Yes. Transcripts for '09, '08 and '07. I'm so glad they're free, can't tell you how many times I've had to order them from the IRS for this or that.

Thank you all in advance for your help!

My fiancée in London has her interview scheduled for Wednesday Feb 16 at 0800 -- and here is the situation with her birth certificate:
She is still waiting for the certified translation of a new copy of it to arrive from Spain.
She does have an older untranslated birth certificate.
By this wednesday, she could probably have a fax of the certified translation, but not the original of that.

Should we re-schedule the interview, or go ahead with what we have?

I'm with Mrs. O?she should attend the interview w/the fax in hand, then let the IO know that the original is on its way, if asked. At the very worst, she could be approved pending receipt of the original. No worries!

Aww, I'm glad this story had a happy ending.

I was nearly denied entry into England by the most sour-faced ####### on the planet, after nearly 10 hours on a plane. I was sweet as pie, showed my return ticket, no attitude, played the game. It took a phone call to John (who sat waiting on the other side) to corroborate our stories in order for her to let me in. I had never been so humiliated - I was the first one in line only to be the last one to leave.

WHY on earth would we want to sneak into our Beneficiary's country if they're coming HERE?!!! After all the money spent and etc.?!!

Having to explain K-1 to the customs shrew made me wonder (in all seriousness) just how safe we all really are that the people working the borders are SO daft about K-1!! I wondered this again at POE (at LAX here in SoCal) when they didn't know what to do with our envelope.

3 hours and 15 minutes after her appointment, she called me and told me PINK!

So happy right now. I will post a review tomorrow after I get the full story from her about what happened. The only thing I know so far is that she saw pink already when she went to the window, and they asked her alot of questions.

I was wondering if anyone else was told it would take up to 90 days for the NVC to recieve paperwork from the CSC and assign a case number? This guy I spoke to was very rude and abrupt. What is the average wait time for the NVC to recieve paperwork from the CSC? I am going on 22 days now. I hope it's not much longer now.

I'm not sure if they over estimate the dates. There was someone in the UK forum recently who received an interview date just over a week from the embassy receiving all the paperwork back, and the interview date itself was only 5 weeks in the future.

I specified on mine that my travel date is the 20th Feb, as I have the "return part" of my last ticket booked for that day (long story short, United Airlines cancelled out my return ticket when I arrived in the States in Sept, so had to book a brand new ticket to get back to the UK and booked the return leg to the US for 20th Feb - a date I would potentially use).

I know they don't have to pull out any stops to get my interview before then, but I know they do try to accomodate where possible. I am still hopeful for an early February interview, but we won't know until they finally decide to schedule it.

We sent our Package 3 to the London Embassy on 12/3 and have heard nothing from them yet in regards to an interview date. I have called the Dept of State every couple days and still no date set. Anyone else having this long of a wait just to recieve the interview date from the London Embassy?

I'm sorry for what you have gone through. You should be proud that you overcame your struggles and is in a happy place, because you decided to do so and took charge. It takes a lot of courage and self-love to do that. :)

 

 

I know depression as I have experienced it myself. I was young and experienced a few traumatic events and my 15 year old self just didn't know how to process it. It is not shameful at all and have disclosed it. My depression was hardly documented though. I saw my doctor once and he referred me to speak with a psychologist. I did and they said I had very mild depression and "in a funk" with what had happened. I sought help from a therapist for a few months and I was good. I was never given medication but I did disclose this information and I was approved. 

 

There is another thread, I believe in the Canadian forums, about a member here who had past mental health and drug problems. I recall reading that she got a doctors note like others have suggested. I believe she also came prepared with reference letters from employers, friends, people in the community. It just shows that yes you had a past but you are also very aware that it is in your past and you have full control over your mental state.

Ok if everyone is able to read!!!!!! they can see by the posts....that iam a liar and a horrible human being.....and my fiancée should run as fast as she can......that being said...if there are no positive comments to help a fellow visa journey member then keep it to your self......ive never seen so many self righteous people.....to all the caring people that try and help thank you......im sure ill just keep getting negative posts from the same people that think their #### dosnt stink....oh well have at it....if you feel better bashing me, I hope it makes you feel better as a human being.....

 

I think it's hard for members to give happy and positive answers when the magnitude of what you didn't disclose is so important. Many of us are beneficiary's here and it hits really close to home for us too. We can imagine what your fiance could be feeling right now, just as how we would feel if that happened to us at our interviews. We get that you may not be a bad person and just made a bad judgement call on not disclosing this information. I could only imagine how I would feel thinking I was going into my visa interview all prepared. I know my relationship, I know my fiance and anything the CO asks me, I know I can answer because our relationship is true. And then I get blindsided by all of these things I didn't know about my fiance... I would be extremely upset that 1) the interview did not go as I planned but more so 2) I would be completely heartbroken to realize that my fiance is not who i thought he was. So although members try to be respectful and positive when others are asking for help, it is hard for us to say "oh, well, it's not a big deal"... when for all of us it also means our life, our live, our future. 

 

But take what others are saying, good and bad to create a plan. Yes, some people who leave their partner. I mean, if I thought my fiance was a law-abiding citizen with no past record, went to this school, does this for work... and then I find out that's not true. Some would say that's a big enough lie or 'hidden information' to stop the relationship. That's how big of a deal this is... So keeping the good and bad in mind there really isn't much you can do other then to fly there and speak with a CO yourself. I don't think your fiance going in (though that's not even allowed) will help her case. The CO may already think that she's the liar, especially when her country is considered more high-fraud.

 

If your hands are tied and you cannot go, then all you can do is wait for the denial. If you get a denial, your best option will be to fly over there and marry her and start the CR-1 process from scratch. 

 

There are options for you to save this petition... but it's up to you to do it. A mess up this big isn't going to go away with a simple phone call. Right now, I'm thinking the CO thinks this is not a bonifide relationship because it was proven that your fiance doesn't know much about you. If different if she knew about all your convictions instead of one... but for her to not be aware of you dealing drugs, 3 DUI's, Bulgary, and all that... There are CO's who deny young men from high fraud countries who marry older women because they don't think it's a bonifide relationshp (i.e. why would a young man who can have a family be with an older woman who can't give that to them? It happens). The CO can very well be thinking "now, even if this woman didn't intentionally lie... why would she now want to marry a man who she just discovered had all of this in his past". Your best option is to fly there and show the embassy that it was your mistake. If they thinks she's lying, there's not much for HER to do now. If they think so, it'll be very hard for her to go back and explain and rectify it. It should be YOU who has to now step up, show up to the embassy and prove to them that she didn't know.

We will be having our wedding in the US and my parents just asked me a question that I don't have the answers to. 

 

In our culture, it is tradition that they give us gives that were passed on through generations. Some of the gifts are old, gold jewelry. They are Jewelry that I would never wear, but it's been passed on from my great great grandparents to my mother and now to me. 

 

Just by looking at them, you can tell that they are old and that they're not 'new' or recently purchased items. 

 

How do we go about declaring them? Will my parents be taxed if they bring them to me during our wedding? We have no receipts since we don't even know exactly when and where they were purchased? they've been in my family longer than I've been alive. 

 

Any help would be appreciated.

Canadaif you could have the same job, same salary, would you choose Canada or the US?

I haven't gotten there yet, since I'm still in Canada and only spend weeks at a time in the US with my fiancé. So I can't say, with 100% confidence, which I would prefer until I'm living it? but as it stands, if I had to chose. 

 

I would say the US. I am moving from one of the most expensive cities in the world to Southern California. Although the city I am from is beautiful, the same salary and job would not get us very far here as it would in SoCal. You cannot buy a house in my city for less than 1 million dollars, many of them being tear down quality. I purchased my condo for the same price as what our budget is to buy a house in SoCal close to the beach. I also love the climate much more. Although the US has it's differences from Canada, I still think that our money goes a bit further in the US.

On a side note, when you poe; just keep it simple... Don't offer information unless you are asked, if you do; you are begging for more questions. I'm not saying this happened in this instance, just something to keep in mind. Please try not to be too paranoid over everything, I know this ones a toughie; we?ve all been there, and know how you feel. I can remember being the exact same way smile.png.

 

Thanks for this! I know? I definitely over talk when I'm nervous. Even if I have nothing to hide and coming back into my own country. I've always been naturally chatty too, so it doesn't help me :). I can admit that I probably stepped into this one. 

 

I'm glad it shouldn't be a problem? just in case, we do have the receipt on hand if they question the value of the jewelry. He asked me how much was the necklace and I didn't know, not something I ask about when receiving a gift. So when my fiancé told him, they ended up raising the cost of what he said by a $500. They probably think that we would've claimed lower, but he was honest and told them exactly how much he paid.

CanadaUSC visiting canadian Fiance in Canada - will we have trouble?

So, during the holidays my F gave me a gift (jewelry, not the e-ring). I don't wear jewelry often but wear ones that he got me. He came to Canada for a week before we took off for Mexico for the holidays. He didn't declare the gift and he admits was a oversight on his part. He normally declares everything and so do I, even though I know I'm over or under the allowed amount. 

 

So we get back to our normal lives and I'm traveling for work. I come back and the customs asks me what I did while I was away. I checked off both business and personal of the sheet. I said I went for a conference but my fiancé met me in the city since he's a USC. He asked how long we've been together and if we had a nice Christmas. I said "yes, we spent it in the sun" and he asked "oh did you get any presents" and I said "just this necklace" not thinking anything of it. Of course I get taken into the back and asked about the jewelry etc. I was completely honest with him and he ended calling my fiancé and my fiancé, without hesitation, asked him who does he need to call to pay for the tax? He didn't realize because technically he didn't give it to me in Canada, but I was bringing it back that it needed to be declared. And I never knew the value and was just wearing it, so I didn't think nothing of it either. The officer was nice and said it's clearly an oversight and that he trusts it won't happen again. We paid and I was out of there. 

 

He's coming back for a visit and hoping that this little hiccup won't get us in trouble or that he will be denied. He did not fight the agent when I called and was completely apologetic and willing to pay. We're both tax payers (income/property etc.) and never have been late in our life. And after starting this process, we've been honest about our intentions (that we are in the process of K1) when I go to the US to visit and he comes visits here. We just don't want some little oversight to follow us. 

 

I know this may be a silly post and maybe I'm just paranoid, but I just don't want to make any mistakes that could not let us see each other during this waiting period.

CanadaDual Citizenship - Yay or Nay?

I'm so new to this process? how much are the fee's? When you do your AOS it's $1070 and that's for 2 year GC? Then after that what's the fees for the 10? And when do you normally have the opportunity to apply for citizenship? If you lose your GC how much is it to replace it? 

 

I know someone mentioned the US tax implications if you were to move back and didn't give up your US citizenship? but I wonder what will happen to RRSP's etc on the Canadian end if you give up your Canadian citizenship. I already feel I would want to become dual but I'm glad I have the opportunity to learn this early on.

Even though you say during the oath ceremony you denounce all citizenships, it doesn't mean you have to go and renounce it in Canada. You can absolutely keep your Canadian citizenship!

 

Ahh, OK. I can see why it would be tough, personally, for some people to do that then. Since they're being required to take an oath and they know they want to remain dual.

What do you guys mean by technically, it means nothing? At the Oath Ceremony they will ask you to promise not to have other citizenship, but you don't actually have to go to the Canadian Gov't to renounce your passport and citizenship from Canada? 

 

I've always thought, when I got to that stage, that I would become a dual citizen. I would like to bring my parents over, years from now, when they retire so I can take care of them in their old age. But I can't be 1000% sure that I won't ever want to live in Canada again. Plus, don't you still need citizenship in order to collect your retirement? I have contributed to a locked RRSP account through an employer for many many years. I believe giving up your citizenship to Canada would also mean losing part of my retirement savings for the last 10+ years?

CanadaCar and home payments

Hey everyone, 

 

We just recently had our petition approved for the K1 visa. With that, I'm trying to get everything sorted before the interview date as people have warned me that things go by quickly and before you know it you're on your way to be with your honey. :)

 

I have a condo that I'm looking to rent out. Does anyone know what the tax implications of having a condo and being a out of country landord is like? I put down over 20% when I first purchased it and own the majority of my home, but I still have a bit of a mortgage. I do not want to sell and it's not really an option I want to consider for a few years. I may rent it out to a family member or I may rent it out to a stranger. If I do, my brother has volunteered to help be the local point of contact for the home. I may consider putting him on the title of the condo right away, since it'd be consider a investment property for the both of us. 

 

I also have a car payment for a new 2013 SUV. My mom is in the market to buy a new car and she asked whether I'd be willing to give the car to her and she'll just make payments on it. I originally wanted to bring it to the US, but since there is still financing on it, I realize it's more difficult to do that. Can I keep the car under my name, insure it under my mom, and she can make payments on the car? I got a really good trade-in value for my old car and the finance is 0% and something my mom hasn't been able to find right now.

I'm in this situation right now. I was told by a salesman that my car would be under warranty, which it isn't. Also, depending on the state you move to, there may be more inspections that need to be done. This means, you need to do more than just have a compliance letter from the manufacturer. I was told that if I were to bring my car over to California, I would have to get it inspected before I can get it insured. My car is about 2 years old, so I don't see it being a problem. However, I thought about what if I wanted to sell it in a few years? the car would only be 5 years old and the value would mean way less in the US then if I were to have sold it in Canada. 

 

I also have finance on my vehicle which is a problem. I was told that I would be able to bring it over but continue paying in my Canadian account (finance payments) but I don't believe that is true. I don't think you can physically bring the car into the US unless there's a clean title on it. 

 

Now, I am thinking of giving the car to my brother. He can make payments on it (through my account, since we won't have to pay for the document change fee's) and put him on the insurance and the car will remain in Canada.

SO I have my letter of compliance from Canada, with no recalls on my vehicle. Do I still need to contact US Acura for a letter? 

 

If you don't have payments on your car, you should be fine at POE. Just a heads up though, if you're moving to California there will be extra inspections that need to be done. The letter won't be enough. 

 

When I looked into importing my car to California, I was told that the letter and clean title (no financing etc.) would get me past POE, but in order for me to get it registered it would need to go under inspection. California has some of the stricter emission laws in the US, I believe.

In case anyone was wondering which they should go to? 

 

I went to the local police department and there was a huge line. I was on my break and couldn't risk getting back to work late, so I decided to skip the police department. The next day, I tried the commissionaires and there was only a family in front of me. It took them 5 minutes to get done and I was up. I asked for the CPIC and told them it was for immigration purposes. They took my information and said that my records will be sent to me within the next few days. While I was waiting, I was talking to the lady at the front desk. I told her that there was a large line up at the police department and she said that's not unusual. I was also surprised that the fee was only $45.00 when the police department charges $70.00 for the same record. 

 

Just an thought on where to go if you anyone else was deciding.

CanadaWhat can I do with my car?

There's a pretty hefty document fee to change the title over to him. It's not something I want to add to the moving expenses now, but we can definitely do that in the near future. I just want to make sure that I won't get stopped at POE or anything because I still have debt or payments. :)

 

I did check kelly bluebook? they're saying I can sell my car at around $20,000-$24,000 but I'm still owing a bit more then that.

I've read through some posts and they resonate with my situation. 

 

I bought a car about a year and a half ago thinking that I could take it with me to the US. However, I realize that it won't be as easy as I thought. I still have financing on it and moving it to the state of California requires emission testing etc. Also, if we were to sell the car in the next couple of years, I don't know what the value of a Canadian car would be in the US. Cars generally are more expensive in Canada, so the amount I'd be paying for the next few years may not make sense. 

 

I tried putting it on craigslist and I am getting offers around $8000.00 less than what I owe on it (I bought it new?. lesson learned). 

 

So I'm thinking about giving it to my brother. He can make the payments on the car and it will remain in my name under financing. Insurance will be under him so he is covered. 

 

Is this OK to do?

I have to figure out where I read it? but something about FBAR, where if I kept currency in another account (say one in Canada), that the IRS will make me disclose or report that information?

 

The only reason I ask is because I would like to transfer some of my $$ to my US account, but keep some in my Canadian account. I have several 'bills' that I'm locked into (like my life insurance) that needs to be paid in a Canadian account. I'll also be traveling often back and forth (I'm not too far from home, even when I move to the US) to visit family. I'll likely only keep $5000-$10,000 in my canadian account and transfer the rest.

What should I do with the funds I currently have in my canadian bank account? I believe we can only transfer $10,000 at a time, or we're subject to tax? I read that there was a law that was passed that any funds in any accounts in any countries with an amount of over $10,000 will need to be reported to US (I think it was called Fbar?). 

 

I'm in the process of selling my home and just wondering what I need to do. I hope to sell it before I move, so I'm not subject to double taxes. Unless, I'm mistaken? It is my primary residence, so I wouldn't be claiming capital gains or losses.

CanadaInterview Vancouver/Montreal… how to change?

Since I can't edit - stop paying attention to that website. Vancouver will send you a letter. In that letter will be a link to the packet 3 checklist. It likes to glitch with Vancouver/Montreal sometimes.

If it starts with vac it's going to Vancouver. You're fine.

 

Thank you! That's what I thought. I thought I had to fill out the DS 160 first before securing an interview? so when it said "interview set in Montreal" I was so confused!
