K-1 Fiance(e) Visa Process & ProceduresReceived a confusing email today

Last night I checked the USCIS website and it states my K1 petition was approved. Still have not received an email or sms on the matter.

I had emailed the CSC a few days earlier asking for status update, never thinking I would get a response. Well, just now I did receive a response which says I should hear an answer regarding my petition in 21 days.

So, this is just another case of someone at the USCIS not knowing what's going on, right? I mean, the website says approved, so it must mean approved. Am I thinking too much into this? :wacko:


No worries, and congrats! You should receive your NOA2 within those 21 days, I guess, but you'll probably get it much sooner than that. Btw, with USCIS, the left hand does not always know what the right one is doing. I remember some people in our K-1 filing group signing up for email alerts and NEVER receiving any alerting them to their status. They simply received their NOA2s in the post.

So don't ever freak out unless you receive a letter telling you to (denial, removal, RFE), and even then ... stay calm and know that there are people here to help you when the ish hits the fan. x

We would go for the CR-1 but we are in trouble with the time: My fiancé arrived in Munich at the 29th of February and will depart at the 29th of August. So there is no time left to apply for CR1 via DCF in Germany. Should he do it in the U.S. or would that take much longer? What do we do now?

Hi Tanja,

My advice: have your fiance file K-1. My hubby and I were together for just three months before we got engaged, so the 8 months we had from engaged to receipt of K-1 visa gave us a lot of time to collect ourselves, build the tools we would need in our marriage (patience, trust, etc.) and have a proper engagement. We figured, if we could survive K-1, we could survive anything, haha. So far, the endurance training we've gotten courtesy of USCIS has kept our little marriage happy through unemployment and all of life's other little disappointments, LOL. Btw, you don't get your EAD (work authorization) until after you file AOS, and then it falls somewhere between Biometrics and We'll Send it To You When We Feel Like It.

What exactly does he need again to get to the US?


Just himself, his passport, the notorious brown envelope from the medical (which goes to Immigration at your fiance's point-of-entry), and his K-1 visa (along with personal items and clothing, of course). When the time comes, Adjustment of Status filing secures his temporary EAD for work. Btw, my husband still keeps his Lloyds account active in the UK, in addition to having a bank account here in the US.

If you're in a position to make as much money as possible while your fiance awaits his visa, then I think that's rad. You and your fiance still have the medical and the actual visa to pay out for, and then there's the wedding, and then the civil surgeon for transcribing the medical, and then AOS! But you'll get through it, and look back and wonder how you ever made any of it possible. x

This K-1 is for your fiance to come to the States, right (sorry if that sounds dumb; trying to get the gist of your question)? If so, his unemployment is irrelevant (my now-husband left his job just prior to coming to the States), but you'll need to secure a sponsor for the Affidavit if you cannot sponsor the petition yourself, and that sponsor would need to provide the paystubs and other supporting documents. As you are a dual citizen, you should have no problem resuming your old job in Florida (entering the country with your US passport).

Your fiance, the beneficiary, would remain in England to do the medical and interview. I think some fiance(e)s do come to the US on tourist visas/VWP to sit out some of the process and return to their countries for the rest, but others here are more knowledgeable in that area than I am. My hubby and I spent four months apart from filing to visa.

- Clearly from the advice we have been given, we should not have any party or anything that might complicate or concern USCIS or the consulate during the Visa process

Have an engagement party! My husband and I had one at his local pub before we came back to the States to get married.

- That said, would they frown on making plans? i.e can we buy dresses, consider booking venues etc albeit with the knowledge that we might have to cancel if we run out of time.

Go ahead and make all the plans you can. We bought our wedding clothes and rings, etc. Make sure you book a place with a good cancellation policy.

- More realistically though we are now thinking it is best to do exactly what you said. Wait till we have the Visa, use it asap because our priority is be in the same place! Then have a small wedding and start planning the big party for some point in 2014.

- To answer a few other queries, she is based in the US and I am in the UK, and our application got NOA1 at VSC just before Christmas.

- I have seen that VSC is currently processing at 6months on average, hopefully if we dont make many mistakes August-October is a realistic time frame for completing this process therefore.

- I noticed some people who applied in July last year got their Visa by November, 4months for the whole thing! What happened since then!!!

We were CSC; took us four months from filing to K-1, so keep your chin up, hun.

My fiance and I submitted our initial K1 petition before the Christmas break. I am the sponsor, UK nationality so going via the US embassy in London. Although we are early in the process we are trying to plan our wedding later in the year (end of August) and had a question about a possible problems that we thought we should check.

Oh honey, welcome to USCIS time. Where they do what they want, when they want and how. I would wait until you have visa in hand (or at least an interview date) before making wedding plans. I wouldn't even have a "ceremonial" wedding. Even if you pull it off and get your K-1, you still have to get through AOS. Happy engagement! x

Cancel the petition and also send an email to the Embassy in DR telling them to send it back and why you are canceling ( he got married to another American).

Send them the new photos. Even though they're new, at least USCIS can no longer say you haven't met, ha ha. Throw in a few affidavits from family and friends if you can, and I would provide all that other proof you've got as well, even if they didn't ask for it. It wouldn't hurt.

 

And no worries, honey. RFEs happen to the best of us, but we get up and over. x

OP> It is best to get them done at or prior to your K-1 medical so you can have them marked off on the DS-3025. If you get all the required vaccinations for AOS and they are marked off on a properly filled out DS-3025, then you will not need to go through the hassle of trying to find a civil surgeon that will not insist on giving you a new medical and/or overcharging you.

It happened to my K1 petition last year too. the deny base on my visit to my wife only 5 days, no engagement ceremony. Base on my experience, you got to front load lots of evidence when you filed for K1 at USCIS. For my case, the deny was on November 2010, I have to wait 4 months for the petition return back to USCIS. however, when the case got to USCIS, it was ex expired because the K1 is only 4 months period for visa. USCIS told me to file new form at my cost. I filed I-130 form on March 2011. My wife will have the interview on this coming November 16, 2011 at Ho Chi Minh city. You have to wait for the case back to USCIS. you might appeal with the deny but as I told you by the time your case get back to USA it will be automatically expired, Good luck for your new file. make sure you have to write your timeline more detail, collect all of your evidences together with your new file to USCIS otherwise they will send you RFE request for more Bona fide marriage relationship. I file I-130 on March 2011, I received RFE for bona fide relationship evidences because USCIS agent told me my wife was approved for K1 by their agency but the CONSULATE at HO CHI MINH city deny base on the evidences we provided are not real at our claimed relationship.

Ok so I log on to the USCIS site, put my case number in and it says the same thing, recieved and pending, how the heck do you know if it's been touched? There is no dates stamp on it except for the date it was recieved.

We recieved our NOA2 on Oct 22,2007. I just called the NVC to see if they recieved it and the guy told me to wait 2-4 weeks or up to 90 days! This seems like a long time compared to others just for them to recieve it. It is so frustrating how slow they are moving.

If you're just starting your petition you should provide photos and proof that you have met in the last 2 years. Passport stamps, boarding passes are all good evidence. I don't think my fiance and I even included chats in ours. We travel to each other so often and travel to other places together, we were able to give a lot of evidence that we were together (in my city, his city and other parts of the world). 

 

For our interview, I took a tonne of pictures, chat logs and even things for our wedding (our invitation, our own wedding website, contracts in both our names from vendors, and cards addressed to both of us from family members to congratulate us on our engagement). None of these things were looked at (maybe except for 1 or 2 pictures) at the interview. They asked a series of questions and they were very easy, it's things you should know about your fiance and no trick questions.

I just got the yellow envelope from the embassy in the mail, but my passport is inside. Wont I need it when I travel to the US? I'm scared to open the envelope, it has a thick tape on it, but it doesnt say 'Do not open'.

After a lot of discussion my German boyfriend and I are thinking it would be financially best for us both to get married in CA then have him go back to Germany and file for CR1. I have concerns about evidence however.

1. I don't have medical insurance so can't place his name on policy I don't have.
2. 3 years past taxes all are joint married to my ex-husband. (Our divorce will be finalized in April 2013 as it takes 6 months in CA for divorces to be finalized). Will this cause problems??
3. in CA and with my bank, we would need an SS number to add him to my bank account or open a joint one so I can't add him or open one together because he doesn't have an SS number.
4. We want to get married in vegas, a small ceremony with just him and I. We would take photos and stuff but we are not into flashy big wedding thing.
5. He and I have been together for almost 4 years now so we've had ongoing relationship and have spent 4 weeks together here in CA, would this help our case?
6. I do own my own car, is it possible to add him as co-owner? Or would he still require SS number for this?

I'm thinking of trying to find lawyer to help because it feels so complicated and we don't want to risk anything going wrong especially after being so long together miles and miles away- we want to be together finally!

Any advice would be grately appreciated.

I originally thought I would just hide this news in a few posts (as I get a bit shy), but I'm posting it because reading other CSC Jan/Feb. '09 approvals helped me track how fast the CSC was going through newly filed petitions (in the meantime trying not to get my hopes up, LOL - John and I thought it could just be pure luck), and I'm thinking others might be doing the same.

So add another NOA-2 to the list for CSC! We got our NOA-2 one month to the day we got the NOA-1, and received the hard copy in the mail tonight - and btw, no email notification or change in status online.

GO CSC!! I always like seeing all the happy posts on VJ ... and now here's mine *blushes* smile.gif
