K-1 Fiance(e) Visa Process & Proceduresdo u think I have enough evidence?
Hey thanks for your service, Hoffy.

My fiance and I had his/her receipts. Maybe (if you can) go out to that dinner, do separate checks and then highlight the date/time on each receipt. Go shopping, to a movie, etc. and repeat until you have enough receipts to tape/paste/etc. onto two sheets of paper (his sheet/her sheet). Maybe hit a bank/ATM together, do the same thing with those receipts. Sign your sheet, and have your fiancée sign hers. I also had a co-worker and my mother write and sign testimonial letters (very brief, a few paragraphs) attesting to having met my fiance. Good luck!

K-1 Fiance(e) Visa Process & ProceduresShould I go to my fiance's graduation.
I personally think you'll be alright, a return ticket and proof that you're collecting unemployment would be all that I'd bring, being on unemployment myself these days (as unemployment here means having to answer on a weekly basis to EDD, I would HAVE to return to my country to make sure I keep getting my check).

Btw, dating and fiance are quite different (to the person who mentioned you were on "only a dating/fiance basis") - I had surgery in February, and my family made sure that John and his family were included in all the doctor/nurse conversations, phone calls, etc. This is your future wife's graduation, not just some girl you're going out with, so props to you for making the plans to be there. That's awesome. Have a safe flight!

K-1 Fiance(e) Visa Process & ProceduresI-129F - How I made the application package
The goal for us wasn't to send as much evidence as possible. It was to send sufficient primary and secondary evidence that would support that we had met at least once, that we were both at the same places at the same times, and that our relationship was bonifide. I attached a paper cover sheet to each section (bio sheets, pics, birth cert, $455 check, etc.) with a paperclip, put everything in a manila folder and that was it.

K-1 Fiance(e) Visa Process & ProceduresGetting married
QUOTE (Nik+Heather @ May 26 2009, 07:28 AM) <{POST_SNAPBACK}>
Most of us on this forum are spending many many many months apart from our loved ones. We all understand the pain of separation, but you won't find any support from us for going about this the wrong way. We are all here to learn how to do this the RIGHT way. Most of us are envious of you Canadian couples who can spend twice as long in the US together on a tourist visa!!

The earlier you resign yourself to the fact that you will actually have to spend some time apart, the easier that will be.

You should do this the right way. If not for the sole reason that it is the only legal way (which should be enough), but also because you don't want to create more stress for yourself - the process is nerve wracking enough, without flirting with bans from the US!

I hate these posts so much. You're basically asking all of us who have paid and are waiting if it's okay for you to take a shortcut. Please be fair and lawful and consider filing K-1, or have her return to her country post-wedding while you file K-3. It's not easy, but it's the right thing to do.

Hello, FutureMrsDisney!! John and I submitted just a few emails that mentioned events and other pertinent info - like him telling me about preparations for his trip to SoCal for Thanksgiving, how well I get on with his mom when we talk on the phone, etc. - and me telling him how my mom couldn't wait to have him back home, how she was planning to cook all his favorite things, etc. We thought this would help establish that A) we had a bonifide relationship, and cool.gif we were building bonified relationships with each other's families.

K-1 Fiance(e) Visa Process & ProceduresWrong "Petition Approved" Date on K-1 Visa
Hi Everybody!

So the good news is, John got his K-1 Visa this morning while we were on the phone (about two hours ago). The bad news is, he says that the "Petition Approved" date is April 23 ... while the date on our NOA-2 is March 23. Wah wah wah waaaah. Considering that we have to provide a copy of the K-1 Visa AND a copy of the NOA-2 for the AOS petition, do we need to send the Visa back - and how on earth do we do that? I've searched all over VJ for an answer and can't find a thing for this.

Thanks in advance!

K-1 Fiance(e) Visa Process & ProceduresHow much evidence is needed for the K-1?
QUOTE (JimVaPhuong @ Aug 29 2009, 02:17 PM) <{POST_SNAPBACK}>
So, you need boarding passes, passport stamps, hotel receipts, ATM receipts, or any other evidence proving the petitioner and beneficiary were in the same place at the same time. Receipts with both of your names on them, or boarding passes for both of you on the same flight are even better evidence.

This is the best thing anyone can do for their K-1. We didn't send a large package - just 5 photos (labeled on the back), boarding passes, flight itineraries, a few emails spanning the months we were apart, photocopies of cards we sent each other, receipts of items purchased for each other, a few pages of our phone records, and two statements from my parents and a co-worker (attesting to having met John) - BUT we sent in a grip of matching receipts and ticket stubs, which really helped our case. We pasted them on his/her sheets and highlighted the dates, times, etc. to make things easier for USCIS.

Good luck!!

K-1 Fiance(e) Visa Process & Proceduresusc visiting foreign fiance

I showed my NOA1 when visiting England and they had no interest. They didn't know what the K-1 was just knew what I told them: that my english husband was trying to move to the US which means I'd probably not try to stay in England while I was there visiting.

I feel like we we were on the same trip. I nearly didn't make it INTO England because the miserable girl questioning me at customs thought I was trying to move there. WHERE is the K-1 and other visa training at airports?!! That most don't even know about K-1 alone bugs the hell out of me.

I did everything right, answered all questions with a smile, without reaching over the counter to snatch a handful of hair from her self-righteous head like I really wanted to. It was a nightmare. Thank GOD John was on the other side of the wall by the duty-free shops, confirming my story to customs on his cell phone.

If I had to do it again, I would definitely make sure I had proper docs showing my ties to the U.S., you just NEVER know who you'll be dealing with.

Edited to add: I recall reading just yesterday of a USC being denied entry into Canada (of all places!) to visit her fiance.

I must say this has been the most stressful 6months of my life trying to plan a wedding is so hard when you dont know if or when you can get into the country.
My interview is on the 19th of march but the problem is that i could lose my job during that time i have the money to pay for the visa and get myself over there and i have money in my savings to keep me going for a good few months. Will this affect my chances if i do lose my job?
Also shipping my stuff over can anyone recommend a door 2 door pallet service?
many thanks

Hello, welcome to VJ, Richard :)

You're the Beneficiary, right? If yes, well then you'll be leaving your job, anyway - so no worries! Even if your USC fiancee lost her job, she could still secure a co-sponsor. I (the USC) lost my job a week after we got our NOA-2, so my parents stepped in as co-sponsors, no problem.

I'm less help on the shipping. We still have a grip of John's things back in Essex.

K-1 Fiance(e) Visa Process & ProceduresFiance laid off between packet 3 and interview
I would do exactly what Otto und Karin suggested.

I was laid off a week after our NOA-2 (as I've mentioned elsewhere), so we got my parents to co-sponsor (complete with their own form and supporting docs), filled out a new I-134 (I still provided my tax transcripts, W-2s, etc.) as "unemployed," and John mentioned in the interview that I was laid off right after our NOA-2 (they did ask him about my unemployment). The interviewer was very sympathetic.

You are in my thoughts. Fortunately, the Affidavit proved to be less of an issue for us at the K-1 stage, so I hope that gives you some consolation. Some people have claimed their unemployment insurance when filing their AOS, but I waited until I got another job; otherwise, I would've once again used my parents as a co-sponsor.

Best wishes in your fiancee's job search. It took me 6 months, but I got another job, and I think she will, too.

The key is intent at entry.

Absolutely. If someone comes here and decides on a spur-of-the-moment to marry, then I have no problem with that. Adjust your status, and the best of luck to you. But I have nothing but contempt for those who come here intending to circumvent the process. I have no hard feelings toward the O.P. (as he's asking a question and has not yet done anything wrong), but as someone who's invested financially and emotionally into doing things the right way, I hope he goes the proper route.

K-1 Fiance(e) Visa Process & ProceduresIn love-Tourist visa or Fiance visa?
Ooh wee, go for the tourist visa.

A lot, a lot, a lot (did I mention a lot? LOL) of time, money, energy and work goes into K-1, so it's not really the best option for a couple that "just wants to spend a little bit of time with each other." Plus K-1 is a one-way entry visa, so once she's here, it's marriage within 90 days, then filing to adjust her status (a whole other  altogether). If she leaves before she adjusts, then you will be creating more problems for yourselves than you could ever in your life imagine.

Sounds like you have something nice with her, though, so I wish you happiness and I wish your girlfriend good luck in securing a tourist visa (perhaps if she could prove that she has obligations [work, personal] that would require her to return to Russia, she might have a chance?). Revisit the K-1 option when you two are really sure you want to take your relationship to the next level.

Just my two cents and pence. (F)

Oh, and if you can visit her in Russia, that's another option (I hope).

Send it any way that makes sense to you but bear in mind that they will take it apart and throw away the binder and anything else the see no need for, then build a government file in their own style. I suggest you stack the papers in the order they are listed in your cover letter, then secure them with a paper clip or binder clip. They won't be cussing you that way when they deal with your binder.

K-1 Fiance(e) Visa Process & ProceduresReceived a confusing email today

Last night I checked the USCIS website and it states my K1 petition was approved. Still have not received an email or sms on the matter.

I had emailed the CSC a few days earlier asking for status update, never thinking I would get a response. Well, just now I did receive a response which says I should hear an answer regarding my petition in 21 days.

So, this is just another case of someone at the USCIS not knowing what's going on, right? I mean, the website says approved, so it must mean approved. Am I thinking too much into this?

No worries, and congrats! You should receive your NOA2 within those 21 days, I guess, but you'll probably get it much sooner than that. Btw, with USCIS, the left hand does not always know what the right one is doing. I remember some people in our K-1 filing group signing up for email alerts and NEVER receiving any alerting them to their status. They simply received their NOA2s in the post.

So don't ever freak out unless you receive a letter telling you to (denial, removal, RFE), and even then ... stay calm and know that there are people here to help you when the ish hits the fan. x
