checked on my case said there was nothing unusual with it, and I should expect some action soon! He said if there are special security checks being doen they usually tell him that, and they didn't say anything. My guess is somehow my particular case was misfiled or something and I am crossing my fingers for good news soon !!!

My guess is you will get some response from one of your fiance's represenatives and have an answer as to why you have waited so long very soon. It is quite possible from reading your timeline that you are in extra security checks. I know the touches are from emails, but it still means someone pulled your case so it is likely not lost of misfiled. I have a feeling you are not being put 'behind' anyone at CSC.

Anyway, good luck and I hope you hear something soon !!

You know it Taye, all the way for the good guys, but if Carolina wins well at least 80% of the players are Canadian.

Darn 1 -1 now

The actual percentage of canadian hockey players in the NHL is 53.7 for the 2005-2006 season.

I was meaning that the Hurricanes have a higher % of Canadian players, I believe there are 17 of them.

And who cares cause the Oiler won, and as Ron said "You may run out of gas but you don't run out f oil"

K-1 Fiance(e) Visa Process & ProceduresAccused of rape
I really want to resist adding this, cause I know it will get flamed, but I feel I have to.

Men and women have a problem with jealousy. It is equal. However, there are women out there who will take advantage of the court systems to lash out at a former lover. The laws and the court systems are set up to be sensitive to women. I'm not saying they should not be that way, I'm saying there are women who use this to seriously hurt a man, and its not fair. I'm suprised there are many people out there who will not acknowledge this.

Rape is serious, and like the case meauxna talks about, prosecuters are hesitant to disregard any case. To me, this is an issue men have to deal with that tends to get swept under the carpet.
ChucklesMaleRussia2006-06-17 11:21:00
K-1 Fiance(e) Visa Process & ProceduresAccused of rape

To the OP, I agree with everyone who said that since this was not a conviction it should have no bearing on your case. I was as surprised as you were at the reactions you got here. I don't know your back story, but what reason should you have to doubt your fiance? Good luck to you.

I just thought I'd mention the Duke rape case here.....Is there anyone who thinks that that wasn't a false accusation??? I do believe it happens all the time.

The Duke case is strange. If it was completely false, I would have thought she would have confessed by now because all the press coverage. Anyway, what were those boys doing with a stripper in a bathroom? Somehow I think they are guilty of at least major stupidity.
ChucklesMaleRussia2006-06-17 11:12:00
K-1 Fiance(e) Visa Process & ProceduresAccused of rape

False Accusations

For those of you that believe women DO NOT make false accusations of sexual misconduct, or believe that women are not capable of lying about such things, perhaps a little light reading will help you realise that is not always the case.

I hope it all goes well, Nat, and that you and your fiance are very happy.

 Can't find a post that states women don't lie, but then men lie too.

8% false accusations doesn't impress me much, 92% truthful accusations and factoring in all of the cases that go unreported my guess is rape is a huge problem vs the few women stupid enough to make false accusations to get even with a man.

B

In fairness, that number is estimated at 60% by that study. If that is the case, it sounds like a serious problem to me.

"The McDowell team did in fact address these questions in follow-up studies. They recruited independent reviewers who were given 25 criteria derived from the profiles of the women who openly admitted making a false allegation. If all three reviewers agreed that the rape allegation was false, it was then listed by that description. The result: 60% of the accusations were identified as false. McDowell also took his study outside the military by examining police files from a major midwestern and a southwestern city. He found that the finding of 60% held (Farrell, 1993, pp. 321-329)."

I just think this law is complete baloney! Yahoo Personals and Match.com also charge money to facilitate contact between 2 people, why are they not required to check people's background? I don't get it!

Yahoo and Match.com become exempt because they are not solely for international marriages.

You are at the K1 application stage so don't worry about it. Just be honest when answering all questions. For the amount of pain in may cause you now it will save you 100 fold in the future if you 'lie'.

Thanks for the clarification. I'm not quite sure what "marriage broker" means. Is it the mail order bride websites? Yes, in my case it was just a regular personals website that facilitated the initial contact after which that website was not invovled further of course.

It has to be a site specifically for international marriages. For example, the site would not accept a profile from an American man/woman. There is more, I wish I had a link handy. Your case may still fall under the IMBRA law since you did in fact pay a fee for contact information.

I suggest you look at it closer.

Here it is.

"If you met your fiancé or spouse through the services of aninternational marriage broker, you must notify USCIS ofthat fact by answering Question 19 on this form. The term?international marriage broker? means a corporation, partnership, business, individual, or other legal entity, whether or not organized under any law of the UnitedStates, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between UnitedStates citizens or nationals or aliens lawfully admitted tothe United States as lawful permanent residents andforeign national clients by providing personal contactinformation or otherwise facilitating communicationbetween individuals."

K-1 Fiance(e) Visa Process & ProceduresNOA2 !

Congratulations to you.

I am curious however, why there are no questions as to whether or not there was Congressional intervention in your case, or was it pure coincidence?

Also, what is the rationale for some cases being moved to CSC, while others remain in Nebraska?

For those of us now in CSC purgatory, I am surprised indeed, in the lack of interest in understanding this debacle.

In any case, I offer my sincerest congrats on your release from Governement red tape. Best of luck to you and your future wife. Long life and happiness to you both!

I recieved this after contacting congressman. I recommend this if your case is being slow.

I cannot prove whether or not contacting my congressman and subsequently having his office contact the USCIS is the reason my case was reviewed and approved. However, nothing happened to it for 120+ days, and then all of a sudden I contact my congressman and it gets adjucated? Hummm... heh.

My assumption is my paperwork was lost or misfiled, then the my congressman's office called and they searched and found the file 'for him'.

As far as my case not being transferred to CSC, I believe it was the intent of NSC to adjucate all petitions that had an NOA1 date prior to March 6, and send the rest to CSC. My NOA1 date was Feb.9, yet another reason I believe they misfiled or misplaced my file.

If they handle RFE's in the same manner as they have handled them in the past, those who get RFE's will not be put at the bottom of the file after returning thier requested evidence. From reading these boards awhile, they seem to recieve your evidence then pull your file right away for re-adjucating.

So, the answer to your question is you will not be put ahead of those who got the RFE for the old I-129F.

At least as far as I can tell...

I have heard a rumor that California will become the Service center for all K1 visas. That is why Nebraska K1's where transferred there, not because of backlog, and that other types of non-immigrant visas will be moved from California to the other service centers.

You know... when I sent my petition off I used a UPS store. They asked me if I wanted to send my package to the physical address instead of the P.O. Box. They looked up the address for the NSC and gave it to me.

I guess if you really wanted to, that would be one way to find the address!

I think your evidence is good. You have a hotel reciept that shows you both at the same place. A plane ticket and reciepts that show you where in his hometown, with pictures to back it up. If you read the 'letter' of the rules, you only have had to have met within the last 2 years. You do not need to show anything other then intent to marry after that. In other words you did not have to have lived together or anything such as that.

I know how it is, you did not necessarily plan to file a K1 when you were visiting so you didn't really pay much attention to saving reciepts and pictures and stuff. I suggest the next time you guys get together you make a conscience effort to keep reciepts/documentation and such for your interview when you show an ongoing relationship because they tend to want more. Of course your interview will be much further down the road, but I wish you luck on your journey!

K-1 Fiance(e) Visa Process & ProceduresCase transferred from Nebraska to California
Someone previously posted a letter they recieved from their congressman about nebraska. I will cut and paste it here:

"Here is the response that I received from my congressman, today:

"Thank you for sharing with me your thoughts regarding immigration issues.

The legislation to which you referred, the International Marriage Broker Regulation Act of 2005, was not considered in the House of Representatives as a stand-alone bill. Instead, it was included in a much larger bill, the Violence Against Women and Department of Justice Reauthorization Act of 2005, which was approved by the House by a vote of 415-4 on September 28, 2005, and was signed into law on January 5, 2006.

Per your request, I contacted officials at the U.S. Citizenship and Immigration Services (USCIS) service center in Lincoln, Nebraska. The Nebraska service center accepts and processes the applications and petitions from people residing in Minnesota, as well as Alaska, Colorado, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Missouri, Montana, Nebraska, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin and Wyoming.

According to USCIS officials, there has been a slow down in operations at the Nebraska regional service center because of an ongoing reorganization of USCIS field offices. Currently, the USCIS four regional service centers, as the name suggests, process visas and petitions filed in the states within each of the centers’ assigned region. USCIS is restructuring its regional service centers so that each center specializes in certain types of visas and petitions. For example, the Nebraska center processes petitions for alien workers filed across the nation, rather than just in its own service region.

Unfortunately, while USCIS continues its restructuring efforts, we can expect to see more delays. USCIS officials are hopeful that once the reorganization is completed, the service centers will be able to process visas and petitions more quickly and efficiently.

Rest assured that I will continue to monitor the situation."

Perhaps this has come to pass. You will notice there are cases before March 6 that have been tranasferred (though not mine oddly) so that rules this out as an 'IMBRA thang'.

If this is the case, California should not slow down because some of its workload (non-immigrant visas?) has moved to Nebraska.

Thanks everyone for all your kind words. Jon called one of his senators today and they recieved his request for help, information. K-1 Fiance(e) Visa Process & ProceduresService center reassignment?

I'm from Utah and my assigned service center was Nebraska so I sent my I-29F there no problems it was received and I got my NOA 1 from the California service center.

Was I reassigned? or am I still being processed in Nebraska? just a little confused.

ALSO.. how fast do the processing times on their website move? They are processing applications received Februay 15 (today is June 27) does this mean it will probably be 4 months until they reach ours??

sorry newb questions trying to read so much still only halfway through sawasdee 2.

You will want to check out the IMBRA forums here. IMBRA is a new law that is slowing down processing temporarily for K visas.

Anyway, to answer your other questions the date they list on the website for processing applications is just a general guideline to follow. They update it every 2 weeks or so, but if you ask people who have been looking at them a while, they are not reliable dates. I highly suggest you do not make any concrete plans based on them.

As for 4 months for your NOA2, that is not a bad guess. It could be alot less, it could be alot more.

Nebraska is currently not processing K1 applications and that is why yours was sent to California. It happened to everyone so do not be worried.
ChucklesMaleRussia2006-06-27 16:02:00
K-1 Fiance(e) Visa Process & ProceduresWhat do you do about a meeting with no proof?
It needs to be mentioned that photos are considered secondary evidence. By themselves they really carry no wieght. But if you can tie them to something else they are usually good.

I have not put much thought into what sorts of evidence you would supply if your fiance is Canadien. I imagine that is hard since in general you can just cross the border without any fanfare (no visa, boarding passes, etc.). Its a challange I suppose. If you haven't filed the I-129f yet maybe make a visit and be sure to get lots of reciepts and other evidence.

You might want to check the Canada forums on here as well. Good luck to you.

Once my I-129F gets approved, how long could the wait be?
Is there anyone who has brought their fiance over from Russia?

Well, I am at that point. Having asked around and done some research, I would say expect an interview date from 3-4 months after your NOA2 date.

There are many factors that go into that, and can alter that, but I would say that is a good guess. But remember... it is only a guess! :D

K-1 Fiance(e) Visa Process & ProceduresIntent to marry...

Some website guides for the K1 application suggested that along with the letter of intent to marry we should also show proof of planning a wedding for example: Banquet hall receipt, Engagement/Wedding ring receipt, photographer contract...etc.

We sent these receipts with our K1 Visa application...did anyone else do this...if so did it speed up your process being that you have a set wedding date?

Quite simply, all that is required is the letter of intent. You actually can slow the process by sending more then that. They will have to look at more evidence, and may get confused and think you are already married.

Also, I hope very much that you have researched how long it takes to get a visa from the DR consulate. I have heard the wait there can be years. I certainly think you should not be making wedding plans at the moment.
