Since I can't edit - stop paying attention to that website. Vancouver will send you a letter. In that letter will be a link to the packet 3 checklist. It likes to glitch with Vancouver/Montreal sometimes.

If it starts with vac it's going to Vancouver. You're fine.

 

Thank you! That's what I thought. I thought I had to fill out the DS 160 first before securing an interview? so when it said "interview set in Montreal" I was so confused!

An addition...they usually send you the packet four stuff electronically (email)

 

I'm not sure, I thought NVC would be sending it to Vancouver. I have emailed them but will likely take a few days. For now, I will start on the DS-160 form. 

 

The NOA 2 notice that my fiancé (petitioner) got in the mail said that our Visa Unit was the one in Vancouver.

I checked our status on CEAC and it says that my interview is scheduled in Montreal. I live in Vancouver and want to change my interview to Vancouver. Is this possible?

 

I haven't received packet 4 yet. Last week, NVC gave us our case # and said it was in transit.

I guess that might make sense, because when you move, it is no longer your primary residence...however, I would say that might not be 100% accurate as the K1 is not an immigration visa (despite it clearly being our intent)...if for example, you returned within the 90 days, that wouldn't be a "relocation"...the 183 days just sounds like 6 months after you become a non-resident.

 

My house took 4 months to sell, and while it wasn't a "loss" (i.e. I was able to pay my mortgage and realty fees) it certainly wasn't what I'd hoped.  We dropped the price 4 times based on what was happening in the neighbourhood, and gave up on Open Houses unless someone on the street had one too.

 

In any case, if the sale is after you relocate, it is still Canadian rules, and you may wish to consult with someone with international tax experience (not saying your accountant isn't, but mine advised me to see an international tax specialist when tax time rolls around after I move).

Like someone else said above, depending on the market, I may just stay in my home a month or so later. I still have 6 months from the date of my medical to use my K1. I would be OK delaying my move for a month and a half or so to just limit any complications. 

 

My home is in the heart of Vancouver. There's a lot of speculation that sales are starting to slow down, but the numbers show that houses are still being sold. Given my home is in good condition and in a good neighbourhood, I hope it takes only a few months to sell. :)

 

You're right thought. Technically the k1 is not considered an immigrant visa. So if I were to move before the sale of my home, I should have some grace period, since I have 90 days to stay in the US and get married or return home.

Sale of your primary residence isn't taxable unless you also used it to get rental income within the last year.  People sell all the time and switch to rentals (move into apartments, nursing homes, etc.) - that is perfectly allowable.  If you had been renting out part of your home, or had business use, it is different.

 

I researched when I sold my house last year...in anticipation of relocating, not realizing I'd be homeless for months waiting for the visa.  Oh well...

 

Thank you! No, it has never been used as an income property. It's my only home and primary residence. 

 

The only concern is if I can't sell it before I leave. My brother can house sit for me, to make sure that it's not vacant and won't get broken into, but won't be paying for my mortgage or 'rent'. I asked my accountant and he said I have 183 days to sell when I relocate.

Well good luck!! As far as once you get your packet 4, they're booking the interviews for may last I checked. So that gives you some breathing time. (Although beware dr cheema is unavailable for a good chunk of may!)

My realtor gave me an idea of where I should list my house at. I'm surprised? it was slightly higher than I thought, but he said that listings aren't sitting that long. Which is great news for me! :) I haven't listed it though? I have to travel for work for 2 weeks, so it's putting a bit of a dent in my plans!

NVC has sent our packet 3 out. So I'm just waiting for it to schedule my interview. I've held off on doing the DS-160? from what I read, doing that online will get packet 4 sent to me where I'll be able to schedule the interview. If I can schedule it for late May or early June, that would be ideal. It'll give me a few months of it on the market? My realtor had a 1 bedroom condo in a less desirable area and it sold within 3 months. So hopefully, with mine being in a pretty good location, it'll go quicker. Who knows, the buyer may be willing to work with me so their possession date is close to when I move to the US. 

 

I'm hoping to list in the next 3 weeks. I have a lot of clean up to do and staging? If it sells earlier, I'm not worried and will have a place to stay.

Nope I'm still in Canada. Put things on hold waiting for the house to sell. Just figured it was easier/less chance of the house getting trashed than dealing with renters or what have you. Now it finally did (yippee) and I've got the stuff booked in Vancouver for may. (Consulate is pretty good if you contact them and say here's the deal the house hasn't sold can I put my petition on hold for a bit)

 

I might just have to do that if I'm nervous. I'll be listing next month and hope that it sells quick. I am in Vancouver and real estate hasn't really slowed down, so I've been told.

I'll be honest. Not sure how irs would see it. Just sold my house (after a flipping year, I hope you're in a better market than me!! And yep, I took a loss too. So much for my rrsp's...) and I didn't even think it would affect my taxes - as it's a primary residence and not an income property. Hopefully someone else can chime in as well.

 

Did you sell it while you were already in the US?

 

I've been told, as far as Canada is concerned, it shouldn't be a problem. I believe there is a 1-year leeway, as far as pro-rating the principal residence exemption allows. So if I sell at a loss, there is no gain. So no needing to claim it as 'income' in Canada because it's a primary residence. The kicker will be how the IRS see's it? 

 

I'm trying to sell, but even though I live in one of the major cities in Canada, it seems to be a bit slow. But they have said the 'bubble is bursting' these last few years. There are 2 bedroom condo's in the low-rise beside me going for $450,000? doesn't sound like it's bursting to me yet.

Sorry for the multiple open threads today? I must be in a 'tying up loose ends' mindset. Every answer seems to open up another question. 

 

I have listed my house. It is my primary residence. What if I don't sell before I move? My realtor is a family member and I can temporarily have a friend, who is like a sister to me, stay in the house until it sells. I will be paying the mortgage still, but at least it's not a vacant house where someone could break in, etc.

 

I've been told that on the Canadian side, since I will likely be selling it at a bit of a loss and that it is my primary residence, I won't have to claim capital loss on it in Canada. If I sell 2-3 months after I move, how does the IRS see it? What will I have to claim immediately or do I wait for tax season?

CanadaVancouver - can petitioners attend interview?

Yes, petitioners are allowed.

 

My fiancee (beneficiary) and I (petitioner) went to Vancouver together in February for the interview, and everything wen't very smoothly. There is a sign out front on what you cannot bring, so follow those rules. Also, they won't let you into the building sooner than 15 minutes before. You won't get to your appointment on time because of the wait in the lines, but you'll be fine. 

 

Thank you! Do they get to attend the interview with you? Or are they just allowed to stay in the waiting area? I'm completely comfortable going on my own, but my fiance wants to attend to support and answer any questions they may have. With all the upcoming expenses we have going on, I don't want us to pay for him to fly up here to just sit in the waiting room.

CanadaK-1 Visa Packet 4 - How long will we have to wait to receive?

So we got an email back from Montreal that said they did not receive our packet 3, even though we got confirmation that it arrived at the Consulate.  Our lawyer also sent the packet 3 via email.  Has anyone had this experience and is there any way to contact the consulate directly for matter like this.  I am so utterly furious I cannot believe this entire process.

 

When you say that they received packet 3, do you mean that they received it from NVC and confirmed receipt? Did you then fill out the D160 online and submit the checklist via email? I remember reading that someone thought that as soon as NVC sends packet 3 to Consulate that they'll just wait for packet 4... not realizing that they had to complete the D160 form and checklist in order to get packet 4. Make sure that if you did fill out the D160 form and checklist to email it. Upon receiving packet 3, I completed the D160 and checklist and sent it in via email... I got my packet 4 within days (Vancouver consulate). If you have the confirmation and checklist, I would submit it again and follow up in a few days.

There's a similar thread for Toronto, but I didn't want to hijack it so thought I should start my own. Hope that's OK. 

 

I'm preparing for my medical that's in a week and a few days. So far I have:

 

- Vaccination records... I have them in ratty old books my mom kept. I went to my family doctor and he's confirmed that all vaccinations that is required of me have been done. Should I have him write a note? Or can I just bring the booklets?

 

- Passport

 

- Consulate papers

 

- Email confirmation of interview date

 

- Photos

 

- Medical Records. My family doctor previous to the one I have now retired years ago. We were given our medical records but my files are thin and don't show much. I don't have any chronic illness or have any special medication. The last time I was in the hospital was a few years ago for dehydration from a really bad stomach flu. Does that count? Would they be upset if I don't bring in my file, even though there's really nothing in there? 

 

Am I missing anything? Thanks so much!

Did it only ask for the last 5 trips? Whoops, I may have gone overboard then. When I did mine, I was certain they asked for all trips to the US... which is hard because like you, I live about a half hour drive from the border. So I've spent many day trips and have gone back and forth for short trips to see my fiance over 30 times in the last 2 years... I put down all the travel I could remember or find email notes for but I'm certain I've missed a few...

Hello All!! Newbie to VJ :)

 

Our I-129F had been approved Sept 11th 2013, got case number on Oct 21st after calling NVC multiple times.

Oct 22nd status shows as in transit and its been almost 4 days and its still the same.

 

I am preparing packet 3, had a few questions, hoping you guys can help:

1) What is the photo size to submit with packet 3, for medicals and to take to interview?

2) Do I book the medical appointment in Toronto before I receive instructions for packet 3/4 or just wait till petition arrives in Montreal?

 

3) Can the petitioner be present at the interview in Montreal?

I have a date booked for Feb 14th 2014..I needed help on trying to find an earlier date. Do we have to cancel the existing one to get a new one?

When I click reschedule appointment it only shows me the next available.. If I cancel the one I have now, I dont want to lose that and get a much later date in the process.

 

Anyone knows how can we find out dates by not cancelling exisiting one?

Hello All,

This is specific for K-1 applicants for Montreal. I checked the site today and it shows new Packet 3 instructions, and it says to email them instead of sending it by post.

 

I was being over enthusiastic I guess and already sent Packet 3 by post. The date on the PDF documents says revised Oct 8/2013 but when I checked in Oct 26th this new instruction list wasnt there.

So I am wondering do I email Packet 3 again or just let it be?

 

Anyone in the same situation?

Hello all,

I had Feb 14th as my first appointment date, then yesterday got it re-scheduled to Jan 24th and was soo happy.

This morning I get an email saying I cancelled my Jan 24th date, when I did not do anything like that. I wasnt even checking for an earlier date coz I was happy with Jan 24th.

I emailed montreal embassy but that would take soemtime to get a reply...

 

I am so so upset..I rescheduled it for March 24th now., but has this happened to anyone before?? 

Can anyone provide any suggestions, would I be able to get my Jan date back..i dunno what happened for the cancellation, im positive its not an error from our side..

 

Im just so upset :(

Got my interview date back for Jan 24th, prepping for that now..

 

With the crazy winter going on now, I was wondering about options for travel from Toronto to Montreal. I am planning to fly, but incase that doesnt work out..

Anyone has experience with bus service to Montreal?

@ethomps: I did send those forms in with Packet 3, but that was before they changed their guidelines to replacing forms with DS-160 only. I sent them Packet 3 mailed in and by email as well as they had requested.

Anyhow I will keep the forms with me just in case.

 

my interview is on 24th and I am stressed out!!

I have my interview soon, and I'm wondering if I, as the beneficiary, have to provide bank statements and paychecks too?

Also, the I-797 has expired, and I read that my fiancee can sign, scan and send a letter to the Stockholm embassy to extend. It's just 2 days over.

What you are paying for is a "panel" physician who follows all the same guides as pretty much every other panel physician in the world.  They aren't going to do much except check that you are in good health.
